This book is an empirically grounded, critical engagement with the politics of immigration detention and deportation.Focusing on the constitutive tensions and political generativity within the activist practices of the anti-detention movement, this book examines the distinction between representational and post-representational political sensibilities. Representational politics centres on representing the interests of disenfranchised people to the state and public and operates primarily within the regime of immigration law. Post-representational politics focuses on working collaboratively with those in detention, to resist and challenge the deportation system. Since representational politics is the predominant political imaginary of migrant rights campaigning, the book focuses on illustrating and evaluating the role of post-representational politics. The book argues that the concept of post-representational politics is important for understanding and participating in radical opposition to state racism. This argument rests on the expanded possibilities it motivates of engaging with and resisting institutions that are poised to co-opt resistance; the attention it fosters to the situated power dynamics of political activities that collaborate with imprisoned people; and its sensitivity to the politically and conceptually generative capacities of everyday, embodied practices of resistance. To make this argument, this book employs innovative methodology to illuminate and engage with the practice-based thinking of activist movements about the concepts of solidarity, hospitality, witnessing and accountability.This book will be of interest to scholars and activists with interests in socio-legal studies of immigration and refugee law, as well as others in social movement studies, critical legal studies, border criminology and critical theory.

Immigration detention is considered by many states to be a necessary tool in the execution of immigration policy. Despite the apparently key role it plays in immigration enforcement, the law on immigration detention is often vague, especially in relation to determining the circumstances under which prolonged detention remains lawful. As a result, the courts are frequently called upon to adjudicate these matters, with scant legal tools at their disposal. Though there have been some significant judgments on the legality of detention at the constitutional level, the extent to which these judgments have had an impact at the lower end of the judiciary is unclear. Indeed, it is the lower courts which are tasked with judging the legality of detention through habeas corpus or judicial review proceedings. This book examines the way this has occurred in the lower courts of two jurisdictions, the UK and the US, and contrasts this practice not only in those jurisdictions, but with judgments rendered by the Court of Justice of the European Union, a constitutional court at the other end of the judicial spectrum whose judgments are applied by courts and tribunals in the EU Member States. Although these three jurisdictions use similar tests to evaluate the legality of detention, case outcomes significantly differ. Many factors contribute to this divergence, but key among them is the role that fundamental rights protection plays in each jurisdiction. Through a forensic evaluation of 191 judgments, this book compares the laws on detention in the UK, US and EU, and makes recommendations to these jurisdictions for improvement.

The UK has some of the largest immigration detention facilities in Europe, holding as many as 3000 individuals at any point in time. Foreign nationals are held under immigration powers in a variety of circumstances including on arrival pending examination, whilst an asylum claim is considered in the Detained Fast Track, and pending administrative removal or deportation. The routine use of detention powers, particularly in relation to foreign national offenders, has increased dramatically in the years since 2006. Advising individuals detained under immigration powers is no longer a niche field. The law and practice in this work is that at 10th] anuary 1978. To complete this work in Autumn 1977, as originally intended, was impossible. Principally, this has been due to the changes in the Finance Act 1977, the various mini budgets and the exchange control changes, many of which are relevant to the subject matter of this work. Gratitude is expressed to the publishers for their patience. The Revenue has just revised its useful practice notes, IR 25 1977, dealing with the taxation of foreign earnings. The new IR 25 1977 modifies only slightly the IR 25 in Appen­ dix4. It will be appreciated that in this work it is impossible to provide for exhaustive treatment of all the taxes. Complexity in some places has been set aside for simplicity and clarity. Any such selectivity consisting of various emphases and omissions rests solely on fallible judgment. It is hoped that some light nevertheless is cast on the basic facets relevant to migrants. Too often these facets are not dealt with appropriately, dealt with separately without any co-ordination or submerged in a plethora of exotic detail of interest to academics and theoreticians only. The Camden Society was a precursor of the Royal Historical Society, and published a range of important historical sources between 1845 and 1896. The Camden Series continued to be published after 1896 by the RHS in the 3rd series of Camden titles.

Questions over immigration and asylum face almost all Western countries. Should only economically useful immigrants be allowed? What should be done with unwanted or'illegal'immigrants?
