Part One: Human Costs examines the harms immigration detention imposes on people who are not personally incarcerated, but whose lives are nonetheless entangled with detention regimes. Part Two: Societal Consequences highlights the corrosive impacts of immigration detention at the societal level, including the role migrant incarceration plays in naturalising and perpetuating inequalities and injustices. Part Three: Ending the Harm interrogates the possibilities of detention reform and detention abolition.This book will be a key reference text for scholars and students in the social and behavioural sciences who are interested in immigration detention, human rights and/or incarceration.

Today's unprecedented levels of human migration present urgent challenges to traditional conceptualizations of national identity, nation-state sovereignty, and democratic citizenship. Foreigners are commonly viewed as outsiders whose inclusion within or exclusion from “the people” of the democratic state rests upon whether they benefit or threaten the unity of the nation. Against this instrumentalization of the foreigner, this book traces the historical development of the concepts of sovereignty and foreignness through the thought of philosophers such as Plato, Locke, Hobbes, Rousseau, Derrida, and Benhabib in order to show that foreignness is a structural feature of sovereignty that cannot be purged or assimilated. Understood in this light, foreignness allows for new forms of democratic political unity to be imagined that reject local practices which deprive individuals of political membership solely on the basis of national citizenship. This cosmopolitan model for citizenship provides a novel conceptual framework that simultaneously upholds the legal importance of democratic citizenship for political justice while ceaselessly contesting the exclusionary logic of the nation-state that reserves democratic rights for members of the nation alone.

Human rights seemingly offer universal protection. However, irregular migrants have, at best, only problematic access to human rights. Whether understood as an ethical injunction or legally codified norm, the promised protection of human rights seems to break down when it comes to the lived experience of irregular migrants. This book therefore asks three key questions of great practical and theoretical importance. First, what do we mean when we speak of human rights? Second, is the problematic access of irregular migrants to human rights protection an issue of implementation, or is it due to the inherent characteristics of the concept of human rights? Third, should we look beyond human rights for an effective source of protection? Written is an accessible style, with a range of socio-legal and doctrinal approaches, the chapters focus on the situation of the irregular migrant in Europe and the United States. Throughout the book, nuanced theoretical debates are put in the context of concrete case studies. The critical reflections it offers on the limitations and possibilities of human rights protections for irregular migrants will be invaluable for students, scholars and practitioners.

The growing scale of international migration has reshaped the debate on the social rights and social protection available to people outside their countries of origin. This book uses conceptual frameworks, policy analysis and empirical studies of migrants to explore international migrants'needs for and access to social protection across the world.

The Migrant Integration Policy Index (MIPEX) is a unique comparative study on indicators of the legal integration of third-country nationals. Though comparing countries on the basis of various indicator types is common in the private sector and increasingly used in policy areas like development, good governance and equality, the exercise remains relatively new in justice and home affairs. The book lays out the instruments used to construct the MIPEX and then situates the study within current debates on integration indicators and policy evaluation. Each chapter considers what the study's key findings add to our understanding of the state of integration policy development across Europe and of recent legal and policy trends on anti-discrimination, naturalisation, labour market access, and political participation.

All persons should, by virtue of their essential humanity, enjoy all human rights. Exceptional distinctions, for example between citizens and non-citizens, can be made only if they serve a legitimate State objective and are proportional to the achievement of the objective. The present publication aims to highlight all the diverse sources of international law and emerging international standards protecting the rights of non-citizens.

The Rights of Others examines the boundaries of political community by focusing on political membership - the principles and practices for incorporating aliens and strangers, immigrants and newcomers, refugees and asylum seekers into existing polities. Boundaries define some as members, others as aliens. Indeed few issues in world politics today are more important, or more troubling. She advocates not open but porous boundaries, recognising both the admittance rights of refugees and asylum seekers, but also the regulatory rights of democracies. The Rights of Others is a major intervention in contemporary political theory, of interest to large numbers of students and specialists in politics, law, philosophy and international relations.

Citizenship implies exclusion of non-members. Migrations, processes and policies of first admission and incorporation of ethnically and culturally diverse newcomers are among the most hotly contested political issues, especially in a world of gross inequalities. This comparative and interdisciplinary collection sees distinguished moral and political philosophers, historians, sociologists, anthropologists and political scientists from America, Australia and Europe criticize existing institutions and increasingly restrictive policies and look for alternatives more in line with principles and constitutions of liberal democratic welfare states.
