The article aims to study the theoretical and applied aspects of pre-trial research in emergency legal regimes such as: martial law, the state of emergency or the area of joint forces operation in Ukraine. International legal requirements for due process in criminal proceedings during emergency legal regimes are analyzed. It is claimed that the existing experience in Ukraine of normative regulation of criminal proceedings under the conditions of special legal regimes is inefficient, fragmentary, and therefore does not fully correspond to modern ideas about human rights and the democratic and legal state. The perspectives for the application of the jurisprudence of the European Court of Human Rights in criminal proceedings under emergency legal regimes are identified. It was concluded that the investigating authorities carry out all the means to establish the facts of the disappeared persons in the area of Operation of Joint Forces within the framework of the criminal process, which will allow to comply, intheory, with all the requirements for the effectiveness of the investigation. The basis for the formation of legislation on this subject should be the relevant law on missing persons., El artículo tiene como objetivo el estudio en profundidad de los aspectos teóricos y aplicados de la investigación previa al juicio en regímenes legales de emergencia como: la ley marcial, el estado de emergencia o el área de la Operación de Fuerzas Conjuntas en Ucrania. Se analizan los requisitos legales internacionales al debido proceso en los procesos penales durante los regímenes legales de emergencia. Se afirma que la experiencia existente en Ucrania de regulación normativa de procesos penales en las condiciones de regímenes legales especiales es ineficiente, fragmentaria, por lo que no corresponde plenamente a las ideas modernas sobre los derechos humanos y el estado democrático y legal. Se identifican las perspectivas de aplicación de la jurisprudencia del Tribunal Europeo de Derechos Humanos en procesos penales bajo regímenes legales de emergencia. Se concluyó que las autoridades de instrucción realizan todos los medios para establecer los hechos de las personas desaparecidas en el área de Operación de Fuerzas Conjuntas en el marco del proceso penal, lo que permitirá cumplir, en teoría, con todos los requisitos para la efectividad de la investigación. La base para la formación de la legislación sobre este tema debe ser la ley pertinente sobre personas desaparecidas.

Based on the provisions of criminal procedure theory and criminology, the problems of international legal assistance are revealed during the pre-trial investigation for crimes of corruption in the field of official and professional activities. Special attention is paid to identifying the details of evidential activities in criminal proceedings for offences related to the provision of public services during a special pre-trial investigation (in absentia). The methodological basis of the article is a set of general and special scientific methods of legal cognition. In particular, the concept of pre-trial special investigation is formulated, its functional purpose is defined, characteristics of the carrying out of separate investigative actions (search) during the special pre-trial investigation for corruption offences. Attention is paid to issues of international cooperation to identify and search for assets in these criminal proceedings. Other problems are revealed in the use of international legal assistance to obtain evidence during the investigation of these crimes. It is concluded that a problem that arises during international cooperation during the preliminary investigation is the uncertainty in international rules on the provision of mutual legal assistance., Con base en lo establecido en la teoría procesal penal y criminología se revelan los problemas de la asistencia jurídica internacional durante la investigación previa al juicio por delitos de corrupción en el ámbito de las actividades oficiales y profesionales. Se presta especial atención a identificar los detalles de las actividades probatorias en los procesos penales por delitos relacionados con la prestación de servicios públicos durante una instrucción especial previa al juicio (in absentia). La base metodológica del artículo es un conjunto de métodos científicos generales y especiales de cognición jurídica. En particular, se formula el concepto de instrucción especial previa al juicio, se define su propósito funcional, características de la realización de acciones de investigación (allanamiento) separadas durante la instrucción especial previa al juicio por delitos de corrupción. Se presta atención a los temas de cooperación internacional con el fin de identificar y buscar activos en estos procesos penales. Se revelan otros problemas de la utilización de la asistencia jurídica internacional para obtener pruebas durante la investigación de estos delitos. Se concluye que un problema que surge durante la cooperación internacional durante la investigación preliminar es la incertidumbre en las normas internacionales sobre la prestación de asistencia judicial recíproca.

The purpose of the article is to analyze the method of reconstruction as one of the general scientific methods of criminology used in the investigation of crimes. The subject of research is the method of reconstruction in forensic science. The research methodology includes the use of general scientific and special methods of scientific cognition: dialectical, historical and legal, formal and logical, comparative and legal, logical, system and structural methods, method of generalization. Research results. General scientific methods of criminology and their significance for crime investigation are considered. Reconstruction as a type of modeling method and its place in the system of forensic methods is defined. The signs of reconstruction and its features distinguishing from modeling are analyzed. The variants of reconstruction and their features are given. Practical meaning. The concept of reconstruction as an independent method of crime investigation and its implementation in the system of investigative (search) actions are proposed. Value / originality. Emphasis is placed on the need for further study of reconstruction as a special method of investigating crimes.
