15. Educating the Approaches to Intellectual Property as the Trends of Application of Subjective Good Faith in Russian Law

Abstract

In Russian law, the term "good faith" ("good conscience") refers to different concepts: "honest practice" and "ignorance of the fact when such ignorance generates legal consequences." The article investigates the educational aspects of distinguishing objective and subjective good faith. The questions of application of the rules on subjective good faith to the relations arising in connection with the establishment, circulation and protection of civil rights are considered. The analysis of the content of the legal regime of objects of absolute property rights (things, property security, share in the right of common property, corporate rights) allowed us to conclude that the consideration of the rules on subjective good faith is a natural, necessary element of the legal regime of any object of civil turnover, and the real question is only the recognition of such an element of the legal regime by the rule of law and the definition of the features of its application.

Abstract

With the aid of structured catalysts and reactors, such as monoliths, solid foams, and 3D printed structures, the limitations of conventional slurry and packed‐bed reactors can be surmounted. Multiphase mathematical models were presented for solid foam structures and the models were verified for the hydrogenation of arabinose, galactose, and xylose to the corresponding sugar alcohols. High product selectivities were obtained in batch and continuous experiments. Three kinetic models were considered: a competitive adsorption model, a semi‐competitive adsorption model as well as a non‐competitive adsorption model for sugar monomers and hydrogen. The models gave a good reproduction of the data, but the semi‐competitive adsorption model was the most plausible one because of the size difference between adsorbed sugar and hydrogen molecules. Abstract

In this work, partial reductive amination of 5‐hydroxymethylfurfural (HMF) with gaseous ammonia over iridium supported on γ‐Al2O3, TiO2, SiO2 and carbon has been studied. The influence of the support and pressure was investigated in the valorization under mild conditions of HMF to 5‐(aminomethyl)‐2‐furanmethanol (AMFM). The catalysts were characterized by TEM, SEM‐EDS, N2 sorption Isotherms, TGA, CO‐Chemisorption, TPR, XRD, NH3‐TPD, ICP‐AES and XPS. The maximum activity and high rates were obtained for all catalytic systems. At 50 minutes of the reaction the Ir/C catalyst achieved 93 % of conversion and exhibited the highest yield and selectivity of 92 % and 99 % respectively, to the desired product 5‐(aminomethyl)‐2‐furanmethanol. The main properties that influence activity and selectivity are related to the amount of iridium on the surface and catalyst acidity. After the third cycle, 63 % and 59 % of selectivity and yield to AMFM respectively at 93 % of conversion were obtained. [ABSTRACT FROM AUTHOR]
