The objective of the second protocol is to strengthen cooperation in cybercrime and the collection of electronic evidence of crimes for the purpose of specific criminal investigations or proceedings. The article also presents and analyzes the most important procedural aspects related to the second additional protocol to the Council of Europe Convention on cybercrime regarding enhanced cooperation and the disclosure of electronic evidence. The phenomenon of cybercrime has a global dimension, characterized by multiple territorial links. The article presents and analyzes aspects related to international cooperation in the field of combating computer crime. The Council of Europe Convention on Cybercrime aims to complement applicable multilateral or bilateral treaties or agreements existing between the parties. The provisions of the Convention become applicable only in the situation where, between the requesting state and the requested state, there is no other bilateral or multilateral legal instrument in force at the time of the adoption of the Convention by the party states. At the same time, the article also presents and analyzes the most important aspects related to the second additional protocol to the Convention on Cybercrime regarding enhanced cooperation and the disclosure of electronic evidence. Starting from the provisions of Article 208 of the Romanian Criminal Code, which refers to the crime of harassment, the article proposed to analyze the crime of harassment both at the national and international level by means of Directive 2011/92/EU on combating sexual abuse on children, sexual exploitation of children and child pornography and the Council of Europe Convention on the protection of children against sexual exploitation and sexual abuse. The article also presents and analyzes issues related to the criminalization and the investigation of the new forms of harassment carried out through information and communications technology. The search at home or at the workplace aims to discover weapons or ammunition and explosive materials possessed without right, manufactured weapons and ammunition or certain parts that were to be assembled into a weapon, manufactured or processed explosive materials of various machines, devices, instruments, which served or were intended to serve in the manufacture of weapons, the manufacture or processing of explosive materials. The purpose of the article is to present several types of searches aimed at the discovery of the proceeds of the crime used through the use of firearms, especially game or fish obtained through acts of poaching, trees or stumps removed with the help of explosives. Also, during the preparation of these procedural activities, the search and discovery of documents that prove the origin of weapons, ammunition and explosive materials must not be omitted. The article presents and analyzes the main tactical rules used by investigators during searches to identify perpetrators of illicit drugs trafficking and use. Illicit drugs trafficking is a whole mechanism involving the production, trade, transport, distribution and sale. The actions of the judicial bodies specialized in the fight against drugs must systematically target all the stages of the illicit activity that takes place inside the networks of traffickers. The criminal investigation should not be limited to the detention or arrest of a single trafficker and the confiscation of his drugs, the aim is to dismantle the entire drug distribution network, which can only be achieved if the criminal activity of all persons involved in the network is proven. The article presents and analyzes issues related to the criminalization of the offence of computer forgery, provided by the Article 325 of the Romanian Criminal Code, as well as issues related to the criminalization of the offence of computer forgery in the main legal instrument in the field of combating cybercrime at the European level: the Council of Europe Convention on Cybercrime. Moreover, the article also mentions some aspects related to the criminalization of the crime of computer forgery in some countries of the European Union. The article presents and analyzes some elements of forensic tactics in connection with conducting the searches in the case of committing crimes that harm the patrimony: theft and robbery, the offence of deceit and embezzlement. The regulation of the measures for the protection of the patrimony provided by the criminal law proves the importance of the protected social value, of the legal object of the crime represented by the social relations regarding the patrimony, the importance that personal wealth represents for man, which, in the end, ensures it. Virtual reality and the computer systems used in communications represent a challenge for traditional research in criminology, introducing new forms of deviant behaviour, crime and social control. Thus, a new notion and a new field of scientific research has emerged, called Cyber Criminology, which is defined as the study of the causality of crimes committed in cyberspace, a virtual space and their impact on physical space. Access to a computer system is the entry into a computer system or a means of storing computer data, either directly or remotely, through specialized programs or through a network, in order to identify evidence. The special methods of forensic investigation are the techniques applied by the competent authorities in criminal investigations, aimed at detecting or investigating serious crimes and suspects in order to gather information, so that the persons concerned are not aware of this. The special method of supervision regarding to access to a computer system is stipulated by the Article 138 (1) (b) of the Romanian Criminal Procedure Code. The article presents and analyzes some legal and technical aspects regarding the special method of forensic investigation of access to a computer system. Moreover, the article emphasizes that the access to an information system must not harm in any way the fundamental rights or freedoms of citizens, private life, honor or subject them to illegal restrictions. Starting from the definition of terrorism, this article aims to present and analyze aspects related to the crimes in relation to terrorist activities at the national and European level. First, the article analyzes the offences related to terrorist activities provided by Law no.535/2004 on the prevention and combating of terrorism in Romania, after which the article analyzes the offences related to terrorist activities included in the European Union Directive 2017/541 from the 15th of March 2017 on combating terrorism, as well as in the Council of Europe Convention on the Prevention of Terrorism and the Additional Protocol to the Council of Europe Convention on the Prevention of Terrorism. At the same time, the article presents and analyzes aspects regarding the activities of prevention and combating of the offences related to terrorist activities, as well as the criminal investigation of these offences. Finally, the article will establish whether the Romanian legislation regarding the offences related to terrorist activities adapted to the provisions in the field included in the most important legal instruments in the field of prevention and combating of terrorism at the European and international level.
