2. Holding the police to account in a divided society : the Northern Ireland reforms

Abstract

This thesis uses a case study of Northern Ireland to examine the difficulties involved in holding the police to account in a divided society. Northern Ireland is a deeply-divided society where the primary political/religious cleavage is reinforced by the fact that the two communities tend to live in distinct areas and use separate educational, social, political, cultural and economic institutions. This has led to long-standing violence and instability, particularly over the last 35 years. Since 1993 there has been a peace process, which has led to an inter-party / inter-governmental agreement on the way forward, ceasefires from the main paramilitary groups, new political institutions and the devolution of government from Westminster (although the local assembly is currently suspended). One element of the conflict has been the different attitudes of each community to the local police force (the Royal Ulster Constabulary or RUC). Unionists looked to the police for protection against an Irish Nationalist insurgency whereas Nationalists viewed the RUC as a tool of oppression. As part of the peace process an independent commission examined this issue and recommended radical change to the RUC's personnel, structure, training and operations. Police accountability was seen as particularly important - the commission made 35 recommendations in this area alone. Examination of these recommendations suggests four different approaches to accountability based on democratic, legalistic, technocratic and community based institutions respectively. This thesis assesses these four models of accountability against three criteria, drawn from the literature concerning the management of ethnic conflict and public management. Firstly, the models are evaluated for their involvement of the public in evaluation and decision-making. The second criterion is whether accountability mechanisms can be insulated from the Unionist/Nationalist conflict, or alternatively, whether they can contribute to the management of this conflict. Finally, the type of competence promoted by each model is considered -whether the police are encouraged to focus on fiscal concerns, political responsiveness, compliance with rules or longterm strategic issues. This analysis suggests that any one model of accountability operating alone has serious flaws. However, collectively, the four models meet all three criteria. This leads to the conclusion that a multi-stranded approach is required if Northern Ireland is to successfully hold its reformed police service to account.

Abstract

Law and order is a collective good, enabling all groups to plan their lives, free from coercion. However, the police are also agents of the prevailing regime. As such they may target dissenting groups, particularly when socio-ethnic divisions threaten regime stability. Policing may therefore exacerbate conflict rather than contain it. The democratic response to this danger is to subject the police to the scrutiny of elected representatives. However, does this oversight encourage impartial policing, or do politicians seek protection for their own group(s), at the expense of minorities? This paper uses debates and questions from the UK and Canadian legislatures to determine the kind of policing demanded by politicians from Northern Ireland and Quebec - regions with deep divisions. Data is compared to the interventions of politicians from more homogenous regions. I therefore examine the reciprocal relationship between conflict and police accountability. Firstly, I detail the impact of inter-group conflict on the type of policing favoured by politicians. Abstract

The public administration literature on accountability often focuses on direct effects â€" positing that political oversight affects performance by altering the behaviour of bureaucrats. This paper examines the indirect impact of oversight, flowing from public reaction to the accountability process. I argue that observing this spectacle affects expectations of the bureaucrats’ likely reaction and the service delivered as a result. This is important because government agencies often rely on the co-operation of the public to fulfill their mandate: taking the example on which this research focuses, the police need community information to apprehend offenders and prevent disorder. The paper uses large-N experimental data to test two hypotheses. First, individuals who observe (in media reports) politicians making particularistic demands that prioritise the needs of a sub-section of the population will expect partial, group-focused policing. Conversely, those observing demands that the police serve the interests of the whole community will expect an impartial, balanced service. Abstract

BackgroundRespiratory complications are an important cause of postoperative morbidity. We aimed to investigate whether continuous positive airway pressure (CPAP) administered immediately after major abdominal surgery could prevent postoperative morbidity.MethodsPRISM was an open-label, randomised, phase 3 trial done at 70 hospitals across six countries. Patients aged 50 years or older who were undergoing elective major open abdominal surgery were randomly assigned (1:1) to receive CPAP within 4 h of the end of surgery or usual postoperative care. Patients were randomly assigned using a computer-generated minimisation algorithm with inbuilt concealment. The primary outcome was a composite of pneumonia, endotracheal re-intubation, or death within 30 days after randomisation, assessed in the intention-to-treat population. Safety was assessed in all patients who received CPAP. The trial is registered with the ISRCTN registry, ISRCTN56012545.FindingsBetween Feb 8, 2016, and Nov 11, 2019, 4806 patients were randomly assigned (2405 to the CPAP group and 2401 to the usual care group), of whom 4793 were included in the primary analysis (2396 in the CPAP group and 2397 in the usual care group). 195 (8·1%) of 2396 patients in the CPAP group and 197 (8·2%) of 2397 patients in the usual care group met the composite primary outcome (adjusted odds ratio 1·01 [95% CI 0·81-1·24]; p=0·95). 200 (8·9%) of 2241 patients in the CPAP group had adverse events. The most common adverse events were claustrophobia (78 [3·5%] of 2241 patients), oronasal dryness (43 [1·9%]), excessive air leak (36 [1·6%]), vomiting (26 [1·2%]), and pain (24 [1·1%]). There were two serious adverse events: one patient had significant hearing loss and one patient had obstruction of their venous catheter caused by a CPAP hood, which resulted in transient haemodynamic instability.InterpretationIn this large clinical effectiveness trial, CPAP did not reduce the incidence of pneumonia, endotracheal re-intubation, or death after major abdominal surgery.
