This textbook considers cases and materials introducing European Union (EU) data protection law to data protection enthusiasts while acting as a reference point for students and practitioners. The book's utility is twofold: the cases and materials can be used as a textbook as well as reference point for research. The book will benefit individuals new to this area and those at an intermediate level of familiarity with data protection law. It includes judgements delivered by the Court of Justice of the European Union (CJEU)/ European Court of Justice (ECJ) and decisions delivered by Data Protection Authorities (DPA) in the EU. While providing an overview of data protection law in the EU, the book introduces basic concepts of data protection law, principles of data protection law and rights and duties and remedies under the data protection law. This book offers a comprehensive and holistic analysis of the cybersecurity, privacy & data protection challenges entailed by IoT devices in EU law. A working definition and three-layered architecture taxonomy of the ‘Internet of Things'are provided, together with a state-of-the-art threat landscape in which each specific attack is linked to a layer of the IoT taxonomy. In a scenario where IoT devices physically interact with individuals, the book disentangles the legal, ethical and technical aspects of the concepts of ‘(cyber)security'and ‘safety', as the former now affects the latter more than ever before. To this end, a normative analysis aims to explore the concepts of ‘cybersecurity', ‘safety'and ‘privacy'against the background of the ‘IoT revolution'. This book assesses the extent to which the current EU competition law framework can incorporate privacy-related theories of harm. Specifically, it evaluates the importance of protecting individual privacy in establishing exploitative abuse of dominance under Article 102 TFEU. The book explores scenarios where Big Tech firms exploit their dominant positions through excessive data collection or limiting consumer choice, thereby harming competition and directly affecting user well-being. It posits that zero-priced business models of online platforms and the ubiquity of data generation create strong incentives to acquire and process consumer data, which can harm digital consumers'privacy. The book assesses how the existing EU competition law framework can address and regulate exploitative abuses, particularly concerning the protection of individuals'privacy. Importantly, this book argues that competition law might recognize privacy-related harms as forming exploitative theories of harm under Article 102 TFEU. This book examines the implications of information security which plays such an important role in modern digital infrastructure. Information security technologies restrict the (mis)use of this infrastructure, while also constantly being probed by researchers, intelligence agencies and criminals. One can see this cycle of making and breaking everywhere in the digital sphere. An important example of this cat-and-mouse game is the development of quantum computers, which may in the near future break some widely used encryption technologies. This cycle also has implications for human rights: weakening encryption may affect privacy, for example. But the relationship between human rights and information security has not been investigated in-depth before. In this study, state obligations relating to information security are analysed under the European Convention for Human Rights and the EU Charter for Fundamental Rights, focusing on issues as human rights-compatible encryption policy, on how governments should deal with vulnerabilities in software, and whether governments can curtail the development and export of quantum computers. This book analyses the human rights-compatibility of quantum computing governance and offers unique insights into the connection between human rights and information security that will be relevant for legal practitioners, policy-makers and academics involved in this field of research. In dem vorliegenden Buch werden die Interessenkonflikte der betrieblichen und behördlichen Datenschutzbeauftragten analysiert. Im Mittelpunkt steht eine ausführliche praxisbezogene Analyse der möglichen Interessenkonflikte der Datenschutzbeauftragten. Es wird herausgearbeitet, wie sich diese Interessenkonflikte auf die Praxis der betrieblichen und behördlichen Datenschutzbeauftragten auswirken und welche Unterschiede sich bei einer internen oder externen Benennung des Datenschutzbeauftragten ergeben.Art. 38 Abs. 6 S. 1 DSGVO sieht ein Verbot der Zuweisung konfligierender Aufgaben vor – die Möglichkeiten eines Interessenkonflikts des Datenschutzbeauftragten gehen jedoch weit über diese normierte Konfliktmöglichkeit hinaus. Konkret werden in der Arbeit Interessenkonflikte in Bezug auf die unabhängige Stellung, die Aufgaben, die Pflichten und die Rechtsbeziehungen des Datenschutzbeauftragten betrachtet. Bei der Analyse der Interessenkonflikte wird berücksichtigt, dass der Datenschutzbeauftragte zugleich dem Verantwortlichen, den Betroffenen, den Aufsichtsbehörden und dem Datenschutz als abstraktes Schutzgut verpflichtet ist. Schließlich wird in der Arbeit aufgezeigt, welchen Verbundenheiten sich der Datenschutzbeauftragte ausgesetzt sieht und welche Antworten des Rechts den Interessenkonflikten gegenüberstehen.

Online platforms and their ecosystems are the cornerstone of the digital economy. They have brought forth positive network effects. But they are also known for their information asymmetries, their potential for market failures and their problematic relationship with data protection law. This volume provides a detailed analysis of the current process of repositioning online platforms in the digital economy as regulators express concerns about the evolution from mere intermediaries to gatekeepers. The exclusive reliance on competition law instruments has proven to be incapable of coping with cases of platforms abusing their market power. Therefore, the book explores the European Union's new approach to digital markets consisting in the adoption or drafting of new legislative instruments, such as the Digital Markets Act, Digital Services Act, Proposal of AI Act, Proposal of Data Act, Proposal of Data Governance Act. The EU's emphasis on new regulatory ex ante instruments (as in the Digital Markets Act) calls for an assessment of their overlap or their interface with existing supranational and national competition rules. The book transcends mere competition law thinking by exploring the status of online platforms from the perspective of trade law rules, unfair competition law, data protection rules and intellectual property law. But in view of the global reach of online platforms, the risks of a jurisdiction-wise approach with conflicting regulatory strategies are all too clear. This book discusses the principle of open justice with a focus on the mechanism of video streaming of court proceedings. The principle of open justice is multidimensional and involves both the human right to a fair trial and freedom of expression. The book distinguishes between three components of open justice: public hearings, media coverage of proceedings, and publication of judgments. All three have been and/or could be substantially affected by the digital revolution: public hearings could benefit from video streaming, the media coverage from social media, and the publication of judgments from online databases. The book analyses recent advances and challenges related to the digitalization of open justice. Particular attention is paid to the relevant case law of European courts, to the impact of the GDPR with an emphasis on the sensitive issue of pseudonymizing judgments, and to a comparison of various national practices. Although the book's primary focus is on European law, it will also be of interest to scholars from other continents, either for purposes of comparative research, or because the topic itself touches on general theory of law issues.

This book highlights the challenges that artificial intelligence (AI), robotics, the Internet of Things (IoT), and other emerging digital technologies pose to existing EU and national liability legislation, while also tracing the evolution of the relevant EU policy and legal framework. Recognising that Member States'current national fault-based liability rules are ill-suited to handle compensation claims for AI-related harm, the book emphasises the difficulty victims face in proving fault and causation due to AI's unique characteristics, such as autonomy and opacity (“black box” effect). Similarly, the current Product Liability Directive (PLD) has several shortcomings: certain products, economic actors, and types of damage in the digital and circular economy are not covered under strict liability; proving defectiveness and establishing a causal link with damage, especially for complex products, is often challenging; in addition, liability claims are subject to restrictive limits and thresholds. Die aktuelle Rechtslage zur präventiven Kontrolle wird aufgearbeitet, gefolgt von der Auseinandersetzung mit abstrakten sowie im Homeoffice konkreten Abwägungskriterien für die datenschutzrechtliche Interessenabwägung, nach der sich die Zulässigkeit von Kontrollen im Homeoffice richtet. Die abstrakten, grundrechtsrelevanten Positionen und Interessen werden anschließend auf die im Homeoffice relevanten Kontrollmaßnahmen angewandt und ihre Zulässigkeit bestimmt. Artificial intelligence (AI) has the potential to radically transform our society. It may lead to a massive increase in the capabilities of humankind and allow us to address some of our most intractable challenges. It may also entail profound disruption to structures and processes that have sustained our society over centuries. These developments present a unique challenge to the socio-economic constitutional arrangements which govern our world at national, regional and international level. The deployment of increasingly powerful AI systems, able to function with increasing degree of autonomy, has led to concerns over loss of human control of important societal processes, over the disruption of existing economic, social and legal relationships, and over the empowerment of some societal actors at the expense of others, together with the entrenchment of situations of domination or discrimination. It has also made increasingly clear how tremendous the potential benefits, that these technologies may bring, are to those who successfully develop and deploy them. There is therefore great pressure on governments, international institutions, public authorities, civil society organisations, industry bodies and individual firms to introduce or adapt mechanisms and structures that will avoid the potentially negative outcomes of AI and achieve the positive ones. These mechanisms and structures, which have been given the umbrella term ‘AI governance', cover a wide range of approaches, from individual firms introducing ethical principles which they volunteer to abide by, to the European Union legislating an AI Act, which will prohibit certain types of AI applications and impose binding obligations on AI developers and deployers. The fast pace of innovation in the development of AI technologies is mirrored by the fast pace of development of the emerging field of AI governance, where traditional legislation by public bodies is complemented with more innovative approaches, such ashybrid and adaptive governance, ethical alignment, governance by design and the creation of regulatory sandboxes. Deshalb sind diese Daten zu einem zentralen Produktionsmittel und Wirtschaftsgut mit erheblichem Wert geworden. Aus diesem Grund haben die datenhaltenden Unternehmen ein großes Interesse daran, ihre Daten für sich selbst gewinnbringend zu nutzen. Demgegenüber besteht wegen der immer größeren Bedeutung der Maschinendaten auch ein erhebliches Interesse am Zugang zu den Daten anderer Unternehmen. Deshalb ist ein Rechtsrahmen für maschinengenerierte Daten erforderlich, der einen hinreichenden Schutz gewährt, aber auch ausreichende Datenzugangsmöglichkeiten etabliert. Ein geeignetes Datenmanagement in der Industrie 4.0 erfordert regelmäßig die Einrichtung von Datenbanken zur Speicherung und Verarbeitung der maschinengenerierten Daten. Deshalb liegt die Anwendung des Datenbankherstellerrechts nahe, um einen rechtlichen Schutz der Daten zu ermöglichen. Die Autorin untersucht, ob das Datenbankherstellerrecht auf Industrie 4.0-Datenbanken Anwendung finden kann und welche Probleme sich dabei ergeben. Es werden Vorschläge für eine Adaption des Datenbankherstellerrechts gemacht.

Der Band beschäftigt sich mit der virulenten Frage, ob die Stolpe-Doktrin als verfassungsrechtlich entwickeltes Instrumentarium zur juristischen Behandlung von mehrdeutigen Äußerungen auf das äußerungsrechtliche Phänomen der verdeckten Äußerungen sowie auf die Bildberichterstattungen übertragen werden kann, um im Ergebnis eine grundrechtskonforme Ausweitung der Mehrdeutigkeitsrechtsprechung herbeizuführen. Unter der Prämisse der Herstellung einer praktischen Konkordanz zwischen der Meinungsfreiheit des sich Äußernden einerseits und dem Allgemeinen Persönlichkeitsrecht des Betroffenen andererseits finden dabei die rechtlichen sowie qua natura existierenden Besonderheiten der jeweiligen Äußerungsarten sowie deren Wirkung auf die grundrechtlich betroffenen Positionen der betroffenen Akteure Berücksichtigung.

Die Arbeit beschäftigt sich mit dem bildnisrechtlichen Öffentlichkeitsbegriff des § 22 S. 1 Alt. 2 KUG, den der Gesetzgeber trotz des massiven technischen Wandels und der herausragenden Bedeutung von Bildnissen im digitalen Zeitalter seit über 100 Jahren nicht novelliert hat. Vielmehr greift die überwiegende Meinung in der Rechtsprechung und der Literatur im Rahmen des § 22 S. 1 Alt. 2 KUG seit jeher auf das Verständnis des urheberrechtlichen Öffentlichkeitsbegriffs gemäß § 15 Abs. 3 UrhG zurück, der infolge der umfassenden Rechtsprechung des EuGH zu Art. 3 Abs. 1 InfoSoc-RL erhebliche Modifikationen erfahren hat. Die Arbeit widmet sich insoweit der Frage, ob für den bildnisrechtlichen Öffentlichkeitsbegriff tatsächlich der urheberrechtliche Öffentlichkeitsbegriff, die Vorgaben des Art. 3 Abs. 1 InfoSoc-RL sowie die hierzu ergangene Rechtsprechung des EuGH herangezogen werden können. Dabei werden erhebliche Unterschiede zwischen dem bildnisrechtlichen und dem urheberrechtlichen Öffentlichkeitsbegriff konstatiert, die eine Autonomisierung des bildnisrechtlichen Öffentlichkeitsbegriffs gebieten. Die Autorin entwickelt daher einen von § 15 Abs. 3 UrhG und Art. 3 Abs. 1 InfoSoc-RL losgelösten Öffentlichkeitsbegriff, der den bildnisrechtlichen Spezifika Rechnung trägt.

Dieser Band widmet sich einem aktuellen Thema an der Schnittstelle des Daten- und Insolvenzrechts. Immer mehr Nutzer speichern ihre Daten in der Cloud, laden Filme und Musik im Internet herunter oder verbringen ihre Zeit beim Online-Gaming. Doch was passiert mit den gespeicherten Daten, wenn über das Vermögen eines datenverwaltenden Unternehmens das Insolvenzverfahren eröffnet wird? Kann der Nutzer weiter auf die Daten zugreifen oder zumindest deren Herausgabe verlangen? Diese Fragen sind in einer von großen Datenmengen geprägten Welt – heute wie auch in Zukunft – von zentraler Bedeutung. Betroffene Unternehmen wie Privatpersonen haben nämlich ein starkes Interesse daran, alsbald wieder auf „ihre“ Daten zugreifen zu können.Die Publikation geht diesen Problemstellungen am Beispiel der besonders virulenten Cloud-Speicher-Verträge als auch anhand anderer Datenverträge mit datenverwaltendem Charakter nach, namentlich E-Mail- und Messenger-Diensten, Video- und Audio-on-Demand-Angeboten und dem Online-Gaming Bereich. Schwerpunktmäßig wird die Frage des Fortbestands der ausgewählten Datenverträge in der Insolvenz nach §§ 108 Abs. 1 S. 1, 103 InsO sowie die Möglichkeit der Aussonderung von Daten nach § 47 InsO untersucht. In diesem Kontext wird auch die Zuordnung von Daten thematisiert.
