Approximately ten years after the Lisbon Treaty came into force, the debate on reforming the European Union has reached new heights. A decade of 'poly-crisis' has rattled long-held certitudes. At the same time, phenomena such as Brexit, a new European Commission, a new European Parliament, and potentially threatening extra-legal developments as diverse as authoritarian populism and climate change have culminated in a moment suggesting an indeterminate future from which much seems possible - even stasis. In the run-up to the next Lisbon decade, EU law scholarship, especially its German variant, must face up to the task of not only commenting on the development of Union law, but also of helping to shape it. However, before shooting aimlessly at amorphous clouds of ideas, it is certainly worthwhile considering the preconditions for reflecting upon the future of the European Union. This second order systematization can then be supplemented with substance by identifying structurally significant fields of reflection of relevance for the future of European integration.

Investigations of cellular processes initiated by volatile organic compounds (VOCs) are limited when modelling realistic long-term exposure scenarios at low concentrations. Exposure to indoor VOCs is associated with a range of adverse effects, but data on molecular changes at regulatory threshold limits are lacking. Activity analysis of VOC in vitro can be a valuable complement to inhalation toxicological evaluations. We developed an exposure platform that generates a stable VOC atmosphere and allows the exposure of cells for longer periods. Using formaldehyde as a model analyte, air-liquid interface cultured A549 lung epithelial cells were exposed to critical concentrations of 0.1 and 0.5 ppm for 3 days. Owing to the lack of known exposure biomarkers, we applied a genome-wide transcriptional analysis to investigate cellular responses at these sublethal concentrations. We demonstrate a minor overlap of differentially expressed transcripts for both treatment concentrations, which can be further analyzed for their use as exposure biomarkers. Moreover, distinct expression patterns emerge for 0.1 and 0.5 ppm formaldehyde exposure, which is reflected in significant enrichment of distinct biological processes. More specifically, metabolism of specific compound classes, lipid biosynthesis and lung-associated functions are affected by lower exposure levels and processes affecting proliferation and apoptosis dominate the higher exposure levels.

\(\bf Background:\) Interscalene brachial plexus (ISB) block is often associated with phrenic nerve block and diaphragmatic paresis. The goal of our study was to test if the anterior or the posterior ultrasound guided approach of the ISB is associated with a lower incidence of phrenic nerve blocks and impaired lung function. \(\bf Methods:\) This was a prospective, randomized and single-blinded study of 84 patients scheduled for elective shoulder surgery who fullfilled the inclusion and exclusion critereria. Patients were randomized in two groups to receive either the anterior (\(\it n\) = 42) or the posterior (\(\it n\) = 42) approach for ISB. Clinical data were recorded. In both groups patients received ISB with a total injection volume of 15 ml of ropivacaine 1 %. Spirometry was conducted at baseline (T\(_{0}\)) and 30 min (T\(_{30}\)) after accomplishing the block. Changes in spirometrical variables between T\(_{0}\) and T\(_{30}\) were investigated by Wilcoxon signed-rank test for each puncture approach. The temporal difference between the posterior and the anterior puncture approach groups were again analyzed by the Wilcoxon-Mann-Whitney test. \(\bf Results:\) The spirometric results showed a significant decrease in vital capacity, forced expiratory volume per second, and maximum nasal inspiratory breathing after the Interscalene brachial plexus block; indicating a phrenic nerve block (\(\it p\)

Dieses Papier geht der Frage nach, ob eine staatliche Rechtspflicht besteht, ein bestimmtes Niveau öffentlicher (Nah-)verkehrsversorgung zu gewährleisten - abgesichert durch ein einklagbares subjektives Recht. In den einschlägigen Gesetzesmaterien des Bundes und der Länder wird man auf der Suche nach einem subjektiven Recht nicht fündig. Es kann auch nicht aus einem tradierten Standard von Daseinsvorsorge, sondern letztlich nur aus den Grundrechten des Grundgesetzes gewonnen werden. Ein solches allgemeines Recht auf öffentlichen Verkehr ist rechtlich existent, jedoch nur unter sehr engen Voraussetzungen und nur für eine minimale Versorgung zu haben. Zudem könnten die Gerichte im konkreten Falle nur dahingehend abhelfen, den Gesetzgeber auf Maßnahmen zu verpflichten, da die konkrete Ausführung von Verkehrsleistungen zunehmend privaten Anbietern überlassen wird. Einer punktuellen Verschlechterung des Verkehrsniveaus kann das subjektive Recht jedenfalls nicht entgegengehalten werden. Für die über das Minimalrecht hinausgehende und daher nicht einklagbare staatliche Verpflichtung steht den entscheidenden Trägern - also den Gesetzgebern - ein Einschätzungsspielraum zu. Is there a statutory duty in Germany to ensure a certain level of (local) public transportation and, if so, is it safeguarded by an enforceable (subjective) right? No such 'subjective right' can be found in either state or federal legislation, nor in the traditional standards of Daseinsvorsorge (provision of basic services). It is, however, anchored in the basic rights set out in the German Constitution. Even though such a legal right exists, it can only be called upon under strict preconditions and only for a minimum standard of service. Since public transportation services are increasingly being run by private agents, the role of the judiciary has become reduced to that of committing legislatures to undertake measures in their respective power. Nevertheless, the constitutional right to public transportation will not prevent selective cutbacks in these services. Provisions which exceed the minimum standard are not required by law and are subject to the legally restricted discretion of public authorities and legislation.
