Through the case of private military and security companies’ employment by French, British and US armies, this chapter deals with the transformation of the military field and the presumed renegotiation of its perimeter on its core business. Comparatively to the aforementioned countries, in France, the construction of a policy on military sub-contracting turned out to be the subject of intense debates revealing how, instead of the development of a ‘global’ market for force and ‘transnational’ policies, we must notice the weight of national practices and military institutions. If the reconfiguration of armies’ role and perimeter has to be considered, it is therefore only in the light of these contrasted policies on sub-contracting., Au travers du cas du recours aux compagnies militaires privées par les armées françaises, britanniques et américaines, cette contribution entend revenir sur les transformations du monde militaire et la renégociation supposée de ses frontières autour de son ‘cœur de métier’. La construction d’une position autour de la sous-traitance dans le domaine militaire s’est en effet avérée, en France plus qu’ailleurs, faire l’objet de débats tranchés rappelant à quel point, en lieu et place du développement d’un marché ‘global’ de la sécurité et de politiques ‘transnationales’, il est possible d’observer ici le poids des pratiques et des institutions militaires nationales. C’est à l’aune de ces politiques contrastées de la sous-traitance militaire que les reconfigurations du périmètre des armées doivent être considérées.

International audience; Quelle est aujourd’hui la situation du monopole de la violence légitime prêté à l’État ? Les auteur∙es des quatre contributions réunies ici s’inscrivent dans une approche de sociologie de l’international pour décrire, à partir d’enquêtes empiriques précises, certaines politiques non seulement de mise en œuvre mais aussi de prévention de la violence : lutte contre le financement de la criminalité et du terrorisme, peine de mort aux États-Unis, guerre en Afghanistan, politiques de sorties de conflits. Plus précisément, ils et elles interrogent les relations, tant de collusion que de collision, qui se tissent entre les différents espaces sociaux contribuant au gouvernement de cette violence légitime. Ils et elles explorent ainsi les interactions et interdépendances entre administrations nationales ou internationales, secteurs bancaire, pharmaceutique, universitaire, ONG, et montrent comment, dans ces configurations complexes, se façonne le rôle de l’État et se consolident des (re)définitions de la violence (il)légitime.

International audience; Control over private violence is traditionally conceived as falling under the remit of the state and law. Yet, since the 2010s, the regulation of private violence is characterized by a soft law mechanism which enables private security companies to adhere to a business certification rather than a legally binding international treaty. While other regulating options were considered, it is indeed the principle of a technical standardization that prevailed. Based on a sociological approach to norms and international relations, this article underscores that this resulted from struggles between national fields as well as social sectors. It channels attention towards the experts involved in the process : their common juridical habitus and strong cultural and social capital help explain the emergence of a consensus among private and public sectors experts, representing states, private security companies and NGOs. This transnational space structured around competing and allied legal experts accounts for the prominence taken by the option of a market regulation of private security companies – an outcome which cannot be explained solely by a focus on power struggles between states.; Traditionnellement pensé comme étant du ressort des États et du droit, le contrôle de la violence privée s’avère depuis 2010 prendre les formes d’un mécanisme de soft law dans la mesure où les compagnies de sécurité privée s’adaptent aujourd’hui à une certification commerciale plutôt qu’à une convention internationale de caractère obligatoire. Là où d’autres options de régulation étaient avancées, c’est en effet le principe d’une standardisation technique qui a prévalu. Au moyen d’une sociologie des normes et des relations internationales, l’article montre que c’est dans la lutte entre champs nationaux mais aussi entre secteurs sociaux que ce mécanisme s’impose. C’est en s’intéressant plus particulièrement aux agents impliqués, à leur partage d’un certain habitus juridique et à leur possession d’un capital culturel et social important, que l’on peut comprendre comment un consensus se forge entre experts du secteur privé et public, représentants des États, des compagnies de sécurité privée et des ONG. Dans la configuration de cet espace trans-sectoriel des experts du droit, émerge une politique de régulation commerciale des compagnies de sécurité privée entre concurrences et alliances qui ne sauraient se réduire à une simple lutte entre puissances étatiques.

International audience; Focusing on the case of internationally active private security companies, the present article examines the role of discourse in processes of legitimation. Long decried as mercenaries, these companies are today widely used and recognized as specialized, private and regulated businesses. Endowed with this newly acquired identity, they now seem to be legitimate actors. It is therefore worth considering the forms that this process of legitimation has taken by comparing the discourse produced by the security companies themselves with the manner in which they are discussed in other arenas. This side-by-side comparison reveals the constraints that operate on the production of a discourse in the area of private security and, above all, allows one to assess the conditions of its authority. For imposing a discourse – and an identity – in a domain considered as falling under the competence of the state cannot be reduced to a process of self-definition.; Le poids du discours dans les processus de légitimation est étudié ici à partir du cas des compagnies de sécurité privée actives à l’international. Longtemps décriées parce que perçues comme une forme de mercenariat, ces compagnies sont aujourd’hui largement utilisées et reconnues en tant qu’entreprises spécialisées, privées et régulées. Fortes de cette identité nouvellement acquise, elles apparaissent désormais comme des acteurs légitimes. Il convient, dès lors, de s’interroger sur les modalités de ce processus de légitimation, en confrontant la production d’un discours sur soi de la part des compagnies de sécurité avec les manières de parler d’elles dans d’autres arènes. Cette mise en parallèle permet de faire ressortir les contraintes pesant sur la production d’un discours en matière de sécurité privée et, surtout, d’analyser les conditions de son autorité. Imposer un discours – et une identité – dans un domaine pensé comme étant du ressort de l’État ne saurait en effet se réduire à un processus d’autodéfinition.

International audience; Can private violence be legitimate? This seemingly tautological proposition reflects the Weberian conception of the state as a political entity that successfully claims the monopoly of the legitimate use of physical force. However, this conception deserves a closer examination given the recent development of private security companies that are new and legitimate actors on the international stage. Implementing diverse forms of physical violence abroad, these private agents are indeed widely and legally used nowadays by corporations, states, or international organizations. Their widespread and diversified use reveals the new legitimacy of a practice formerly condemned on moral and juridical grounds: the use of mercenaries. How should we view such a process of legitimating an activity conceived to be the purview of governments, but which is today carried out by private contractors? Far from being anecdotal, the analysis of the legitimation practices implemented by the “industry” illustrates, through the shift from stigmatized mercenary activity to a redefined identity, the broader question of the construction of a professional and social norm. It also sheds light on how it is viewed and its limits considering the facts that it has been established primarily by private actors and touches on the supposed foundations of the modern state.; La violence privée peut-elle être légitime ? Apparemment tautologique, cette proposition renvoie à la conception weberienne de l’État en tant qu’« entreprise politique [...] revendiquant avec succès le monopole de la contrainte physique légitime ». Elle mérite cependant une nouvelle analyse à l’aune du développement, récent, des compagnies de sécurité privée construites comme de nouveaux acteurs légitimes sur la scène internationale.Mettant en œuvre diverses formes de violence physique hors des frontières nationales, ces opérateurs privés sont en effet utilisés aujourd’hui légalement et de manière croissante, par des entreprises, des États ou des organisations internationales. Ces usages massifs et diversifiés indiquent la légitimité nouvelle d’une pratique jusqu’alors condamnée moralement et juridiquement : le mercenariat.Comment comprendre alors un tel processus de légitimation d’une activité vue comme fondamentalement régalienne, mais exercée aujourd’hui par des sous-traitants privés ?Loin d’être anecdotique, l’analyse des pratiques de légitimation mises en œuvre par cette « industrie » illustre, à travers le passage du mercenariat stigmatisé à une identité redéfinie, la question plus générale de la construction d’une norme professionnelle et sociale, mais aussi celle de sa réception et de ses limites alors qu’elle est élaborée en premier lieu par des acteurs privés et qu’elle revient sur les fondements supposés de l’État moderne.

International audience; This article analyzes recent measures designed to control private violence and offers a new perspective on the privatization of the State. The increasing use of private security companies by States reveals both the extension and normalization of commercial reasoning as a method of governing, even in situations of war. Yet, the limits of the security market and the subsequent implementation of regulations aimed at controlling this business activity suggests that the vision of a withdrawal of state involvement should be reconsidered. The three-phased emergence of regulations progressively reintroducing the state will result in confirming the legitimate and sovereign role of the State, within the context of outsourcing control of violence.; À partir d’une analyse des régulations mises en œuvre depuis une décennie autour des activités de violence privée, cet article se propose de revenir sur l’apparent constat de privatisation de l’État. L’usage croissant des compagnies de sécurité privée par les États traduit en effet l’extension et la normalisation de logiques marchandes comme mode de gouvernement, y compris dans la conduite de la guerre. Cependant, les limites de ce marché de la sécurité et le développement conséquent de contrôles autour de cette activité commerciale invitent à infirmer la vision d’un simple retrait de l’État. L’émergence, en trois séquences, d’une régulation où l’État se réinvestit progressivement, permet alors de constater in fine sa respécification en tant qu’autorité légitime et souveraine, au cours de ce processus de sous-traitance de la violence et de son contrôle.

The article offers information about the International Traffic in Arms Regulation (ITAR), which was established in 1978 in the context of the Cold War in the U.S. defense industry. It notes that multiple reform attempts and persistent criticism failed to improve overly complex, overloaded and dated procedure and become necessary to alter and improve the functioning of defense export control procedures. It also serves dual and potential contradictory purpose.
