Artykuł prezentuje podstawowe założenia dotyczące teoretycznych aspektów powstania kontradykcji w procesie o nieważność małżeństwa poprzez zaskarżenie małżeństwa przez jednego z małżonków, oboje małżonków albo rzecznika sprawiedliwości. W tym kontekście rozważania dotyczą istoty zasady dwustronności oraz zasady kontradyktoryjności, bowiem dopiero, gdy istnieją dwie strony procesu o przeciwstawnych stwierdzeniach, możliwe jest powstanie kontradykcji. Natomiast instytucja obrońcy węzła małżeńskiego zapewnia powstanie kontradykcji procesu o nieważność małżeństwa w tych wszystkich przypadkach, gdy obydwaj małżonkowie domagają się wydania wyroku pro nullitate albo strona pozwana nie bierze udziału w procesie.

18 listopada 2021 roku odbyło się na Wydziale Prawa Kanonicznego Uniwersytetu Papieskiego Jana Pawła II w Krakowie sympozjum naukowe pt. Przełożony – podwładny. Odpowiedzialność prawna w Kościele, które po przerwie związanej z pandemią koronawirusa zgromadziło liczną grupę kanonistów z całej Polski. Miejscem obrad tradycyjnie była aula Instytutu Teologicznego Zgromadzenia Księży Misjonarzy przy ul. Stradomskiej 4 w Krakowie.

The article covers the influence of Pope Francis’ Apostolic Letter motu proprio Mitis Iudex Dominus Iesus on the scope of the principle of contradiction in matrimonial nullity trials. This article will present certain remarks concerning the effect of Pope Francis’s process reform on the extent of the principle of contradiction in respect of such constituting factors of that principle as: the libellus; identification of the subject-matter of the process. In conclusion, it should be stated that Pope Francis’ trial reform of 2015 extended the scope of the principle of adversarial in matrimonial nullity trial.

W tym kontekście rozważania dotyczą zmian, jakie reforma papieża Benedykta XVI wprowadziła w zakresie minimalnych warunków kontradyktoryjności postępowania w analizowanym procesie kanonicznym w odniesieniu do jego elementów dotyczących skargi jako impulsu procesowego, oznaczenia przedmiotu procesu, stron sporu i podmiotu uprawnionego do jego rozstrzygnięcia, równouprawnienia stron procesowych, minimum dyspozycyjności stron, organu procesowego wyposażonego w atrybuty niezawisłości i bezstronności. W konkluzji należy stwierdzić, iż reforma papieża Benedykta XVI z 2008 r. miała istotny wpływ na zakres obowiązywania zasady kontradyktoryjności w procesie sporno-administracyjnym przed Najwyższym Trybunałem Sygnatury Apostolskiej.

W artykule zaprezentowane zostaną zmiany jakie reforma procesowa papieża Franciszka wprowadziła w zakresie warunków kontradyktoryjności postępowania w procesie kanonicznym dotyczących: stron procesu i podmiotu uprawnionego do jego rozstrzygnięcia oraz równouprawnienia stron procesu. W konkluzji należy stwierdzić, iż reforma procesowa papieża Franciszka z 2015 r. poszerzyła zakres obowiązywania zasady kontradyktoryjności w procesie o nieważność małżeństwa.

The article concerns the research on the emission of pollutants of a rail-road tractor in two stationary research tests. The purpose of the tests was to carry out control tests of pollutant emissions and their analysis. The object used during the works was approved in accordance with the Stage V standard, which requires measurements of emissivity both in stationary, dynamic and real conditions. Despite the requirement to test engines installed on a vehicle during their normal duty cycle with PEMS, the emission limits measured in this test have not yet been defined. Therefore, the work below focuses on the stationary test cycle. The measurements were carried out in accordance with the combustion engine operating points described in the approval test, and then compared with the modernized NRSC test. It contains modified measuring points and rotational speeds of the crankshaft, adopted on the basis of the most common operating parameters of agricultural tractor combustion engines in real operating conditions. The measurements were performed with the use of a mobile dynamometer and devices for measuring emissions of harmful exhaust gas compounds and recording on-board data. In the test, the vehicle drive system worked at fixed operating points, with defined values of crankshaft rotational speed and load. Based on the recorded data on the concentrations of pollutants in the exhaust gases, the specific emission of the object was determined. In the final stage of the work, these data were used to perform a comparative analysis with the emission limits contained in the standard.

Założeniem niniejszego opracowania jest ukazanie jak kształtowała się problematyka wyroku łącznego w polskich kodyfikacjach karnych, począwszy od pierwszego Kodeksu postępowania karnego z 1928 r., poprzez nową kodyfikację ustawy karnoprocesowej z 1969 r. na kodyfikacji Kodeksu postępowania karnego z 1997 r. oraz kolejnych jej nowelizacjach skończywszy. Celem prowadzonej analizy nie jest odtworzenie treści norm prawnych obowiązujących we wskazanych kodyfikacjach w kontekście przepisów regulujących postępowanie w przedmiocie wydania wyroku łącznego, ale ukazanie ewolucji poglądów doktryny i judykatury na pojawiające się problemy interpretacyjne o wymiarze nie tylko teoretycznym, ale przede wszystkim praktycznym. Prezentacja zmian jakie dokonywały się na przestrzeni dziesięcioleci pozwoli lepiej zrozumieć genezę przepisów obecnie istniejącej instytucji wyroku łącznego w kontekście jej prawie stuletniego istnienia w polskich kodyfikacjach karnych.

The article presents the results of a simplified analysis of the feasibility of designing a rail chassis of a two-way tractor with an internal combustion or electric drive. Basic traction and operating parameters have been assumed for which the road-rail tractor could operate in an effective manner. On their basis, strength calculations were carried out and mechanical elements of the drive system meeting the required assumptions were selected. All the calculations presented in the text were fulfilled. The technical feasibility of building the mechanical part of the rail running gear of a rail-road tractor driven by an internal combustion engine or electric motors has been demonstrated.

Track works typically require the use of special-purpose rail machines, in which the main source of propulsion are high-power compression ignition engines. Reliance on these types of engines, which are characterized by a significant degree of wear and tear, relates to a relatively high specific fuel consumption and the exhaust emissions of toxic compounds. Using such rail machines to perform modernization and repair works has a negative impact on the natural environment. The article presents test results of toxic compounds exhaust emissions as measured from a special purpose rail machine. The tested vehicle was a machine designed for profiling the ballast cess labelled as PŁT-500. The machine was classified as NRMM (Non Road Mobile Machinery) and used for profiling and cleaning the cess. A PEMS (Portable Emissions Measurement System) type apparatus was used for the emissions measurement. This made it possible to measure the exhaust emissions as RDE (Real Driving Emissions) of toxic compounds from the machine in real operating conditions. The obtained test results include the measured exhaust emissions of gaseous compounds: CO, CO2, HC and NOx as well as the vehicle fuel consumption while performing its track works.

Zagadnienia dotyczące automatyzacji systemów wspomagania maszynistów oraz dyspozytorów są obecnie coraz szerzej wprowadzane również w transporcie szynowym. W artykule przedstawiono działania oraz rozwiązania wybranych producentów, zarówno w zakresie pojedynczego pojazdu szynowego, jak i systemowego sterowania koleją. Rozwiązania te mają na celu zwiększenie bezpieczeństwa, oszczędność energii elektrycznej oraz pomoc w podejmowaniu decyzji dyspozytorów. W dalszej części artykułu opisano również nowe systemy wspierające pracę maszynisty w celu minimalizacji zużycia energii, które już teraz są wykorzystywane w kolei w Niemczech, a także zaprezentowano europejski system inteligentnej komunikacji w transporcie kolejowym.

Most vehicles are powered by internal combustion engines. Due to the nature of their operation they emit, among others, carbon dioxide which contributes to the greenhouse effect. CO2 production is strictly correlated with fuel consumption. The article presents the results of road tests of a passenger car with a spark-ignition engine meeting the Euro 6 emission norm. The test vehicle was equipped with a classic exhaust gas aftertreatment system – a three-way catalytic converter. The aim of the study was to verify the impact of the cruise control use on the vehicle fuel consumption. The measurements were based on Portable Emission Measurement System type mobile equipment for exhaust emission tests. The tests were carried out in real driving conditions travelling on an express way. Test drives took place on a route with variable topographic profile. Three test drives with different speeds were carried out, but the aim was to obtain an average speed of 130 km/h.

The paper presents the general concept of an innovative rail-road tractor solution. The innovation of the solution is characterized by equipping the combustion engine tractor with an additional electric drive for the wheels of the rail drive system. The options of using the tractor in operation along with rolling stock were presented. The results of preliminary conceptual work on the selection of electric propulsion and energy storage devices to power electric motors has been illustrated. Directions for further conceptual and design research were also determined. The aim of the paper is to popularize the results of the performed research work carried out at the Institute in the field of rail-road vehicle development.

W artykule przedstawiono metody pomiaru zużycia paliwa i energii elektrycznej stosowane w badaniach taboru kolejowego, autobusów, trolejbusów oraz tramwajów. Na podstawie zebranych doświadczeń opisano ograniczenia stosowanych obecnie metod badawczych i wskazano możliwe rozwiązania.

Rail vehicles are one of the sources of environmental pollution in the transport sector. Therefore, it is necessary to equip these vehi-cles with modern drive systems. This article concerns the issues of contemporary and future-oriented solutions of drive systems used in rail vehicles. The article analyzes energy storage possibilities including: electrochemical, mechanical and hydraulic accumulators. The conducted analyzes have taken into account the importance of how frequently they charge up, which dictates their possible applications. Characteristics of hybrid drive systems were presented, with particular emphasis on parallel systems of: hydrostatic, flywheels and electrochemical batteries. The analysis of energy flow control strategies in hybrid drive systems of railway vehicles has been made. In the summary, a solution was chosen that resulted in high conversion efficiency of the energy extracted from the vehicles wheels.

The article evaluates economic indicators of selected types of locomotives used on railway lines in Poland. Rail vehicles are characterized by lower energy consumption compared to the majority of currently used means of transport, which translates into higher efficiency of the transport system in the whole country. The share of rail transport in Poland and its development is limited by several aspects related to the costs of purchase and operation of vehicles, infrastructure and the availability of new technologies. The article presents, among others the results of measurements carried out on several ST44 locomotives with varying degrees of technical wear. The research showed above all the impact of the degree of this consumption on the fuel consumption by the propulsion system.

The article presents the results of measurements of exhaust emissions of commercial vehicle in real traffic conditions. The aim of this study was to determine how the driving style affects on the exhaust emissions from vehicle engine. The determinants were the measurements of the concentration of main toxic substances emitted to the atmosphere from the power unit of the tested vehicle. In the measurements a portable exhaust emission analyzer was used (PEMS type).

W artykule przedstawiono zagadnienia aktualnych i przyszłościowych rozwiązań układów napędowych stosowanych w pojazdach szynowych. Dokonano przeglądu oraz analizy możliwości gromadzenia energii w pojazdach z uwzględnieniem akumulatorów elektrochemicznych, mechanicznych oraz hydraulicznych. Wskazano na duże znaczenie częstości ich ładowania, co przekłada się na możliwość ich zastosowania. Przedstawiono charakterystyki układów napędu hybrydowego ze szczególnym uwzględnieniem układów z ogniwami paliwowymi oraz ultrakondensatorami. Zaprezentowano obecne i koncepcyjne rozwiązania szeregowych i równoległych układów napędowych.

The dynamic development of transport recorded in recent decades is an important factor in the economic development of the world on the one hand, and on the other hand, it is a significant source of nuisance and environmental problems. The adverse impact of transport can be felt both in the natural environment and in society, where the dynamic development of this sector has enabled significant civilization development, with the effects varying depending on the level of economic development, the degree of advancement and the use of various transport sectors, geographical location (including climate), and also the sensitivity of the elements of the environment. Considering contemporary transport hazards, it is important to prevent them from occurring, and when that is not possible – limiting their impact on the environment and reducing the scale and extent of negative impacts. In the paper the environmental and social nuisance of transport of goods loaded in semi-trailers was analyzed. The transport of semi-trailers using intermodal wagons pulled by the diesel locomotive in accordance with the assumptions adopted in the railway with the maximum length of train composition was, inter alia, taken into account. The ecological aspects focused on such harmful compounds as: carbon monoxide, hydrocarbons and nitrogen oxides.

Considering the significant development of transport and the increase in its popularity, an important element for the industry is the use of the most efficient and affordable vehicles. In addition, with modern transport threats, it is important to prevent them or minimize not only for environmental reasons, but also for financial reasons. The article presents an economic analysis of the environmental and social burden of transporting goods by means of various means of transport. Economic analyzes of rail and road-rail vehicles were also taken into account. They focused on such aspects as: purchase, exploitation and comparative indicators.

The article focuses on the impact of the rolling stock modernization program covering the comprehensive reconstruction of diesel loco-motives with Impact of modernization of locomotives operated in Poland on the emission of toxic compounds in exhaust gases the assumption of replacing their drives with engines meeting the Stage IIIA standard for the emission of toxic compounds in exhaust gases. In connection with this, the subject of the rolling stock was discussed in Poland and legal regulations concerning exhaust emissions in locomotives. The final result was the estimated emissions of toxic compounds before and after modernization and the comparison of these results.

W artykule dokonano oceny wskaźników ekologicznych oraz ekonomicznych wybranych typów lokomotyw użytkowanych na liniach kolejowych w Polsce. Pojazdy szynowe charakteryzują się niższą emisyjnością i energochłonnością w porównaniu do większości stosowanych obecnie środków transportu, co przekłada się na większą wydajność systemu transportu w skali całego kraju. Udział transportu szynowego w transporcie w Polsce i jego rozwój jest ograniczony kilkoma aspektami związanymi z kosztami zakupu i eksploatacji pojazdów, infrastruktury oraz dostępnością nowych technologii. W artykule przedstawiono wyniki pomiarów przeprowadzonych na 15 lokomotywach ST44 o różnym stopniu zużycia technicznego. Tym samym reprezentowały one duże zróżnicowanie stanów technicznych tego typu pojazdów eksploatowanych na polskich szlakach kolejowych. Badania wykazały wpływ stopnia zużycia technicznego lokomotywy spalinowej, zarówno na poziom emisji związków toksycznych, jak i wielkość zużycia paliwa.

Effective management of marshalling works requires their appropriate organization. This has its impact not only on economic considerations (including energy consumption), but also ecological (emission of pollutants in exhaust gases). In the article, operational analyzes were made to determine the impact of the use of various wagon management methods on the issue of toxic substances emission via the SM42 locomotive's exhaust system. The locomotive belongs to a group of specialized machines necessary for maneuvering work. It should be noted that vehicles of this type have a significantly different nature of work than locomotives used in personal and freight traffic. A large percentage share is engine work under idling conditions and at low load. The nature of the load is, among other things, the cause of a substantially high concentration of pollutants in the exhaust gases.

W pracach torowych obserwuje się pewne marnotrawstwo energetyczne, spowodowane między innymi długimi i bezproduktywnymi postojami maszyn z włączonymi silnikami (nieefektywna praca na biegu jałowym). Ponadto często występujące niewielkie obciążenie silnika spalinowego jest przyczyną zasadniczo dużego zużycia paliwa (mała sprawność ogólna). Przeprowadzone analizy miały na celu określenie warunków eksploatacji i wielkości zużycia paliwa przez lokomotywę SM42 wykorzystywaną w trakcie prowadzenia prac modernizacyjnych na linii kolejowej.

W artykule przedstawiono wyniki badań i dokonano analizy warunków użytkowania żurawia kolejowego TAKRAF ZU-EDK-300 oraz podstawowych parametrów gazów wylotowych jego silnika podczas prowadzenia wybranych prac torowych, wspomagających modernizację odcinka linii kolejowej wiodącej z Poznania do Piły. Przedstawione w opracowaniu rezultaty badań pozwoliły między innymi określić potencjał odzysku energii gazów wylotowych.

W artykule przeprowadzono analizę uciążliwości środowiskowej przewozu towarów naczepami, z wykorzystaniem zarówno transportu drogowego, jak i kolejowego. W tym drugim przypadku uwzględniono transport naczep przy wykorzystaniu intermodalnych wagonów kolejowych ciągniętych przez lokomotywę spalinową. Aspekty ekologiczne koncentrowały się na takich szkodliwych związkach, jak: tlenek węgla, węglowodory i tlenki azotu.

W ostatnich latach nastąpił znaczny wzrost liczby ludności na świecie, a tym samym wzrost zapotrzebowania na transport. Aby sprostać temu zapotrzebowaniu, konieczny jest zrównoważony rozwój sektora transportu, tak aby nie zwiększać zanieczyszczenia środowiska. Wymagania co do ograniczeń emisji związków toksycznych wymuszają wprowadzanie zmian konstrukcyjnych w silnikach pojazdów, stosowanie nowoczesnych i skutecznych układów oczyszczania spalin silnika oraz poprawę sposobu użytkowania pojazdów. Redukcję emisji zanieczyszczeń i zużycia paliwa można osiągnąć także poprzez wykorzystanie paliw alternatywnych, w tym gazowych, jak również ich współspalanie z paliwami konwencjonalnymi. W artykule przedstawiono przede wszystkim wyniki badań toksyczności spalin z pojazdu kolejowego, zasilanego paliwem B100 (tzw. biodiesel). Wykazano różnice w stężeniach toksycznych związków w układzie wylotowym silnika.

The article discusses the results of applying real driving emissions (RDE) testing methods in measuring the exhaust emissions of a passenger rail vehicle. Portable Emissions Measuring Systems (PEMS) were used to measure the exhaust emissions from a motor coach in real operation, performed on a test track for selected drive cycle parameters. The road emission values of exhaust components have been calculated and compared to road vehicles and road exhaust emission limits based on the legal norms. The assessment was concluded with a comparison of the environmental cost, in terms of exhaust emissions, of transporting passengers using the tested rail vehicle relative to alternative road transport, based on measurements in real operating conditions.

The article presents the issue of creating, implementing and summarizing a research experiment using an advanced simulator of a passenger vehicle AS1200-6 from AutoSim within the framework of laboratory classes "Environmental protection in transport" at the Poznan University of Technology in the Institute of Combustion Engines and Transport in the field of safety and eco-driving. The issues presented in the article are aimed at defining the implementation aspects of an interesting and effective training program for young drivers, which was also aimed at making the examined drivers aware of the potential dangers and cause and effect correlation for driving a real vehicle in specific conditions. Additional objectives were to collect data for self-assessment on the knowledge and habits of the surveyed groups of drivers, which may have a significant impact on the safety and economy of driving a road vehicle. This was aimed at a later attempt to identify errors in knowledge and to identify deficiencies in drivers’ experience, which could provide an interesting material for improving the training program for category B drivers, but also to try to define tips for a good process for basic training for future standard simulation training.

Vehicles used in rail transport are characterized by a long service life, which is caused, among others, by the high cost of their purchase. In Poland, the average age of freight diesel locomotives exceeds 40 years. Increasing the wear and tear of vehicles has an impact on many aspects of machine operation, including environmental pollution. Significant wear and degradation of the powertrain components contributes to the increase in pollutant emissions and fuel consumption, which is closely correlated with the production of carbon dioxide. Modernizations involving the replacement of the drive unit are performed in order to reduce the negative impact of rail vehicles on the environment. The article compares the energy consumption of the ST44 locomotive prior to and after modernization. The older 14D40 two-stroke internal combustion engines were replaced with a more modern engine unit 12CzN26/26. Fuel consumption tests were carried out on a test bench using a OW6300 water resistor.

W artykule opisano procedury manewrowe zgodnie z instrukcją o technice pracy manewrowej (R-34), scharakteryzowano lokomotywy manewrowe oraz prace, jakie wykonują podczas manewrów. Przedstawiono sposoby wykonywania manewrów oraz dopuszczalne prędkości gwarantujące zachowanie bezpieczeństwa ludzi, pojazdów kolejowych i ładunków. Scharakteryzowano nową i zmodernizowaną lokomotywę, które aktualnie są używane w Polsce podczas wykonywania prac manewrowych. W artykule przedstawiono także pojazdy specjalne, które mogą zastąpić lokomotywy manewrowe podczas wykonywania przez nie prac. Pojazdy tego typu pozwalają na redukcję kosztów do 50% w odniesieniu do całkowitego cyklu życia lokomotywy, ponadto emitują mniej hałasu i spełniają bardziej rygorystyczne normy emisji spalin, gwarantując zachowanie bezpiecznego otoczenia pracownikom. Aktualnie pojazdy szynowo-drogowe mogą wykonywać w szczególności pracę tam, gdzie użycie tradycyjnych lokomotyw jest ekonomicznie nieuzasadnione lub po prostu niemożliwe.

Artykuł zawiera podstawowe informacje dotyczące aktualnie stosowanych metod konstrukcyjnych i eksploatacyjnych, powodujących zmniejszenie zużycia paliwa przez pojazdy transportu masowego, przeznaczone zarówno do przewozów pasażerskich, jak i towarowych. W szczególności zwrócono uwagę na rozwiązania wykorzystujące układy napędu hybrydowego (hamowanie rekuperacyjne) oraz układy odzysku energii ze spalin silnikowych (generatory termoelektryczne). Uwagę zwrócono również na aspekty ekonomicznego użytkowania pojazdów związane z właściwym sterowaniem jednostkami napędowymi (tzw. eko-jazda).

W celu minimalizowania udziału substancji toksycznych w emitowanych przez silniki gazach wylotowych, należy ciągle, bo przepisy dotyczące emisji zanieczyszczeń są obecnie w szybkim tempie zmieniane i zaostrzane, pracować nad nowoczesnymi układami oczyszczania tych gazów. Wymagane jest zatem stosowanie coraz doskonalszych konstrukcyjnie oraz efektywniejszych rozwiązań, które zapewnią maksymalne zmniejszenie ilości toksycznych składników spalin. W artykule zaprezentowano przykładowe systemy znajdujące aktualnie zastosowanie w wybranych pojazdach kolejowych trakcji spalinowej.

W artykule w głównej mierze przedstawiono efekty prowadzonych prac, w postaci wyników badań emisyjnych pojazdów, nad przystosowaniem sprowadzanych z zagranicy lokomotyw spalinowych starego typu do warunków ruchu na polskich liniach kolejowych (dopuszczenie do eksploatacji). W celu dokonania analizy właściwości ekologicznych pojazdów, przeprowadzono pomiary emisji spalin w warunkach stacjonarnego testu badawczego ISO 8178-F.

W artykule dokonano oceny korzystności zastosowania pojazdów szynowo-drogowych w prowadzeniu prac manewrowych na torach, zamiast stosowanych powszechnie, spalinowych lokomotyw manewrowych. Skupiono się głównie na aspektach ekologicznych – emisji toksycznych substancji w spalinach. Przedstawiono w nim między innymi przykładowe wyniki badań emisji zanieczyszczeń z wybranych pojazdów transportu masowego, użytkowanych na polskich liniach kolejowych. W celu dokonania analizy uciążliwości środowiskowej tych pojazdów wykonano pomiary toksyczności spalin w warunkach testu badawczego (ISO 8178-F) oraz, co jest znacznie istotniejsze, podczas rzeczywistego użytkowania pojazdów – przy wykorzystaniu mobilnej aparatury naukowo-badawczej.
