Purpose – This paper aims to investigate the link between agency costs mitigation via three levels of rights protection (minority rights protection, enforcing contracts, resolving insolvency issues) provides the propitious climate for financing investment opportunities around the world. Design/methodology/approach – We use Bartlett’s three-group method to stratify countries based on how well they protect investors as measured by the scores provided in the Doing Business dataset developed by the world bank for 189 countries. We then test a variety of independent hypotheses that the alleviation of agency costs via three levels of protection (minority investors’ rights, contract enforcement, resolving insolvency issues) is associated with better access to credit via the banking system, better valuation of listed firms via the stock market and higher investment and growth. Findings – Our findings support Agency Theory which explains why the absence of legal protection of external investors leads to stock markets and financial institutions failing to fulfill their role of financing the economy. Practical implications – The policy implication from this study indicates that countries ought to (1) develop legislation that protects investors’ rights, (2) improve the quality of their judicial system in terms of enforcing the legislation and (3) build the framework for resolving disputes during insolvency as these are important ingredients for a developed financial system. Originality/value – We use the World bank dataset and a new methodology to quantify the significance of the relationship between minority rights protection, ineffective enforcement, lack of bankruptcy laws and access to firm financing via the banking sector and the stock market. It provides new evidence that the quality of the judicial system in a country matter for firms’ ability to raise financing and enhance value creation.

This study explores the impact of minority shareholders' participation in governance on corporate investment efficiency. The study focuses on the effects of online voting rules in China, utilizing data from firms listed on the Shenzhen Stock Exchange between 2011 to 2017. Employing a quasi-natural experiment with the difference-in-differences model, the results reveal that online voting by minority investors increases corporate investment efficiency. This conclusion is verified using a series of robustness tests and endogeneity adjustments. Furthermore, the findings indicate that the impact of minority investors' online voting is more evident in firms with less internal governance and weaker external monitoring mechanisms. Additionally, minority investor participation in governance increases corporate investment efficiency by increasing information transparency and the quality of internal control. Online voting encourages the organization's management to make more favorable decisions and assure the steady growth of the business. • Minority investors' online voting increases corporate investment efficiency. • This effect is influenced by internal governance and external supervision. • The mechanisms are the information transparency and the internal control quality. Doing Business sheds light on how easy or difficult it is for a local entrepreneur to open and run a small to medium-size business when complying with relevant regulations. It measures and tracks changes in regulations affecting 11 areas in the life cycle of a business: starting a business, dealing with construction permits, getting electricity, registering property, getting credit, protecting minority investors, paying taxes, trading across borders, enforcing contracts, resolving insolvency and labor market regulation. Doing Business 2016 presents the data for the labor market regulation indicators in an annex. The report does not present rankings of economies on labor market regulation indicators or include the topic in the aggregate distance to frontier score or ranking on the ease of doing business. This regional profile presents the Doing Business indicators for economies in Southern African Development Community (SADC). It also shows the regional average, the best performance globally for each indicator and data for the following comparator regions: East Asia and the Pacific (EAP), Economic Community of West African States (ECOWAS), European Union (EU), Middle East and North Africa (MENA) and Organization for the Harmonization of Business Law in Africa (OHADA). The data in this report are current as of June 1, 2015 (except for the paying taxes indicators, which cover the period January–December 2014).

Market-based reforms and the opening up of trade and investment initiated over the past four years have had a positive impact on growth in Myanmar. These have enhanced private sector participation and increased the role of exports in the economy. Reforms have included streamlined business entry procedures, reduced export and import licensing requirements, and enhanced public-private partnerships and dialogue. Promoting private sector competitiveness and inclusion in Myanmar have enormous potential to drive job creation, economic diversification, and structural transformation. This would involve improving the investment climate with an emphasis on transparency and predictability; reducing trade costs and strengthening connectivity for economic integration; enhancing public-private partnerships; and strengthening institutional capacity to drive the reform process. The ongoing peace process calls for careful sequencing of reforms, starting with reducing the costs of doing business and engaging in trade; consulting with local communities; and supporting vulnerable groups adversely affected by economic changes.

Vietnam’s economy has weathered the recent turbulence in the external environment fairly well, reflecting resilient domestic demand and robust performance of export-oriented manufacturing. Growth further accelerated to 6.5 percent (year-on-year) in the first three quarters of 2015 (after coming in at 6 percent last year). Low inflation and strengthening consumer confidence supported an uptick in private consumption while investment was lifted by robust foreign direct investment, rising government capital expenditures, and a recovery of credit growth. Exports of the foreign-invested manufacturing sector also accelerated, but this was offset by a slowdown of commodity exports and a surge in imports of capital and intermediate goods, reflecting stronger investment and the high import content of manufacturing exports.

The World Bank Group’s investment climate project conducted a survey of foreign investors in the Kyrgyz Republic - both those currently operating and those that have terminated their operations for various reasons. The purpose of the survey was to assess selected aspects of the investment policy and legal environment in place in the Kyrgyz Republic, so as to determine whether the current regulations are investment-conducive or otherwise. The following aspects were studied as part of this survey: reasons for selecting a country for investing, ease of market entry, investor confidence, and protection in running a business, investor incentives and market exit. This report presents the analysis of the results of the survey. It consists of six sections, five of which discuss the results of each of the assessed aspects of the investment policy. The sixth section presents some demographics of the survey.
