O objetivo da pesquisa é analisar os diálogos — e a eventual ausência de comunicação — entre os regimes do Direito do Mar e do Comércio Internacional em controvérsias sobre o tema da pesca. Na Parte I, desenvolvem-se os conceitos e os pressupostos teóricos. Apresentam-se o cenário da discussão sobre a fragmentação do Direito Internacional e a multiplicação de cortes internacionais e problematiza-se o debate sobre a existência de regimes autossuficientes. Discute-se sobre os diferentes conceitos de regimes bem como explica-se o porquê de o Comércio Internacional e o Direito do Mar serem considerados regimes especiais. Em seguida, serão analisadas as ferramentas de resolução de conflitos normativos desenvolvida pela Comissão de Direito Internacional e outras formas de abordar as interações elaboradas pela doutrina. Especial atenção foi destinada à cooperação entre cortes e à interação mainstreaming, que constitui uma forma de cooptação. A parte II é dividida em dois momentos. No capítulo 2, realiza-se um estudo sobre os regimes do Direito do Mar e do Comércio Internacional, sinalizando o vocabulário e o ethos de cada um; os principais instrumentos normativos aplicáveis aos casos que versam sobre pesca; e a estrutura de seus respectivos mecanismos de solução de controvérsias. No capítulo 3, as propostas doutrinárias apresentadas na Parte I são aplicadas a casos sobre o tema da pesca que foram julgados em cada um dos tribunais, com ênfase às situações que geraram procedimentos paralelos. Como metodologia de abordagem para a análise da interação, três níveis de diálogo foram utilizados: a citação direta de um tribunal ao outro; as referências sobre os casos apontadas pela doutrina e a análise transversal dos termos princípio da precaução, desenvolvimento sustentável e abordagem ecossistêmica. Ao final, identifica-se que o regime do Direito do Mar não logrou constituir um vocabulário ou ethos próprio. Dessa forma, apesar de elementos do vocabulário protetivo terem sido absorvidos, o Tribunal Internacional do Direito do Mar se manteve atrelado às posições desenvolvidas pela Corte Internacional de Justiça e pela Corte Permanente de Justiça Internacional, atendendo ao público do Direito Internacional geral com a prevalência do princípio do mare liberum, conectado ao interesse comercial. O regime do Direito Comercial, por sua vez, é autocentrado e possui um vocabulário forte e um mecanismo compulsório de solução de controvérsias eficiente. Nesse contexto, seu movimento é de atender ao público interno. Assim, argumentos que busquem a conservação dos estoques pesqueiros são, em sua maioria, interpretados de forma submissa em relação à liberdade comercial. Entende-se que, para promover diálogos transparentes, plurais e contra hegemônicos, é essencial descortinar os interesses políticos envolvidos nas atividades de cada um desses regimes. The purpose of this research is to analyze the dialogues — and the absence of communication — between the regimes of the Law of the Sea and Trade in conflicts about fisheries. Part I discusses the concepts and theoretical assumptions. The debate on the fragmentation of international law and the proliferation of international Courts is reviwed as the argument over the existence of self-contained regimes. The definitions of regimes are discussed and it is explained why the Law of the Sea and Trade should be understood as regimes. Subsequently, the toolbox of principles developed by the International Law Comission to deal with normative conflicts is analyzed, as will be other approaches developed by international lawyers. Special attention will be addressed toward the cooperation between courts and the mainstreaming interaction, which is a form of co-optation. Parte II is split in two sections. In chapter 2, a study is carried out on the regimes of the Law of the Sea and Trade law, emphasizing the vocabulary and the ethos of each one, as well as the main normative instruments applicable on cases about fisheries and the structure of their dispute settlement mechanisms. In chapter 3, the theoretical insights developed in Part I will be applied to a specific research study on case law surrounding fisheries, a study that includes some parallel judicial proceedings. The methodological approach adopted to analyze the interactions between regimes is based on three levels of dialogue: the direct quotation of one tribunal to another; the interaction between cases informed by the doctrine; and the cross-application of the terms precautionary principle, sustainable development and ecosystem approach. In the end, it is concluded that the regime of the law of the sea fails to provide a vocabulary or an ethos in and of itself. In this sense, although many elements of the environmental vocabulary have been assimilated, the International Tribunal for the Law of the Sea remains attached to the orthodox legal positions held by International Court of Justice and Permanente Court of International Justice, serving the general international law audience in which the mare liberum principle and the trade ethos prevails. The Trade law regime, in turn, is very self-centered and has a strong vocabulary and an efficient Dispute Settlement Understanding. In this context, its mainly concern is to attend to the regime’s internal audience. As such, arguments that seek the conservation of fish stocks are, for the most party placed in a compliant position towards free trade. It is understood that disclosing the political interests surrounding the activity of each regime is essential to promote transparent, plural and counter-hegemonic dialogues among them.
