Textual Ambiguity and the [...], Ten years after the passage of the Mental Health Parity and Addiction Equity Act (MHPAEA), parity between mental health/substance use disorders and medical/surgical benefits remains elusive. This Note describes the statutes cooperative federalist framework and analyzes enforcement data and settlement documents demonstrating the role of states in prospective enforcement. In comparing the MHPAEA to other cooperative statutes, it concludes that MHPAEA compliance could be improved by expanding private rights of action, promoting stakeholder collaboration, utilizing conditional spending, and allowing for waivers. The Note also renews calls for consumer education, clarifying regulations, and proactive enforcement by federal agencies and states.

Abstract

The Americans with Disabilities Act (ADA) is a seminal piece of legislation aimed at protecting those with disabilities from discrimination. The ADA, however, has not been consistently able to integrate people with disabilities successfully into society. With a specific focus on individuals with serious brain injuries, this Article aims to provide insight into the shortcomings of the ADA, specifically focusing on lackluster enforcement of the legislation and its failure to incorporate promising new technologies. These limitations of the ADA are made even more clear in light of the evolution occurring in the understanding of rights and capabilities. As such, the time has come for a new piece of legislation that fully incorporates the advanced technology available to individuals, while promoting a more positive understanding of advancing rights and capabilities. The proposed Americans with Abilities Act (AWAA) will correct the deficiencies in the ADA, ultimately allowing individuals with disabilities to integrate more fully into society.

4. SOFT ON CRIME: ANTITRUST SOFT LAW TO SOLVE CYBERSECURITY GOVERNANCE CRISES.

Abstract

To combat bioterrorism and cybercrime in the 2000s, antitrust agencies stepped up where Congress failed repeatedly to pass a cybersecurity bill. Their actions were surprising both in content and method. Substantively, the policy the FTC and DOJ promoted was to encourage plausibly anticompetitive joint ventures to proceed, so long as these collaborations existed for cyber safety purposes. The administrative agencies pursued this policy not via either formal or informal rulemaking, but rather a network of non-binding guidance known as "soft law." This technique structured industry incentives such that joint ventures would continue developing cyber defense mechanisms to protect the entire country. This analysis forces questions about ongoing debates within antitrust law and theories of agency activity. The Article also muses on why decentralized regulation, typically a polarizing subject, is so universally favored for cyber governance. [ABSTRACT FROM AUTHOR]

Abstract

The COVID-19 pandemic is a catastrophe that has caused societal upheaval globally. In the US, 2 it triggered an economic shock and laid bare societal inequities. However, it also afforded a unique 3 opportunity to elucidate the dynamics of psychosocial processes during extreme and volatile 4 conditions. From April 2020 through January 2021, we conducted a within-participant longitudinal 5 study—in 16 waves—to capture the COVID-19 experiences of >1000 US residents, together with 6 curated, external data to contextualize participants' responses. Each hour-long wave combined 7 standard psychological assessments with surveys of emotion, social/political/moral attitudes, 8 COVID-19-related behaviors, and tasks assessing implicit attitudes and social decision-making. 9 Here we characterize the sample, assess data quality, and showcase examples to demonstrate 10 the promise of this dataset, which is intended to be a resource for researchers interested in a 11 multitude of psychological questions, as well as clinicians and policy makers looking to mitigate 12 the psychological effects of future calamities.
