It's a part of social fairness, justness, harmony and stability for the children of the floating population to receive education equally, which is a right stated in the international laws, the "Constitutional Law of China", as well as other relevant policies and codes. In the modern international community, equal right to education has become a basic human right confirmed by the international, which is not to be deprived and common to human beings as a whole. Equal right to education is, in the fields of culture and education, the extension and deepening of right of equality stated in the constitutional law, and it is one of the basic rights, which has been written clearly both in the "Education Law" and "Compulsory Education Law". However, at the present time, there still exist various problems in the education for the children of the floating population, such as unfair requirements for admission, less chance of sharing the public education resources, education segregation, weak insurance of the right, low quality education, etc. , which all make it difficult for them to enjoy equal right to education. In the aspect of admission requirements, the children of the floating population have to face unfair treatments, such as severe restriction in the time of residence, certification conditions, and discriminatory fees.
