- Abstract
Learn to become a great writer and master modern grammar rules with the U.S. Supreme Court justices as your guide. In The Supreme Guide to Writing, law professor Jill Barton cuts through competing advice to detail definitive grammar rules based on the nation's unequivocal authority: the U.S. Supreme Court. The book details a revolution in legal writing, with the justices progressing beyond the drab and technical for the deft and lyrical. With the first-ever analysis of 10,000 pages of Court opinions, the book pinpoints grammar and style rules that the justices follow--and describes the outdated rules they leave behind. Today's Court casts aside formality in favor of pop-culture references, contractions, and approachable language. In addition to establishing grammar and style rules, the book illustrates best practices with hundreds of examples of the justices'most brilliant sentences from the past several years. With step-by-step instructions, the book describes how to emulate the justices'writing styles by breaking down their strategies and techniques. It shows how Justice Elena Kagan lands amusing quips and weaves together down-to-earth analogies, how Justice Neil Gorsuch executes witty retorts, and how Chief Justice John Roberts pens unforgettable lines with understated style and humor. The best writing appears effortless, but it also takes tremendous effort. Legal writing even more so. The Supreme Guide to Writing provides a nonpartisan look at how the justices present their words to the world.

This Research Handbook inspires a new vision of contracts, with practical illustrations of how they should be designed, rather than just drafted. The contributors offer a proactive approach, merged with innovative design, to show how contracts can be both user-friendly and legally functional. This ground-breaking work goes beyond the initial drafting and formation of contracts to cover implementation and integration with business infrastructure – including digital processes. Drawing on a multi-disciplinary perspective, it highlights all aspects of the contract lifecycle, using both theoretical and practical scenarios. As well as improved design and communication, the Handbook takes a creative view of the role of emerging technologies, including AI, and how they can increase contract functionality and visualisation. The goals are simplification, clarity about rights and obligations, and the prevention of unnecessary legal problems. Providing an up-to-date analysis of current trends in contract design thinking and practice, this Handbook will be an excellent resource for contract and legal professionals, scholars and practitioners. - Legal composition, Law--Language.--United States
- Abstract
'Effective legal writing calls not only for artistry but also for scientific understanding.'In this synthesis of his experience on the bench and his own research into the science and art of written communications, Robert E. Bacharach, a federal court judge, shares his insights on ways language can determine different responses -- and how to use this knowledge to craft a powerful and persuasive message. Judge Bacharach follows a logical progression in crafting effective legal writing, beginning with the importance of an introduction that provides a context for the argument. At this stage, it is important to consider clarity, context, identification of the underlying legal issues, the structure of your argument, and stating the rationale for the optimum outcome. Subsequent chapters look at specific aspects of effective legal writing, including: Organization - the guiding principles of parallelism, logical sequence, and developing the point before responding to the adversarial argument Headings - creating a familiar context to make it easier for readers to follow your argument Fact sections - the importance of a clearly written summary of legal facts that is readily understandableSentences and paragraphs - in-depth commentary on structural issues such as varying the length of the sentence structure to key rhetorical devices, all to make the reader follow the flow of the argument Diction - how to choose the right word (and why) Grammar - the most essential rules to follow for effective legal writing Conclusions - how to end strong with a concise reminder of the core points Quoting - when--and when not--to use it Typography and page layout Throughout the book, Judge Bacharach illustrates his points with real-world examples from lawyers and judges. As Lisa Blatt of Williams & Connolly states, this is an'easily readable and comprehensive catalogue of do's and don'ts that provides the essential foundations for clear, persuasive legal writing... From diction to grammar, and alliterations to aphorisms, this book is mandatory reading for law students and lawyers alike.'

SOCIAL enterprises , *JURISDICTION , *LEGAL composition - Abstract
This Article argues that there should be a new legal form for social enterprises in Asia that takes into account the distinctive contexts within which different types of social enterprises operate in the different Asian jurisdictions. In order to understand and evaluate social enterprise law, this Article advances an analytic framework consisting of (i) corporate purpose; (ii) directors' duties; (iii) decision-making powers; (iv) reporting and certification; and (v) distribution of dividends, assets, and tax benefits. Using the four leading common law jurisdictions (Singapore, Hong Kong, Malaysia, and India) as a case study, the Article challenges the dominant assumption that the existing legal forms in Asia are adequate and appropriate to achieving the aims of social enterprises in Asia. It also critiques the legal forms for social enterprises in the United Kingdom and the United States, and finds them unsuitable for adoption by the Asian jurisdictions. [ABSTRACT FROM AUTHOR]

- Abstract
Lawyers like to think they are good writers. Their non-lawyer readers are more likely to describe their writing as turgid, pedantic, Latin-filled, jargon-ridden, misspelt, ungrammatical, and inelegant. Guthrie's Guide to Better Legal Writing won't solve all your problems, but it will help you make your prose clear, correct, and compelling. The focus is on communicating more effectively in email, letters, memos, blog posts, client updates, and social media, but there are some pointers on contractual drafting and written advocacy as well. A bit of strategy, some grammar and spelling, and a lot of style. The second edition of Guthrie's Guide incorporates significant new material based on reader queries and the author's on-going review of the legal writing that crosses his desk and screen.

- Abstract
Pre-Litigation Drafting - Legal opinions, demands and settlements is a useful reference for anyone working in areas of law in which there is a need to comply with a host of legislative imperatives to write in'plain language', or generally in a manner that meets the needs of a particular target audience including the imperative to write pleadings that are ‘clear and concise'. The book is also of value to those who are new to the practice of law, and who seek guidance in preparing and planning legal documents that are written before litigation commences, such as opinions and letters of demand. Inspired by the UK Department of Justice ‘Pre-action Protocols', the aim of the guidance is to provide a set of guiding principles for drafters to follow in writing documents that are effective in avoiding litigation. To this end the book now includes settlement agreements reached before summons is issued. The text applies these principles in a variety of hypothetical contexts.

- Abstract
'Legal Drafting in a Nutshell, 5th Edition, provides guidance on producing transactional documents, contracts, instruments, legislation, and regulations that solve existing problems and prevent future problems. The book provides both a large scale, macro overview of the drafting process as well as small scale, micro focused discussion of the mechanics of legal documents at the sentence, word, and punctuation level. The book incorporates current and developing perspectives regarding subjects like plain English, legal typography, and document preparation in the 21st century. This is especially the case in sections of the text dealing with contracts and instruments, although it is true throughout the text. Legal drafting is as much a thought process as a writing process; clear thinking leads to clear drafting. This book is a guide for clear, structured thinking about drafting in order to provide readers with a structured process to follow when assembling useful legal documents.'-- Publisher.
