Kategorische Zuordnungen von Spuren zu Gegenständen oder Personen in forensisch-wissenschaftlichen Gutachten, sog. Individualisierungen, erfreuen sich in der juristischen Praxis seit je her grosser Beliebtheit. Geläufige Beispiele finden sich in Fachbereichen wie der DNA-Analyse, der vergleichenden Handschriftenuntersuchung sowie, neuerdings, dem Gesichtsvergleich, den auch hiesige Behördenkreise in der Praxis zu verankern gedenken. Entgegen weitläufiger Auffassungen beruhen Individualisierungen in Sachverständigengutachten jedoch auf wissenschaftlich unhaltbaren Annahmen. Im vorliegenden Beitrag greifen wir diese Problematik einmal mehr kritisch auf und illustrieren sie anhand einer unlängst von forensischen Genetikern veröffentlichten Empfehlung, die darauf abzielt, DNA-Spurenzuordnungen auf Personen durch Sachverständige zu legitimieren. Wir zeigen auf, dass Individualisierungen in Sachverständigengutachten praktische, begriffliche und rechtstheoretische Probleme aufwerfen, und aus diesem Grund in sämtlichen forensisch-wissenschaftlichen Fachbereichen als praxisuntauglich zu betrachten sind. -- L'individualisation, c'est-à-dire l'association catégorique de traces à des objets ou à des personnes dans le cadre d'expertises forensiques est encore largement répandue dans la pratique juridique. On trouve des exemples courants dans des domaines spécialisés tels que les traces digitales, l'analyse de l'ADN, l'examen comparatif d'écritures et de signatures, et, plus récemment, la comparaison des visages, que les autorités de notre pays envisagent d'utiliser prochainement en routine. Contrairement aux idées reçues, l'individualisation dans les expertises forensiques repose sur des prémisses scientifiquement infondées. Dans le présent article, nous abordons une fois de plus cette problématique de manière critique et l'illustrons à l'aide d'une recommandation publiée récemment par des généticiens forensiques, visant à légitimer l'association de traces d'ADN à des personnes par des expert·e·s. Nous montrons que les individualisations dans les expertises forensiques posent des problèmes pratiques, conceptuels et théoriques et qu'elles doivent donc être considérées comme inadaptées à la pratique dans tous les domaines de la science forensique.

At a time when developments in computational approaches, often associated with the now much-vaunted terms Machine Learning (ML) and Artificial Intelligence (AI), face increasing challenges in terms of fairness, transparency and accountability, the temptation for researchers to apply mainstream ML methods to virtually any type of data seems to remain irresistible. In this paper we critically examine a recent proposal to apply ML to polygraph screening results (where human interviewers have made a conclusion about deception), which raises several questions about the purpose and the design of the research, particularly given the vacuous scientific status of polygraph-based procedures themselves. We argue that in high-stake environments such as criminal justice and employment practice, where fundamental rights and principles of justice are at stake, the legal and ethical considerations for scientific research are heightened. Specifically, we argue that the combination of ambiguously labelled data and ad hoc ML models does not meet this requirement. Worse, such research can inappropriately legitimise otherwise scientifically invalid, indeed pseudo-scientific methods such as polygraph-based deception detection, especially when presented in a reputable scientific journal. We conclude that methodological concerns, such as those highlighted in this paper, should be addressed before research can be said to contribute to resolving any of the fundamental validity issues that underlie methods and techniques used in legal proceedings.

This paper grapples with the issue of naked statistical evidence in general and the reference class problem (RCP) in particular. By analysing the reasoning patterns underlying the RCP, I will show, first, that the RCP rests on theoretical presuppositions which we are by no means willing to accept. Such a presupposition is the wholesale approach in decision-making. Secondly, I will show that the very effort to increase the level of precision to a maximum so that a reference class contains a single member only is theoretically inconsistent insofar, as it deprives reference classes of their general (and thus scientific) character. Thereupon, I will argue, thirdly, that the decision to enact a specific evidence rule is a political one and reflects deep moral and jurisprudential values, not scientific propositions. Such a value is personal autonomy, which I go on to illuminate briefly. Whether the trier of fact will treat cases in a wholesale approach or not depends on constitutional arrangements and legal values putting emphasis on the individual and the latter’s dignity.

Evidence law regimes across several contemporary legal orders provide a host of doctrinal devices designed to probe various sorts and sources of information, especially with respect to their accuracy and reliability. These legal provisions, however, are vulnerable to or even tolerant towards uninterpretable evidence, that is evidence whose probative value cannot be assessed. This article critically examines and discusses the “littering paths” of uninterpretable evidence in legal proceedings. We point out the misinformative character and potentially misleading impact on criminal adjudication when using scientific evidence for purposes that, strictly speaking, the evidence cannot help with. We identify common causes and possible remedies and argue that to track uninterpretability, it is necessary to understand what exactly it means to say that a piece of evidence is probative in the procedural space of reasons, and how to draw the line between informative and non-informative items of evidence.

Criminal law’s efficient and accurate administration depends to a considerable extent on the ability of decision-makers to identify unique individuals, circumstances and events as instances of abstract terms (such as events raising ‘reasonable suspicion’) laid out in the legal framework. Automated Facial Recognition has the potential to revolutionise the identification process, facilitate crime detection, and eliminate misidentification of suspects. This paper commences from the recent decision regarding the deployment of AFR by South Wales Police in order to discuss the lack of underpinning conceptual framework pertinent to a broader consideration of AFR in other contexts. We conclude that the judgment does not give the green light to other fact sensitive deployments of AFR. We consider two of these: a) use of AFR as a trigger for intervention short of arrest; b) use of AFR in an evidential context in criminal proceedings. AFR may on the face of it appear objective and sufficient, but this is belied by the probabilistic nature of the output, and the building of certain values into the tool, raising questions as to the justifiability of regarding the tool’s output as an ‘objective’ ground for reasonable suspicion. The means by which the identification took place must be disclosed to the defence, if Article 6 right to a fair trial is to be upheld, together with information regarding disregarded ‘matches’ and error rates and uncertainties of the system itself. Furthermore, AFR raises the risk that scientific or algorithmic findings could usurp the role of the legitimate decision-maker, necessitating the development of a framework to protect the position of the human with decision-making prerogative.

Forensic science is currently undergoing a transformation and expansion to include modern types of evidence, such as evidence generated by digital investigations. This development is said to raise a series of challenges, both in operational and conceptual dimensions. This paper reviews and discusses a series of convoluted conceptual hurdles that are encountered in connection with the use of digital evidence as part of evidence and proof processes at trial, in contradistinction to investigative uses of such types of evidence. As a recent example raising such hurdles, we analyse and discuss assertions and proposals made in the article “Digital Evidence Certainty Descriptors (DECDs)” by Graeme Horsman (32 Forensic Science International: Digital Investigation (2020) 200896).

The modification of nuclear, mitochondrial, and cytosolic proteins by O-linked βN-acetylglucosamine (O-GlcNAc) has emerged as a dynamic and essential post-translational modification of mammalian proteins. O-GlcNAc is cycled on and off over 5000 proteins in response to diverse stimuli impacting protein function and, in turn, epigenetics and transcription, translation and proteostasis, metabolism, cell structure, and signal transduction. Environmental and physiological injury lead to complex changes in O-GlcNAcylation that impact cell and tissue survival in models of heat shock, osmotic stress, oxidative stress, and hypoxia/reoxygenation injury, as well as ischemic reperfusion injury. Numerous mechanisms that appear to underpin O-GlcNAc-mediated survival include changes in chaperone levels, impacts on the unfolded protein response and integrated stress response, improvements in mitochondrial function, and reduced protein aggregation. Here, we discuss the points at which O-GlcNAc is integrated into the cellular stress response, focusing on the roles it plays in the cardiovascular system and in neurodegeneration.

Although low circulating levels of the vitamin A metabolite, all-trans retinoic acid (ATRA), are associated with increased risk of cardiovascular events and all-cause mortality, few studies have addressed whether cardiac retinoid levels are altered in the failing heart. Here, we showed that proteomic analyses of human and guinea pig heart failure (HF) were consistent with a decline in resident cardiac ATRA. Quantitation of the retinoids in ventricular myocardium by mass spectrometry revealed 32% and 39% ATRA decreases in guinea pig HF and in patients with idiopathic dilated cardiomyopathy (IDCM), respectively, despite ample reserves of cardiac vitamin A. ATRA (2 mg/kg/d) was sufficient to mitigate cardiac remodeling and prevent functional decline in guinea pig HF. Although cardiac ATRA declined in guinea pig HF and human IDCM, levels of certain retinoid metabolic enzymes diverged. Specifically, high expression of the ATRA-catabolizing enzyme, CYP26A1, in human IDCM could dampen prospects for an ATRA-based therapy. Pertinently, a pan-CYP26 inhibitor, talarozole, blunted the impact of phenylephrine on ATRA decline and hypertrophy in neonatal rat ventricular myocytes. Taken together, we submit that low cardiac ATRA attenuates the expression of critical ATRA-dependent gene programs in HF and that strategies to normalize ATRA metabolism, like CYP26 inhibition, may have therapeutic potential.

In a paper published recently in this journal, Dror and Scurich (2020) [20] critically discuss the notions of “inconclusive evidence” (i.e., test items for which it is difficult to render a categorical response) and “inconclusive decisions” (i.e., experts’ conclusions or responses) in the context of forensic science error rate studies. They expose several ways in which the understanding and use of “inconclusives” in current forensic science research and practice can adversely affect the outcomes of error rate studies. A main cause of distortion, according to Dror and Scurich, is what they call “erroneous inconclusive” decisions, in particular the lack of acknowledgment of this type of erroneous conclusion in the computation of error rates. To overcome this complication, Dror and Scurich call for a more explicit monitoring of “inconclusives” using a modified error rate study design. Whilst we agree with several well-argued points raised by the authors, we disagree with their framing of “inconclusive decisions” as potential errors. In this paper, we argue that referring to an “inconclusive decision” as an error is a contradiction in terms, runs counter to an analysis based on decision logic and, hence, is questionable as a concept. We also reiterate that the very term “inconclusive decision” disregards the procedural architecture of the criminal justice system across modern jurisdictions, especially the fact that forensic experts have no decisional rights in the criminal process. These positions do not ignore the possibility that “inconclusives” – if used excessively – do raise problems in forensic expert reporting, in particular limited assertiveness (or, overcautiousness). However, these drawbacks derive from inherent limitations of experts rather than from the seemingly erroneous nature of “inconclusives” that needs to be fixed. More fundamentally, we argue that attempts to score “inconclusives” as errors amount to philosophical claims disguised as forensic methodology. Specifically, these attempts interfere with the metaphysical substrate underpinning empirical research. We point this out on the basis of the law of the excluded middle, i.e. the principle of “no third possibility being given” (tertium non datur).

Abstract Follistatin‐like 1 (Fstl1) is a secreted protein that is acutely induced in heart following myocardial infarction (MI). In this study, we investigated cell type‐specific regulation of Fstl1 and its function in a murine model of MI. Fstl1 was robustly expressed in fibroblasts and myofibroblasts in the infarcted area compared to cardiac myocytes. The conditional ablation of Fstl1 in S100a4‐expressing fibroblast lineage cells (Fstl1‐cfKO mice) led to a reduction in injury‐induced Fstl1 expression and increased mortality due to cardiac rupture during the acute phase. Cardiac rupture was associated with a diminished number of myofibroblasts and decreased expression of extracellular matrix proteins. The infarcts of Fstl1‐cfKO mice displayed weaker birefringence, indicative of thin and loosely packed collagen. Mechanistically, the migratory and proliferative capabilities of cardiac fibroblasts were attenuated by endogenous Fstl1 ablation. The activation of cardiac fibroblasts by Fstl1 was mediated by ERK1/2 but not Smad2/3 signaling. This study reveals that Fstl1 is essential for the acute repair of the infarcted myocardium and that stimulation of early fibroblast activation is a novel function of Fstl1.

The relationship between forensic science and legal adjudication is intricate mainly because the need to inform fact-finders on issues going beyond the layman’s knowledge poses challenges both on empirical and normative dimensions, in particular with regards to the specific role and duties of the different participants in the legal process. While rationality is widely upheld as one of the aspirations of the legal process across many modern jurisdictions, a pending question is how to remedy the uneasy relationship between general propositions (and knowledge claims) conditioning expert witness testimony, and individualized decisions taken by fact-finders. The focus has hitherto been put on the utilization of model-based and formal methods of reasoning while, regrettably, the concepts of judgment and decision-making have not received equal attention. A first aspiration of our paper will thus be to further clarify the nature of this systemic relationship in the particular area of the legal process involving scientific experts, by conducting a critical transversal analysis of current empirical, normative and doctrinal understandings of expert witness testimony. As a second aim, we will use this insight to argue in favor of the view that structural features of expert witness testimony are embedded in a decision-making process, and that the understanding of this decisional dimension is important for clarifying the respective roles of expert witnesses and fact-finders, and for favoring their mutual understanding thereof. To substantiate this perspective, and attest to its growing recognition as a frontier understanding, we will provide real-world examples from forensic science reporting practice and policy documents of professional bodies.

The time-on-stream catalytic performance and stability of 8 wt. % Ni catalyst supported on two commercially available catalytic supports, ZrO2 and 15 wt.% WO3-ZrO2, was investigated under the biogas dry reforming reaction for syngas production, at 750°C and a biogas quality equal to CH4/CO2 = 1.5, that represents a common concentration of real biogas. A number of analytical techniques such as N2 adsorption/desorption (BET method), XRD, H2-TPR, NH3- and CO2-TPD, SEM, ICP, thermal analysis (TGA/DTG) and Raman spectroscopy were used in order to determine textural, structural and other physicochemical properties of the catalytic materials, and the type of carbon deposited on the catalytic surface of spent samples. These techniques were used in an attempt to understand better the effects of WO3-induced modifications on the catalyst morphology, physicochemical properties and catalytic performance. Although Ni dispersion and reducibility characteristics were found superior on the modified Ni/WZr sample than that on Ni/Zr, its dry reforming of methane (DRM) performance was inferior; a result attributed to the enhanced acidity and complete loss of the basicity recorded on this catalyst, an effect that competes and finally overshadows the benefits of the other superior properties. Raman studies revealed that the degree of graphitization decreases with the insertion of WO3 in the crystalline structure of the ZrO2 support, as the ID/IG peak intensity ratio is 1.03 for the Ni/Zr and 1.29 for the Ni/WZr catalyst.

The present investigation provides an overview of the current technology related to the green diesel, from the classification and chemistry of the available biomass feedstocks to the possible production technologies and up to the final fuel properties and their effect in modern compression ignition internal combustion engines. Various biomass feedstocks are reviewed paying attention to their specific impact on the production of green diesel. Then, the most prominent production technologies are presented such as the hydro-processing of triglycerides, the upgrading of sugars and starches into C15–C18 saturated hydrocarbons, the upgrading of bio-oil derived by the pyrolysis of lignocellulosic materials and the “Biomass-to-Liquid” (BTL) technology which combines the production of syngas (H2 and CO) from the gasification of biomass with the production of synthetic green diesel through the Fischer-Tropsch process. For each of these technologies the involved chemistry is discussed and the necessary operation conditions for the maximum production yield and the best possible fuel properties are reviewed. Also, the relevant research for appropriate catalysts and catalyst supports is briefly presented. The fuel properties of green diesel are then discussed in comparison to the European and US Standards, to petroleum diesel and Fatty Acid Methyl Esters (FAME) and, finally their effect on the compression ignition engines are analyzed. The analysis concludes that green diesel is an excellent fuel for combustion engines with remarkable properties and significantly lower emissions.

Lysine modifications have been studied extensively in the nucleus, where they play pivotal roles in gene regulation and constitute one of the pillars of epigenetics. In the cytoplasm, they are critical to proteostasis. However, in the last decade we have also witnessed the emergence of mitochondria as prime locus for post-translational modification of lysine thanks, in large measure, to evolving proteomic techniques. Here, were we review recent work on evolving set of post-translational modifications that arise from the direct reaction of lysine residues with energized metabolic thioester-coenzyme A intermediates, including acetylation, succinylation, malonylation and glutarylation. We highlight the evolutionary conservation, kinetics, stoichiometry and cross-talk between members of this emerging family of PTMs. We examine the impact on target protein function and regulation by mitochondrial sirtuins. Finally, we spotlight work in the heart and cardiac mitochondria, and consider the roles acetylation and other newly-found modifications may play in heart disease.
