This article outlines measures adopted in national social security schemes to promote the (re)integration into work of people with disabilities. The measures are evaluated in the light of broader reform trends, stemming from EU policies to foster labour market participation. Since the beginning of this century, the EU has played an active role in confronting national authorities with the need to design employment policies in which competitiveness and economic growth go hand in hand with measures that ensure that disadvantaged groups have equal access to the labour market and receive effective support to access employment. Recent statistical data show, however, that the employment position of disadvantaged groups is still weak. This would seem to suggest that the social quality of national schemes to foster labour market participation falls short of expectations. To gain insight into this matter, thirty European countries were asked to draw up national reports on the employment position of people with disabilities within the framework of the EU-funded MISSOC project. This article presents a synopsis of the main findings from these reports. It starts with an overview of relevant developments at the European level (section 1). A framework for the evaluation of the social quality of national programmes to promote the (re)integration into work of people with disabilities is then developed in section 2. The results of the evaluation are presented in section 3, thereby focusing on measures addressing people with disabilities on the one hand (sections 3.1 and 3.2) and measures addressing the employer on the other hand (section 3.3). The evaluation winds up with some concluding observations with regard to the way in which the social dimension of employment policies has been implemented in national schemes to promote the (re)integration into work of people with disabilities (section 4).

The reform of long-term care (LTC) in the Netherlands is a much debated topic. The reform essentially comes down to a shift in healthcare claims and a cutback. As of 1 January 2015, the Long-Term Care Act (WLZ) shall replace the Exceptional Medical Expenses Act (AWBZ). In doing so, parts of the AWBZ will shift to the Health Care Insurance Act (ZVW) and the renewed Social Support Act (WMO 2015), which will be carried out by municipalities. This is a significant change: whereas the AWBZ provides a right to care, the WMO commands delivery of tailor-made support. Care that falls under the WMO is only awarded if the capacity of persons seeking care, among others their financial resources and social network, are insufficient. Higher contributions than in the AWBZ may also be requested. These developments influence the experienced level of solidarity.

This paper has been composed within the framework of the’ shifts in governance’ project. One of the main objectives of this project is to identify shifts from one personal injury compensation system to another (e.g. From public funding to civil law), as well as shifts within a particular compensation system. In that respect a number of countries and various domains of accident law (notably work injury, medical negligence and environmental damage) have been analysed. As far as work injury (industrial accidents and occupational diseases) is concerned, we have considered the netherlands, belgium, germany and great britain. Other ‘shifts in governance’ papers in this domain have dealt with, respectively, the legal analysis of shifts in governance and a presentation of first empirical findings in these four countries.1.

This article introduces two of the core topics in the current debates concerning the European Employment Strategy (EES) that are likely to have a significant impact on the strategy’s future development. The first concerns the changing view of work and security, exemplified by the growing attention for ‘flexicurity’ and employment security. The second is the debate on the effectiveness of the EES in influencing Member State policies and performance. This article also serves as an introduction to this special issue, which approaches and discusses these two key debates in various ways.

This paper, which has been composed within the framework of the’ shifts in governance’ project, contains an impression of first empirical data that was collected on industrial accidents and occupational diseases in four european countries: the netherlands, belgium, germany and great britain. The analysis so far is modest: we just looked for data on the incidence and scope of work injury in those countries. In a next phase these data could be used to analyse the effectiveness of various compensation systems, such as tort law and private insurance on the one hand and no-fault compensation funds and social security on the other. This paper addresses seemingly simple questions, such as: what exactly are the sources of compensation for work injury in each of those countries? and how much do these sources of compensation pay out in cases of industrial accidents or occupational diseases? it will be very difficult, however, to answer these questions, as in all four countries under review here the compensation system consists of several different layers.

In 2003 the research programme compensation for damage — the shift from civil law to public funding and vice versa started under the supervision of prof. Dr willem h. Van boom (erasmus university rotterdam) and prof. Dr michael f. Faure ll.m (university of maastricht) and with financial support of the dutch scientific organisation (nwo). Inspired by recent changes in the legal basis for compensating damage, this research programme aims at analysing shifts in paradigm with regard to compensation for damage across the borderline between civil law and public funding and vice versa. Several trends are discernable in this respect. On the one hand, there are clear signs of shifts being made from public funding to compensation systems based on civil law and individual responsibility. On the other hand, there are also developments which would seem to mirror shifts from individual responsibility to public funding or alternative systems of solidarity, such as compulsory insurance.
