As transnational crime has no regard to borders, competent authorities need to overcome the barriers the barriers of national jurisdictions and cooperate together. The UN and regional organisations, including the EU and ASEAN, have required States to criminalise transnational crime, including terrorism, and to implement effective measures to prevent, investigate, detect, prosecute and punish these offences. They have also required States to cooperate; cooperation being one of the key measures to ensure the effectiveness of States’ action.The regional level is considered to be the most effective to harmonise legislation as well as to adopt and implement mechanisms of cooperation for security purposes. However, the nature and level of cooperation vary a lot depending on the regional framework considered. In the EU, this cooperation has been legally framed and institutionalised as well as associated with harmonisation of Member States’ legislation. By contrast, cooperation remains much more informal in ASEAN and is not associated with harmonization of legislation. Despite its low level of integration, ASEAN plays an increasing role in the region by leading efforts to create a regional legal architecture. ASEAN is the most successful regional grouping in the “developing world” and has a particular approach vis-à-vis terrorism. Both regions have therefore a legitimate ground and purpose in learning from each other (comparative regionalism) and in working together (interregionalism) in order to ensure – up to the capacities of each regions – the best response to terrorism.The differences between the two regions are due to various factors, among which the unalike degree of trust between their respective Member States and their capacity to cooperate. En des temps différents et pour défendre des causes différentes, ils entreprirent un voyage qui les mena à prendre les armes dans des guerres étrangères. Ce phénomène historique a connu, depuis la dernière décennie, un nouveau tournant juridique à travers le flux des milliers d’étrangers qui ont rejoint l’une des parties belligérantes en Syrie ou en Irak. Pour faire face à cette menace pour la paix et la sécurité internationales, les Nations unies ont alors créé le statut juridique de « combattant terroriste étranger », soumettant ces étrangers des conflits armés aux dispositions de la lutte contre le terrorisme. Toutefois, ce statut semble souffrir de nombreuses lacunes qui, notamment, ne permettent pas de différencier un terroriste international d’un simple volontaire international, d’un membre d’un groupe armé organisé ou encore d’un combattant d’une force armée étatique. In different times and to defend different causes, they undertook a journey which led them to take up arms in foreign wars. This historic phenomenon underwent a new legal turning point the last decade through the flow of thousands of foreigners who joined one of the belligerent parties in Syria and Iraq. To address this threat to international peace and security, the United Nations created the legal term of “foreign terrorist fighter”, subjecting these foreigners in armed conflicts to provisions in international counter-terrorism law. However, this status suffers shortcomings, which make it impossible, in particular, to differentiate between an international terrorist, an international volunteer, a member of an organized armed group or even a combatant of a state armed force. Today, George Orwell, André Malraux and Davy Crockett would probably be considered as "foreign terrorist fighters". In addition, the application of such status to identify actors of armed conflicts is in opposition with some rules of international law. Finally, to determine the correct legal status of "foreign fighters", to identify them and thus regulate their activities, including their terrorist acts, it is to the rules of international humanitarian law that we must turn. La thèse porte sur la conception qu’ont les Nations Unies de ce qu’est l’« état de droit » dans les situations de conflit et sortie de conflit. Le concept spécifiquement onusien d’état de droit découle du triple rôle normatif, conceptuel et opérationnel de l’ONU. La recherche repose sur une étude comparative de six cas (Sierra Leone, Afghanistan, Côte d’Ivoire, Haïti, Mali et République centrafricaine), complétée par une exploration exhaustive de la pratique onusienne de paix depuis 2000. Cette recherche permet d’établir que les Nations Unies conçoivent l’état de droit comme un système de justice pénale ou « chaîne pénale » composée du triptyque institutionnel « police-justice-prisons ». Ces institutions remplissent fondamentalement une fonction répressive dont le but est le maintien de l’ordre dans les Etats concernés, et, de façon plus secondaire, une fonction de protection des droits humains. Le contenu spécifique de l’état de droit ainsi identifié s’explique par les caractéristiques du concept onusien d’état de droit et l’usage qui en est fait. Les Nations Unies conçoivent en effet l’état de droit comme un outil au service de la réalisation de buts extérieurs, et non comme une fin en soi. En conséquence, ces buts influent, de façon substantielle, sur le contenu même de la notion. Il faut alors s’intéresser à ces buts qui sont, en premier lieu, l’objectif d’instaurer la paix au plan interne, en second lieu, le but de maintien de la paix et de la sécurité internationales, et enfin, les fins davantage sociologiques de l’ordre international., The thesis addresses the United Nations’ conception of the « rule of law » in conflict and post-conflict contexts. The concept of the rule of law proper to the UN stems from the Organisation’s normative, conceptual and operational role and activities. The research consists in a comparative study of six cases (Sierra Leone, Afghanistan, Côte d’Ivoire, Haiti, Mali and the Central African Republic), as well as an exhaustive review of the UN peace practice since 2000. From this review it appears that the UN understands the rule of law as equivalent to a criminal justice chain including the police, justice and prisons. These institutions intrinsically assume a repressive function, and, more marginally, a function of human rights protection. This specific understanding of the rule of law results from the characteristics and usage of the concept. Indeed, the UN see the rule of law as a means for the realisation of external ends rather than as a end in itself. As a consequence, these ends determine in a substantial way the very content of the concept. Many behaviors require choosing between conflicting options competing against each other in visuomotor areas. Such choices can benefit from top-down control processes engaging frontal areas in advance of conflict when it is anticipated. Yet, very little is known about how this proactive control system shapes the visuomotor competition. Here, we used electroencephalography in human subjects (male and female) to identify the visual and motor correlates of conflict expectation in a version of the Eriksen Flanker task that required left or right responses according to the direction of a central target arrow surrounded by congruent or incongruent (conflicting) flankers. Visual conflict was either highly expected (it occurred in 80% of trials; mostly incongruent blocks) or very unlikely (20% of trials; mostly congruent blocks). We evaluated selective attention in the visual cortex by recording target- and flanker-related steady-state visual-evoked potentials (SSVEPs) and probed action selection by measuring response-locked potentials (RLPs) in the motor cortex. Conflict expectation enhanced accuracy in incongruent trials, but this improvement occurred at the cost of speed in congruent trials. Intriguingly, this behavioral adjustment occurred while visuomotor activity was less finely tuned: target-related SSVEPs were smaller while flanker-related SSVEPs were higher in mostly incongruent blocks than in mostly congruent blocks, and incongruent trials were associated with larger RLPs in the ipsilateral (nonselected) motor cortex. Hence, our data suggest that conflict expectation recruits control processes that augment the tolerance for inappropriate visuomotor activations (rather than processes that downregulate their amplitude), allowing for overflow activity to occur without having it turn into the selection of an incorrect response. Les mandats incluant la protection de populations civiles font-ils naître des obligations dont la violation serait susceptible de générer une responsabilité internationale ?Les OMP dotées de ce type de mandat dit « robuste » doivent-elles respecter les règles du jus ad bellum et du jus in bello durant l’exécution de leur mandat ?À quelle entité internationale, Nations Unies et/ou États fournisseurs, faut-il attribuer la responsabilité en cas de violation du mandat (défaut d'accomplissement du mandat et/ou de dépassement de celui-ci) ou des obligations internationales de la part des OMP dotées de mandat « robuste » étant donné qu’elles sont formées de contingents militaires dépendant, au plan fonctionnel, des Nations Unies et, au plan hiérarchique, des pays d’appartenance ?Dans la présente thèse, après avoir analysé le fondement juridique, les caractéristiques et la structure de commandement des opérations de maintien de la paix ainsi que l’évolution historique du mandat quant à la protection de la population civile, nous avons tenté de répondre à ces questions en démontrant que, même si la protection des civils en danger est une marque distinctive des OMP dotées d’un mandat robuste et, donc, une des conditions légitimant l’emploi de la force, l’usage de la force doit être considérée comme une option laissée au pouvoir discrétionnaire des opérations de maintien de la paix qui, normalement, préfèrent adopter des mesures de prévention et d’atténuation pour protéger la population civile.En cas d’intervention, les OMP doivent respecter les principes de nécessité et proportionnalité de la légitime défense (jus ad bellum) auxquels s’ajoutent les obligations découlant des normes pour la protection des droits de l’homme et des principes du droit international humanitaire lorsque les Forces des Nations Unies « participent activement à des combats » (jus in bello).
