Alışveriş merkezlerinde faaliyet göstermek isteyen işletmeler, alışveriş merkezleri ile kira sözleşmesi akdeder. Alışveriş merkezi ile perakende işletmeler arasındaki kira sözleşmeleri diğer kira sözleşmeleri gibi kurulur. Fakat, alışveriş merkezleri büyük yatırım ile kurulan kendilerine has özellikleri olan işletmelerdir. Dolayısıyla, burada kurulacak kira sözleşmelerinin, bu sözleşmeler her ne kadar Türk Borçlar Kanunu hükümlerine tabi olsa bile, kendine has özellikleri vardır. Alışveriş merkezleri ile kurulan kira sözleşmelerinin hukuki niteliğinin tespiti bu sözleşmelere uygulanacak hükümlerin belirlenmesi açısından önemlidir. Alışveriş merkezleri ile kurulan kira sözleşmelerinde, kira bedeli açısından da bazı farklılık söz konusudur. Buna göre, kira bedelinin konut ve çatılı işyeri kiralarından farklı yönlerinin de belirlenmesi gerekir. Son olarak makalemizde, alışveriş merkezlerinde ortak giderlerin neler olduğu belirlenecek, alışveriş merkezi ile perakende işletme arasında kurulan kira sözleşmesine uygulanacak hükümler incelenecektir

Purpose To assess measurement equivalence, inter- and intra-rater reliability, standard error of measurements (SEM) and false positive measurements (FPM) of four different knee arthrometers (KLT,Karl Storz; KiRA, I + ; KT-1000 MEDmetric Corp; Rolimeter, Aircast) in healthy patients. Methods Four different investigators (two advanced (AR) and two beginners (BR)) examined 12 participants with healthy knees at two time points with regards to anterior tibial translation (ATT) and side-to-side difference (SSD). Test equivalence was assessed using the TOST (two-one-sided t test) procedure with ± 1 mm equivalence boundaries. Intraclass correlation coefficients (ICCs) were calculated using two-way mixed effects models. Furthermore, false positive-(SSD > 3 mm) and SEMs were assessed. Results A total of 2304 Lachman Tests were performed. Between-rater SSDs were equivalent between AR and BR raters for the Rolimeter only. Inter-rater ICC values (SSD, ATT) were graded as “poor” to “moderate” for all devices. Equivalent test–retest results were observed for all raters using the Rolimeter, KLT and KT-1000, whereas measurement consistency with KiRA was given in the advanced examiners group only. Intra-rater ICC values (Range: SSD, ATT) were graded as “poor” to “moderate” for SSD values and “moderate” to “good” for ATT. SEMs were lowest for the Rolimeter and highest for KiRA. FPM were never obtained with the Rolimeter (0%), twice (2.1%) with the KT-1000, three times (3.1%) with the KLT and 33 times (34.4%) using KiRA. Conclusion There is acceptable intra-rater but poor inter-rater reliability with all tested arthrometers. Measures of knee laxity are comparable between Rolimeter, KLT and KT-1000 but higher for KiRA. Clinically, the present study shows that repeated arthrometry measurements should always be performed by the same investigators.

İnsanlar, temel ihtiyaçlarını karşılamaya yönelik olarak çeşitli akidlere dayalı ticari faaliyetleri sürdüre gelmişlerdir. Yeni ihtiyaçların getirdiği birçok alanda işleri kolaylaştıracak veya hızlandıracak yöntemlere başvurulmuştur. Özellikle sermaye ve fon toplama araçlarının çeşitlendiği günümüzde suistimale açık sorunlar da peşpeşe gelmeye başlamıştır. Gerek ülkemizde gerekse dünyada artık normal hale gelen ekonomik krizlerin temelinde vaadlere dayalı projelerin fon toplama maksadıyla ölçüsüz bir şekilde suistimali ve borcun satımına dayalı şişirilmiş finans çarklarının beslenmesi yatmaktadır. Ancak bu gibi vakıalar, hakiki ve selim bir niyetle yola çıkan, kalkınmayı ve paylaşmayı hedefleyen müteşebbislerin önünü kesmek için bir bahane olarak görülmemelidir. Artık ekonomik faaliyetlerin çok hızlı ve karmaşık hale gelmesi nedeniyle müteşebbislerin önüne çıkan sorunları ele almak ve çözümler üretmek gerekmektedir. Yeni geliştirilen kira getirisine dayalı kira ortaklığı sistemleri de bunlardan biridir.

Background: Various technologies have been developed to quantify the pivot shift, as it is regarded as a key indicator of anterolateral rotatory laxity of the knee. Purpose: To determine the usefulness of a commercially available triaxial accelerometer (Kinematic Rapid Assessment [KiRA]) in numerically quantifying the pivot shift in patients under anesthesia with an anterior cruciate ligament (ACL)–deficient knee. Study Design: Cohort study (diagnosis); Level of evidence, 3. Methods: Both knees of 50 patients (26 male [mean age, 30.4 years], 24 female [mean age, 26.6 years]) under anesthesia were assessed immediately before unilateral ACL reconstruction by an orthopaedic fellow and 1 of 3 experienced knee surgeons. The pivot-shift grade and 2 KiRA outputs (range of acceleration and slope of acceleration change) were compared. Results: The surgeon and fellow recorded the same pivot-shift grade for 45 of 50 patients (90%). Data from the 5 patients with no agreement and 1 patient with extreme outlying data were excluded from subsequent analysis. Using the KiRA range and slope data, the surgeon identified the injured knee in 74% and 76% of patients, respectively, while the fellow’s rate of injured knee identification was 74% and 80%, respectively. A correlation could be found only between pivot-shift grade and surgeon-derived range data ( ρ = 0.40; P < .01) but not slope data or any fellow-derived outputs. Using the surgeon-derived range data, there was a significant difference between a grade 3 pivot (>5 m/s2) and a grade 1 or 2 pivot (2) ( P = .01). Conclusion: Although a correlation between KiRA output data and pivot-shift grade was found when the device was used by an experienced surgeon, there was no correlation when used by a well-trained but less experienced orthopaedic fellow. Furthermore, the KiRA output data identified the ACL-deficient knee correctly in only 74% of patients. Although a threshold acceleration range value could be identified, above which the value was associated with a grade 3 pivot shift, this was dependent on the examiner, and distinction between other grades could not be made.

Inositol-requiring enzyme 1&alpha, (IRE1&alpha, ) is a transmembrane dual kinase/ribonuclease protein involved in propagation of the unfolded protein response (UPR). Inositol-requiring enzyme 1&alpha, is currently being explored as a potential drug target due to the growing evidence of its role in variety of disease conditions. Upon activation, IRE1 cleaves X-box binding protein 1 (XBP1) mRNA through its RNase domain. Small molecules targeting the kinase site are known to either increase or decrease RNase activity, but the allosteric relationship between the kinase and RNase domains of IRE1&alpha, is poorly understood. Subsets of IRE1 kinase inhibitors (known as &ldquo, KIRA&rdquo, compounds) bind to the ATP-binding site and allosterically impede the RNase activity. The KIRA compounds are able to regulate the RNase activity by stabilizing the monomeric form of IRE1&alpha, In the present work, computational analysis, protein&ndash, protein and protein&ndash, ligand docking studies, and molecular dynamics simulations were applied to different IRE1 dimer systems to provide structural insights into the perturbation of IRE1 dimers by small molecules kinase inhibitors that regulate the RNase activity. By analyzing structural deviations, energetic components, and the number of hydrogen bonds in the interface region, we propose that the KIRA inhibitors act at an early stage of IRE1 activation by interfering with IRE1 face-to-face dimer formation thus disabling the activation of the RNase domain. This work sheds light on the mechanism of action of KIRA compounds and may assist in development of further compounds in, for example, cancer therapeutics. The work also provides information on the sequence of events and protein&ndash, protein interactions initiating the unfolded protein response.

Purpose: To assess the relationship between the KiRA triaxial accelerometer and the KT-1000 measurements in the intact, anterior cruciate ligament (ACL) deficient, and ACL reconstructed knee joint for the quantification of the Lachman test. Moreover, the intra- and inter-examiner repeatability of the KiRA device will be determined. It was hypothesized that the side-to-side difference of the anterior tibial translation as measured by the KiRA device would be equivalent to the one measured by the KT-1000 during the Lachman test. Methods: Sixty patients were divided into three groups and have been prospectively included in the present study. Group_A composed of 20 patients with a diagnosis of an isolated ACL tear. Group_B composed of 20 patients who underwent ACL reconstruction with a Single-Bundle Lateral Plasty (SBLP) technique with at least 20years of follow-up. Group_C was the control group and included 20 patients with no history of ACL lesion. Lachman test has been performed at manual-maximum load on both sides, the involved and the contralateral and analyzed with the two different devices. Results: The KiRA device in terms of side-to-side difference resulted not statistically different from the measurement of the KT-1000 arthrometer for the three study groups (n.s): Group_A: (4 ± 2mm KiRA, 4 ± 2mm KT1000), Group_B: (4 ± 2mm KiRA, 4 ± 2mm KT-1000), Group_C: (4 ± 2mm KiRA, 4 ± 2mm KT-1000), an excellent intra- (ICC = 0.88–0.89) and inter-examiner (ICC = 0.79) agreement was found for KiRA measurements. Conclusion: The KiRA (I+, Italy) device offers a valid method to quantify the Lacham test. Level of evidence: II.

Sürekli edimli bir sözleşme niteliği taşıyan kira sözleşmesinde kanun koyucu tarafından kiracılara asli borçların yanında kanundan doğan bazı yan borçlar da yüklenmiştir. Bunlardan biri de Türk Borçlar Kanunu madde 316 kapsamında düzenlenen kiralananı sözleşmeye uygun özenle kullanma ve kiralananın bulunduğu taşınmazda oturan kişiler ile komşulara saygı gösterme borcudur. Bu borca aykırılık nedeniyle kira sözleşmesinin feshinin sonuçlarının daha iyi anlaşılabilmesi için ilk bölümde sürekli edimli sözleşmelerin haklı nedenle feshi konusu incelenmiştir. Bu bölümde kısaca olağan fesih, olağanüstü fesih, süreli ve süresiz fesih kavramlarından ve kira sözleşmesinin genel hükümlere göre sona erme sebeplerinden bahsedilmiştir. Rental Agreements are one of the most common types of contracts encountered in practice. In the lease contracts, that possess the characteristics of Collateral Consistent Contracts, the legislators have imposed some obligations on the tenants. One of them is the obligation to use the premise in accordance with the contract, in a careful manner, with respecting the neighbours and the residents of the premise, which is regulated under article 316 of the Turkish Code of Obligations. In order to fully understand the consequences of the rental agreement termination due to the violation of this obligation, in the first chapter, the case of termination with a valid reason of Collateral Consistent Contracts has been examined in detail. The concepts of “ordinary-extraordinary termination” and “definite-indefinite termination” have been explained, and the reasons for the termination according to the general provision have been briefly addressed under this section. Afterwards, non-compliance behaviours towards the obligations, who should be included in those who need to be respected in the premise, and the consequences of non-compliance behaviours have been examined in the following sections. Furthermore, the concept of “termination with a valid reason”, which is frequently confused in practice, regulated under article 331 of the Turkish Code of Obligations, and its differences from article 316 have been discussed under this section. In this context, the provisions of article 256 of the former Code of Obligations No. 818 and article 316 of the Turkish Code of Obligations No. 6098 have been compared; and the obligations related articles of the Property Ownership Law No. 634’s and the Turkish Civil Code No. 4721’s provisions have been discussed. During the observation of non-compliance behaviours towards these obligations, various Court of Appeal’s decisions have been examined. Although it can be gathered from the article 316 of the Turkish Code of Obligations, that the legislator aims to protect the neighbours and the residents of a premise, in fact, the main purpose of the legislator with this provision is to protect the landlord from situations in which the tenant may be accountable to those around him/her, due to his/her actions, and make it easier for the landlord to rent his/her property later. Çınar, Ömer (IHU Author) Kefilin sorumluluktan kurtulması bakımından süreli ve süreli olmayan kefaletin sonuçları çok farklıdır. Kira sözleşmelerinde kira süresinin tamamlanmasından sonra kiralananın kiracı tarafından kullanılmaya devam edilmesi nedeniyle kira sözleşmesinin belirsiz süreli sözleşmeye dönüşmesi ya da bir yıllık süre için uzaması hallerinde kefalet sözleşmesinin devam edip etmediği hususu kefaletin süreli olup olmaması ile yakından ilgilidir. Bu çalışmada Türk Borçlar Kanunu’nun süreli ve süreli olmayan kefalet sözleşmeleri hükümleri yanında kefalet sözleşmesinde süre öngörülmemesi halinde kira sözleşmesindeki sürenin kefalet sözleşmesine uygulanıp uygulanamayacağı ve kefilin sorumlu tutulabileceği kefalet süresi ayrıntılı şekilde incelenmiştir. The provisions on fixed-term and open-ended surety contracts are very different in terms of release of the surety. Lease contracts may extend for one year or indefinitely, if the lease is tacitly continued. In this case, the status of the surety contract for the benefit of tenant mostly depends on the duration of the contract. This study examines the grounds for implementation of the time limit on the lease contract for the liability of the surety in open-ended surety contracts in detail, in addition to the provisions of Turkish Code of Obligations on fixed-term and open-ended surety contracts.

Ülkemizde birçok kimse kendi mülkiyetinde ikamet etmekle birlikte birçok kimse de bir konutun, bir mülkün veya taşıt gibi herhangi bir şeyin belli bir bedel karşılığında, bir süre için sahibi tarafından başkasına verilmesi anlamına gelen kirada hayatlarını idame ettirmektedir. Kira sözleşmesine ilişkin hükümler hem 6098 sayılı Türk Borçlar Kanununda hem de Mülga 6570 saylı Gayrimenkul Kiraları Hakkında Kanunda mevcuttur. Mülga 6570 sayılı Kanunda gerek belediye sınırları içindeki çatılı taşınmazların kiralanması gerekse belediye sınırları dışındaki iskele, liman ve istasyonlarda var olan çatılı taşınmazların kiralanmasında özel hükümler düzenlenmiştir. Bu makalede, 6098 sayılı Türk Borçlar Kanunundaki konut gereksinimi sebebiyle tahliye konusu mülga 6570 sayılı Kanunun 7.maddesinde hüküm altına alınan konut ihtiyacı nedeniyle tahliye konusu da dikkate alınarak incelenecektir., Many people in our country reside in their own property but also many other live by paying “rent” which means handing over a residence, property or vehicle by its owner to another person for a period of time in return for a certain price. There are articles on rental contracts both in the Turkish Law of Obligations (no. 6098) and in the Repealed Law on Real Estate Rentals (no. 6570). In Law No. 6570, specific articles are present for the regulation of both the leasing of real estates with roofs within the boundaries of municipalities and the leasing of existing real estates with roofs on piers, seaports and stations outside the boundaries of municipalities. In this paper, the subject of "evacuation due to need of residence" in Turkish Law on Obligations no 6098 will be examined by taking into account the subject of "evacuation due to need of residence" regulated in the article 7 of abolished law no 6570 as well.

Tezimiz, giriş, üç bölüm ve sonuç kısmından oluşmaktadır.Giriş bölümünde icâre akdinin önemi, sınırlandırılması ve konunun sunumu yapıldı.Birinci bölümde konu ile ilgili kavramlar, icâre akdinin meşruiyetinin; kitap ve sünnete dayandığı, icâre akdinin hikmeti, icâre akdinin rükünleri; taraflar, icâp ve kabul, menfaat ve ücret kavramlarını açıklanarak icârenin kısımları, icâre akdinin sıhhat şartları, zimmetteki icârenin şartları anlatıldı.İkinci böülümde icâre akdinin feshini, Ehl-i Sünnet'in dört mezhebine göre değerlendirerek günümüz hukuk sisteminde konu hakkıda bilgi verdik.Üçüncü bölümde ise, Kuran-ı Kerim öğretimi için ücret almak, sütanne kiralamak, dokumacı, terzi, boyacı ve bunlar gibi sanatkârların ücretle tutulması, hava parası, leasing (finansal kiralama) kavramlarının tanımı, şartları ve İslam hukukunda geçerliliği hakkında kısaca bilgi verdik. Ayrıca işçinin tazminat ödemesi, icâre müddetinin açıklanması, menfaat mahallinin izahatı, kiralanan maldan faydalanma kaidesi konuları hakkında bilgi verdik. Kira bir malın kullanım hakkının bir bedel karşılığında karşı tarafa bırakılması olarak tanımlanabilir. Ülkemizde âdi kira sözleşmeleri Borçlar Kanunu ve 6570 saylı Gayrimenkul Kiraları Hakkında Kanun ile düzenlenmiştir. Kanun koyucu, konut ve işyeri niteliğindeki taşınmazların ihtiyacı karşılayamamasını göz önünde tutarak, 6570 sayılı Kanun ile, belediye sınırları içinde veya belediye sınırları dışında olmakla birlikte, iskele, liman ve istasyonlarda bulunan çatılı taşınmazların kiralanmasını özel olarak düzenlemiştir. 6570 sayılı Kanun, 7. maddesinde tahliye sebepleri sınırlayıcı biçimde sayılmıştır. Bu makalemizde, konut ihtiyacı nedeniyle tahliye davası incelenecektir (6570 sayılı Kanun m.7/b). Lease is defined that one party conveys the right of the exclusive use and enjoyment of a thing to another party in exchange for a price. In our Cou ntry, ordinary lease contracts have been regulated by the Code of Obligations and the Statute Concerning Real Property no: 6570. The legistor, considering that real estate which is residene and place of employment can’t servet he need enough, with the Statute no:6570, has particularly regulated renting roofed real estate within the district of municipality or whorves, horbours and stations that are located out of municipality borders. In the articles 7 and 12 of the Statute Concerning Real property no: 6570, reasons of termination of lease contract has been contuned and limited these ones. In this work, we, the Statute Concerning Real Property no:6570 in articles 7/ (b)housing needs to be looked at discharge than lease.

Glass-ceramics were produced by crystallization of glasses in the SiO2-Al2O3-B2O3-MgO-CaO-N2O-F system. The experimental results showed that bulk glasses are prone to surface crystallization. Hence, crystallization of bulk glasses resulted in non-homogeneous crystalline materials, which comprised relatively coarse crystals. Therefore, processing was realized using (glass-powder compacts. Maximum densification was reached at 700-750 degrees C. This interval is positioned at relatively lower temperatures than those often reported for similar sintered glass-ceramics. Doping with P2O5 improved sintering behaviour and broadened sintering temperature range. Akermanite-based glass-ceramics were successfully produced from the SiP2-Al2O3-B2O3-MgO-CaO-Na2O-F system via sintering and crystallization of glass-powder compacts at low temperatures between 750 and 800 degrees C. The experimental results indicated that the amount of Al2O3 in the parent glass composition is seemingly a key factor with regard to the potential of this system to crystallize into a mono-mineral akermanite glass-ceramic. The aesthetics and the mechanical, the chemical and the thermal properties of the produced glass-ceramics in conjunction with the evaluation of the economic processing route proposed qualify these glass-ceramics for further investigation as potential materials suitable for applications in restorative dentistry. Glass-ceramics based on the CaO-MgO-SiO2 system with limited amount of additives (B2O3, P2O5, Na2O and CaF2) were prepared. All the investigated compositions were melted at 1400 degrees C for 1 h and quenched in air or water to obtain transparent bulk or frit glass, respectively. Raman spectroscopy revealed that the main constituents of the glass network are the silicates Q(1) and Q(2) units. Scanning electron microscopy (SEM) analysis confirmed liquid-liquid phase separation and that the glasses are prone to surface crystallization. Glass-ceramics were produced via sintering and crystallization of glass-powder compacts made of milled glass-frit (mean particle size 11-15 mu m). Densification started at 620-625 degrees C and was almost complete at 700 degrees C. Crystallization occurred at temperatures > 700 degrees C. Highly dense and crystalline materials, predominantly composed of diopisde and wollastonite together with small amounts of akermanite and residual glassy phase, were obtained after heat treatment at 750 degrees C and 800 degrees C. The glass-ceramics prepared at 800 degrees C exhibited bending strength of 116-141 MPa, Vickers microhardness of 4.53-4.65 GPa and thermal expansion coefficient (100-500 degrees C) of 9.4-10.8 x 10(-6) K-1. Konut, toplumun en küçük yapı taşı olan ailenin bir arada olmasını sağlayan ortak mekan, ekonomik olarak üretilen ve tüketilen bir mal, kişilere gelecek için güvence sağlayan bir yatırım aracı, yerleşme dokusunun, kimliğinin oluşmasında yapılaşmış çevrenin en önemli yapı taşı olma özelliklerine sahiptir. Konut piyasasında aynı yapısal özelliklere sahip konutların kira değerlerinin farklı olduğu gözlenmektedir. Bu kapsamda çalışmanın amacı konut kira değerinin belirlenmesinde konutun yapısal özelliklerinin yanında, içinde yer aldığı çevrenin özelliklerinin de etkili olduğunu ortaya koymaktır. Araştırma kapsamında yapılan anket çalışmasında konut kira değerlerini en çok etkileyen faktörün konutun yer aldığı çevrenin doğal özellikleri olduğu görülmüştür., The subject of this study is to research the factors affecting the housing rent values/prices. Housing is the common accommodation of the smallest social unit; family, an economical property which is produced and consumed, the most important factor of constructed environment for the identity of the settlement. It is observed that housing with same structural properties have different rent price. In this extent the aim of the study is to prove that besides the structural properties the environmental factors also affect the renting price. ÖZET Bu çalışmamızda, 6570 sayılı Gayrimenkul Kiralan Hakkındaki Kanun'a tabi kira özleşmelerinin sona ermesi halleri, diğer bir deyişle anılan yasada düzenlenen tahliye sebepleri konu edilmiştir. Çalışma 3 bölümden oluşmaktadır. Birinci bölümde, kısaca kira sözleşmesinin tanımı, unsurları, hukuki niteliği ile Gayrirnenkul Kjralan -Hakkındaki Kanun' un tarihçesi, kabul ediliş gayesi ve uygulama alanı açıklanmıştır. İkinci ve üçüncü bölümde yasada düzenlenen tahliye sebeplerine yer verilmiştir. İkinci bölümde kiralayandan kaynaklanan tahliye sebepleri, üçüncü bölümde ise kiracıdan kaynaklanan tahliye sebepleri birer birer ve ayrıntılı bir şekilde incelenmiştir. II ABSTRACT In this study, expiry conditions of rental contracts subjected to the law 6570 about real estase renting, or in other words, eviction reasons regulated in the mentioned act have been examined. The study consists of three parts; In the first part, a definition of rental contract, its elements, its juridical features, and a history of the law about real estate renting, the reason for its acceptance and its effectuation field have been briefly interpreted. In the second and third parts, the reasons for eviction regulated in the act have been included.
