Los mecanismos alternos de resolución de conflictos (ADR por sus siglas en inglés) se han erigido en la contemporaneidad como una de las herramientas más relevantes para dirimir pleitos. En el Ecuador, aunque existen indicios de la utilización de varios de estos métodos en su historia, legalmente sólo han pasado varias décadas desde su regulación. En la actualidad, la utilización de la mediación no adquiere la importancia deseada, a pesar de sus innegables beneficios continúa siendo una tarea pendiente. Analizar la pertinencia de regular la mediación prejudicial obligatoria, de forma tal que previo a la presentación de procesos contenciosos en el ámbito judicial, las partes hayan asistido a mediación, constituye el principal objetivo del estudio. Para ello, se ha utilizado una metodología mixta, apoyándose en un enfoque cualitativo y cuantitativo, que utilizando un método analítico, inductivo y deductivo, y técnicas como el fichaje bibliográfico y la entrevista expertos, han permitido demostrar los beneficios de considerar en el futuro cercano en el Ecuador, la regulación de la mediación prejudicial obligatoria, pues se ha podido concluir que ello tributaría a una reducción sustancial del congestionamiento procesal que sufren en la actualidad los juzgados y a una solución más armoniosa de los pleitos.

RESUMEN:Analizar el papel de la norma jurí­dica en la configuración de los derechos fundamentales, constituye el principal reto del artí­culo que se presenta, conscientes de que, no es tarea fácil, sin embargo, constituye en la contemporaneidad, en la que los derechos fundamentales son constante y habitualmente amenazados, una necesidad que se logra establecer con los postulados esenciales que se determinan en el estudio. Es así­ que, Ley y derechos fundamentales se reúnen en un documento que ofrece claridad doctrinal y legal sobre el ví­nculo que, ineludiblemente existe. Una amplia revisión doctrinaria sustenta las posiciones que son asumidas en el trabajo, el que, se espera aporte humildemente a la comprensión y reflexión actual, sobre la relevancia que la norma jurí­dica posee para, la garantí­a o el menosprecio de lo que ha sido en llamarse, derechos fundamentales.
