The article depicts manifestations of the law in the educational work of renowned Polish-Jewish educator Janusz Korczak, and re-evaluates Korczak's work in terms of children's legal education. It does so in relation to the theoretical insights of Polish-Russian legal sociologist Leon Petrazycki -- and particularly the notion of "Intuitive Law", a term that describes the nature of the law as separate from formal state laws and as based on psychological and emotional experiences, when it comes to expressions of progressive justice. To illustrate Korczak's legal work and to fully understand its intuitive nature, the article closely follows the legal "institutions" in Korczak's main, Jewish, orphanage, which usually involved the children themselves. Among other things, it offers descriptions of the children's parliament as it was enacted at the orphanage, the orphans' court, their self-published newspaper -- which promoted progressive democratic views, etc. The article also analyses a sampling of Korczak's literary works in relation to the field of law. The various testimonies indicate that Korczak viewed the legal practice as a means of education and as a potentially educational aim in itself, and the legal field as a platform for fairness in day-to-day life as part of living law, similarly to Petrazycki's views.

This two-part study explored whether discrimination encoded into U.S. school absenteeism policies leads to racially minoritized students being overrepresented in the juvenile court system. First, we examined unexcused absenteeism policies in a nationally representative school district sample (n = 97). All districts excused absences for reasons White students often miss school but not necessarily for reasons racially minoritized students do. Next, in three school districts we documented large racial disparities in both the proportion of absences designated unexcused (Whites 13%, Asians 18%, Hispanics 21%, Blacks 24%, and American Indians 24%) and risk of court petition for truancy, even after accounting for the total number of absences: Whites hazard ratio (HR) = 1.0; Asians HR = 1.15, 95% confidence interval (CI) [0.98, 1.36]; Hispanics HR = 1.60, 95% CI [1.34, 1.92]; Blacks HR = 2.17, 95% CI [1.88, 2.50]; and American Indians HR = 3.94, 95% CI [3.12, 4.97]. Disproportionality in unexcused absenteeism fully explained the Hispanic/White and partially explained the Black/White and American Indian/White court petition disparities.

Andrew Monroe [pseud.] (b. 1894) was a Colorado street kid whose acts of truancy and theft landed him before the state's early juvenile courts, and his youth was marked by attempts at escape from reform school. His childhood and youth provide insights into the mechanics of how systems of juvenile corrections operated in the early twentieth century. To enforce new truancy laws, Progressive Era child-savers relied on report cards for the surveillance of probationers, categorizing children like Andrew as "stubborn," "unyielding," and "disobedient." Ultimately, Andrew's refusal to comply with these new forms of institutional control serves as a case study for the challenges that children faced in escaping an apparatus that reduced them to the label of "delinquent."

The current case demonstrates the complexities of utilizing Youth Court as a restorative practice in an urban high school, by focusing on the complexities it presents for one student in particular. In this case, there are reasons why Youth Court clearly is not working at this particular school site as intended. However, more importantly for leadership preparation, the case surfaces dilemmas of cultural difference, teacher preparation, leadership preparation, and school policy that leaders must address prior to restorative implementation in order to ensure sustainable restorative practice moving forward.

The primary aim of this study was to examine gender and racial differences in the association between system involvement types (i.e., child protective services [CPS] only, juvenile justice system only, and dual involvement) and academic outcomes (i.e., grade failure, chronic absenteeism). This study used records from a linked database of public youth-serving institutional records within a county's youth court, law enforcement agencies, and CPS. Multivariate logistic regression analyses were performed. The impact of systems involvement on academic outcomes was most salient among Black males, while none of the system involvement types were associated with chronic absenteeism or grade failure among White males. Findings highlight the need for the development of intervention strategies to address educational needs of youth involved in the CPS and juvenile justice systems, with a heightened attention to Black and male youth, to improve their attendance and academic performance.

The recognition of social work as a writing-intensive profession is the first step needed to bridge the divide between academic and practice writing. The demonstration of persuasive writing skills rarely achieves a highly-ranked social work curriculum priority despite the recognition by faculty that these skills are essential for effective practice. This paper features curriculum examples that incorporate persuasive writing skills, the use of related rubrics, a proposed framework for bridging the gap between academic and practice writing, and a comprehensive illustration of persuasive writing in the form of a child welfare court report. It concludes with recommendations for enhancing student writing skills.

Youth with disabilities are overrepresented in the juvenile justice system, but few studies have investigated the mechanisms by which this occurs. In this study, we considered how juvenile court adjudication and length of commitment in secure facilities contributed to disproportionality in court involvement and detention, addressing an important gap in the intersection of disability and juvenile justice literature. Using linked educational and juvenile justice records of 41,812 youth, we sought to ascertain whether, among juvenile offenders, youth with disabilities had higher likelihood of adjudication as delinquent or placement in secure facilities for longer periods of time compared to youth without disabilities. Results indicated that youth with and without disabilities were adjudicated and placed similarly, suggesting that disparities contributing to overrepresentation of youth with disabilities in detained populations may manifest earlier in youths' involvement in the justice system. We conclude with implications for research, policy, and practice.

The Baby Leadership Learning Collaborative (Baby LLC) initiative is a leadership group committed to bridging relationships across service sectors to promote infant-early childhood mental health and to break the multigenerational cycle of risk often associated with early adversity and trauma. Baby LLC has guided an early relational health focus within Rhode Island's Safe and Secure Baby Court (SSBC) and leverages the power of creative partnerships for the benefit of the baby. The authors describe efforts to enhance collaboration among the family court, child welfare, a local birthing hospital, family home visiting programs, and university-based clinical research programs to expedite, improve, and individualize services for vulnerable families so they are better able to maintain healthy relationships with their babies.

Young women living in urban contexts, particularly those with involvement in the foster care and juvenile justice systems, experience significant barriers to academic well-being as a result of childhood trauma. To date, little research has been done to evaluate evidence-based, trauma-informed educational interventions to improve outcomes among these students. This study used survey data from a multi-year trauma-informed teaching intervention to quantitatively measure the well-being of trauma-exposed girls in an urban, trauma-informed school setting. The study explored whether girls at a trauma-informed school demonstrated significant changes in trauma symptomatology and whether these changes varied by race/ethnicity. As hypothesized, participants experienced a statistically significant decrease in trauma symptoms over the observation period. However, there were no significant differences in trauma symptom change based on race/ethnicity. Policy and practice implications are discussed.

Tom Ward and Tony Majors, community and district lead partners in Nashville, Tennessee, talk about what the Positive and Safe Schools Advancing Greater Equity (PASSAGE) initiative has meant in their city. They share how and why their journey began by embedding the work to end discipline disparities across a broad, cross-sector table that includes a judge, a police commander, parents, principals, organizers, researchers, and civic and faith-based leaders. This article contains a section of individually authored perspectives: (1) Restoring Hope: The Juvenile Court as a Partner in Reform (Sheila Calloway); (2) Acknowledging the Gap (Tracy Bruno); and (3) Separating School Discipline from Crime in Partnering with Law Enforcement (J. Marlene Pardue).

Multiple, intersecting factors contribute to the over-representation of youth of color, including Black girls, in the juvenile justice system, and specifically, in confinement. This study examined the self-identified, educational experiences of Northern California Black girls in confinement. This phenomenological study found that Black girls in trouble with the law experience a history of exclusionary discipline and poor relationships with schools that are exacerbated by the absence of a learning environment in confinement that emphasizes their ability to build positive relationships with teachers and each other. The study also found that the use of exclusionary discipline was heightened in the juvenile court school, largely for infractions unrelated to girls posing a threat to physical safety. This investigation also uncovered policy and infrastructure development opportunities that may facilitate a repair the relationship between Black girls and school.

Because misbehavior in schools is often instigated by a confluence of organizational features, the purpose of this research was to understand what Youth Court reveals about the causes of in-school conflicts and to what extent its processes help to address them. This multi-site qualitative case study collected data in the form of observations, documents, semi-structured and focus group interviews in order to explore Youth Court processes and outcomes. Double-loop learning was used to describe the extent and quality of dialogue and interventions. The research questions were: Does Youth Court facilitate double-loop learning? What contributing variables influencing student misbehavior does this discourse reveal? What is the impact of this discourse on school policies and practices? Youth Court surfaces vital information about students, teachers, classrooms, and school-wide policy necessary to inform the development or adaptation of discipline policies and practices; in some cases, that information became a catalyst for changes in classroom and school-wide policies and practices. Youth Court helped to address individual instances of misbehavior with interventions that were restorative rather than punitive. And yet, the greater benefits of Youth Court, namely improvements to a school's culture and climate, were not necessarily fully realized because Youth Court activity and other school processes and structures are not formally linked. Further research using linkage theory would help to unpack why successes in Youth Court did and did not spread to other areas of school.

The overrepresentation of youth with disabilities in the juvenile justice system is a persistent concern, but estimates of their involvement vary dramatically due to differences in how disability is conceptualized and when involvement in juvenile justice is measured. This study linked juvenile court and educational records for 230,760 students in one state to describe the involvement of students with and without disabilities in juvenile court. Overrepresentation of students with disabilities was not robust to sociodemographic controls (relative risk ratio [RR] = 1.07) but varied by disability category such that students with emotional or behavioral disorders (RR = 1.98) and other health impairments (RR = 1.12) remained overrepresented. Students with disabilities were charged with more severe offenses than their peers without disabilities and were more likely to be petitioned to court with a higher degree of offense even after controlling for the type of offense. Implications for policy, practice, and research are discussed.

Schools' ability to manage student misbehavior rests largely on students' perceptions of the discipline system and authority. According to the procedural justice perspective, when schools use discipline practices students perceive as unfair, they fail to see authority as legitimate, making them less likely to comply with rules and demand. Youth Court, a peer adjudication program, has been implemented in schools as an alternative to punitive policies. While effective, there is no current research that examines if Youth Court creates procedural justice and legitimate authority. Using qualitative data from three urban schools, this study investigates the fairness of Youth Court procedures within a procedural justice framework, as well as perceptions of primary discipline practices and authority. Findings revealed that each school still largely uses punitive policies that create procedural unfairness and undermine legitimate authority. Additionally, findings indicate Youth Court utilizes practices that allow for procedural justice that foster legitimate authority.

The opioid epidemic has led to a dramatic increase in the number of infants and toddlers being removed from their homes and placed in foster care. Doing so places these vulnerable young children at high risk for attachment issues, postnatal medical problems, and development delay. Early Childhood Courts have been found to be a very effective intervention in coordinating two-generation services and utilizing an infant mental health approach toward addressing the child, parent, and relationship needs using Child-Parent Psychotherapy. Florida has a statewide approach with 22 judges currently implementing Early Childhood Court which are showing more timely permanency, minimizing return to foster care, and improving child well-being as has been demonstrated in previous evaluations of the Safe Babies Court Teams. Structures and procedures imbedded in Early Childhood Court protocols can ensure CAPTA [Child Abuse Prevention and Treatment Act] compliance with tracking and follow up.

Laurie Chassin focuses on the elevated prevalence of substance use disorders among young offenders in the juvenile justice system and on efforts by the justice system to provide treatment for these disorders. She emphasizes the importance of diagnosing and treating these disorders, which are linked both with continued offending and with a broad range of negative effects, such as smoking, risky sexual behavior, violence, and poor educational, occupational, and psychological outcomes. The high rates of substance use problems among young offenders, says Chassin, suggest a large need for treatment. Although young offenders are usually screened for substance use disorders, Chassin notes the need to improve screening methods and to ensure that screening takes place early enough to allow youths to be diverted out of the justice system into community-based programs when appropriate. Cautioning that no single treatment approach has been proven most effective, Chassin describes current standards of "best practices" in treating substance use disorders, examines the extent to which they are implemented in the juvenile justice system, and describes some promising models of care. She highlights several treatment challenges, including the need for better methods of engaging adolescents and their families in treatment and the need to better address environmental risk factors, such as family substance use and deviant peer networks, and co-occurring conditions, such as learning disabilities and other mental health disorders. Chassin advocates policies that encourage wider use of empirically validated therapies and of documented best practices for treating substance use disorders. High relapse rates among youths successfully treated for substance use disorders also point to a greater need for aftercare services and for managing these disorders as chronic illnesses characterized by relapse and remission. A shortage of aftercare services and a lack of service coordination in the juvenile justice system, says Chassin, suggest the need to develop treatment models that integrate and coordinate multiple services for adolescent offenders, particularly community-based approaches, both during and after their justice system involvement. In this paper, the author points out that youth with mental disorders make up a significant subgroup of youth who appear in U.S. juvenile courts. And he notes that juvenile justice systems today are struggling to determine how best to respond to those youths' needs, both to safeguard their own welfare and to reduce re-offending and its consequences for the community. He examines research and clinical evidence that may help in shaping a public policy that addresses that question. (Contains 61 endnotes.)

Rising juvenile crime rates during the 1970s and 1980s spurred state legislatures across the country to exclude or transfer a significant share of offenders under the age of eighteen to the jurisdiction of the criminal court, essentially redrawing the boundary between the juvenile and adult justice systems. Jeffrey Fagan examines the legal architecture of the new boundary-drawing regime and how effective it has been in reducing crime. The juvenile court, Fagan emphasizes, has always had the power to transfer juveniles to the criminal court. Transfer decisions were made individually by judges who weighed the competing interests of public safety and the possibility of rehabilitating young offenders. This authority has now been usurped by legislators and prosecutors. The recent changes in state law have moved large numbers of juveniles into the adult system. As many as 25 percent of all juvenile offenders younger than eighteen, says Fagan, are now prosecuted in adult court. Many live in states where the age boundary between juvenile and criminal court has been lowered to sixteen or seventeen. The key policy question is: do these new transfer laws reduce crime? In examining the research evidence, Fagan finds that rates of juvenile offending are not lower in states where it is relatively more common to try adolescents as adults. Likewise, juveniles who have been tried as adults are no less likely to re-offend than their counterparts who have been tried as juveniles. Treating juveniles as adult criminals, Fagan concludes, is not effective as a means of crime control. Fagan argues that the proliferation of transfer regimes over the past several decades calls into question the very rationale for a juvenile court. Transferring adolescent offenders to the criminal court exposes them to harsh and sometimes toxic forms of punishment that have the perverse effect of increasing criminal activity. The accumulating evidence on transfer, the recent decrease in serious juvenile crime, and new gains in the science of adolescent development, concludes Fagan, may be persuading legislators, policymakers, and practitioners that eighteen may yet again be the appropriate age for juvenile court jurisdiction. Elizabeth Scott and Laurence Steinberg explore the dramatic changes in the law's conception of young offenders between the end of the nineteenth century and the beginning of the twenty-first. At the dawn of the juvenile court era, they note, most youths were tried and punished as if they were adults. Early juvenile court reformers argued strongly against such a view, believing that the justice system should offer young offenders treatment that would cure them of their antisocial ways. That rehabilitative model of juvenile justice held sway until a sharp upswing in youth violence at the end of the twentieth century led both public opinion and public policy toward a view that youths should be held to the same standard of criminal accountability as adults. Lawmakers seemed to lose sight of developmental differences between adolescents and adults. But Scott and Steinberg note that lawmakers and the public appear now to be rethinking their views once more. A justice system that operates on the principle of "adult time for adult crime" now seems to many to take too little note of age and immaturity in calculating criminal punishment. In 2005 the United States Supreme Court abolished the juvenile death penalty as cruel and unusual punishment, emphasizing that the immaturity of adolescents made them less culpable than adult criminals. In addition, state legislatures recently have repealed or moderated some of the punitive laws they recently enacted. Meanwhile, observe the authors, public anger has abated and attitudes toward young offenders have softened somewhat. In response to these changes, Scott and Steinberg argue that it is appropriate to reexamine juvenile justice policy and to devise a new model for the twenty-first century. In this article, they propose what they call a developmental model. They observe that substantial new scientific evidence about adolescence and criminal activity by adolescents provides the building blocks for a new legal regime superior to today's policy. They put adolescent offenders into an intermediate legal category--neither children, as they were seen in the early juvenile court era, nor adults, as they often are seen today. They observe that such an approach is not only more compatible than the current regime with basic principles of fairness at the heart of the criminal law, but also more likely to promote social welfare by reducing the social cost of juvenile crime. The dual requirement to ensure community safety and promote a youthful offender's positive development permeates policy and frames daily practice in juvenile justice. Balancing those two demands, explain Edward Mulvey and Anne-Marie Iselin, requires justice system professionals at all levels to make extremely difficult decisions about the likely risk and amenability to treatment of adolescent offenders. Mulvey and Iselin point out that although various forms of "structured" decision-making instruments are used widely in other fields, juvenile justice professionals today make limited use of these tools. Instead, they make decisions based mainly on their intuition about whether the adolescent before them is more likely to harm the community or to use justice system services to turn his life around. The reluctance of busy court professionals to use these structured decision-making tools, they say, arises partly from their heavy work load. But it also grows out of the ethos of the juvenile court itself. Restricting an adolescent's freedom or access to interventions based on a tallying of empirical data is antithetical to viewing each adolescent as a unique individual whose life chances may remain intact with developmentally appropriate intervention. Mulvey and Iselin recommend and examine three ways to integrate structured judgment approaches into the juvenile justice system that both capitalize on their strengths and support the court's attempts to provide fair, individualized justice. First, more reliance on actuarial methods at detention and intake would promote more efficient and equitable screening of cases for subsequent court involvement. Second, the use of structured decision making by probation officers could provide more consistent and valid guidance for the court when formulating dispositions. Finally, implementing structured data systems to chart the progress of adolescents in placement could allow judges to oversee service providers more effectively. The challenge for the juvenile system, say the authors, will be to harness the new capacities of the science of decision making and of computer technology to increase the efficiency of its limited resources for the benefit both of the community and of the adolescents in the system.
