The right to a favourable environment is a constitutionally guaranteed right. It is also linked to the duty of every entity to protect and improve the environment. The rights and obligations related to this are further regulated in the legislation of parliament. However, the municipality has also its irreplaceable place in ensuring environment protection, including in the form of issuance of generally binding regulations. The purpose of this paper is the assessment of the municipality’s competence in the field of environmental protection, taking into account its legislative competence. The aim is to examine the definition of the municipality’s power to issue generally binding regulations in the previous decision-making activity of the Constitutional Court of the Slovak Republic, the subsequent legislative changes and the current state of the scope of these powers of municipalities.

The paper deals with the legal requirements for the procedure of local self-government entities (municipalities, cities) and state administration bodies at the local level in case of detection of illegally placed waste. The article also outlines how the person responsible for illegal dumping is identified, what is done if such a person is not identified and how those who have placed waste in black dumps can be punished. The author also points out in this paper the application problems in the application of the legal procedure for dealing with illegally placed waste, the lack of definition of competences between the subjects of local self-government and state administration bodies, as well as proposes certain changes to the legal regulation, which would be possible to eliminate the alleged application problems. A characteristic feature of transnational administrative acts is that their effects extend beyond the borders of the issuing State, i.e., they have also effects in the territory of other States. It is one of the institutes that is also used within the European Union to harmonise the activities of the Member States at the application level, too. It represents the so-called horizontal form of harmonisation. The aim of this paper is to analyse possible ways of defence of the Member State concerned against the effects of a transnational administrative act issued by another Member State. In addition, the paper also includes a debate about the new concept of such defence in European Union legislation. In preparing this paper, the basic methods of scientific research were used, consisting in the analysis of the current legal regulation of transnational administrative acts in European Union law, the synthesis of common features and groups of possible means of defence, and subsequently the description of possible proposals de lege ferenda for better legislation. The author concludes that in the current legislation there are several different ways of defence of a Member State against the effects of transnational administrative acts and also formulates his proposals for the unification of possible procedural defence.
