Trotz schwieriger Rahmenbedingungen durch die hohe Inflation verlief das erste Halbjahr 2022 vergleichsweise harmonisch (Lesch, 2022a). Dieser Trend setzte auch im zweiten Halbjahr fort. Das Konfliktbarometer des Instituts der deutschen Wirtschaft (IW-Konfliktbarometer) ermittelt für das gesamte Jahr 2022 im Durchschnitt von 26 untersuchten Tarifkonflikten in 15 Branchen eine Konfliktintensität von 5,3 Punkten, eine maximale Eskalationsstufe von 1,9 und eine Verhandlungsdauer von 3,3 Monaten. Damit verliefen die Tarifverhandlungen deutlich harmonischer als im Jahr 2021. Damals lag die Konfliktintensität mit 11 Punkten je Tarifverhandlung mehr als doppelt so hoch. Die maximale Eskalationsstufe betrug 3,0. Im langjährigen Durchschnitt (2010 bis 2021) lagen die Vergleichswerte bei 8,7 Punkten für die Konfliktintensität, bei 2,4 für die maximale Eskalationsstufe und bei 4,5 Monaten für die Verhandlungsdauer. Die Konfliktintensität gibt an, in welchem Umfang verbale Eskalationsformen (wie Streikdrohungen) und materielle Konflikthandlungen (wie Warnstreiks, Aussperrungen und Streiks) in einem Tarifkonflikt genutzt wurden. Die maximale Eskalationsstufe beschreibt, bis zu welcher Eskalationsstufe sich ein Tarifkonflikt auf einer Skala von 0 bis 7 zuspitzt und die Verhandlungsdauer, über welchen Zeitraum hinweg verhandelt wurde. Allerdings verbergen sich hinter diesem Durchschnittswert große Branchenunterschiede. Während die Tarifparteien in einigen Branchen wie der Chemischen Industrie, der Papiererzeugenden Industrie und den Universitätskliniken (Ärzte), konfliktfrei zum Kompromiss kamen, eskalierten im Flugsektor zwei Konflikte mit der Pilotengewerkschaft Vereinigung Cockpit bis hin zum Arbeitskampf. Am konfliktreichsten ging es beim Cockpit von Eurowings zu. Hier fielen insgesamt 30 Konfliktpunkte an, dicht gefolgt von den Banken mit 29 Punkten bei den öffentlichen und 28 Punkten bei den privaten Banken. Auf Platz vier folgt das Cockpit der Lufthansa mit 19 Punkten, Platz 5 teilen sich die Eisen- und Stahlindustrie sowie die Metall- und ElektroIndustrie mit jeweils 16 Punkten. Bislang hat sich die Tarifpolitik trotz der hohen Inflation überaus stabilitätskonform gezeigt. Die Tariflohndynamik zieht zwar aktuell leicht an, bleibt aber noch im stabilitätspolitischen Rahmen. Dadurch werden Konflikte mit der Europäischen Zentralbank vermieden, an deren Ende eine Stabilisierungsrezession stehen würde. Im Jahr 2023 stehen für fast 11 Millionen Beschäftigte neue Tarifverhandlungen an. Den Auftakt macht unter anderem der Öffentliche Dienst von Bund und Kommunen, wo die Gewerkschaften 10,5 Prozent mehr Geld fordern, mindestens aber monatlich 500 Euro, was effektiv auf 15 Prozent mehr Geld hinausläuft. Sollten sich die Gewerkschaften mit ihren hohen Forderungen, die weit über die Inflationsrate hinausgehen, durchsetzen, droht 2023 eine Lohn-Preis-Spirale. Es ist zu hoffen, dass die im Rahmen der sogenannten Konzertierten Aktion gegen den Preisdruck von der Bundesregierung angebotenen steuerfreien Einmalzahlungen von den Tarifparteien genutzt werden und die Akteure einer Lohn-Preis-Spirale konzertiert entgegenwirken.

This paper aims to research the motivation of human resources, with a case study at CONEREPET SA PLОIЕȘTI[1], a Romanian crude oil products transport company.In the first part of the work, we dealt with the theoretical aspect of environmental pollution with petroleum products: polluting factors and methods of depollution. Then we presented theoretical aspects of human resource management, so that we can approach a research study in the second part of the paper. Also, we analyzed the CONEREPЕT SA company, and, like the research study, we dealt with the motivation of human resources within the company. We chose this topic due to the experience in the field.We concluded that human resources are primary among those needs and resources available to the organization in carrying out the activity to achieve its objectives and, consequently, it is logical to pay special attention to their management. At the center of all business are the people. All other resources, land, buildings, machinery, equipment, vehicles, or money are only of secondary importance. Business cannot be done without people. Businesses have no other purpose than to serve people's needs.[1] We will not divulge the name of the company where we conducted the case study for security reasons of the data and information provided. Leseprobe ----- Zusammenfassung Seit den 1990er Jahren ist die Reichweite von Branchentarifvertragen in Deutschland rucklaufig. Im gleichen Zeitraum wachst die Zahl der Betriebe, die sich an einem Branchentarifvertrag orientieren. In der Diskussion uber die Erosion des deutschen Tarifsystems werden die formale Tarifbindung und die Orientierung an einem Tarifvertrag haufig als gleichwertig angesehen und die Anteile dieser Betriebe einfach addiert. Offen ist aber, was die Orientierung an einem Branchentarifvertrag fur die betrieblichen Arbeitsbedingungen bedeutet. Wie eine ganze Reihe von Studien belegt, beeinflusst die Existenz eines Betriebsrats das betriebliche Lohnniveau und zwar abhangig davon, ob der Betrieb tarifgebunden ist oder nicht. Wir erweitern den Blick auf Betriebe, die sich an einem Branchentarif orientieren. Fur unsere OLS-Lohnschatzungen (ordinary least squares) verwenden wir einen Datensatz, der Betriebs- und Individualinformationen auf Personenebene verknupft (LIAB). Die verschiedenen institutionellen Settings in ihrer Kombination mit dem Betriebsrat finden mit entsprechenden Interaktionstermen Berucksichtigung. Wie sich zeigt, bleibt das bereinigte Lohnniveau in Orientiererbetrieben deutlich hinter dem in branchentarifgebundenen zuruck. Die Orientierung an einem Branchentarif ist somit kein Ersatz fur eine formelle Bindung. Existiert in diesen Betrieben ein Betriebsrat, so sind auch dort signifikant hohere Lohne zu beobachten, wobei der Lohnzuschlag aber hinter dem bei Geltung eines Branchentarifvertrags zuruckbleibt. In the same period, the number of firms with orientation toward sectoral agreements is growing. In the debate about the erosion of the German system of industrial relations formal coverage by a collective agreement and orientation toward one are often taken to be roughly the same and the shares of those establishments are simply added up. However, what orientation toward a sectoral collective agreement means for company working conditions is an open question. As available studies have shown, the existence of a works council influences the level of wages in a company, depending on whether the company is bound by a collective agreement or not. We broaden the view to companies that are oriented toward a sectoral collective agreement. For our OLS wage estimates we use a data set that links company and individual information at the personal level (LIAB). The different institutional settings in their combination with the existence of a works council are taken into account with corresponding interaction terms. As it turns out, the adjusted wage level in orienting companies is clearly below the level in companies bound by a sectoral agreement. Orientation toward such an agreement is therefore no substitute for a formal commitment. However, if a works council exists the wages are significantly higher, but considerable lower than in companies with a sectoral collective agreement. In the middle of the night of June 8th, El Salvador’s Congress hastily passed the Bitcoin Law. This law will make bitcoin legal tender (actually, forced tender). Since the modalities concerning the implementation of the Bitcoin Law change with each passing day, we cannot opine on the details surrounding the scheduled launch of the Bitcoin Law on September 7, 2021. That said, it’s abundantly clear that if the Bitcoin Law is actually implemented, El Salvadoran banks, merchants, and their customers will cross swords with Financial Action Task Force regulators and be ensnared in the FATF’s web of regulations.Keywords. The monetary aggregate M2 increased from $15,473 billion in February 2020 to $19,670 billion in February 2021, or by 27.1%. Real M2 (M2 deflated by the CPI) increased similarly by 25.3%. This monetary acceleration, unprecedented outside of wartime, is apparent in a longer-run perspective. From the trough of the last business cycle in June 2009 through February 2020, annualized monthly growth rates for M2 averaged 5.9%. Over the interval March 2020 through June 2020, they averaged 65.6%. Although diminished, rapid M2 growth continued, averaging 12.9% from July 2020 through March 2021. Milton Friedman famously said that inflation is always and everywhere a monetary phenomenon. If he is right, should not this bulge in money lead to an undesirably high rate of inflation? Section 1 summarizes what the Fed must do to avoid an undesirable increase in inflation. Section 2 lays out the argument in terms of a need for procedures that ensure monetary control. Section 3 describes the Fed’s new monetary policy called “flexible-average-inflation targeting” (FAIT). It highlights how radical a departure FAIT is from the policy of the Great Moderation as a consequence of making the unemployment rate an independent goal rather than using its changes as an indicator variable for whether the economy is growing unsustainably fast or slow. Section 4 draws out the parallels between FAIT and the monetary policy followed in the 1970s. It makes the argument that unless the FOMC reinstates the policy of preemptive increases in the funds rate guided by the necessity of unwinding the 2020 bulge in M2, it will inaugurate an undesirably high period of inflation. Section 5 argues that in many ways with its dismissal of money FAIT resembles modern monetary theory (MMT) adapted to exploitation of the trade-offs promised by a Phillips curve. Section 6 contends that money remains at the heart of any serious conceptual framework for discussing the powers of a central bank. In many countries, notably across Europe, collective bargaining coverage is enhanced by government-issued extensions that widen the reach of collective agreements beyond their signatory parties to all firms and workers in the same sector. This paper analyses the causal impact of such extensions on employment using a natural experiment in Portugal: the immediate suspension by the government that took office in 21 June 2011 of the (until then) nearly automatic extensions. The combination of this suspension and the time needed for processing the extension applications resulted in a sharp and unanticipated decline in the extension probability of agreements signed several month earlier around 1 March 2011. Our results, based on a regression discontinuity design and matched employer-employee-agreement panel data, suggest that extensions had a negative impact on employment growth. Moreover, the effects tend to be concentrated among non-affiliated firms. The lack of representativeness of employer associations is a potentially important factor behind the adverse effect of extensions. Another is the role of retro-activity in combination with the administrative delay in processing extensions. This is particularly relevant in the context of a recession.

Die Arbeit in der ambulanten und stationären Altenpflege muss von wenigen Fachkräften geschultert werden - zulasten der Beschäftigten, Pflegebedürftigen und Angehörigen. Beschäftigte fordern deshalb mehr qualifiziertes Personal; eine Form, dies zu erreichen, sind tarifliche Regelungen über Personalschlüssel, sogenannte Entlastungsregeln. Im Folgenden werden zwei wesentliche Einwände gegen solche Regelungen untersucht: das finanzielle und das rechtliche Argument. Die Analyse des Finanzierungssystems der Altenpflege und eine grundrechtsdogmatische Prüfung zeigen, dass beide Einwände nicht haltbar sind und Entlastungsregeln sowohl finanzierbar als auch rechtlich zulässig sind. Work in elderly care in Germany is characterized by a lack of professionals. The workers, the elderly, and their relatives all suffer from the workload caused by the lack of employees. Therefore, workers are claiming more and better qualified staff. One way to reach this goal are collective bargaining agreements on staffing ratio. This article analyses two main objections against this claim: the financial and the legal argument. An examination of the financing system and an analysis of the fundamental rights of the employer and the employees show that both objections are insupportable. Staff ratios are both fundable and legally justified in collective bargaining.

In many countries, labor courts play a central role in the determination of firing costs by monitoring and supervising the procedures for dismissals, and, eventually, deciding severance payments mandated by the employment protection legislation (EPL). To get some insights about the impact of labor courts on effective firing costs, we explore a new database that contains information on labor courts’ intervention in firings before and after the implementation of significant EPL reforms modifying severance payments and procedures for dismissals. Our results suggest that labor court rulings on economic dismissals did not fully translate the reduction of firing costs mandated by the new EPL to effective firing costs.

Using the 2019 ECS, we investigate the relationship between union organization, workplace representation, industrial relations quality and strike incidence. We also consider some six issues behind the most recent instances of industrial action or threatened industrial action and their outcomes. Strike incidence is found to be elevated in establishments where union density is higher and where workers are covered by mixed-level collective agreements. Distrust and strained workplace relationships are associated with increased strike incidence, and the converse for an employee-focused business strategy and heightened employee motivation. In discussing the outcomes of different types of industrial action or threatened industrial action specific to the establishment, a distinction is drawn between worker wins, worker retractions/losses, and win-win outcomes, where the default is unresolved outcomes. Higher union density is associated with worker wins, collective bargaining with balanced agreements, and there is now some suggestion that works councils may play a moderating role.

A growing number of firms offer compensation packages that link pay to performance. The aim is to motivate workers to be more efficient while also increasing their attachment to the company, thereby reducing turnover and absenteeism. The effects of performance-related pay on productivity depend on the scheme type and design, with individual incentives showing the largest effect. Governments often offer tax breaks and financial incentives to promote performance-related pay, though their desirability has been questioned due to large deadweight losses involved. The diffusion of remote work will increase the relevance of performance-related pay.

Die Inflationsdynamik hat sich bislang noch nicht auf die gesamtwirtschaftliche Tariflohndynamik übertragen. Es gab zwar einzelne Abschlüsse, die überdurchschnittlich hoch ausfielen - etwa der Abschluss in der Eisenund Stahlindustrie, der neben einem einmaligen "Energiebonus" von 500 Euro eine Anhebung der Löhne und Gehälter um 6,5 Prozent bei einer Laufzeit von 18 Monaten vorsah. Zudem wirft die von der Bundesregierung beschlossene Erhöhung des gesetzlichen Mindestlohns ihren Schatten voraus. Um eine Verdrängung von Tariflöhnen zu verhindern, pochten die Gewerkschaften in Branchen wie der Gastronomie oder der Gebäudereinigung auf deutliche Lohnsteigerungen. Einer expansiveren Lohnpolitik im ersten Halbjahr 2022 standen aber moderate Stufenanpassungen aus der Tarifrunde des letzten Jahres gegenüber. Dadurch blieb die am Tariflohnindex des Statistischen Bundesamtes gemessene Tariflohndynamik moderat. Sie blieb auch deutlich hinter der Inflationsdynamik zurück. Vor allem im privaten und im öffentlichen Bankgewerbe verliefen die jüngsten Tarifrunden recht konfliktreich. Zählt man die im Laufe der jeweils mehr als neun Monate andauernden Verhandlungen ergriffenen Eskalationsstufen wie Verhandlungsabbrüche, Streikdrohungen oder Warnstreiks zusammen, ergibt sich eine Konfliktintensität von 29 Punkten im öffentlichen und von 28 Punkten im privaten Bankgewerbe. Auf den Plätzen drei und vier folgen die Eisen- und Stahlindustrie mit 16 und der Sozial- und Erziehungsdienst des Öffentlichen Dienstes mit 15 Punkten. Konfliktfrei ging es in den vorgezogenen Tarifverhandlungen für das Gebäudereiniger-Handwerk zu und in den Verhandlungen über einen als "Zwischenergebnis" bezeichneten Kurzläufer mit einer Laufzeit von sieben Monaten in der Chemischen Industrie. Im Durchschnitt aller verhandelnden Branchen lässt sich nicht feststellen, dass die Inflation die Tarifverhandlungen belastete. Die Konfliktintensität lag im Durchschnitt der 15 analysierten Tarifkonflikte bei 5,7 Punkten. Das sind nur halb so viele Punkte wie im Vorjahr (11,5 Punkte). Im zweiten Halbjahr 2022 stehen unter anderem Tarifverhandlungen in der Metall- und Elektro-Industrie, in der Chemischen und pharmazeutischen Industrie und im Öffentlichen Dienst von Bund und Kommunen an. Da allein in diesen drei Tarifbereichen für mehr als sieben Millionen Arbeitnehmer neue Tarifverträge verhandelt werden, kommt den zuständigen Tarifpartnern eine große Verantwortung zu. Sie stellen die Weiche in Richtung Lohn-Preis-Spirale oder Preisstabilität. Aus stabilitätspolitischer Sicht sollten sich die Tariflohnsteigerungen nicht an der aktuellen Inflationsrate orientieren, sondern an der Zielinflationsrate der Europäischen Zentralbank. Andernfalls droht sich die Inflation auch von der Lohnseite her zu verfestigen.

Das Tarifjahr 2021 war durch langwierige Verhandlungen geprägt. Pandemiebedingt wurden einige Konflikte schon 2020 unterbrochen oder ausgesetzt, etwa im Hotel- und Gaststättengewerbe, im Sozial- und Erziehungsdienst oder in der Druckindustrie. Aber auch neue, erst im Laufe des Jahres 2021 begonnene Tarifverhandlungen zogen sich hin. Im Einzelhandel dauerten die Verhandlungen 7,6 Monate, in der Metall- und Elektro-Industrie 7,4, im Bauhauptgewerbe 7,0 und im Groß- und Außenhandel 6,9 Monate. Bei den privaten und öffentlichen Banken, wo die Verhandlungen bereits im Juni 2021 starteten, ist keine Einigung in Sicht. Die durchschnittliche Verhandlungsdauer lag 2021 in den 21 Tarifkonflikten aus insgesamt zwanzig Branchen, die im Rahmen des IW-Konfliktmonitorings analysiert wurden, bei 6 Monaten. Im langjährigen Durchschnitt der Jahre 2005 bis 2020 waren es lediglich 4,2 Monate und 2020, im ersten Pandemiejahr, 5,3 Monate. [...]
