في الآونة الأخيرة برزت الوساطة کإحدى الوسائل البديلة لتسوية المنازعات Alternative Disputes Resolution؛ وذلک لأسباب متعددة منها على سبيل المثال: إرادة أطراف المنازعة من التحرر من الإجراءات الشکلية المصاحبة للتقاضي أمام محاکم الدولة أو للتحکيم أمام الهيئات التحکيمية المختلفة، ويضاف إلى ذلک: أن تدخل المحاکم- في کثير من الأحيان- في سير العملية التحکيمية يؤثر بالسلب على مدة تسوية النزاع وتکلفته؛ حيث أصبح التحکيم- وخاصة التحکيم في المنازعات بين المستثمرين والدول المضيفة للاستثمار- يستغرق وقتا طويلا ومکلفا للغاية. وفي هذا الإطار تم اعتماد اتفاقية الأمم المتحدة بشأن اتفاقات التسوية الدولية المنبثقة من الوساطة United Nations Convention on International Settlement Agreements Resulting from Mediation (المعروفة باتفاقية"سنغافورة للوساطة Singapore Convention") في جلسة الجمعية العامة رقم(62) بتاريخ 20 ديسمبر 2018، ودخلت حيز النفاذ في 12 سبتمبر 2020، وتهدف الاتفاقية-بصفة عامة- إلى تشجيع الاستخدام المتزايد للوساطة کوسيلة فعالة لتسوية المنازعات العابرة للحدود بغرض المحافظة على العلاقات التجارية بين الأطراف المعنية؛ حيث إنها تخلق إطارا قانونيا يشير إلى أهمية الوساطة دوليا، ويؤيد تواجد آلية تسمح بالاعتماد على اتفاقات التسوية الناتجة عن الوساطة وإنفاذها بسهولة في الدول الأطراف. فهل يمکن أن تسهم هذه الاتفاقية من الناحية العملية إلى تشجيع الأطراف المعنية إلى اللجوء إلى الوساطة لتسوية منازعاتهم؛ وخاصة منازعات الاستثمار. يهدف هذا البحث إلى دراسة اتفاقية سنغافورة للوساطة؛ مبرزا الدوافع إلى إبرامها، وأهم الأحکام التي تضمنتها، خاصة تلک المتعلقة بإنفاذ الاتفاقات الناتجة عن الوساطة وأسباب الاحتجاج ضد إنفاذها، وتحديات استخدام الوساطة في تسوية المنازعات بين المستثمرين والدولة المضيفة للاستثمار، ومدي انطباق الاتفاقية على هذا النوع من المنازعات. Mediation has emerged as an important alternative dispute resolution mechanism. Disputants are often attracted by its informality especially when compared to the rigidity associated with litigation before the state courts or with arbitration before the various arbitration tribunals. In addition, the frequent interference of the courts in the arbitration process adversely affects the duration of the dispute settlement and its cost. Consequently, arbitration- especially the arbitration of disputes between investors and the host countries of the investment- has become very time-consuming and costly. In view of this, the United Nations Convention on International Settlement Agreements Resulting from Mediation(“the Singapore Convention”) was adopted at the General Assembly session No. 62 on December 20, 2018. It recently came into force on September 12, 2020. The Convention generally aims to encourage the use of mediation as an effective means of settling cross-border disputes for the purpose of preserving commercial relations between the parties concerned. It creates a legal framework that indicates the importance of mediation internationally, and supports the existence of a mechanism that allows reliance on settlement agreements resulting from mediation and their uncomplicated enforcement at state level. However, can this Convention effectively increase the uptake of mediation among disputants, particularly those embroiled in investment disputes? This paper examines the reasons behind the conclusion of the Singapore Convention on Mediation. It analyzes its key provisions, particularly those relating to the enforcement of mediated agreements and defences against the enforcement of these agreements. It also examines the challenges surrounding the usage of mediation in settling disputes between investors and the host country, and the Convention’s scope for this type of disputes.

The Singapore Convention seeks to establish a universal standard for the recognition and enforcement of international settlement agreements resulting from mediation. Assuming it finds wide acceptance, the Convention could harmonize existing enforcement mechanisms, the effect of which typically does not extend to foreign jurisdictions. Ideally, this could leverage mediation in a similar way as the New York Convention helped establish arbitration as the prime means of dispute settlement on the international plane. After contextualizing the Singapore Convention in light of the increasing diversification of dispute resolution methods, this article concludes that this aspiration is unlikely to turn into reality anytime soon. To this end, it considers traditional approaches to the enforcement of settlement agreements as well as the genesis and cornerstones of the Singapore Convention and briefly examines its interplay with arbitral proceedings and domestic legal systems.
