The booklet discusses the legal rights of the retarded focusing on the question of advocacy. A number of issues relating to setting priorities in legal services programs are examined with respect to the retarded. Resources for legal advocacy for the retarded are listed and described, including community legal services programs, state advocacy systems, consumer organizations, the Legal Services Corporation, and state bar associations and law schools. Also considered are the executive responses to the "mental retardation crisis" and the congress and state legislatures as new champions for the disabled. (DLS)

Abstract

New York State's Surrogate Decision-Making Committee (SDMC) appears effective and efficient in approving or denying medical treatments for mentally disabled patients who do not have guardians. The SDMC, a nonjudicial organization, acts as a decision-making body for residents in state-operated and licensed facilities. The SDMC consists of a panel of four volunteers. Each panel is composed of a lawyer, a health professional, an advocate or relative of someone with mental disabilities and another person experienced in the care of people with mental disabilities. The panel holds a hearing after receiving a treatment request from a doctor or dentist. The patient and someone familiar with the patient's care must be present at the hearing. If the patient cannot attend the hearing, a panel member must interview the patient. The panel cannot make decisions about life-sustaining treatment, abortion or sterilization.

The guide examines fundamental rights of mentally retarded and developmentally disabled persons. The monograph focuses on some of the central controversies of which consumers, professionals, planners, and advocates concerned with developmental disabilities should be aware. Problems of living and dying, resettlement and confinement, choice and coercion, assertion and passivity are considered. An overview chapter states the central problem in protecting human and legal rights, followed by a more in-depth look at specific court cases. Chapter 3 examines implications for the field of mental retardation of three major cases: Romeo v. Youngberg and the right to minimal training, Rogers v. Mills and the right to refuse treatment, and Rowley v. Hendrick Hudson Central School District and the right to appropriate education. Chapter 4 outlines methods to upgrade the quality of care, safeguard individual rights, and help consumers identify and exercise their rights. The final chapter summarizes themes and topics for further study, noting unsettled questions in such areas as equality, legitmacy, diversity, professionalism, and self determination. (CL)
