- Abstract
This open access book presents an interdisciplinary, multi-authored, edited collection of chapters on Artificial Intelligence (‘AI') and the Law. AI technology has come to play a central role in the modern data economy. Through a combination of increased computing power, the growing availability of data and the advancement of algorithms, AI has now become an umbrella term for some of the most transformational technological breakthroughs of this age. The importance of AI stems from both the opportunities that it offers and the challenges that it entails. While AI applications hold the promise of economic growth and efficiency gains, they also create significant risks and uncertainty. The potential and perils of AI have thus come to dominate modern discussions of technology and ethics – and although AI was initially allowed to largely develop without guidelines or rules, few would deny that the law is set to play a fundamental role in shaping the future of AI.As thedebate over AI is far from over, the need for rigorous analysis has never been greater. This book thus brings together contributors from different fields and backgrounds to explore how the law might provide answers to some of the most pressing questions raised by AI. An outcome of the Católica Research Centre for the Future of Law and its interdisciplinary working group on Law and Artificial Intelligence, it includes contributions by leading scholars in the fields of technology, ethics and the law.

- Abstract
As IV Jornadas Luso-Brasileiras de Responsabilidade Civil convidaram-nos a refletir sobre a responsabilidade civil no quadro dos novos desafios que a comunicação e a informação comunicam. O tema, dogmaticamente muito rico, não poderia ter sido mais apropriado. Tendo sido escolhido pela Comissão Científica das ditas Jornadas num momento em que ainda se desconheciam os contornos da crise pandémica que o mundo viria a enfrentar, ele veio a revelar-se quase profético, tantos os problemas que a aceleração da digitalização do mundo, entretanto vivenciada, potenciou. Num formato adaptado aos novos desafios, todo ele realizado em ambiente digital, as IV Jornadas foram palco para profícuas discussões sobre os mais variados temas, desde a conformação dos pressupostos da responsabilidade por informações (v.g. a ilicitude e a causalidade), até ao tratamento de matérias específicas, no quadro da proteção de dados, do exercício de direitos nas redes sociais, da liberdade de imprensa, da necessidade de controlo das fakes news, sem se cair em formas de censura mais ou menos encapuçadas, mas também no domínio dos mercados financeiros, da atividade médica, da proteção do consumidor ou de outras partes economicamente mais débeis numa relação contratual. O encontro anual de juristas portugueses e brasileiros ofereceu-nos, assim, um espaço para continuar a aprofundar os contornos de um instituto transversal a todo o direito – a responsabilidade civil – tendo como horizonte de referência alguns dos grandes desafios que o século XXI nos coloca. A riqueza das reflexões ensaiadas nestas IV Jornadas Luso-Brasileiras de Responsabilidade Civil impele-nos a torná-las públicas, oferecendo ao público em geral uma coletânea de textos que, de forma enriquecida, fazem memória dos principais ensinamentos partilhados. É essa memória pública que ganha corpo através da obra que agora se pública.

7. Civil Liability Applicable to Artificial Intelligence: A Preliminary Critique of the European Parliament Resolution of 2020

On 20 October 2020, the European Parliament approved a Resolution with recommendations to the Commission on a civil liability regime for artificial intelligence (2020/2014(INL)) (the 2020 Resolution). The Resolution highlighted the importance of defining a clear and harmonised civil liability regime in Europe for the development of artificial intelligence technologies and the products and services that benefit from them, so as to provide due legal certainty for producers, operators, affected persons and other third parties. The same motivation had previously led the European Parliament to put forward a series of proposals on the subject of liability in its 2017 Resolution (European Parliament Resolution of 16 February 2017 with recommendations to the Commission on Civil Law Rules on Robotics (2015/2103(INL)). There are some important differences between the two documents. These differences reflect the deeper analysis that the European Commission, in particular, has been engaged in with regard to civil liability for harm attributable to artificial intelligence systems. On this subject, we may note, lastly, the “Report on the safety and liability implications of Artificial Intelligence, the Internet of Things and robotics” (COM(2020) 64 final - Report), which accompanies the European Commission White Paper on Artificial Intelligence – COM(2020) 65 final, of 19 February 2020 (White Paper). One important element underpinning the 2020 Resolution is the distinction made between two different regimes for establishing civil liability for harm attributed to artificial intelligence-systems: strict liability for high-risk situations, and subjective liability with a presumption of fault, in other situations. The aim of these brief notes is to, on one hand, provide a critical assessment of how far this option corresponds to the assumptions on which the Resolution is based, also taking a brief look at the concept of wrongdoing proposed and the scope of compensable harm, and, on the other hand, to assess the adequacy of the distinction indicated in the light of the choices made in the 2017 Resolution and, above all, in the light of the challenges that the development of artificial intelligence raises for the traditional foundations on which compensation regimes have been based up to the present.

O tempo vem demonstrando que nos sistemas jurídicos romano-germânicos o resgate do lucro ilícito carece de uma resposta adequada e eficaz. Em vários instrumentos, nomeadamente de direito europeu, o dever de indemnizar é concebido como um remédio que transfere o lucro para o lesado. Tivemos oportunidade de defender que a indemnização é, na verdade, o lugar natural para a restituição do lucro ilícito, mas, de qualquer forma, a emergência das novas soluções legislativas tornam essa resposta evidente. Deigual modo, o espaço próprio do direito civil exige a restrição das sanções administrativas, excluindo essa intervenção do direito público quando os bens ofendidos são de natureza exclusiva ou prevalentemente individual. Justificar-se-á, nesses casos, a aplicação alternativa de uma pena privada, repondo a dignidade do direito subjetivo violado. Este enquadramento reclama uma reforma do Código Civil português, o que aqui se propõe.

'As III Jornadas Luso-Brasileiras de Responsabilidade Civil convidaram-nos a refletir sobre a relação entre a responsabilidade e a pessoalidade. Se com base no tópico'Pessoa, Direito e Responsabilidade'pudemos, durante dois dias, debater muitos e importantes aspetos dogmáticos da responsabilidade civil, tornou-se também evidente a negação do formalismo com que, noutras épocas, o direito foi mascarado. O encontro anual de juristas portugueses e brasileiros (mas também espanhóis e de outras nacionalidades) garantiu-nos, assim, a problematização do próprio sentido do direito que, radicando na ideia de autonomia personalista, necessariamente responsável, nos oferece o princípio da responsabilidade – enquanto princípio normativo positivo, transpositivo e suprapositivo – como sustentáculo das soluções de quid iuris que se encontram para aqueles problemas de primeiro grau. A riqueza das reflexões ensaiadas nestas III Jornadas Luso-Brasileiras de Responsabilidade Civil impele-nos a torná-las públicas, oferecendo ao público em geral uma coletânea de textos que, de forma enriquecida, fazem memória dos principais ensinamentos partilhados. The science of Law cannot ignore the phenomenon of the influence in Europe of the language, practice and teaching of American law, within an Americanization of Law which takes place alongside the Americanization of European culture. With regard to representative group litigation, Portuguese law has implemented a general set of rules in this area (Law 83/95). The law in force covers popular action to prevention, to the prosecution of offenses and to claims for damages. Popular action includes, amongst other interests protected by the law, public health, the environment, quality of life, consumers' rights, cultural heritage and the public domain. Standing is granted to any citizen who enjoys civil and political rights, and to associations and foundations, regardless of whether they have a direct interest in the claim or not, with the res judicata binding all members of the class who have not exercised their right to opt out.

Recentemente tem sido muito propalada a ideia de que Cristóvão Colombo teria sido português, natural da vila de Cuba, e agente secreto de D. João II, aduzindo como prova sobretudo a toponímia das terras que descobriu. Na realidade, os topónimos que lhe têm sido atribuídos ou não são da sua autoria ou se justificam por razões que as fontes coevas nos explicam. Tampouco há razão para preferir o apelido Colón a Colombo, visto a documentação provar claramente que, sucessivamente, usou ambos. Quanto aos serviços a D. João II, prestou‑lhe o pior que se poderia imaginar: desviar para o Atlântico, onde entravam facilmente em choque com os interesses portugueses as atenções de uma Espanha unificada voltada para o interior da Península, para o Magrebe e para o Mediterrâneo., In Portuguese private law, as it happens in other legal systems in continental Europe, the removal of the benefits obtained by the injuring party as a result of his committing the unlawful act do not fall within the scope of civil liability. In general, the restitution of patrimonial advantages obtained via intervention in the legal rights of another has been dealt with in law according to the rules of unjust enrichment. However, in our view, there is a relationship between the presuppositions of civil liability and the recognition of the duty to disgorge illegal profits and, even, of punitive effects. According to Article 496 (1) of the Portuguese Civil Code, any non-patrimonial damage which, due to its severity, warrants legal protection is indemnifiable. We advocate that a relevant non-patrimonial damage occurs whenever an economic benefit for a third party is the result of the culpable sacrificing of rights of the injured party. It is damage which is born out of a rupture in the fair patrimonial relationship between individuals. Compensation for this damage may only, naturally, be achieved by passing into the sphere of the injured party the advantages that the third party obtained unlawfully. The restitution of profit as a consequence of civil liability is nothing more than complying with the need to satisfy the injured party, both with regard to the fixing of compensation for other non-patrimonial damage, and in the autonomous restoring of the situation prior to this harm.
