Deep-ocean observing is essential for informing policy making in the arenas of climate, biodiversity, fisheries, energy and minerals extraction, pollution, hazards, and genetic resources. The Deep Ocean Observing Strategy (DOOS), a UN Ocean Decade endorsed programme, is meeting with representatives from relevant international bodies and agreements to strengthen their interface with the deep-ocean science community, ensure that deep observing is responsive to societal needs, identify points of entry for science in policy making, and to develop relevant products for broad use. DOOS collaboration with the Environmental Systems Research Institute (Esri) facilitates this co-design. A DOOS policy liaison team is being formed to link the contacts, voices, and messaging of multiple deep-ocean networks and organizations in reaching international policy makers. The UN Ocean Decade will help to gain the ear of target communities, scale communication channels appropriately, minimize duplicative efforts, maximize limited resources, and organize inclusive and equitable public and private partners in deep-ocean science and policy.

The Deep Ocean Observing Strategy (DOOS) is an international, community-driven initiative that facilitates collaboration across disciplines and fields, elevates a diverse cohort of early career researchers into future leaders, and connects scientific advancements to societal needs. DOOS represents a global network of deep-ocean observing, mapping, and modeling experts, focusing community efforts in the support of strong science, policy, and planning for sustainable oceans. Its initiatives work to propose deep-sea Essential Ocean Variables; assess technology development; develop shared best practices, standards, and cross-calibration procedures; and transfer knowledge to policy makers and deep-ocean stakeholders. Several of these efforts align with the vision of the UN Ocean Decade to generate the science we need to create the deep ocean we want. DOOS works toward (1) a healthy and resilient deep ocean by informing science-based conservation actions, including optimizing data delivery, creating habitat and ecological maps of critical areas, and developing regional demonstration projects; (2) a predicted deep ocean by strengthening collaborations within the modeling community, determining needs for interdisciplinary modeling and observing system assessment in the deep ocean; (3) an accessible deep ocean by enhancing open access to innovative low-cost sensors and open-source plans, making deep-ocean data Findable, Accessible, Interoperable, and Reusable, and focusing on capacity development in developing countries; and finally (4) an inspiring and engaging deep ocean by translating science to stakeholders/end users and informing policy and management decisions, including in international waters.

The impacts of deep seabed mining on people have not been sufficiently researched or addressed. Using a legitimacy framework, we discuss the social-equity dimensions of this emerging industry in the ocean commons.

The ocean is Earth’s greatest climate mitigator, but it cannot do its work without biodiversity. Yet, accelerating climate change, unsustainable fishing, and widespread plastic and other pollutants, combined with increased resource demands, are threatening life throughout our global ocean. This is particularly acute in the two-thirds of the ocean (the high seas and seabed below) located beyond national boundaries, and as such, no state can solve these problems alone. Since 2018, member states of the United Nations have been crafting an international treaty to protect high-seas biodiversity and to ensure that human pressures are kept to a level that sustains this variety. Last month, the fifth and supposedly final session of the UN Intergovernmental Conference fell short of this goal. Unfortunately, disagreements on fundamental issues meant that negotiators ran out of time. Achieving a timely treaty requires resuming the dialogue as soon as possible with more visible public and political support to surmount remaining hurdles.

Calls to address social equity in ocean governance are expanding. Yet ‘equity’ is seldom clearly defined. Here we present a framework to support contextually-informed assessment of equity in ocean governance. Guiding questions include: (1) Where and (2) Why is equity being examined? (3) Equity for or amongst Whom? (4) What is being distributed? (5) When is equity considered? And (6) How do governance structures impact equity? The framework supports consistent operationalization of equity, challenges oversimplification, and allows evaluation of progress. It is a step toward securing the equitable ocean governance already reflected in national and international commitments.

The Ocean Decade is a critical chance to move toward a sustainable and equitable ocean. Realizing this vision requires that we all recognize inequities, learn from failure, listen to the diverse voices of people who rely on the ocean for their lives and livelihoods, and value their expertise.

The ocean crisis is urgent and central to human wellbeing and life on Earth; past and current activities are damaging the planet's main life support system for future generations. We are witnessing an increase in ocean heat, disturbance, acidification, bio‐invasions and nutrients, and reducing oxygen levels. Several of these act like ratchets: once detrimental or negative changes have occurred, they may lock in place and may not be reversible, especially at gross ecological and ocean process scales. Each change may represent a loss to humanity of resources, ecosystem function, oxygen production and species. The longer we pursue unsuitable actions, the more we close the path to recovery and better ocean health and greater benefits for humanity in the future. We stand at a critical juncture and have identified eight priority issues that need to be addressed in unison to help avert a potential ecological disaster in the global ocean. They form a purposely ambitious agenda for global governance and are aimed at informing decision‐makers at a high level. They should also be of interest to the general public. Of all the themes, the highest priority is to rigorously address global warming and limit surface temperature rise to 1.5°C by 2100, as warming is the pre‐eminent factor driving change in the ocean. The other themes are establishing a robust and comprehensive High Seas Treaty, enforcing existing standards for Marine Protected Areas and expanding their coverage, especially in terms of high levels of protection, adopting a precautionary pause on deep‐sea mining, ending overfishing and destructive fishing practices, radically reducing marine pollution, putting in place a financing mechanism for ocean management and protection, and lastly, scaling up science/data gathering and facilitating data sharing. By implementing all eight measures in unison, as a coordinated strategy, we can build resilience to climate change, help sustain fisheries productivity, particularly for low‐income countries dependent on fisheries, protect coasts (e.g. via soft‐engineering/habitat‐based approaches), promote mitigation (e.g. carbon storage) and enable improved adaptation to rapid global change.

Climate-driven redistribution of tuna threatens to disrupt the economies of Pacific Small Island Developing States (SIDS) and sustainable management of the world’s largest tuna fishery. Here we show that by 2050, under a high greenhouse gas emissions scenario (RCP 8.5), the total biomass of three tuna species in the waters of ten Pacific SIDS could decline by an average of 13% (range = −5% to −20%) due to a greater proportion of fish occurring in the high seas. The potential implications for Pacific Island economies in 2050 include an average decline in purse-seine catch of 20% (range = −10% to −30%), an average annual loss in regional tuna-fishing access fees of US$90 million (range = −US$40 million to –US$140 million) and reductions in government revenue of up to 13% (range = −8% to −17%) for individual Pacific SIDS. Redistribution of tuna under a lower-emissions scenario (RCP 4.5) is projected to reduce the purse-seine catch from the waters of Pacific SIDS by an average of only 3% (range = −12% to +9%), indicating that even greater reductions in greenhouse gas emissions, in line with the Paris Agreement, would provide a pathway to sustainability for tuna-dependent Pacific Island economies. An additional pathway involves Pacific SIDS negotiating within the regional fisheries management organization to maintain the present-day benefits they receive from tuna, regardless of the effects of climate change on the distribution of the fish. Climate change will alter the distribution of tuna, impacting the economies of Pacific Small Island Developing States. This study finds that greater greenhouse gas emissions will worsen these impacts.

The high seas—marine areas beyond national jurisdiction (1)—cover nearly half of Earth's surface (2). The high seas support our planet in countless ways, from regulating the climate, to feeding millions of people, to supporting industries that contribute billions of dollars to the global economy (3). Even so, less than 1% of the high seas are fully protected (4), and the current patchwork of management and lack of oversight leaves them vulnerable to abuse. In 2017, the United Nations resolved to develop an international treaty for the conservation and sustainable use of the high seas. Negotiations are set to end this year. We must ensure that the forthcoming framework conserves high-seas biodiversity and promotes sustainable and equitable use.

The United Nations Decade of Ocean Science for Sustainable Development (2021–2030, henceforth the Ocean Decade) aims to galvanize the international community to acquire and apply scientific knowledge of the ocean. The Ocean Decade is specifically intended to help achieve the Sustainable Development Goals (SDGs), including its promise to “leave no one behind,” which includes coastal Least Developed Countries and Small Island Developing States, and will undoubtedly influence research agendas and financing well beyond 2030. This focus is captured in the phrase “the science we need for the ocean we want” (1). This first-of-its-kind UN Decade will require ambition and commitment, especially during the coronavirus disease 2019 (COVID-19) crisis. Researchers hoping to help deliver the “ocean we want” as a society-first principle need to understand how science can benefit ocean-dependent people. This requires a science model that co-designs and co-delivers solutions in collaboration with people whose livelihood depends on the ocean, such as the Madagascar fishers pictured here. The current draft of the Ocean Decade Implementation Plan establishes a framework of outcomes, actions, and objectives, acknowledging the need for interdisciplinary approaches to design and deliver solution-oriented research alongside ocean-dependent people (1). Recent proposals from the academic literature for the Ocean Decade emphasize increasing our global biophysical understanding through exploration and observation of, and experimentation on, the ocean (2⇓⇓–5). But will understanding the ocean lead to “the ocean we want”? We argue that proposals for the UN Decade should consider a crucial point: To achieve the ocean we want, we must better understand the needs and priorities of ocean-dependent peoples and evaluate potential solutions for them. Humans have been harnessing the natural properties of marine organisms for millennia—initially in their unprocessed form for sustenance, and more recently via extracted products as biomaterials, functional food ingredients, and medicines. As accelerating scientific and technological advances open up the deep ocean, potential avenues to exploit components and characteristics of marine biodiversity are revealed. To keep pace with such innovations and to promote equitable and sustainable activities, the international legal framework has evolved over recent decades to address the conservation and sustainable use of biodiversity, together with the sharing of benefits arising from the utilisation of genetic resources. Gaps remain, however, particularly for the deep, remote and technologically demanding ocean areas beyond national jurisdiction (ABNJ) that account for more than 60 per cent of the global ocean. The question of how to share benefits from marine genetic resources is one of the most contentious issues in ongoing negotiations for the development of a new international legally binding instrument for the conservation and sustainable use of marine biodiversity in ABNJ under the 1982 United Nations Convention on the Law of the Sea (UNCLOS). In this chapter, the potential exploitation of deep-sea biodiversity is considered, and the governance challenges associated with the sharing of benefits are discussed. Associated opportunities and challenges for the conservation and sustainable use of deep-sea biodiversity are discussed. The development of a new legal instrument under UNCLOS provides a central focus for the discussion in this chapter.

The oceans are facing a catastrophic decline in biodiversity. States are now in the final stage of negotiations for an implementing agreement under the United Nations Convention on the Law of the Sea to fill governance gaps for the conservation and sustainable use of marine biodiversity beyond national jurisdiction. This paper outlines the apparent areas of convergence and divergence between States on the 2019 draft treaty text. It outlines the contributions of the articles in this Special Issue “Biodiversity Beyond National Jurisdiction (BBNJ) Treaty: the Final Stage of Negotiations”, which offer suggestions for breaking negotiation deadlocks and practical ideas for transformative governance change. As States prepare for the postponed fourth and final (planned) negotiating session, we hope that this Special Issue will offer a useful tool for decision-makers and other stakeholders by offering creative ideas for BBNJ governance and for reaching timely agreement on the BBNJ treaty text., Highlights • Proposed UN treaty for the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction. • This paper outlines the apparent areas of convergence and divergence States on the November 2019 draft treaty text. • It outlines the contributions to the BBNJ Special Issue with practical approaches for transformative governance change. • It presents the Special Issue as a useful tool for stakeholders in debating new ideas and concluding BBNJ negotiations.

unga Resolution 69/292 requires that the development of an international legally binding instrument (ilbi) for the conservation and sustainable use of biodiversity in areas beyond national jurisdiction (abnj) under the United Nations Convention on the Law of the Sea should not undermine existing relevant legal instruments and frameworks and relevant global, regional and sectoral bodies. The South West Pacific regional oceans governance framework is reviewed, highlighting the importance of dedicated mechanisms for cooperation in the integration of regional institutions and in collective diplomacy for the development of an ilbi. It is argued a sufficiently inclusive description of existing arrangements under an ilbi is needed to not undermine the competence or integration of the regional architecture for oceans’ governance. Shared governance principles between an ilbi and existing regional governance architecture could play an important role in preserving coherence and contribute to ensuring regional standards for conservation of bbnj are not diminished.

Pacific Island Countries have limited capacity to engage in scientific research involving marine genetic resources in areas beyond national jurisdiction (abnj). Marine scientific research and capacity development are central to the regime for technology transfer established by the 1982 United Nations Convention on the Law of the Sea (losc), but gaps and ambiguities weaken this framework. In this article, options to strengthen scientific capacity in Pacific Island Countries, through the development of a new international legally binding instrument for the conservation and sustainable use of biodiversity in abnj under the losc, are examined. The international framework for technology transfer could be strengthened by fostering an integrated approach to the advancement, sharing and application of scientific knowledge. Coordination and collaboration at global and regional levels will be required to increase marine science cooperation, improve access to data and information, deliver training, and overcome barriers to develop institutional and individual scientific capacity.

The deep-sea is a large source of marine genetic resources (MGR), which have many potential uses and are a growing area of research. Much of the deep-sea lies in areas beyond national jurisdiction (ABNJ), including 65% of the global ocean. MGR in ABNJ occupy a significant gap in the international legal framework. Access and benefit sharing of MGR is a key issue in the development of a new international legally-binding instrument under the United Nations Convention on the Law of the Sea (UNCLOS) for the conservation and sustainable use of marine biological diversity in ABNJ. This paper examines how this is relevant to deep-sea scientific research and identifies emerging challenges and opportunities. There is no internationally agreed definition of MGR, however, deep-sea genetic resources could incorporate any biological material including genes, proteins and natural products. Deep-sea scientific research is the key actor accessing MGR in ABNJ and sharing benefits such as data, samples and knowledge. UNCLOS provides the international legal framework for marine scientific research, international science cooperation, capacity building and marine technology transfer. Enhanced implementation could support access and benefit sharing of MGR in ABNJ. Deep-sea scientific researchers could play an important role in informing practical new governance solutions for access and benefit sharing of MGR that promote scientific research in ABNJ and support deep-sea stewardship. Advancing knowledge of deep-sea biodiversity in ABNJ, enhancing open-access to data and samples, standardisation and international marine science cooperation are significant potential opportunity areas.

Marine scientific research is crucial to forge solutions in the development of a new international legally binding instrument for the conservation and sustainable use of marine biological diversity in areas beyond national jurisdiction (ABNJ) under the 1982 United Nations Convention on the Law of the Sea . The transfer of marine technology, capacity development and marine genetic resources are key issues. This paper examines how the Intergovernmental Oceanographic Commission (IOC), as a competent international organisation for marine scientific research and technology transfer, can inform the development of the instrument. Synergies between marine technology transfer and non-monetary benefit sharing of genetic resources are illustrated. Four key lessons from the IOC are examined: 1. Coordinating international cooperation in marine scientific research; 2. Enabling open access to data and knowledge; 3. Facilitating capacity development through scientific training and education; and 4. Governance of marine scientific research. Realising the potential of the IOC to advance governance solutions for ABNJ will depend on increased political will from Member States and strengthened partnerships to reduce resource constraints and enhance the IOC's capacity at global and regional scales.

Marine areas beyond national jurisdiction (ABNJ) comprise most of Earth's interconnected ocean, hosting complex ecosystems that play key roles in sustaining life and providing important goods and services. Although ABNJ encompass nearly half the planet's surface, biological diversity found in these areas remains largely unprotected. Mounting pressures generated by the escalation of human activities in ABNJ threaten vital ecosystem services and the fragile web of life that supports them. Marine protected areas (MPAs) are widely acknowledged as an important tool for the conservation of biological diversity. Currently less than 1% of ABNJ are protected, with the vast majority of MPAs located in waters within national jurisdiction. The existing legal framework for protection and sustainable use of ABNJ lacks common goals, principles or standards, multi-sectoral coordination and comprehensive geographic coverage to ensure conservation or good governance grounded in science-based decision-making, transparency, accountability and effective enforcement. This paper highlights the urgency and importance of protecting the last conservation frontier on Earth. Key lessons for conservation in ABNJ can be learned from regional, cross-boundary and national experiences shared during the high seas governance workshop at the IUCN World Parks Congress in Sydney, Australia in November 2014. The intent of this paper is to inform the deliberations now underway in the United Nations General Assembly to develop a new legally binding international instrument for the conservation and sustainable use of marine biological diversity in ABNJ. It also aims to encourage further initiatives to protect and preserve our last conservation frontier using currently available mechanisms and powers consistent with international law. Capacity building and technology transfer (CBTT) are vital for the success of a new international legally-binding agreement for marine biodiversity beyond national jurisdiction. Without effective CBTT, many developing countries are unlikely to be able to fulfill their obligations in areas beyond national jurisdiction (ABNJ), including by undertaking area-based management, evaluating environmental impact assessments, and benefiting from the utilization of marine genetic resources – or to realize their rights. Meanwhile, several other international commitments require varying forms of CBTT at global, regional and national levels. This article analyses areas where synergies are possible for implementing CBTT, and those where additional, ABNJ-related capacities will need to be mainstreamed for holistic ocean management. We argue that CBTT is more meaningful, effective and resource-efficient if it corresponds to the ecological realities of an interconnected ocean by linking initiatives relating to ABNJ with those within national jurisdiction. We discuss why and how CBTT is also more useful on the national level if it maximizes synergies between international policies and agreements, and allows countries to concurrently participate in a BBNJ agreement and fulfill national priorities related to sustainable development, for example by enhancing livelihoods, eradicating hunger and poverty, and building capacity for science and innovation as part of national blue economies based on healthy ocean ecosystems. The Decade of Ocean Science for Sustainable Development offers a timely opportunity to operationalize robust CBTT measures under the BBNJ agreement and maximize synergies with other international commitments - as part of broader efforts to achieve Agenda 2030.

The development of a new international legally binding instrument for the conservation and sustainable use of marine biodiversity beyond national jurisdiction (BBNJ agreement) is in the final negotiation phase. Legal recognition of rights of nature is emerging worldwide as a fresh imperative to preserve ecological integrity, safeguard human wellbeing, broaden participation in decision-making, and give a voice to nature – but so far exclusively within national jurisdiction. In this paper, we consider how a Rights of Nature perspective might inform the BBNJ agreement. We examine Rights of Nature laws and identify four characteristics relating to: i) rights; ii) connectivity; iii) reciprocity; and iv) representation and implementation. We argue that a Rights of Nature perspective can reinforce existing ocean governance norms, inspire new measures to enhance the effectiveness and equitability of the BBNJ agreement and enable global ocean stewardship in ABNJ.

Developing enduring capacity to monitor ocean life requires investing in people and their institutions to build infrastructure, ownership, and long-term support networks. International initiatives can enhance access to scientific data, tools and methodologies, and develop local expertise to use them, but without ongoing engagement may fail to have lasting benefit. Linking capacity development and technology transfer to sustained ocean monitoring is a win-win proposition. Trained local experts will benefit from joining global communities of experts who are building the comprehensive Global Ocean Observing System (GOOS). This two-way exchange will benefit scientists and policy makers in developing and developed countries. The first step toward the GOOS is complete: identification of an initial set of biological Essential Ocean Variables (EOVs) that incorporate the Group on Earth Observations (GEO) Essential Biological Variables (EBVs), and link to the physical and biogeochemical EOVs. EOVs provide a globally consistent approach to monitoring where the costs of monitoring oceans can be shared and where capacity and expertise can be transferred globally. Integrating monitoring with existing international reporting and policy development connects ocean observations with agreements underlying many countries' commitments and obligations, including under SDG 14, thus catalyzing progress toward sustained use of the ocean. Combining scientific expertise with international capacity development initiatives can help meet the need of developing countries to engage in the agreed United Nations (UN) initiatives including new negotiations for the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction, and the needs of the global community to understand how the ocean is changing.

Climate change manifestation in the ocean, through warming, oxygen loss, increasing acidification, and changing particulate organic carbon flux (one metric of altered food supply), is projected to affect most deep‐ocean ecosystems concomitantly with increasing direct human disturbance. Climate drivers will alter deep‐sea biodiversity and associated ecosystem services, and may interact with disturbance from resource extraction activities or even climate geoengineering. We suggest that to ensure the effective management of increasing use of the deep ocean (e.g., for bottom fishing, oil and gas extraction, and deep‐seabed mining), environmental management and developing regulations must consider climate change. Strategic planning, impact assessment and monitoring, spatial management, application of the precautionary approach, and full‐cost accounting of extraction activities should embrace climate consciousness. Coupled climate and biological modeling approaches applied in the water and on the seafloor can help accomplish this goal. For example, Earth‐System Model projections of climate‐change parameters at the seafloor reveal heterogeneity in projected climate hazard and time of emergence (beyond natural variability) in regions targeted for deep‐seabed mining. Models that combine climate‐induced changes in ocean circulation with particle tracking predict altered transport of early life stages (larvae) under climate change. Habitat suitability models can help assess the consequences of altered larval dispersal, predict climate refugia, and identify vulnerable regions for multiple species under climate change. Engaging the deep observing community can support the necessary data provisioning to mainstream climate into the development of environmental management plans. To illustrate this approach, we focus on deep‐seabed mining and the International Seabed Authority, whose mandates include regulation of all mineral‐related activities in international waters and protecting the marine environment from the harmful effects of mining. However, achieving deep‐ocean sustainability under the UN Sustainable Development Goals will require integration of climate consideration across all policy sectors., As use of the deep sea and its resources intensifies, consideration of climate change should become integral to planning and management. A suite of climate and biological modeling tools can inform holistic environmental management and decision making for the deep ocean on multiple fronts.

Negotiations for a new international legally binding instrument under the United Nations Convention on the Law of the Sea for the conservation and sustainable use of marine biological diversity of areas beyond national jurisdiction (ABNJ) have commenced. For the new agreement to be fair and effective, it is vital that all States are able to participate in the long-term sustainable use and conservation of the ocean beyond national jurisdiction. This includes participation in marine scientific research and the utilization of marine genetic resources (MGR) through subsequent innovation processes. Open access to MGR, such as data, coupled with capacity building, can promote the equitable sharing of benefits associated with MGR. In this paper, it is hypothesized that an ‘inclusive innovation’ approach may facilitate participation and promote enhanced engagement in the conservation and sustainable use of biodiversity beyond national jurisdiction. A number of existing genetic resource initiatives provide examples of efforts to foster inclusivity in the innovation process, including BioBricks, Open Source Drug Discovery, GenBank and the Global Genome Biodiversity Network. An analysis of these examples enables clear identification of common elements that are adopted by such initiatives, whereby inclusive innovation either develops naturally or is promoted actively through measures for open access, capacity building, and collaboration. By empowering more States and stakeholders to participate in research and innovation processes, global potential in terms of enhanced scientific knowledge and opportunities associated with biodiversity of ABNJ can be promoted and the overall objective of the conservation and sustainable use can be best pursued.
