12. Restraint interventions in people with moderate to profound intellectual disabilities: Perspectives of support staff and family members

Abstract

Background Due to incompatibilities in communication, it is key that family members and support staff can take the perspective of people with moderate to profound intellectual disabilities (ID) whilst putting aside their own perspectives. Method Ten vignettes describing types of restraint interventions (RIs) were presented to 20 unique pairs of support staff and family members related to individuals with moderate to profound ID. Results In taking their own perspective, more than half of the support staff and family members perceived all RIs as involuntary and severe. In contrast, when asked to put themselves in the position of the client/family member, only three RIs were considered involuntary by a majority of support staff and family members. Conclusions These results indicate that support staff and family members can take into account the perspective of people with moderate to profound ID in the evaluation and consideration of involuntary care.

13. Onvrijwillige zorg. Van Wet Bopz naar Wet zorg en dwang

Abstract

De essentie van de in 2002 uitgevoerde evaluatie van de Wet Bopz was: geen vrijheidsbeperking behalve als uiterste redmiddel (ultimum remedium) en alleen wanneer wordt voldaan aan de eisen proportionaliteit, subsidiariteit en effectiviteit. Met het opstellen van de Wet zorg en dwang heeft de wetgever beoogd deze essentie te vertalen naar een op de zorg aan mensen met een verstandelijke beperking aansluitende wet, die duidelijke aanknopingspunten biedt voor het zorgvuldig omgaan met vrijheidsbeperking. De wetgever introduceert een zeer brede definitie van vrijheidsbeperking, ‘onvrijwillige zorg’, waarmee wordt aangesloten op de in de praktijk en de IGZ al langer in gang zijnde ontwikkelingen. Tijdens het onderzoek ‘Van Wet Bopz naar Wet zorg en dwang’ is een eerste verkenning uitgevoerd van de gevolgen van de Wet zorg en dwang en in het bijzonder het begrip onvrijwillige zorg voor de dagelijkse zorgpraktijk van zorg aan mensen met een verstandelijke beperking. De bevindingen van de juridische en empirische onderzoeksmethoden laten zien dat de invulling en uitwerking van het begrip onvrijwillige zorg de zorgpraktijk voor verschillende uitdagingen plaatst.

Abstract

Research suggests that restrictive measures are widely used on adolescents with mild intellectual disabilities. In the Netherlands, restrictive measures are defined as all measures that limit the freedom of a person. In most countries, legislation and policies that seek to reduce the use of restrictive measures focus on seclusion and mechanical and physical restraints. The study aimed to investigate the extent to which restrictive practices are used in the care of adolescents with mild intellectual disabilities while also exploring the attitudes of support staff toward these interventions. A survey study was done among a nationally representative Dutch research sample consisting of support staff. A structured questionnaire was completed by 195 staff members (response of 68.7%) working in settings providing care for people with intellectual disabilities. The measures generally used by staff members who work with adolescents with mild intellectual disabilities involved restricting the freedom of movement and so‐called social restrictions (such as limiting the use of mobile phones). Nearly all respondents considered restrictive measures to be justified in the case of danger, physical aggression, or sexually abusive behavior (87.8–96.8%). Frequently mentioned reasons for using restrictive measures were averting or avoiding danger (90.4 and 83.0%, respectively) and calming the adolescent (63.8%). Although seclusion and mechanical and physical restraints were generally considered most intrusive, staff members were aware that social restrictions could also be instrusive. The fact that current policies do not address these measures makes support staff question the lawfulness of their actions. As well as staff training to reduce the use of restrictive measures, rules, and legislation are also needed to clarify the options and limits to using such measures in the professional care of adolescents with mild intellectual disabilities.

Abstract

De casus Brandon en zeer recentelijk de casus Roelie hebben de discussie rondom het thema vrijheidsbeperking weer doen oplaaien. Gelijkertijd vond ook de Kamerbehandeling van het wetsvoorstel Zorg en dwang plaats. De auteurs beargumenteren dat met de inhoud van dit wetsvoorstel een casus als Brandon of Roelie niet voorkomen gaat worden. Er is meer nodig in de sector. Ervaringen uit de praktijk leren dat veel vormen van vrijheidsbeperking - in het bijzonder bij mensen met een lichte verstandelijke beperking - worden toegepast om situaties te beheersen. De wettelijke criteria - subsidiariteit, proportionaliteit en doelmatigheid - worden daarbij onvoldoende in acht genomen. Onderzoek laat zien dat veel vrijheidsbeperking kan worden voorkomen als zeer intensief wordt geïnvesteerd in het contact begeleider - cliënt.
