- Abstract
Ethik und Psychotherapie bilden eine untrennbare Einheit. Allerdings setzen ethische Reflexionen für gewöhnlich verständige und der Vernunft fähige Akteure voraus, weshalb der intrinsische Zusammenhang zwischen Psychotherapie und Ethik in der Kinder- und Jugendlichenpsychotherapie neu überprüft werden muss. Kinder und Jugendliche verfügen, im Vergleich zu erwachsenen Menschen, in der Regel über weniger Autonomie, Handlungs- und Entscheidungsfähigkeit. Dimensionen und Konsequenzen von Taten oder Entschlüssen können meist noch nicht vollständig abgeschätzt werden, weshalb sich in Bezug auf Psychotherapie auch Fragen nach Freiwilligkeit und Einwilligung in die entsprechenden Diagnostik- und Behandlungsmaßnahmen stellen. Gegenwärtig soll bei der Entscheidung für die adäquate Diagnostik und Behandlung die Einwilligung der Eltern oder Erziehungsberechtigten erfolgen. Doch dieser Ansatz ist insofern problematisch, da es infolgedessen zu einer generellen Unterschätzung der Autonomie und Entscheidungsfähigkeit von Kindern und Jugendlichen kommen kann und daraus resultierend die durch die Kinderrechtskonvention garantierten Partizipations- und Informationsrechte, die allen Kindern zustehen, nicht beachtet werden. Wie kann Kinder- und Jugendlichenpsychotherapie aus ethischer Perspektive begründet und legitimiert werden und wo liegen gegebenenfalls Grenzen?

Orientador: Prof. Dr. Vitor Emanuel Marchetti Ferraz Junior Dissertação (mestrado) - Universidade Federal do ABC, Programa de Pós-Graduação em Políticas Públicas, 2016. As mudanças ocorridas no Poder Judiciário em todo o mundo decorrentes da ampliação do acesso à justiça, encontraram respaldo no Brasil a partir da Constituição Federal de 1988. A constitucionalização dos direitos sociais e dos mecanismos de acesso à justiça visando fortalecer o processo de redemocratização, não só ampliaram os poderes do Judiciário, como também possibilitaram que novos atores sociais pudessem exigir a implementação desses direitos por meio do processo de judicialização. Os novos canais de acesso à justiça como a Defensoria pública e o Ministério Público, bem como a constitucionalização de novos instrumentos jurídicos e a ampliação dos processos interpretativos aliados à descoberta pela Sociedade da obrigatoriedade de um pronunciamento do Judiciário quanto provocado, levou diversos atores a intentarem litígios, com a finalidade de obter a implementação de direitos que foram constitucionalizados e que deveriam ser operacionalizados por meio de políticas públicas.A judicialização da política e das relações sociais potencializadas pela expansão do acesso à justiça e pela oportunidade política gerada no processo de redemocratização, estenderam a atuação do Judiciário a todas as áreas da vida social, transformando-o em uma nova arena política e ao mesmo tempo, estimulando diversos atores a se utilizarem dessa instância para lutar por seus direitos. A judicialização dos direitos sociais, especialmente da saúde e da educação, transferiram as discussões sobre as políticas públicas do âmbito do Executivo para a seara do Judicário levando esse Poder a decidir sobre temas que antes eram restrito apenas à Administração Pública Na educação, a judicialização vem ocorrendo em todos os níveis de ensino e nas universidades federais, ela acabou sendo intensificada pelo processo de expansão e democratização do ensino superior. O Direito à educação superior sempre foi exercido pelas eleites, porém a instituição de políticas públicas no Ensino superior público vem democratizando e ampliando o acesso a esse nível de ensino.Nesse contexto, as universidades federais tem sido objeto de transformação social, na medida em que vêm implementando políticas destinadas a democratizar o ensino supeior e facilitar o acesso de atores que se encontravam excluídos desse processo. No âmbito das universidades federais a judicialização tem ocorrido tanto na prestação do serviço público de ensino, com ações questionando à burocratização, quanto nas políticas públicas de acesso que estão sendo implementadas por elas. A maioria dessas ações são interpostas por atores individuais buscando uma vaga nessas instituições de ensino superior. The changes that occurred in Judiciary power, all over the world, due to the enlargement of the access to justice, had found support in Brazil after the Federal Constitution of 1988. The constitucionalization of social rights and ways to access justice in order to strengthen the process of redemocratization, not just enlarged the power of Judiciary as well made possible that new social actors could demand implementation of these rights through the process of judicialization. The new channels of access to justice, such as public Defensory and the Public Ministry , as well the constitucionalization of new juridical instruments and the enlargement of interpretative processes allied to the discovery by Society of the obligation of a pronouncement by the Judiciary when provoked, has taken many actors to intent their litigations, with the finality to have the implementation of rights that has been constiucionalized and should be operacionalized through public politics. The judicialization of the politic and of the social relationships enhanced by the expansion of the access to justice and by the political opportunity created in the process of redemocratization, extended the action of Judiciary to all social life areas, transforming it in a new political arena, and at the same time, stimulating many actors to use this proceeding to fight their rights. The judicialization os social rights, specially health and education, had transferred the discussions about public politics at Executive to the Judiciary, making this Power decide about subjects that were restricted to Public Administration before. In education, the judicialization is happening in all teaching levels and federal universities. It ended up being intensified by the process of expansion and democratization of superior education. The Right to superior education has always been enjoyed by the richest ones, but the institution of public politics in superior education is democratizating and enlargening the access to this level of education to the rest of the population. In this context, the federal universities had been object of social trasnformation, for they are implementing politics that are destinated to democratize the superior education and make easier the access of actors that were previously excluded from this process. In Federal Universities, the judicialization has occurred in offering public service to education, with actions that questions its burocracy, as well in public politics from access that are being implemented by them. Most of these actions found in this research had been made by individual actors fighting for a place in these teaching institutions.

No diagnóstico de borreliose de Lyme, infecção sub-diagnosticada em Portugal, o apoio laboratorial é crucial para o tratamento atempado dos doentes, sob risco destes evoluírem para fases crónicas, resistentes à terapêutica. A difícil confirmação do agente etiológico através da cultura, aliada ao conhecimento actual sobre as elevadas taxas de falsos negativos nos testes serológicos de rastreio, bem como de casos seronegativos de doença, torna da maior importância a implementação da nova tecnologia de amplificação (PCR) de DNA borreliano no diagnóstico de rotina desta patologia. Tratando-se de uma técnica mais rápida e sensível tem-se revelado de maior sucesso do que a cultura. O presente trabalho compara a sensibilidade destas duas técnicas de detecção directa dos agentes do complexo Borrelia burgdorferi sensu lato, em 96 doentes com suspeita clínica desta afecção e em 569 vectores (ixodídeos) capturados em território nacional. Obteve-se o isolamento de borrélias em 1,3% das biópsias cutâneas e em 1,2% dos ixodídeos (carraças) não se tendo registado isolados noutros materiais biológicos humanos. A aplicação da técnica de nested PCR confirmou a presença de DNA de B. burgdorferi sensu lato em 24,8% das amostras analisadas. A identificação dos agentes patogénicos, por técnicas de hibridação (Reverse Line Blot), sequenciação e/ou RFLP, revelou a presença de quatro espécies genómicas: B. garinii, B. lusitaniae, B. valaisiana e B. afzelii. Em conclusão, a amplificação de DNA borreliano permite uma resposta mais rápida e sensível do que a cultura, contribuindo para um diagnóstico laboratorial mais eficaz da borreliose de Lyme humana. Lyme borreliosis (LB) is an under-diagnosed zoonosis in Portugal, specially due to the absence of specific clinical signs. The role of the laboratory diagnosis, together with an epidemiological information, is extremely important for the correct treatment of patients with this pathology. The sensitivity of two laboratory techniques (culture and DNA amplification by nested PCR) for direct detection of Borrelia burgdorferi sensu lato complex agents was evaluated in samples from 96 clinically suspected patients, as also in 569 vector ticks collected throughout Portugal. Borrelia genospecies were identified in 1.3% of the skin biopsies and in 1.2% of the vectors, after growth in selective culture medium (BSK). No growth was obtained from other type of samples. B.burgdorferi sensu lato DNA was present in 24.8% of analyzed samples, as per intergenic rRNA 5S-23S (rrf–rrl) spacer amplification by nested PCR. Four genomic species (B.garinii, B.lusitaniae, B.valaisiana and B.afzelii) were identified by DNA hybridization (Reverse-Line-Blot), sequencing and/or RFLP. In conclusion and taking into account the results found in this study, it seems that Borrelia DNA amplification technique is quicker and present higher sensitivity than culture, providing a more effective laboratory diagnosis of LB in human populations and in vectors. published

- Abstract
Background: Borrelia lusitaniae was isolated from an Ixodes ricinus tick in Portugal in 1993 for the first time. Further, this borrelia genospecies has been found in ixodid ticks collected around the coasts of southern Portugal and North Africa. Its reservoir has not been defined yet. B. lusitaniae was isolated once until now from a patient with a long standing and expanding skin disorder., Patient and Methods: A 46-year-old Portuguese woman presented with a skin lesion on the left thigh which had evolved slowly over ten years. The patient reported limb paraesthesias, cramps, chronic headaches, and cardiac rhythm disturbances. History of tick bites was negative nor had the patient ever noticed a skin lesion comparable with erythema chronicum migrans. Skin biopsies were taken for histological evaluation, culture and DNA detection. Antibodies to borrelia were searched by indirect immunofluorescence assay and Western-blot., Results: A bilateral carpal tunnel syndrome and local synovitis was diagnosed. Dermato-histology was normal, serology was negative. Spirochaetal organisms were cultured from a skin biopsy and identified as B. lusitaniae. The patient improved after a 2-week course of intravenous ceftriaxone; the skin lesions did not expand further., Conclusions: This culture confirmed skin infection by B. lusitaniae in a patient from Portugal suggests an additional human pathogen out of the B. burgdorferi sensu lato complex in Europe, particularly in Portugal.
