3. Student Performance in the Legal Environment Course: Determinants and Comparisons

Abstract

Finding reliable determinants to successful performance of students has long been an important topic in business education literature. The quest to determine why some students succeed and others fail has driven a great deal of research in both the education and business literature. This area of inquiry is related to assessment of student performance, a topic that has been given increased scrutiny in recent years. This intensified scrutiny of student performance is due to pressure of legislative calls for increased accountability from postsecondary educators. A review of the literature on predictors of success in business disciplines finds rich threads of research in accounting, economics, and finance that attempt to discover characteristics of students who thrive in these disciplines. To date, though, there have been no studies examining students of legal studies in business, a surprising void given the importance of legal studies to business education. This article reports on the relationships between student characteristics and student performance in a required upper division undergraduate legal environment of business course. It begins with a literature review and is then followed by a discussion of the data set, the methodology, and the results. The conclusion includes a discussion of the findings and their implication on legal instructors in business schools. (Contains 4 tables and 44 footnotes.)

16. Monitoring Microemboli During Cardiopulmonary Bypass with the EDAC® Quantifier

Abstract

Gaseous emboli may be introduced into the bypass circuit both from the surgical field and during perfusionist interventions. While circuits provide good protection against massive air embolism, they do not remove gaseous microemboli (GME) from the bypass circuit. The purpose of this preliminary study is to assess the incidence of GME during bypass surgery and determine if increased GME counts were associated with specific events during bypass surgery. In 30 cases divided between 15 coronary artery bypass grafts and 15 valve repairs, GME were counted and sized at the three locations on the bypass circuit using the EDAC® Quantifier (Luna Innovations, Roanoke, VA). A mean of 45,276 GME were detected after the arterial line filter during these 30 cases, with significantly more detected (p = .04) post filter during valve cases (mean = 72,137 ± 22,113) than coronary artery bypass graft cases (mean = 18,416 ± 7831). GME detected post filter were significantly correlated in time with counts detected in the venous line (p < .001). Specific events associated with high counts included the initiation of cardiopulmonary bypass, heart manipulations, insertion and removal of clamps, and the administration of drugs. Global factors associated with increased counts post filter included higher venous line counts and higher post reservoir/bubble trap counts. The mean number of microemboli detected during bypass surgery was much higher than reported in other studies of emboli incidence, most likely due to the increased sensitivity of the EDAC® Quantifier compared to other detection modalities. The results furthermore suggest the need for further study of the clinical significance of these microemboli and what practices may be used to reduce GME incidence. Increased in vitro testing of the air handling capability of different circuit designs, along with more clinical studies assessing best clinical practices for reducing GME activity, is recommended.

As one of the poorest countries in the world, Somalia continues to struggle due to a weak government, committed insurgency, and a dysfunctional counterinsurgency strategy. The international community, led by the U.S., has attempted to address Somalia's problems with limited success. This research project applies both qualitative and quantitative methods in addressing the primary research question: Are U.S. policies towards Somalia effective? The results are arresting: analysis reveals that U.S. policies during the Cold War and early years of our government's War on Terrorism may have led to the creation of Al Shabaab. Analysis also indicates that Al Shabaab possesses a strong organizational profile and that it will be difficult to eliminate in comparison to other terrorist organizations. Among other findings, research demonstrates that America and its allies must provide significantly increased resources to overall counterinsurgent strength if a military focused solution is to be pursued. However, research also reveals that a military focused solution is not the best fit for confronting Al Shabaab. A more patient and consistent policy approach oriented primarily on non-military methods (diplomatic, information, and economic) may provide the best chance of success against Al Shabaab.

Abstract

This two-part paper presents a case study related to the development andevaluation of warning labels for a class of products known as personal watercraft(pwcs). These two papers serve as an example application of a general process[sup 1] for developing and evaluating safety information. Part 1, presentedin the companion paper,[sup 2] describes the process of project planning,identifying and analyzing potential hazards, and developing two preliminarywarning labels to address pwc operational hazards. Part 2, the present article,describes the process of evaluating and revising the preliminary labels toproduce the final iterations. In all, eleven iterations of the labeling wereproduced and evaluated. Evaluation took many forms including seeking inputfrom various parties with special expertise, assessing the ease with whichwords and phrases were understood, and assessing the extent to which peopleunderstood the concepts being conveyed by the labels. The results demonstratedthat the various components of the final version of the labels were comprehendedat rates that ranged from 96.3% to 100%. As a result of the work describedin these papers, revised labels for pwcs with increased uniformity will beused by pwc manufacturers, although flexibility for specific model featuresor future changes in design will be retained. Abstract

This two-part paper presents a comprehensive case study related to the development and evaluation of warning labels. In particular, this two-part paper describes the development and evaluation of revised warning labels applicable to a class of products known as personal watercraft (pwcs), and serves as an example application of a general warnings design process described by Frantz et al.1 Part 1, presented in this paper, includes the process of project planning, identifying and analyzing hazards, and developing two preliminary warning labels to address pwc operational hazards. Included are discussions regarding the methods used to address problems frequently encountered in the development of warning labels. Topics of these discussions include the prioritization and selection of hazards to be addressed, message development strategies, avoiding information overload, and organizing the presentation of information using human factors models and concepts. The work conducted in Part 1 resulted in two preliminary labels: one label dealing with issues related to Collision Avoidance and a second label dealing with General Operational Hazards. Part 2, the companion article,2 describes the process of evaluating and revising the preliminary labeling to produce the final labels. Discussions regarding the methods used to address challenges related to the evaluation and revision of warning labels are provided. As a result of the entire process, revised labels for pwcs with increased uniformity will be used by pwc manufacturers, although flexibility for specific model features or future changes in design will be retained.
