Abstract

This case comment contains an analysis of the judgment of the Competition Court in Warsaw (SOKiK) of 12 May 2022 (XVII AmA 61/21). This ruling was issued as a result of an appeal filed by Agora against the decision of the Polish NCA, the President of UOKiK (DKK-1/2021) that had prohibited a concentration whereby Agora intended to acquire control over Eurozet. The judgment is interesting in particular because of its in-depth analysis of the prerequisites for the existence of a collective dominant position, the issue of coordinated effects, and the burden of proof in competition law cases. This case comment largely approves of SOKiK’s reasoning in the said case and values the clarity and comprehensiveness of the reasoning where the Court did not shy away from making a complex analysis of an economic and market nature.

Abstract

This article offers a critical assessment of the European Court of Human Rights’ Judgment in the case J.C. and others v Belgium, the first pronouncement of an international court concerning the jurisdictional immunity of the Holy See. Rendered in a case concerning sexual abuse within the Catholic Church, the decision raises a number of relevant questions concerning the application of State immunity to a non-state actor and its impact on the right to have access to a court. The article discusses the legal status of the Holy See and whether it enjoys state immunity under international law, focusing on the distinction between sovereign and private acts, and the possibility to qualify the members of the clergy as agents of the Holy See for the purpose of the territorial tort exception. It also discusses how granting immunity to the Holy See may frustrate the attempts of the victims to make the apical organs of the Church accountable for their handling of sex abuse scandals.

Abstract

In two decisions of 2019, the Dutch courts have come up with novel interpretations of the ‘control-based’ standard of attribution in the international law of State responsibility. This is a standard of attribution that is laid down in Article 8 of the International Law Commission‘s (ILC) Articles on the Responsibility of States for Internationally Wrongful Acts (ARSIWA), which is, by and large, reflective of customary international law. The traditional understanding of Article 8 ARSIWA is that it applies to relations between States and private persons or entities, in particular armed groups: conduct of a non-State armed group is attributed to a State to the extent that the State exercises control over that group. However, the Dutch courts have extended the scope of application of Article 8 ARSIWA to conduct of organs of international organisations (the UN) as well as foreign States ('i.e.', States other than the Netherlands). Internationally speaking, this is a novel interpretation of Article 8 ARSIWA, for which there are no precedents. After introducing the Dutch courts’ reasoning in these cases, the contribution zooms out and inquires what the Dutch evolutions imply for the development of the controlbased attribution standard in the international law of State responsibility. The author argues that the relatively peculiar interpretation of Article 8 ARSIWA, as applying to interactions between States and international organisations and between States inter se, is practically viable in a narrow range of scenarios characterised by relatively strong politico-military relations and hierarchies.

Abstract

In a resolution adopted on 1 February 2018, the European Committee of the Regions noted that a legislative proposal of the European Commission concerning a Regulation that changes the rules governing the EU regional funds for 2014-2020 did not comply with the principle of subsidiarity. Accordingly, the Committee considered challenging the legislative proposal before the Court of Justice if the proposal was formally agreed upon. Although at a later stage the European Commission decided to take into account the Committee’s argument and amended the proposal accordingly, such a context offers the chance to investigate more in detail the role of the Committee of the Regions in the legislative process of the EU and, more in particular, its role as a watchdog of the principle of subsidiarity. This paper aims to shed light on a rather neglected aspect of the EU constitutional practice, such as the potential of the Committee of the Regions to contribute to the legislative process, and answer the question of whether this Committee is the right body to guarantee compliance with the principle of subsidiarity.

Abstract

Richtlijn 2004/38/EG legt de voorwaarden vast waaronder EU-burgers van hun vrij verkeer gebruik kunnen maken in de EU. Voor economisch niet-actieve EU-burgers zijn bijvoorbeeld specifieke voorwaarden verbonden aan hun verblijf. In het bijzonder gaat het om het hebben van voldoende bestaansmiddelen alsmede het hebben van een dekkende zorgverzekering. Waar het Hof van Justitie in de afgelopen jaren enkele belangrijke uitspraken heeft gedaan over de bestaansmiddeleneis, doet het in de zaak A uitspraak over de zorgverzekeringseis. Deze bijdrage analyseert het nieuwste arrest van het Hof van Justitie in het licht van het geldende Europese recht en rechtspraak. Abstract

The Anthropocene requires of us to rethink global governance challenges and effective responses with a more holistic understanding of the earth system as a single intertwined social-ecological system. Law, in particular, will have to embrace such a holistic earth system perspective in order to deal more effectively with the Anthropocene's predicaments. While a growing number of scholars have tried to reimagine law and legal scholarship in a more holistic way, these attempts remain siloed. What is required is a shared epistemic framework to enable and enhance collaborative intradisciplinary and interdisciplinary research and co-learning that go hand in hand with thorough transdisciplinary stakeholder engagement. We argue that the nascent concept of earth system law offers such an overarching epistemic framework. This article serves as an invitation to fellow explorers from various legal fields, other disciplines, and from a wide range of stakeholders to explore new frontiers in earth system law. Our aim is to further stimulate the study of earth system law, and to encourage collaboration and co-learning in a fertile epistemic space that we share.

Abstract

Exclusionary innovation poses a bigger threat to competition in digital platform markets than in other innovation markets given the relevance of data-driven network effects as well as the strong incentive and ability of digital platforms to pursue an envelopment strategy. This paper advocates a theory of harm called “platform-wide exclusionary innovation” which applies to conduct that plausibly creates short-term consumer benefit but is more likely to foreclose rivals and therefore reduce technological progress in the long run. This theory of harm can help to explain Google’s conduct that the European Commission condemned in its three decisions against Google between 2017 and 2019. Due to interconnections between Google’s practices in the three cases this article assesses whether they may be considered jointly for the purpose of finding of an infringement of Article 102 TFEU or under the proposed Digital Markets Act.

Abstract

Evidence-based policymaking has become crucial in the area of asylum. In an attempt to offer a critical overview of the role and weight of ‘evidence’ in the current phase of reform of the Common European Asylum System (CEAS), this article illustrates how evidence-based policymaking in EU asylum law presents a number of pitfalls. Lack of a full impact assessment, instrumentalization of data and oversimplification of the available evidence, adversely impact the effectiveness of the CEAS. Conversely, the article aims to unfold the potential that the use of evidence may have in improving the quality of the EU legislation, by reflecting on its impact on migrants. The article will, therefore, propose that the use of evidence from a user’s perspective, namely from the point of view of those subjects that are mostly affected by the legislation, can contribute to the teleological effectiveness of the CEAS: ensuring adequate protection for third-country nationals in need for it.

Abstract

National sovereignty has been the key consideration for basing judicial cooperation in the European Union on mutual recognition. More than one decade after the creation of the Area of Freedom Security and Justice (AFSJ), this contribution assesses whether mutual recognition-based EU legislation in civil and criminal law indeed respects national sovereignty. To this end, it studies the Framework decision on the European Arrest Warrant (EAW), the EU’s flagship instrument in the AFSJ. We distinguish two elements of national sovereignty: (a) the protection of the State and its basic structures (its statehood); (b) the State’s values, principles and fundamental rights (its statehood principles), and assess the EAW from a dynamic perspective: from its initial inception, in which mutual trust primarily implied little interferences with the laws and practices of issuing states, to the current state of affairs which is marked by what could be called a ‘mutual trust supported by harmonization’- approach. Especially in the judge-driven harmonization of the EAW and the dialogue between judicial authorities we witness important (and oftentimes overlooked) elements that impact national sovereignty. At the end, the findings of the article are put in the context of the current rule of law crisis in the EU.
