The General Data Protection Regulation has the main purpose of protecting personal data and ensuring the free flow of this data within the European Union. However, uniform application of the regulation across all Member States is essential to guarantee its effectiveness. In its 2020 report on the application of the regulation, the European Commission pointed out that there are significant differences between the procedures applied by national data protection authorities. These procedural differences constitute an obstacle to the harmonious and efficient functioning of the cooperation and dispute resolution mechanisms provided for in the regulation. These discrepancies can lead to legal uncertainties and uneven application of the regulation in different Member States, which undermines confidence in the data protection system at European level and can negatively affect both individuals and organizations operating across borders.
