CRIMINAL jurisdiction , *CRIMINAL sentencing , *EQUALITY , *BLINDNESS , *CUSTODIAL sentences - Abstract
Courts in many jurisdictions remain indifferent to criticisms for their overly harsh or unequal treatments. There has been a debate whether this is attributed to judges' individual dispositions or rather their environments. This article contributes to this debate by offering evidence from Thai courts about their indifference to inequality generated by the wealth-insensitive fine and fine-default custody. It argues that judges are situationally driven to adopt rigid framing about justice when performing duties, as a result of which judges develop indifference to the 'side-effects' of their frame-influenced decisions. The findings imply the possibility that the same mechanisms may exist in other jurisdictions and underline the need to address indifference to prevent failure in reforming for a more egalitarian system. Abstract This study explores the following theoretical research question: How can business ethics help to reframe corporate sustainability strategies? This paper’s contribution to corporate sustainability (CS) theory is the interconnection of concepts and models from disparate fields of thought, addressing gaps of perception that can impair the development of CS strategies. This paper’s main result is a comprehensive and articulated framework that links the societal level of sustainability to the organizational dimension of CS and the individual dimension of managers’ moral orientation. The framework reinforces the perception that business ethics driven by a normative orientation could improve CS results when supported by an organizational culture that allows reversing ethical blindness.

BUSINESS ethics , *JOB involvement - Abstract
Ethical blindness means that people who take responsibility for decision-making unknowingly engage in unethical behavior. Due to the need for a valid and reliable measurement tool in the national literature, studies in the field of ethics are considered insufficient. In the study, it is aimed to bring the Ethical Blindness at Work scale developed by Aleksić (2017) into Turkish literature. The relevant scale is analyzed in terms of scope, construct and criterion validity recommended in adaptation studies. First, the scale items re adapted to Turkish. Then, the scale is finalized by examining the internal consistency ratio (a<0.70) and item-total correlation values (r>0.30) with the help of a pilot study. The questionnaire form, which is prepared with the final form of the scale, is applied to employees in different sectors. Data from 550 participants are analyzed. The results show that the scale has a three-factor structure: "rationalization", "routine" and "ignorance" in accordance with its original structure. In addition, within the scope of criterion validity, the relationship between the scale of Ethical Blindness in the Workplace and other structures is examined by using the scale of work engagement and emotional commitment scale. Considering all the results, it can be said that the Ethical Blindness Scale at Work is a valid and reliable measurement tool that can be used in the Turkish literature. [ABSTRACT FROM AUTHOR]

ETHICAL decision making ,EXPLORATORY factor analysis ,MORAL development ,CONFIRMATORY factor analysis ,LITERATURE reviews - Abstract
Recent models of ethical decision making have underlined the influence of unconscious processes of unethical behavior, and ethical blindness has been identified as a construct that deepens the understanding of unintentional unethical behavior. However, to date, no empirically tested measure of ethical blindness exists. Consequently, we have explored and developed a tool for measuring ethical blindness, which is presented in this paper. Based on qualitative data from interviews with individuals employed in different industries and a literature review, we developed a multidimensional measure of ethical blindness. The measure was tested and validated in several consecutive steps on three quantitative data sets. Exploratory factor analysis generated three factors (rationalization, routine, and ambiguity) comprising 12 items of ethical blindness. Confirmatory factor analysis verified that the three-factor structure had an acceptable fit. The dimensions displayed good internal reliability. Preliminary evidence of construct and discriminant validity was also provided. The paper discusses the practical implications and future research. [ABSTRACT FROM AUTHOR]

The articles comprising this thematic symposium suggest options for exploring the nexus between freedom and unfreedom, as exemplified by the British abolitionists' anti-slavery campaign and the paradox of freedom. Each article has implications for how these abolitionists achieved their goals, social activists' efforts to secure reparations for slave ancestors, and modern slavery (e.g., human trafficking). We present the abolitionists' undertaking as a marketing campaign, highlighting the role of instilling moral agency and indignation through re-humanizing the dehumanized. Despite this campaign's eventual success, its post-emancipation phase illustrates a paradox of freedom. After introducing mystification as an explanation for the obscuring rhetoric used to conceal post-emancipation violations of freedom during the West's colonial phase, we briefly discuss the appropriateness of reparations. Finally, we discuss the contributions made by the articles in this thematic symposium. [ABSTRACT FROM AUTHOR]

Double-blind peer review is widespread in research and publishing activities. The procedure for double-blind peer review is regulated by local acts of publishers, codes of publication ethics, etc. However, there are a number of moral problems that arise in the process of double-blind peer review: the impossibility of ensuring the "blindness" of peer review, conflict of interest, peer review of articles authored by members of the editorial board, and a number of others. To eliminate the ethical blindness of double-blind peer review, it is necessary to develop and introduce into the practice of reviewing new norms that are of a compromise nature. Currently, such methods are proposed as the creation of international databases of reviewers, the deanonymization of experts after the publication of the manuscript, the use of automated intelligent systems to ensure maximum objectivity in the selection of reviewers. However, it seems equally promising to form a comfortable working environment that provides a diversity of opinions and guarantees of academic freedom, as well as training reviewers to work with frames that interfere with moral decision making.

The current situation of the biomedical sciences is critically discussed. It can be summarized as follows: 1. We have to acknowledge the presence of a serious credibility problem, which might undermine the foundations of medical science. ("Sliding on a slippery slope") 2. Multiple forces going beyond simple conflicts of interest push medical science further down the slippery slope. ("Who is pushing?") 3. The public awareness of something seriously wrong with medical science is mounting on all levels of our multimedia society. ("Looking into the media mirror") 4. Technical corrective measures may be easily implemented, however, to change an expanding and "successful" science culture actually destroying it's own foundations will need a sustained effort by the medical and scientific community on all levels. ("Look away - or act?")

BUSINESS ethics , *PROFESSIONAL ethics - Abstract
Much like the example of David and Nathan in 2 Samuel 11-12 demonstrated, moral lapses victimize the entire organization, and members often persist in ethical misconduct without full comprehension of the gravity of their actions. As an antidote, organizational members must be vigilant and resolute in watching for the signs of ethical degradation, forming a noticing organization. however, as opposed to confronting ethical misconduct head-on, dialogical leadership, encompassing a trinitarian perspective, attempts to preserve the fabric of community through strategic narrative and transparent dialogue aimed at raising ethical awareness and inhibiting unethical behavior. Ethical blindness describes the temporary inability of a person to make moral judgments and acting morally in the context of working in an organization. Such a failure of moral judgment can be harmful and may damage the entire organization, its reputation, and public legitimacy. This chapter provides both an introductory overview and definition of the theory of “ethical blindness.” The chapter proceeds by first introducing to the general social phenomenon of ethical blindness. Then it presents the specific theory of ethical blindness proposed by Palazzo et al. (J Bus Ethics 109:323–338, 2012). The structure is as follows: First, the chapter shows how the theory relies on an epistemology of individuals’ cognitive propensity to be fallible in combination with a theory of individual “sensemaking” and “framing.” The sensemaking process is under external pressure from social contexts within the organization and its surrounding society. The possible outcome of inflexible and too “rigid framing” is ethical blindness – an incapacity to be sensitive to moral demands elicited by the situation. Second, the normative aspect of the theory is outlined to argue for a pluralistic democratizing of the business organization as a means to prevent ethical blindness in the organization. The theory of political CSR is suggested as a means to secure business legitimacy and counteract ethical blindness in organizations. Finally, the chapter concludes with a brief discussion of the practical usages of the theory of ethical blindness as a possible template for a tool to educate employees to withstand pressures that might lead to harmful ethical blindness in the working place.

In today's information and technology era, in order to have competitive advantage, using modern management methods instead of traditional ones is very important for establishments. Otherwise, it is seen that the probability of contracting enterprise disease increases. Managers suffering from organizational blindness could not find solution to problems, lag behind technological innovations and therefore they cause enterprises have difficulties in the long or the short term. On the other hand, managers suffering organizational silence remain silent by not telling their anxieties over their enterprises and actions. Organizational learning and educational and developmental activities having supportive qualities which enable employees generating innovational ideas and sharing them with their enterprises and which avail on offering solutions to probable difficulties, are used for enterprises who are serving individuals to develop themselves. Within the scope of the purposes of this study, the effects of education and development on organizational blindness, organizational silence and organizational learning; the effects of organizational learning on organizational blindness and organizational silence; the effects of organizational silence on organizational on organizational blindness have been analyzed and it is ascertained that they have a positive and significant relationship between each other. Moreover, it is confirmed that the organizational learning has a full mediating role on the effect of educational and developmental activities on organizational blindness, and the organizational learning has a semi mediating role on the effect of educational and developmental activities on organizational silence. 105

Workplaces are the places where an employee spends considerably amount of his/her working hours during daily time. Any factor during the process may affect the overall productivity, conformity of employee to his/her company. In addition to this, nowadays, growing number of companies show their interest in ethics. The emotional situations and attitudes of the employees tend to be changed before and after having been accepted into a specific position. Either these changes can be occured automatically or those changes might cause from having some blind spots.Ethical Blindness is a kind of situation that the employees act unethical in several conditions without being aware of it. There are three factors that constitute ethical blindness; these are, the rationalization, routinization and ambiguity factors. Therefore, Organizational Citizenship Behavior is the volunteerly contributions to the organization by employees. Organizational citizenship behavior has been analyzed in the literature in detail. In this research, the influence of Ethical Blindness regarding the constructing factors of rationalization, routinization and ambiguity factors on Organizational Citizenship Behavior has been studied. While measuring the influence of Ethical Blindness on Organizational Citizenship Behavior in organizations; for the Ethical Blindness section, the vignette method has been preferred. There were three vignettes including rationalization, routinization and ambiguity factors has been presented to the participants. They were asked to put themselves in the vignette's main character's position then evaluate the statements accordingly. In addition, for the Organizational Citizenship Behavior section, a scale developed by Basım and Şeşen (2006) has been preferred to use including five dimensions of OCB; altruism, conscientiousness, courtesy, civic virtue and sportsmanship dimensions. 132

There is an old debate on the liberating function, or not, of visual communication technologies. Originally the question was focused on the role of film and photography for the social and cultural relations. Walter Benjamin and Theodor Adorno are the precursors of these investigations, and, to some extent, Guy Debord, Jean Baudrillard and Paul Virilio as heirs. From the dialogue with these authors, we will construct a reflection on the ethical blindness to which we return also the observations of Gabriel Marcel and Martin Buber, seeking to understand the links between television, the violence of the images and ethical behavior in contemporary society. - Abstract
This paper seeks to explain how organizational corruption can shift from a condition in which the individuals involved should have 'known better' to one in which they did not 'know any different'. Drawing on an qualitative study of Greek managers in the public and private sectors, we argue that in some cases the 'reference point' that actors use to gauge organizational wrongdoing can shift to such an extent that individuals no longer see their criminal behavior as ethically wrong. How does this reference point shift? We suggest that answering this question is critical for explaining corruption in organizations today and devising measures to curb it. [ABSTRACT FROM AUTHOR]
