Los principales fundamentos intelectuales del Derecho y del Estado desde el punto de vista de la filosofía jurídica nacionalsocialista, elaborados por el conocido jurista alemán Carl Schmitt. El presente trabajo aborda, entre otros, algunos escritos de Schmitt que fueron redactados durante su etapa de filiación al partido nazi. Se analizará la formulación de la teoría del estado totalitario schmittiano o el "Führerstaat" partiendo de su conocida dialéctica amigo-enemigo, y la aplicación de dicha teoría totalitaria como justificación de los crímenes cometidos durante la noche de los cuchillos largos. El papel y relevancia de la figura del mundo académico en la fundamentación y legitimación de la represión estatal realizada por el régimen nazi. The main intellectual foundations of the law and the State made from the point of the National Socialist legal philosophy, made by the famous german jurist Carl Schmitt. This work addresses, among others, some of Schmitt's writings which were written during his affiliation with the Nazi party. It will be analyzed the formulation of the Schmittianian totalitarian state theory or the "Führer State" based on its well-known friend-enemy dialectic, and the application of this totalitarian theory as a justification for the crimes committed during the night of the long knives. Este projeto de dissertação reflete sobre a instrumentalização dos corpos sobretudo o corpo feminino, na Alemanha nazi (1933 - 1945). Essa análise será feita através de determinados elementos visuais como o cinema de Leni Riefenstahl e o design gráfico das revistas Bund Deutscher Mädel (BDM), examinando-os como elementos-chave de propaganda e normalização dos discursos e ações do Terceiro Reich. A atenção à dimensão estética como recurso para moldar e doutrinar a sociedade durante a construção da ideia de nação do estado totalitário é um dos pontos de abordagem deste documento. A reflexão parte da questão: de que forma certas ideologias e ideais estéticos moldam a mente e o corpo da sociedade? Na verdade, veremos como a estetização pode camuflar e ajudar a normalizar de ações violentas e discurso de ódio. O legado do Terceiro Reich, ao nível discursivo e estético permanece até agora. Quantas histórias distópicas parecem ter inspiração em acontecimentos reais? A análise e identificação de determinados valores estéticos, que idealizaram e normalizaram os corpos através da propaganda e artes visuais, permitem refletir sobre os ecos desse regime, transcendendo no tempo e evidentes na ficção e realidade contemporânea. This dissertation project reflects on the instrumentalization of bodies, especially the female body, in Nazi Germany (1933 - 1945). This analysis will be done through certain visual elements such as Leni Riefenstahl's cinema and the graphic design of the Bund Deutscher Mädel (BDM) magazines, examining them as key elements of propaganda and normalization of the Third Reich's speeches and actions. Attention to the aesthetic dimension as a resource to shape and indoctrinate society during the construction of the nation's idea of the totalitarian state is one of the points of approach in this document. The reflection starts from the question: how do certain ideologies and aesthetic ideals shape the mind and body of society? In fact, we will see how aesthetics can camouflage and help normalize violent actions and hate speech. The legacy of the Third Reich, at the discursive and aesthetic level, remains until now. How many dystopian stories seem to be inspired by real events? The analysis and identification of certain aesthetic values, which idealized and normalized bodies through advertising and visual arts, allow us to reflect on the echoes of this regime, transcending time and evident in fiction and contemporary reality.

O contrato social garante o homem enquanto cidadão livre, funcionando como fim último, como a própria garantia da humanidade de cada um, valorizando o ser humano e os princípios republicanos. Assim, o contrato é um verdadeiro consenso em torno do bem-comum, tendo o povo por soberano, e a justiça por objetivo.

Què passa quan una obra literària s'oposa i resisteix a un estat totalitari? Intentar respondre aquest interrogant i trobar respostes vàlides que ens permetin valorar en la seva justa dimensió aquestes obres literàries es la finalitat d'aquest treball. Específicament a les obres “Fuera de juego” de Heberto Padilla i “Otras cartas a Milena” de Reina María Rodríguez, es pot apreciar una postura crítica i de resistència davant de la submissió a la que es va veure exposada la societat cubana a través de l'exercici del poder polític de forma autoritària, fent del discurs estètic i la obra, la millor ferramenta d'oposició i de resguard davant l'opressió de l'estat totalitari., What does happen when a literary work opposes and resists a totalitarian State? The main objective of this essay tries to answer or find valid responses to that question. Especially in the books, Fuera del juego by Heberto Padilla and Otras cartas a Milena by Reina Maria Rodriguez is evident that the authors stand in criticism and resistance against the subjugation of the Cuban society generated by the exercise of the totalitarian political power. As a result, the esthetic discourse and the literary work become the best alternative to oppose and be protected against the oppression in the totalitarian state., ¿Qué sucede cuando una obra literaria se opone y resiste a un estado totalitario? Intentar responder esta interrogante, y encontrar respuestas válidas que nos permitan valorar en su justa dimensión esas obras literarias es la finalidad de este trabajo. What this study proposes is, first, to state the essential questions the foundation of human rights. Secondly, we will answer to the problem of the theoretical, systematic and practical relevance of the foundation of human rights. It concludes with the idea of the need to base the rights from the ethics, philosophy of law, legal science and Sciences on the law as an instrument to consolidate the necessary link between theory and praxis and consequently as an instrument of guarantee rights. Lo que se propone este trabajo es, en primer lugar, enunciar las preguntas esenciales que plantea la fundamentación de los derechos humanos. En segundo lugar, responderemos al problema de la legitimidad teórica, sistemática y práctica de la fundamentación de los derechos humanos. Se concluye con la idea de la necesidad de fundamentar los derechos desde la Ética, la Filosofía del Derecho, la Ciencia Jurídica y las Ciencias sobre el Derecho como instrumento de consolidar la necesaria unión entre teoría y praxis y, consiguientemente, como instrumento de garantía de los derechos.

What this study proposes is, first, to state the essential questions the foundation of human rights.
