This article examines the extent to which personal characteristics of heads of lists differ from those of all other candidates. It draws upon an original dataset on the candidates to the Portuguese Parliament in five parliamentary elections between 1983 and 2009. The results reveal that candidates with public visibility – famous politicians, public figures, and candidates with more parliamentary experience – have a greater probability of being placed in the top positions of the lists than candidates having a prominent local profile. This pattern does not vary significantly when we consider district magnitude, type of party, or the amount of time since democratization., Este artigo investiga em que medida as características pessoais dos cabeças de lista diferem das dos outros candidatos, partindo de uma base de dados original sobre os candidatos à Assembleia da República, em cinco eleições legislativas entre 1983-2009. DL 57/2016/CP 1359/CT0023 UIDB/04647/2020 UIDP/04647/2020 Portugal adotou em 2006 a Lei da Paridade, que assegura uma representação mínima de cada sexo, não podendo nenhum dos sexos ocupar mais de duas posições consecutivas nas listas eleitorais. O artigo segue a abordagem Gender Equality Policy in Practice (GEPP) e visa aprofundar a compreensão do processo de adoção e implementação da Lei da Paridade em Portugal. Depois de mapear a forma como a lei foi implementada – incluindo uma descrição das ferramentas e instrumentos que foram criados e como se desenrolou na prática – é feita uma avaliação dos efeitos diretos da política, contribuindo para o debate sobre os indicadores de sucesso relacionados com as leis de quotas. Portugal adopted legislative quotas in 2006, passing the so-called Parity Law which specifies that candidate lists must include a minimum representation for each sex, and neither sex can occupy more than two consecutive positions in the candidate lists. This paper follows the Gender Equality Policy in Practice (GEPP) approach and aims to deepen our understanding of the adoption and implementation process of the Parity Law in Portugal. After mapping how the law was implemented in Portugal – including a description of the tools and instruments that were set up and how the process unfolded in practice – an assessment of the policy’s direct effects is carried out, contributing to the open debate on the indicators of success related to legislative quota laws. publishersversion published

A importância dessa Lei reside no fato de ela estabelecer as Diretrizes e Bases da Educação Nacional para incluir, no currículo oficial da rede de ensino, a obrigatoriedade da temática História e Cultura Afro-Brasileira, em todas as disciplinas, especialmente nas áreas de Educação Artística e de Literatura e História Brasileira. É uma pesquisa pautada em estudos etnográficos, teorias de análise do discurso, estudos sobre letramento e culturas negras. Com esses recursos tentar-se-á buscar possíveis explicações para uma quase ausência dos pressupostos da Lei no documento que regulamenta o ensino nos Colégios Militares pertencentes ao Exército Brasileiro e, consequentemente, no material didático e para didático adotados para o Ensino Fundamental. A partir dessa inquietação, esta pesquisadora procurou, ao assumir o 8º ano do Ensino Fundamental, estabelecer estratégias de leitura, debate e produção textual que propiciassem momentos de inserção da Lei 10.639/03. Selecionou-se para a realização da inserção as atividades de Grafite, manifestação do Movimento Hip-hop considerada uma forma de múltiplos letramentos, capaz de atrair o interesse de jovens estudantes do Ensino Fundamental de escolas públicas e/ou privadas porque lhes disponibilizam linguagens reveladoras de ideologias, conhecimentos e entendimentos de novas culturas, socializando pensamentos e ações que os levam a refletir sobre temas sociais, a fazer denúncias, a conscientizar o outro sobre um determinado tema. This is an intervention project, carried out with four classes from the 8th grade elementary school of the Military College of Salvador, which aimed to create strategies to effectively insert the assumptions of Law 10.639 / 03 in the Plans of Didactic Sequence (PSDs) of the discipline Portuguese Language. The importance of this Law lies in the fact that it establishes the Guidelines and Bases of National Education to include in the official curriculum of the education system the obligation of the History and Culture of Afro-Brazilian subjects in all disciplines, especially in the areas of Artistic Education And of Literature and Brazilian History. It is a research based on ethnographic studies, theories of discourse analysis, studies on literacy and black cultures. With these resources we will try to find possible explanations for a near absence of the presuppositions of the Law in the document that regulates the teaching in the Military Colleges belonging to the Brazilian Army and, consequently, in didactic and didactic material adopted for Elementary School. As a result of this uneasiness, this researcher sought to establish strategies for reading, debate and textual production that would lead to the insertion of Law 10.639 / 03. The activities of Graffiti, a manifestation of the Hip-Hop Movement considered as a form of multiple literatures, were selected to carry out the insertion, capable of attracting the interest of young elementary school students from public and / or private schools because they provide them with languages that reveal Ideologies, knowledge and understanding of new cultures, socializing thoughts and actions that lead them to reflect on social issues, to make denunciations, to make the other aware about a certain theme.

The present research project focuses on the link between descriptive and symbolic representation and seeks to understand what consequences a more proportional political environment produces on the attitudes of both underrepresented and overrepresented groups towards the political system. Women remain among the least politically represented groups and therefore this project focuses on and analyses them in various political positions. Two dimensions of the relationship between citizens and politics are analysed: the level of political engagement and the evaluation of the political system. While there is a clear gender gap in the former, the same does not apply to the latter. This dissertation reaches three important achievements. The first one is to develop the first theoretical framework of the potential causal mechanisms that are likely to operate behind the impact that female politicians have on both women and men. The second is to show that men can indeed be positively influenced but mainly to clarify that the way they evaluate the political system is nearly the only way they are affected – their level of political engagement does not change. The third achievement is to show that, while most scholarship has been focusing on the topic political involvement, the presence of female politicians seems to be more connected to the way women evaluate the political system. This means that the ‘role model effect’ is not the main mechanism at work here. Instead, the idea that the presence of women is necessary to represent women’s interests and the fact that they are seen as bringing something new into the political world appear more influential factors. Altogether the signs of the impact of the presence of female politicians are modest.

Dissertação de mestrado em Direito Judiciário (Direitos Processuais e Organização Judiciária), O recurso extraordinário de revisão de sentença penal, nomeadamente à luz da revisão operada pela Lei n.º 48/2007, de 29 de Agosto, se bem que conflitue com o valor do caso julgado, é um instrumento da justiça material que visa colmatar o erro judiciário. Mas como excepção que é da intangibilidade do caso julgado, apresenta requisitos apertados, como a análise do seu regime legal revela, ressaltando o elenco taxativo dos fundamentos que possibilitam tal revisão. Nota-se que o grande peso recai sobre decisões condenatórias apenas se admitindo revisão pro societate em duas situações, sendo que na revisão pro reo a ocorrência do erro judiciário assume maior gravidade, justificando-se, com maior premência, a excepção, constitucionalmente consagrada, ao princípio do ne bis in idem. Todas as situações contempladas no n.º 1 do art.º 449.º do CPP, e que podem fundar a revisão, suscitam dificuldades de interpretação que se impõe enfrentar e aprofundar. Acresce que a Lei n.º 48/2007, de 29 de Agosto, introduziu três novos fundamentos de revisão, ainda não suficientemente estudados na doutrina, mas objecto da atenção da jurisprudência, que suscitam questões que se prendem com a sua necessidade, o seu regime e mesmo a sua constitucionalidade e aos quais se presta toda a atenção. Parte-se da análise dos fundamentos, na letra da lei, nas considerações da doutrina e no estudo da jurisprudência do Supremo Tribunal de Justiça, que evidencia a sua complexidade em função da sua aplicação prática. Daí que se tenha procurado a sua decifração à luz da realidade judiciária, consideração que se estende, aliás, a vários outros aspectos do regime legal da revisão. A revisão sendo aparentemente um tema simples surpreende, afinal, pela sua complexidade face à segurança jurídica plasmada no caso julgado, e que não tem merecido a devida atenção que se não esgota, aliás, neste trabalho., Although conflicting with the merit of the tried case, the extraordinary appeal for review, under the review of Law nº 48/2007, dated August 29th, is instrumental for material justice which entails to reduce judiciary error. The legal standards for this review, as an exception to the intangibility of a tried case, demonstrate that it is possible only under narrow and taxing pre-requisites. The main criteria for the review fall mostly on condemnatory sentences and pro societate review it’s only allowed in two instances. In the pro reo review, the occurrence of judiciary error has more severe effects, which pressingly justifies the constitutionally guarded exception of the ne bis in idem principle. Every exception discussed in art.º 449.º of the Código de Processo Penal, which could lay the ground for the review appeal, generate interpretative difficulties and call for further discussion. In addition, Law nº 48/2007, of August 29th, has introduced three new grounds for the review which have not been sufficiently developed in doctrine and raise issues regarding their validity, applicability and even constitutionality. Jurisprudence is aware of this and it shall also remain under scrutiny throughout this study. Given that the complexity of this review is most obvious in its applicability, the analysis of the grounds for appeal undertaken in this essay will keep within the letter of the law, the doctrinal considerations and the jurisprudence of the Supremo Tribunal de Justiça. The analysis undertaken will also keep within the judiciary reality, which is the standard extended to other aspects of the legal proceedings of reviews. Although this review may appear to be a simple theme, it becomes surprisingly complex in the context of juridical safety of a tried case and begs further attention beyond the boundaries of this study.
