15. Legal bases in the European Union : an analysis of pre- and post-Lisbon conflicts across the pillars

Abstract

This thesis explores the structure of legal bases according to competences, instruments, and procedures; as well as legal basis litigation in the European Union before and after the introduction of the Treaty of Lisbon. Its main contribution lies in the analysis of general criteria for legal basis litigation as they have been developed under supranational EU law. It discovers several flaws inherited in the quest for the correct legal basis on the grounds of overlapping competences, divergent inter-institutional interests, and inconsistencies in the courts’ judgements. In addition, the previous pillar structure of the EU has also led to cross-pillar litigation which is particularly the case in the area of external relations. With the introduction of the Treaty of Lisbon, the previous pillar structure has been abolished and the former third pillar has been integrated into the realm of supranational EU law. While the intergovernmental sphere is thus minimised to the area of common foreign and security policy, legal basis conflicts will continue to occur between this area and the TFEU as well as within the TFEU itself. In addition, the Lisbon Treaty has even created new problems concerning the choice of the correct legal basis, most notably as regards the newly codified competence categories as well as the new hierarchy of legal instruments. This may require the development of new criteria for legal basis litigation in order to guarantee legal certainty in these areas for future cases.

16. Judicial Review in the Digital Era: Safeguarding the Rule of Law Through Added Safeguards?

Abstract

This article analyses the rule of law in the Digital Single Market with a particular focus on the recent Ligue des droits humains judgment (in case C-817/19), which deals with the PNR Directive (directive (EU) 2016/681). In that judgment, the CJEU essentially imposed additional safeguards on a legislative measure in an attempt to protect fundamental rights and the rule of law, rather than declaring that measure invalid. This indicates a shift in its approach to judicial review. On the one hand, this could weaken the rule of law where unfit legislation is judicially validated. On the other, the new approach might strengthen the rule of law by means of the added safeguards. This, however, raises further questions as regards legal certainty and the CJEU’s appropriation of quasi-legislative functions. As will be argued, such judicial powers may become both a blessing and a curse, in particular concerning the rather fast-paced Digital Single Market, where the legislator is often two steps behind. One potential benefit is that recent legislation in the digital field, such as the Digital Markets Act and the Digital Services Act, if legally challenged and found wanting, may be more likely to remain intact, which reduces the risk of a legislative void and legal uncertainty.

Abstract

Proceedings from EUI LAW Workshop "Deconstructing EU Federalism…" which took place in Florence on 14 June 2011. This paper is a collective endeavour to depart from the traditional view that a clear-cut separation of powers between the European Union and its Member States is one of the main features and one of the main safeguards of the European quasi-federalism. On the one hand, it is an effort to show the deep intertwining of EU and national powers in the actual course of European integration. On the other hand, it is an attempt to discover new legal and political safeguards to the development of EU federalism.
