Abstract

Lo studio affronta la risalente questione dell’ambito di applicazione dell’arbitrato in materia societaria, con particolare riferimento alle dispute che insorgono nelle s.p.a. e s.rl. L’A. constata le perduranti incertezze in ordine alla nozione di diritti disponibili rispetto alle controversie societarie, non superate neppure dai recenti interventi sulla materia. Dopo un esame degli orientamenti sviluppati dalla giurisprudenza e dalla dottrina nell’applicazione della disciplina speciale dell’arbitrato societario introdotta con il d.lgs. 5/2003, l’A. conclude per l’ammissibilità di una interpretazione estensiva della nozione di controversie arbitrabili nel contesto in esame. Inoltre, de iure condendo l’A. presenta anche argomenti a favore della compromettibilità delle controversie che insorgono nell’ambito di società che fanno ricorso al mercato del capitale di rischio, a condizione che siano adottate misure tali da non precludere in concreto ad alcuna tipologia di soci l’accesso alla procedura in questione.

Abstract

In this contribution, new data concerning the distribution of native vascular flora in Italy are presented. It includes new records, confirmations, exclusions, and status changes to the Italian administrative regions for taxa in the genera Artemisia, Chaetonychia, Cirsium, Cynanchum, Genista, Hieracium, Iberis, Melica, Misopates, Myosotis, Thalictrum, Trifolium, Utricularia, Veronica, and Vicia. Nomenclatural and distribution updates, published elsewhere, and corrigenda are provided as supplementary material.

Abstract

The inventory of the taxa collected during the annual field trip of the working group for Floristics, Systematics and Evolution of the Italian Botanical Society is reported. The field trip was held in 2016 along the Velino and Aterno valleys located between Lazio and Abruzzo administrative regions (central Italy). The flora documented for the studied area amounts to 629 specific and subspecific taxa (including two hybrids) belonging to 300 genera and 69 families. Thirty-eight taxa are endemic to Italy, and only 16 alien taxa were detected. Thirty-eight taxa are included in the IUCN Red List of the Italian Flora. Twenty-four taxa have to be considered as floristic novelties because either new or confirmed for the regional flora of Lazio or Abruzzo. In particular, 15 taxa are new and 6 are confirmed for Lazio. Regarding Abruzzo, 2 taxa are new for the regional flora and one is confirmed. Furthermore, the alien status in Lazio has been updated for one taxon.

Abstract

Despite the importance for scientific and conservation purposes, the knowledge of the Italian territory is far from exhaustive. New chorological data for 87 vascular taxa regarding the central-southern part of Italy and its two main islands (Sicilia and Sardegna) are presented. Among these taxa, Epilobium nummularifolium, Metrosideros excelsa, and Salvinia minima are recorded as casual aliens for the first time in Europe (excluding Azores and Madeira for M. excelsa), while Cyclamen balearicum and Polygala rupestris are reported for the first time and confirmed for Italian native flora, respectively. Furthermore, several taxa are new or confirmed at regional level. Finally, Lathyrus cirrhosus, Urginea fugax, and Linum tenuifolium are excluded from Italy, continental and peninsular Italy, and Sardegna, respectively.

Abstract

In order to improve the floristic knowledge of the Italian territory, we report the inventory of the taxa collected during the annual field trip of the working group for Floristics, Systematics and Evolution of the Italian Botanical Society held in 2015 in eastern Irpinia and Vulture-Melfese area (South Italy). The investigated territories are located in southern Apennines, along the border between the Campania and Basilicata administrative regions. These areas are scarcely known in terms of vascular flora. The floristic samplings were performed in 19 sites selected as representative of the local environmental diversity as regards to climate, litho-morphology and land-use. The research led to the identification of 4,137 specimens of vascular plants, belonging to 815 species and subspecies, 399 genera, and 85 families. Among these taxa, 42 were endemic to Italy, 38 were included in the IUCN Red List of the Italian Flora, 28 were alien and 5 were cryptogenic in Campania and/or Basilicata administrative regions. Two taxa, Aquilegia coerulea (casual alien, native to North America) and Lolium × boucheanum (native), were found to be new for Italy. On the basis of the available floristic literature the first one is also to be considered new for the European flora. At regional scale, we have found 18 taxa new for the Campania and 15 new for the Basilicata region. Finally, 10 taxa were confirmed for Campania. Data obtained during this study, confirmed the important role of a collaborative approach among botanists and the great relevance of these territories for plant diversity.

Abstract

In this paper, we focused our attention on the taxonomy and distribution in Italy of taxa belonging to Trifolium sect. Vesicastrum subsect. Mystillus. A short description of these closely related clovers, based on the study of fresh plant material, revision of herbarium specimens, and analysis of the relevant literature, is provided. Diagnostic features were highlighted by means of high-resolution digital images and, accordingly, an identification key is given. Trifolium spumosum, T. vesiculosum, T. mutabile and T. setiferum are reported to be distributed throughout Italy. We have updated the Italian distribution of the first three species by providing new occurrences from Tuscany, Umbria, Campania, Basilicata, and Calabria and by correcting previous references. The current presence of T. multistriatum in southern Italy is confirmed by our study, while T. setiferum must be excluded from the flora of Sicily. The study resulted in five new regional occurrences and 16 changes of presence status. Finally, intermediate forms between T. vesiculosum, T. multistriatum and T. mutabile were found both in living material and in the revised herbarium specimens.

Abstract

In 2014, the annual field trip of the working group for Floristics, Systematics, and Evolution of the Italian Botanical Society was held in Piemonte (northern Italy), at the head of the Po Valley. This valley, at whose extremity is located the Monviso (3,841 m a.s.l.), belongs to the Cottian Alps about which very little is known from a floristic point of view. An inventory of the taxa of vascular plants collected during the field trip is reported here. The research led to the identification of 3,546 exsiccata, kept in nine public and nine private collections. A total of 669 taxa belonging to 79 plant families were recorded. Six taxa resulted endemic to Italy and three exclusive to Piemonte, while only nine alien species were detected; six taxa are new and five confirmed for the regional flora.

Abstract

Surgery is a major stress factor that activates several inflammatory and catabolic pathways in man. An appropriate nutritional status allows the body to react properly to this stressor and recover in a faster and more efficient manner. On the other hand, malnutrition is related to a worse surgery outcome and to a higher prevalence of comorbidities and mortality. The aims of this study were to evaluate the nutritional status of patients undergoing major surgery and investigate the potential correlation between malnutrition and surgical outcomes.Mini Nutritional Assessment (MNA) and global clinical examination (including biochemical parameters and comorbidities existence) were undertaken in 50 consecutive patients undergoing major surgery. Patients' clinical conditions were re-evaluated at 3 and 6 days after surgery, recording biochemical parameters and systemic and/or wound-related complications.A compromised nutritional status was present in more than half (54%) of patients (malnutrition in 10% and risk of malnutrition in 44% of patients, respectively). Females were slightly more at risk of malnutrition (48% vs. 41%, p=NS, females vs. males) and clearly malnourished (14% vs. 7%, p0.05, females vs. males). Age was an independent risk factor for malnutrition and within the elders' group (80 years old) 16.70% of patients was diagnosed with malnutrition and 58.3% was at risk of malnutrition. Systemic complications were registered in all patients both at 3 and 6 days after surgery. However, well-nourished and at-risk of malnutrition patients had earlier complications that only partially resolved within six days after the operation. Malnourished patients showed fewer complications at the 3rd post-surgery follow-up day but had a worse outcome six days after surgery.Older age and but not female sex are independent risk factors for malnutrition development in patients undergoing major surgery. More interestingly, more than half of patients with an impaired nutritional status presented a less appropriated stress response to surgery. These data suggest that nutritional status assessment may be important to recognize patients at potential risk of surgical complications and that early nutritional interventions must be promptly arranged.

An updated inventory of the vascular flora alien to Italy, providing details on the occurrence at regional level, is presented. The checklist includes 1597 species, subspecies, and hybrids, distributed in 725 genera and 152 families; 2 taxa are lycophytes, 11 ferns and fern allies, 33 gymnosperms, and 1551 angiosperms. 157 taxa are archaeophytes and 1440 neophytes. The alien taxa currently established in Italy are 791 (570 naturalized and 221 invasive), while 705 taxa are casual aliens, 4 are not assessed, 7 are of unknown regional distribution, 47 have not been confirmed in recent times, 3 are considered extinct or possibly extinct in the country, and 40 are doubtfully occurring in Italy. This checklist allows to establish an up-to-date number (9792) of taxa constituting the whole (native and alien) Italian flora.

Abstract

The inventory of the taxa collected during the annual field trip of the working group for Floristics Systematics and Evolution of the Italian Botanical Society is reported. It was held in 2013 along the Maddalena Mountains a mountain ridge of the southern Apennines located between the Basilicata and Campania administrative regions (southern Italy) considered as being poorly characterized in terms of vascular flora. A total of 701 units belonging to 74 plant families were recorded including two varieties and four hybrids.Thirty-five taxa resulted endemic to Italy and only 11 alien species were detected while 36 taxa are new or confirmed for the regional floras of Basilicata and/or Campania. In particular 12 taxa are new for Basilicata while four are confirmed. Regarding Campania 14 taxa resulted new for the regional flora and five were confirmed.

Abstract

This work provides an overview of plant diversity in the municipality of Rome (Italy) through an assessment of the flora in urban and suburban sectors of the city. It is aimed at providing the knowledge required to support proactive action for plant conservation. On the basis of a literature-derived catalogue and of an extensive survey campaign, the flora was investigated in terms of conservation interest; habitat types and locations that require protection measures were identified according to the occurrence of valuable native plants. Valuable species exclusive of the urban sector are threatened by the compaction trend affecting the urban fabric. Such species occur mainly in ruderal environments and fallows of archaeological sites and urban parks, near river courses and in remnants of natural forests. Valuable species exclusive of the suburban sector are threatened by urban sprawl. Abstract

Context. At about 1000 days after the launch of Gaia we present the first Gaia data release, Gaia DR1, consisting of astrometry and photometry for over 1 billion sources brighter than magnitude 20.7. Aims. A summary of Gaia DR1 is presented along with illustrations of the scientific quality of the data, followed by a discussion of the limitations due to the preliminary nature of this release. Methods. The raw data collected by Gaia during the first 14 months of the mission have been processed by the Gaia Data Processing and Analysis Consortium (DPAC) and turned into an astrometric and photometric catalogue. Results. Gaia DR1 consists of three components: a primary astrometric data set which contains the positions, parallaxes, and mean proper motions for about 2 million of the brightest stars in common with the Hipparcos and Tycho-2 catalogues - a realisation of the Tycho-Gaia Astrometric Solution (TGAS) - and a secondary astrometric data set containing the positions for an additional 1.1 billion sources. The second component is the photometric data set, consisting of mean G-band magnitudes for all sources. The G-band light curves and the characteristics of ∼3000 Cepheid and RR Lyrae stars, observed at high cadence around the south ecliptic pole, form the third component. For the primary astrometric data set the typical uncertainty is about 0.3 mas for the positions and parallaxes, and about 1 mas yr-1 for the proper motions. A systematic component of ∼0.3 mas should be added to the parallax uncertainties. For the subset of ∼94 000 Hipparcos stars in the primary data set, the proper motions are much more precise at about 0.06 mas yr-1. For the secondary astrometric data set, the typical uncertainty of the positions is ∼10 mas. The median uncertainties on the mean G-band magnitudes range from the mmag level to ∼0.03 mag over the magnitude range 5 to 20.7. Conclusions. Gaia DR1 is an important milestone ahead of the next Gaia data release, which will feature five-parameter astrometry for all sources. Extensive validation shows that Gaia DR1 represents a major advance in the mapping of the heavens and the availability of basic stellar data that underpin observational astrophysics. Nevertheless, the very preliminary nature of this first Gaia data release does lead to a number of important limitations to the data quality which should be carefully considered before drawing conclusions from the data. © ESO, 2016.

Summary Italian species of the Viola tricolor group, Sect. Melanium are examined from the morphological view-point. Additional diagnostic characters have been highlighted on the basis of in situ and ex situ experimental data, direct analysis of exsiccata and high resolution digital images of several Herbaria, check of previous international literature. Measures have been taken on well developed flowers after a given vegetative period. Diagnostic features of stigma, labellum, position of opening to the stigmatic chamber and detailed photos are provided. Scanned images of stipules and corresponding leaves taken from the lower, median and upper part of the stem are also provided. These images provide clearer discrimination and correct identification of this difficult group. Abstract

Riassunto Il presente studio analizza la flora del Monte Scalambra, estrema propaggine nord-occidentale dei Monti Ernici. Il territorio, la cui altitudine e compresa tra 400 m e 1420 m s.l.m, ha una estensione di circa 4200 ha ed e prevalentemente costituito da sedimenti carbonatici. Il clima e di tipo temperato. La flora risente della particolare collocazione del Monte Scalambra tra due importanti unita geografiche: l'Antiappennino laziale e l'Appennino laziale-abruzzese; si compone infatti di elementi di diversa provenienza, con una prevalenza delle componenti eurasiatica (35,4 %) e mediterranea s.l. (31,4%), tra loro ben bilanciate. Sono state censite 1164 entita, appartenenti a 483 generi e 102 famiglie, tra le quali le piu ricche di specie risultano Compositae (138), Gramineae (117) e Leguminosae (109). Abstract

Two patients with the syndrome of proper name anomia were investigated. Both patients were only able to produce around 50% of the names of contemporary celebrities, but performed significantly better on a task calling for naming of historical figures. The names of relatives and friends were spared in one patient, while the other retrieved names of people known since childhood much better than those of people familiar to him since the age of 25. Geographical names, names of monuments and masterpieces were preserved. The above dissociations are taken to imply that in moderately impaired patients, a temporal gradient effect concurs to modulate the severity of the naming block. A similar impairment was found in both patients when they attempted to retrieve or relearn familiar telephone numbers. This finding suggests that the core of the disorder resides in the inability to gain access to words used to identify a single entity, regardless of whether they belong to the class of proper or common names.

Abstract

The aim of this paper is to document plant diversity in the metropolitan area of Rome (Italy) by providing a comprehensive inventory of the present-day vascular flora and an overview of its composition and species diversity. We compiled the floristic catalogue by including all vascular plant entities that occur spontaneously within the administrative boundaries of the Rome municipality. The data, which were gathered from extensive field surveys, from a broad review of the literature and from herbaria records, were updated and integrated in a comprehensive account. The inventory of the flora of metropolitan Rome lists 1649 entities, from 139 families and 677 genera. The flora contains 228 taxa that are non-native to the Italian flora, 81 of which are established in the study area. The overview of flora reveals a remarkable species diversity and outlines the main characteristics of the flora of Rome, which may be summarized as (1) a large number of taxa of high conservation value which occur in remnants of near-natural vegetation, (2) the loss or decline of some species, particularly of native freshwater plants, (3) a remarkably high native species richness within the urban area, which includes many native woody species and (4) a rich ruderal flora, prevalently composed of native species that are well adapted to human disturbance, along with a variety of taxa of non-native or uncertain origin. The large set of data and the overview presented in this paper represent a fundamental framework for future research and for the conservation of plant diversity in metropolitan Rome.

The most commonly used old‐growth forest indicators are structural attributes; nevertheless, they do not necessarily represent the biodiversity value of old‐growth forests. The aim of this study is to analyse the relationships between species richness data of different taxa and structural indicators of old‐growth and to identify taxonomic/functional groups, species and structural attributes that may be used as indicators of old‐growth. To achieve this goal we sampled forest structure, vascular plants, lichens, bryophytes, fungi, saproxylic beetles and birds in mature and old‐growth stands in southern Italy. Therefore, the optimal data set for a phytogeographical (fioristic) Classification of Italy would be a floristic atlas including all the vascular plants species of the country: grid cells should be treated as OGUS (Operational Geographic Unit) and elaborated through multivariate presence/ absence analysis. However, such an atlas has never been realized in our country. Aim of the paper is to present a quantitative phytogeographical classification of Italy based on available data, i.e. the new chet:l(—list of the Italian vascular Hora, the large amount ofpublished local Horas and information about the distribution of Potential Natural Vegetation (vegetation series). As the check-list shows the plant list of each of the 20 administrative regions of Italy, these can be treated as OGUS For a first, coarse—grain framework classification of the country. A more detailed and fine—grainecl analysis of Italy’s phytogeographical units can be made analyzing a wide set oflocal floras, chosen — among the many available — on the basis of their study area surface and ecological heterogeneity. We also present a detailed analysis regarding the chorological attributes of species exclusive of the Thyrrenic regions compared to the Adriatic ones. The complex of the analysis confirm the presence of a gradient north—south and a clear separation est—west along the Peninsula. Twenty-four patients with HCV and NonBNonC chronic hepatitis--4 with HIV coinfection--were treated with r-IFN alpha for at least six months. In this period 62.5% of patients show a normalization of ALT but not a sustained remission. Non-responders have histologically more severe and long-lasting chronic hepatitis.

Abstract

Hospice bereavement services vary widely and are often loosely defined. This paper describes the results of a survey on the form and function of hospice bereavement services completed by NHO Provider Member hospices. It explores issues related to staffing, training, size, services provided, and service priorities. Additionally, data collection and research, referrals, funding, risk assessment, obstacles programs face and the limitations that are inherent in hospice structures are examined. These important elements are presented along with a discussion of critical issues and recommendations for future research and study.

Abstract

THE relationship of liver glycogen to the ketosis of diabetes is not clear. The most widely held belief, cited often in medical literature, is that ketosis is a sequel to the depletion of liver glycogen reserves (Mirsky, 1942; Korenberg, 1943; McKay, 1943). According to this view the diabetic animal becomes depleted of liver glycogen because of lack of insulin, and approximates the condition of the normal animal when fasted. The depletion of hepatic glycogen reserve is thought to stimulate overproduction of ketone bodies. It is generally assumed that ketosis occurs in diabetes only after liver glycogen is exhausted. This assumption is not warranted without reexamination. Bondy et al. (1948) found high liver glycogens in some humans with severe diabetic ketosis. Vallance-Owen (1952) found normal to high glycogen in the livers of patients who had died in diabetic coma without insulin therapy. Abstract

Between 101 and 188 medical records of children hospitalized in each of three community hospitals and one major teaching hospital were examined to determine need for admission and quality of care administered. Two of the hospitals had been similarily studied two years before. Twenty-five percent of all admissions and 17% of all patient days were considered unnecessary. The smallest number of inappropriate admissions was found in the major teaching institution, but one of the community hospitals without any teaching affiliation was notably better than the other two. The teaching hospital and the same community hospital also achieved the lowest questionable management rates. Significant (P less than 0.5) but minimal reduction had occurred in number of unnecessary admissions when first and second utilization studies in these two hospitals were compared.
