Die Argumente pro und contra die Subsidiaritätsregelung wägt das Buch gegeneinander ab. Der Autor vertritt als Ergebnis die These von der «faktischen Subsidiarität» und propagiert, die gesetzliche Regelung ersatzlos zu streichen.

Das vorliegende Buch untersucht die psychische Situation von OrganspenderInnen und -empfängerInnen vor einer Lebendnierentransplantation. Ausgangspunkt für diese empirische Studie war der in den vergangenen Jahren häufig diskutierte Geschlechterunterschied in der Lebendorganspende, wonach Frauen häufiger zum Spenden bereit sind als Männer. Daher wurden Spendemotivationen und Entscheidungsprozesse im Hinblick auf eine Geschlechtsspezifik in den Blick genommen. Zentrales Ergebnis ist die Existenz eines so genannten «Imperativs zur Spende», der zwar für alle Angehörigen gilt, der aber in einer geschlechtsspezifischen Weise wirksam wird. Frauen vernehmen die «Anrufungen zur Spende» in anderer Weise als Männer und kommen diesen Anrufungen an sie häufig zuvor, während Männer vermehrt dann zu spenden scheinen, wenn außer ihnen niemand anderes in Frage kommt. Welche Herausforderung, Zumutung, aber auch Chance diese spezielle Situation im Vorfeld einer Lebendorganspende darstellt und wie sie psychisch verarbeitet wird, davon handelt dieses Buch.

In response to persistent donor organ shortages, organs from marginal donors, such as expanded criteria donors (ECD) and donation after cardiac death (DCD) donors, are now accepted and have been successfully transplanted, reducing the waiting times for transplantation. Especially in Japan, transplantation of DCD kidneys has a relatively long history because of the difficulty or lack of national consensus in accepting brain death, which has made it possible to accumulate considerable clinical experience. Thus, the current organ shortage has stimulated interest in the use of marginal donors for transplantation. On the other hand, however, it is known that these organs have a high rate of delayed graft function and a more complicated postoperative course. These drawbacks have created the greatest clinical challenge in transplantation to date because of the current shortage and limitations of donors using ECD and DCD.This book, prepared by distinguished authorities in their fields, is intended for clinicians and researchers. It highlights the use of marginal donors as a comparatively novel source of transplantation organs and provides a thorough overview of marginal donors from their historical origins to recent clinical applications, including the state-of-the-art science of organ/donor management, procurement, and preservation. Also provided is valuable information on ABO-incompatible donors which extend the availability of donor sources. Each chapter offers an individual analysis of the optimal requirements for the safe management and preservation of organs, including the heart, lung, liver, kidney, pancreas, and pancreatic islets.

Die Arbeit unterzieht die Regelungen des Transplantationsgesetzes (TPG) hinsichtlich der Verknüpfung einer Organspendeerklärung mit einer Bedingung einer verfassungsrechtlichen Prüfung. Nach einem Überblick über den aktuellen gesetzlichen Rahmen für Leichen- und Lebendspende wird zunächst die Verfassungsmäßigkeit der Restriktion des Empfängerkreises bei der Lebendspende untersucht, um sodann die generelle Beschränkbarkeit der Organspendeerklärung zu erörtern. Der Schwerpunkt der Arbeit liegt auf einer verfassungsrechtlichen Prüfung der Vereinbarkeit einer Leichenspende zugunsten eines ausgewählten Empfängers mit dem TPG. Die verfassungsrechtliche Prüfung zeigt, dass dem (postmortalen) Selbstbestimmungsrecht des potentiellen Spenders sowie dem Gleichheitsgrundsatz nicht hinreichend Beachtung zukommen. Insofern plädiert die Autorin für die Einführung einer Rechtssicherheit schaffenden Ausnahmeregelung in § 9 Abs. 2 TPG, welche die empfängergerichtete Leichenspende unter gewissen Voraussetzungen zulässt, und stützt dieses Ergebnis durch ethische Aspekte.

Untersucht werden die relevanten Rechtsquellen auf europäischer und nationaler Ebene, die Rechtsposition der Spender, der Spendenempfänger und die Organisationsstrukturen in der Transplantationsmedizin. Der deutsche Gesetzgeber hat sich für eine rechtliche Trennung zwischen der Organ- und Gewebespende entschieden. Untersucht wird in diesem Zusammenhang, ob trotz der Vielzahl medizinischer Überschneidungen zwischen Organ- und Gewebespende eine praktikable und rechtsgemäße Transplantationsmedizin gewährleistet werden kann. Hierbei wird der Frage nachgegangen, ob die Regelungssituation der Transplantationsmedizin das Spendenaufkommen fördert und welche rechtlichen Lösungen in Betracht kommen.

This book brings together researchers from three different continents who present different perspectives on the complex issue of organ donation. Several important authors have contributed to this edited book on organ donation discussing the phenomenon from different aspects, particularly the psychological, medico-legal, religious and communications perspectives. Some of the authors have not only studied these questions academically, but they themselves are live organ donors or organ recipients as well. The chapters by Cole, Camilleri-Zahra, Schweda and Wolhke, Siegel, Anker and Jansen give importance to the voice of organ donors, recipients and their families. They discuss the dilemmas which donors, recipients and their families face when they come to learn that a family member needs an organ transplant, and the subsequent difficult decisions that have to be made by the recipients, possible donors and family members. The phases before and after the donation of organs are as important as the donation itself. Fear, guilt and other strong emotions are intrinsic to the donation process both in live donation as well as in cadaveric donation. The psychological and health challenges presented by organ donation, discussed by Lauri, Moloney, Walker and Charlton, Shanteau and Hyde, are compounded by legal, religious and cultural issues, which will also be discussed in different chapters of the book by Ellul, Borg and Reinhart. Finally, the chapters by Alvaro, Feeley and Yang discuss how the media can influence and inform public attitudes towards organ donation and discuss how it can help increase the number of organ donors. This book is meant for those who, in some way, come in contact with people who need an organ transplant and those who have to help people come to reach informed decisions.

This book is a compilation of common and uncommon surgical and ancillary techniques that we have found useful in the multiorgan transplantation pro­ gram at the University of Minnesota. Descriptions of these techniques are not available at a single source elsewhere. Use the book as a teaching aid, a source of workable techniques, and as a reference for individuals with relatively little experience in a particular area of transplantation. Because of the varying levels of expertise of our readers, vascular access is described in exquisite detail, as it is aimed at an audience of individuals who want to learn the fine points about how to prolong the function of shunts. The chapter on organ preservation is aimed at the surgeon or beginning technician who must learn how to do it from scratch--even the catalogue numbers of the necessary equipment are included. In contrast the chapters on heart, liver, and pancreas transplantation, while omitting fine points of suture technique, concentrate on the essential principles and safeguards. Individuals contemplating such transplants are presumably already schooled in the fine points of surgical technique. The chapters on cadaver organ donation are perhaps the most innovative. They represent our attempt to reorganize organ donation in a way that will provide the greatest usefulness of each donor as a source for multiple organs for transplantation. We hope that the book will become available to centers that, while not performing liver, pancreas, or heart transplants, wish to serve as donation centers.

With a current US need of over 115,000 organs one would think that Good Samaritan donors would be welcomed with open arms by transplant centers and society in general; however, this is often not the case. Tell someone that you have donated an organ to a stranger and the reaction is likely to be one of astonishment and disbelief. Some doctors even consider people who offer their organs to strangers crazy. Why would anyone do that? Who are these people so committed to helping others-strangers-that they would undergo surgery, discomfort, and disruption of their lives? This book profiles donors who have offered their organs to strangers and helps readers understand the meanings behind their donations. For the donor, altruism should always be the primary motivation, though other motivations often come into play. Often, there are also subconscious reasons for performing this great act of kindness. Since its inception in 1968, the brain-death criterion for human death has enjoyed the status of one of the few relatively well-settled issues in bioethics. However, over the last fifteen years or so, a growing number of experts in medicine, philosophy, and religion have come to regard brain death as an untenable criterion for the determination of death. Given that the debate about brain death has occupied a relatively small group of professionals, few are aware that brain death fails to correspond to any coherent biological or philosophical conception of death. This is significant, for if the brain-dead are not dead, then the removal of their vital organs for transplantation is the direct cause of their deaths, and a violation of the Dead Donor Rule. This unique monograph synthesizes the social, legal, medical, religious, and philosophical problems inherent in current social policy allowing for organ donation under the brain-death criterion. In so doing, this bioethical appraisal offers a provocative investigation of the ethical quandaries inherent in the way transplantable organs are currently procured. Drawing together these multidisciplinary threads, this book advocates the abandonment of the brain-death criterion in light of its adverse failures, and concludes by laying the groundwork for a new policy of death in an effort to further the good of organ donation and transplantation.

Tissue banking is undergoing a paradigm shift. There are now a plethora of guidance and regulatory documents, in response to recent regulation. There is however, relatively little information on the scientific and technical principles on routine tissue banking practices. The information that exists is relatively old and in somewhat obscure journals. This book attempts to provide a coherent and up to date approach. Each author, who is a recognized expert in their field, was asked to illustrate the processes involved in modern tissue banking practices. Where these are based on evidence and science, they were asked to explain this in a clear and concise manner. Where evidence it is not available, the authors were asked to provide the reasons why they believe practices have developed the way they have. This could range from the precautionary principle, custom and practice, common sense approach etc. This book has been split into 5 sections: Management of donors and the banking of common tissues and cells, principles of storage and processing of tissues, ensuring safety of the products by testing the donor, the tissue and the environment, ensuring quality of the products by establishing a quality system and an IT infrastructure and the Regulatory and ethical environment in which we operate. Although it is possible to bank all types of cells, including stem cells, these are not covered in this book. The organisation and target audiences for stem cells are quite different from those of tissues. Cord blood banking, on the other hand is very similar and they have therefore been included. The intention of this book is to cover the basis of current practices, rather than future developments, such as embryonic cell developments, tissue engineering and gene therapy. These are more akin to cellular therapies. Although they share many banking similarities to tissues, their inclusion in this book would have made it too cumbersome.
