This study examines if and how pet protection orders have been used by domestic violence survivors in the 36 states and the District of Columbia in which they have been enacted. A review of court websites determined if there was a specific item to include a pet in the temporary and/or final protection order. In addition, individual court administrators were contacted in various states to determine if statistics were available on the number of pet protection orders issued. Another mode of investigation included examining appropriate websites in each state to ascertain if the state issued a report on domestic violence statistics, and if so, if that report contained information on pet protection orders. While the appropriateness of restorative justice for sexual and family violence continues to experience worldwide feminist debate, these programs already exist. We thematically analyzed the transcripts of former members of a second-wave feminist antirape organization in Australia to ascertain their perspectives on a victim-centered conferencing model. They provided informed and valuable insights drawn from their decades of advocacy. Participants supported restorative justice in principle, stressing respect for victims' agency and independence in all policies and program designs. By reversing the questions and focusing on the perpetrator's behavior, the notion of coercive control revolutionizes the apprehension and understanding of violence within the family for all its members. This heuristic approach, which represents a genuine paradigm shift, has legal, semiological and diagnostic effects. Women are the primary victims of domestic violence, but their experiences are often ignored in Chinese judicial judgments. Among 350 Chinese civil judgments on domestic violence in 2020, more than 96% involved female victims, and they faced various judicial dilemmas when seeking civil remedies. The court confirmed the existence of domestic violence in 26% of the cases, and 27% of applications for personal safety protection orders were rejected. More than two-thirds of female plaintiffs' divorce applications were not approved, and they received no compensation. Medical confidentiality is the cornerstone for a trustful relationship between patients and the health professionals attending to them. However, when history or clinical findings suggest certain offenses, statutory laws (Children's Act, Older Persons Act, Mental Health Care Act, Sexual Offenses Act) establish a legal obligation for health professionals to report suspected instances of abuse to the police or alternatively, in some cases, to a designated social worker. Given the high rate of domestic violence and abuse in South Africa, health professionals are most likely to encounter such situations. Many clinicians are oblivious of the obligations, exposing themselves to possible liability and their patients to potential additional harm. This article aims to demonstrate the reporting requirements under the respective acts through case scenarios. Finally, the advantages and disadvantages of the existing legal setting are discussed briefly.

China has made remarkable progress in preventing and intervening in domestic violence against women. Scholars have reported on this development. Methodologically, this paper, which draws on 3362 references selected from the China National Knowledge Infrastructure, uses the bibliometric method to summarize the characteristics, evolution, and frontiers of key topics into research on abused women in China between 1993 and 2020. The paper has three key findings. (1) The volume of literature has grown continuously, but in three stages: initial, rapid growth, and peak fluctuation; (2) the topic has five research hotspots: fundamental issues in domestic violence against women; new legislation, notably the 2015 Anti-Domestic Violence Law ; social support for abused women; matrimonial disputes involving abused women; and conviction and sentencing of abused women who kill their husbands; and (3) the current research frontiers lie within the defects of the Anti-Domestic Violence Law and challenges in the implementation of the law. In addition, the paper examines characteristics and limitations of the study on abused women in China and suggests changes in practice, policy, and directions for future research.

Domestic violence is sequential, developmental and dynamic. The aim of this study was to examine whether, in the perceptions of students in Poland and Belarus, there is a relationship between involvement in violence and the legal and social consequences for the perpetrators. A total of 482 university students took part in the study, including 251 students from Poland and 231 students from Belarus. Statistically, Polish respondents were more frequently involved in domestic violence as witnesses and victims, which was confirmed by χ 2 test. Based on the 95% confidence interval (CI), it can be concluded that the largest number of respondents from both countries surveyed who have been involved in violence as witnesses (85.2-94.8) indicated that an adequate punishment for perpetrators of violence is imprisonment. Students who have never been involved in domestic violence indicated social consequences as appropriate punishment for the use of violence more often than those who have been involved in violence as witnesses, victims or perpetrators. Witnesses and victims were not found to be in favour of more severe punishment or more serious moral and social consequences than perpetrators. The largest number of respondents indicated that the appropriate consequence of using violence should be imprisonment, followed by a restraining order and eviction from the place of residence.

Background: Over the past years medical centres specifically addressed in gender-based violence have developed protocols for the collections of evidence useful in the courtroom, including accurate documentation of physical and psychological states of the victim and collection of samples. Previous studies showed an association between documented physical trauma and conviction but unfortunately, few studies in the recent literature analysed the factors that influence the legal outcome and final judgement. The present study focused on the elements that appeared of significance in the legal outcome, including medico-legal evaluation, source of the crime report and circumstance of the assault., Methods: It was conducted a retrospective analysis of all the judgments issued by the Public Prosecutor's Office at a Court of a Metropolitan Italian city regarding sexual and domestic violence, from January 1st 2011 to 31st December 31st 2015. Examination regarded the demographic information of the victim and of the defendant, information on the crime, the circumstances of the aggression and medical information retrieved. Sentences were subsequently divided into two categories based on the legal outcome (conviction vs acquittal) and the different characteristics of the two sub-populations were compared to verify if there were variables significantly associated to the judge's final judgment., Results: Over the 5 years taken into consideration, there have been 1342 verdicts regarding crimes of sexual violence (374 cases) and regarding abuses against family members or cohabitants (875): other 93 cases regarded both sexual violence and abuse. 66.3% ended in conviction of the offender and 33.7% in acquittal of the accused. Cases of conviction were more frequent when they involved: use of a weapon by the assailant, as well as if the assailant had a criminal record and had a history of drug abuse or other addictions; duration of proceeding less 22 months and a civil party involved; presence of clinical documentation together with other deposition in addition to victim's deposition; also frequent episodes of violence and application of precautionary measures were associated to conviction., Conclusions: Many factors seem able to influence the judge's judgment, although clearly each case must be singularly evaluated. The mere presence of medical documentation, without the support of other sources of evidence, such as the victim's statement or further declarations, however, is almost always not definitive for the verdict. Despite so, in cases where there are multiple sources of evidence, clinical documentation can provide useful elements and can give clues on the consistency between the history told and injuries observed., Competing Interests: The authors have declared that no competing interests exist.

The Violence Against Women Act (VAWA) is the signature federal legislative accomplishment of the anti-violence movement and has ensured that criminalization is the primary response to intimate partner violence in the United States. But at the time of its passage, some anti-violence activists, particularly women of color, warned that criminalization would be problematic for a number of reasons, a caution that has borne fruit in the 25 years since VAWA's passage. This article critiques the effectiveness of criminalization as anti-domestic violence policy and imagines what a non-carceral VAWA could look like.

One of the goals of the Violence Against Women Act (VAWA) was to improve law enforcement responses to sexual and domestic violence by providing funding to expand prevention, enhance investigations, and increase victim services. Since VAWA's enactment, police responses to these crimes have evolved, including officer responses to victims and offenders, and various agency operations. This article highlights some noteworthy changes in law enforcement related to facilitating victim reporting, enhancing victim advocacy and services, crime reduction and investigative tools, supplementing personnel and training, and encouraging multiagency collaborations as a result of VAWA.

The Violence Against Women Act (VAWA), originally passed in 1994, was successfully reauthorized in 2000, 2005, and 2013. Over time, VAWA altered the environment for many victims who had previously suffered in silence. This article focuses on how VAWA impacted American Indian (AI) and Alaska Native (AN) victims of dating and domestic violence. AI and AN women experience these crimes at a rate higher than the national average, yet they are often denied justice due to the interplay of federal and state laws and tribal sovereignty. VAWA affirmed tribes' sovereign authority to exercise criminal jurisdiction over non-Indians who commit crimes against AI and AN victims on tribal lands. This article also discusses future steps to enhance justice reforms.

Background: Family violence (including intimate partner violence/domestic violence, child abuse, and elder abuse) is a hidden pandemic happening alongside COVID-19. The rates of family violence are rising fast, and women and children are disproportionately affected and vulnerable during this time., Objective: This study aims to provide a large-scale analysis of public discourse on family violence and the COVID-19 pandemic on Twitter., Methods: We analyzed over 1 million tweets related to family violence and COVID-19 from April 12 to July 16, 2020. We used the machine learning approach Latent Dirichlet Allocation and identified salient themes, topics, and representative tweets., Results: We extracted 9 themes from 1,015,874 tweets on family violence and the COVID-19 pandemic: (1) increased vulnerability: COVID-19 and family violence (eg, rising rates, increases in hotline calls, homicide); (2) types of family violence (eg, child abuse, domestic violence, sexual abuse); (3) forms of family violence (eg, physical aggression, coercive control); (4) risk factors linked to family violence (eg, alcohol abuse, financial constraints, guns, quarantine); (5) victims of family violence (eg, the LGBTQ [lesbian, gay, bisexual, transgender, and queer or questioning] community, women, women of color, children); (6) social services for family violence (eg, hotlines, social workers, confidential services, shelters, funding); (7) law enforcement response (eg, 911 calls, police arrest, protective orders, abuse reports); (8) social movements and awareness (eg, support victims, raise awareness); and (9) domestic violence-related news (eg, Tara Reade, Melissa DeRosa)., Conclusions: This study overcomes limitations in the existing scholarship where data on the consequences of COVID-19 on family violence are lacking. We contribute to understanding family violence during the pandemic by providing surveillance via tweets. Although family should be the basis for the development and formation of a child's personality, violence is mostly done in the family, and remains undiscovered for a long time. The real number of abused children is much more than that displayed in the registered cases. The secrecy of the problem is an important feature of this phenomenon. Families in which abuse takes place are mostly isolated. Social isolation does not come about by chance; secrecy is usually encouraged by an abuser to control over famoly members. In most cases, social reaction to violence is late, inadequate and focused on the consequences, but not on the causes. "Abuse implies an act of execution that directly inflicts damage, while neglect implies an act of non-fulfillment of something that is necessary for the well-being of a child". The most common forms of domestic violence are physical, emotional abuse in the presence of violence against the mother, and in a lesser extent sexual abuse. In addition, there is physical, emotional, educational and medical neglect. The presence of violence against the mother and the feeling of impotence leave the same consequences as the endured violence. It is considered that children living in violent families are likely to live under cumulative stress. Traumatic responses include a wide range of conditions from acute stress reactions through post-traumatic stress disorder to complex long-lasting, repeated trauma syndrome. All children will not react to this kind of experience in the same way, with the protective and risk factors in developmental psychopathology having a significant role to play. Because of their developmental vulnerability and dependency, children are at greater risk of violence than adults. Researches point to the need for a multidisciplinary approach to treatment and prevention of child abuse, with greater interaction between health institutions, relevant centers for social work, police, court, government and non-governmental sector, and the existence of adequate family and criminal laws.

The Lethality Assessment Program (LAP) aims to empower law enforcement officers to screen victims of domestic violence for potential lethality and connect them to service providers. This research surveyed domestic violence victims seeking legal services ( n = 141) to assess whether LAP receipt is associated with greater rates of self-protective measures, service use, or empowerment, and to examine victims' perspectives on the LAP process. Findings indicate no relationship between receipt of the LAP and use of self-protective measures or victim empowerment, mixed evidence between receipt of the LAP and service utilization, and room for improvement regarding how law enforcement officers explain the LAP to victims. Implications are discussed.

Violence against women (VAW) in Turkey is concerning, and to develop and implement effective prevention strategies for addressing it, careful consideration must be given to the factors that influence it. In this review, we synthesized the body of literature on VAW in Turkey according to a social ecological framework, which is a theoretical model considering the complex interplay between individual, relationship, community, and societal factors. Consistent with this framework, we obtained research articles and commentaries in Turkish and English from a variety of national and international databases and websites regarding risk factors, cultural practices violating women's rights, and trends and current practices, including prevention efforts. Our review revealed that factors influencing VAW are marriage at young age, lower education level, alcohol abuse, and childhood trauma or abuse history for individual level; having multiple partners, low relationship satisfaction, and forced marriage for relationship level; poverty, lack of social support, and lack of employment opportunities for community level; cultural acceptance of men's superiority and dominance over women, acceptance of violence, cultural practices, and weak legal sanctions for societal level. Additionally, we reviewed multilevel prevention strategies in the extant literature on effective prevention and intervention efforts according to social ecological framework and proposed research, practice, and policy implications derived from this framework.

Background: Domestic violence and abuse (DVA) is common and damaging to health. UK national guidance advocates a multi-agency response to DVA, and domestic homicide reviews consistently recommend improved information-sharing between agencies. Identification of patients experiencing DVA in general practice may come from external information shared with the practice, such as police incident reports and multi-agency risk assessment conference (MARAC) reports. The aim of this study was to explore the views of general practitioners (GPs) and the police about sharing reports about DVA with GPs., Methods: Qualitative semi-structured interviews were conducted with GPs, police staff and a partnership manager. Participants were located across England and Wales. Thematic analysis was undertaken., Results: Interviews were conducted with 23 GPs, six police staff and one former partnership manager. Experiences of information-sharing with GPs about DVA varied. Participants described the relevance and value of external reports to GPs to help address the health consequences of DVA and safeguard patients. They balanced competing priorities when managing this information in the electronic medical record, namely visibility to GPs versus the risk of unintended disclosure to patients. GPs also spoke of the judgements they made about exploring DVA with patients based on external reports, which varied between abusive and non-abusive adults and children. Some felt constrained by short general practice consultations. Some police and GPs reflected on a loss of control when information about DVA was shared between agencies, and the risk of unintended consequences. Both police and GPs highlighted the importance of clear information and a shared understanding about responsibility for action., Conclusion: GPs regarded external reports about DVA as relevant to their role, but safely recording this information in the electronic medical record and using it to support patients required complex judgements. Both GPs and police staff emphasised the importance of clarity of information and responsibility for action when information was shared between agencies about patients affected by DVA.

Background: Violence against women and girls (VAWG) is a human-rights violation with adverse long-term and inter-generational consequences. Redefining VAWG as legally unacceptable is one strategy for social change. The co-occurrence of national laws against VAWG is understudied, and tools to monitor the national legal environment are lacking. We developed the Laws on Violence against Women and Girls Index (LoVI) to measure global progress to develop comprehensive national legislation against child marriage, sexual harassment, domestic violence, and marital rape., Methods: Using data from 2016 and 2018 for 189 countries from the World Bank Women, Business, and the Law database, we used factor analysis to assess the dimensionality of the LoVI. We examined the distribution of the LoVI across countries and regions, and the relationship of national rankings on the LoVI with those for other indicators from the United Nations, Demographic and Health Surveys, and World Factbook., Results: A single LoVI factor showed good model fit in the factor analysis. National LoVI rankings were positively associated with gender equality in human development and economic rights-related rankings and negatively associated with rates of justifying wife beating and of lifetime and prior-year physical and/or sexual IPV. The LoVI was not associated with national indicators for human development and income inequality., Conclusion: The LoVI is a concise, coherent, validated index to monitor the progress of nations on adopting comprehensive legislation to advance 2030 Sustainable Development Goal 5, to eliminate VAWG.

In 2013, the Violence Against Women Act became one of the first federal laws to explicitly prohibit discrimination against transgender people, yet little is known about its impact in practice. This qualitative study draws on in-depth interviews with transgender people working in domestic and sexual violence advocacy organizations. Building on critical and intersectional perspectives, the findings suggest that the persistence of inequities for trans survivors are tied to the reliance on criminal legal responses, contingent access to gender-specific services, compliance-focused approaches to inclusion, operating theories of gender-based violence, and the diversion of responsibility to LGBTQ (lesbian, gay, bisexual, transgender and queer) programs. This study highlights the participants' recommendations for change.

Recent research has pointed to the need for systematic law enforcement training on domestic violence when nonfatal strangulation is involved to improve evidence-based prosecution of these potentially deadly assaults; however, virtually no research has examined the legal response to nonfatal strangulation since many states have made it a separate criminal felony. The current exploratory study examines filing, charging, and adjudication decisions of nonfatal strangulation cases over a 3-year period based on evidence documentation in law enforcement reports to explore how these cases are handled by the criminal justice system in Brevard County, Florida. Results support previous research showing the importance of training police officers and other personnel as insufficient evidence may be one possible factor limiting the prosecutors' ability to successfully prosecute domestic violence strangulation offenders to the highest extent available under the law. Introduction: Adolescent-to-parent violence/aggression (APV/A) is an understudied yet increasingly common social problem for adolescents and families, particularly those involved in the juvenile justice system. The current study focused on improving interventions for this population by gathering qualitative data from stakeholders to inform treatment targets., Methods: Participants (N = 23) comprised of court professionals (n = 7), parents/guardians (n = 9), and their male adolescent children (n = 7) in the United States. Parent and adolescent participants were recruited through monthly court-mandated domestic violence education classes offered by the juvenile court. Parent/guardian participants were between the ages of 38 and 77 and consisted of four males and five females. Adolescents were between the ages of 14 and 17. Court professional participants consisted of judges, probation officers, and court psychologists. Semi-structured interviews were analyzed qualitatively using grounded theory., Results: Results indicated that, from the perspective of key stakeholders, an effective intervention to reduce APV/A likely involves a two-pronged approach: (1) address specific and theoretically modifiable emotional, behavioral, and psychological factors at the adolescent-level; and (2) induce change in the family system by addressing environmental barriers to seeking treatment and by creating positive family relationships., Conclusions: The present study aimed to gather the perspectives of court professionals, adolescents, and parents/guardians regarding the development of an effective intervention for APV/A-involved families. Generally, filing a formal report of family violence is considered a difficult task, although it is the main source from which police can take action. The purpose of this study was to examine the factors predicting the intention to formally report family violence in South Korea, based on Black's theory of law. The data were drawn from the National Survey of Domestic Violence, collected from a representative sample of 5777 members of the South Korean population. The results indicated that people generally showed a greater intention to report violence that they witnessed in other families as opposed to their own family. Perceived gender roles and information about institutions where individuals might seek help for family violence were the strongest negative and positive predictors of the intention to report, respectively. The findings can be used as evidence when developing public education and practical guidelines to promote official reporting of family violence.

Crimes committed against partners and family members have devastating effects on victims. Unfortunately, recidivism rates for offenders are high, and there is a need to establish risk factors that may be potential treatment targets. This study aimed to investigate childhood maltreatment, symptoms of trauma, and personality disorder (PD) traits in males convicted of domestic violence (DV) offences. Data were extracted from the files of 40 males under the supervision of the probation service in the United Kingdom. Actual return to custody was recorded after a minimum follow-up of 6 months. Self-reported childhood maltreatment was associated with increases in PD traits, posttraumatic symptoms, and assessed risk. However, maltreatment did not predict return to custody. Tension-reducing behaviours and depressive symptoms predicted return to custody as did antisocial PD. These preliminary findings highlight important areas of future research, in particular, factors which may be relevant treatment targets in reducing the risk of recidivism.

Interview participants sometimes share anecdotes (stories about past events), to illustrate a point or discuss their perspectives. When sharing these stories, participants may imbue the events with their own personal meaning-making, selective memory, and biases. We conducted a narrative analysis of anecdotes shared by judges ( n = 20) who preside over Domestic Violence Protective Order (DVPO) hearings to examine how biases and misperceptions shape decisions in DVPO cases. We found that judges rely on biases to sort cases as "true domestic violence" compared with "frivolous cases." In the anecdotes they shared, judges often used gendered stereotypes to depict litigants, and many judges felt that DVPOs had limited efficacy in preventing violence. We argue that important cognitive insights are revealed by interview participants during the spontaneous act of storytelling. In the case of judges, their biases could lead to DVPOs being denied in situations when they are warranted.

Batterers intervention programs (BIPs) have only a marginal impact on domestic violence (DV) recidivism, in part because treatment attrition is high. The current study evaluates a new BIP based on Acceptance and Commitment Therapy (called ACTV, Achieving Change Through Values-Based Behavior) in a sample of incarcerated DV offenders who failed to complete community-based BIP ( N = 23). The current study examined participants' risk factors and assessed criminal justice outcomes in the 1 year following treatment completion. The men exhibited high levels of experiential avoidance, adverse childhood experiences, psychopathy, and attachment when compared to clinical and forensic samples from past research. Consistent with the theory underlying ACTV, experiential avoidance decreased significantly over the course of treatment. In addition, 1 out of 22 (4.5%) had a domestic assault charge in the 1-year follow-up period. Based on the recommendations of a commission set up to review the handling of Family Law cases in Israel, the Family Courts Law 5755-1995 included a revolutionary provision - that a Social Services Unit, staffed by senior social workers, would be an integral part of each Family Court. Their mandate includes giving assessment, advice and assistance services to litigants and to the court, and this provision has been broadly interpreted, to include mediation and referrals for therapy. The activities of the Unit are confidential and free of charge to the parties. More recently the Units were given the task of seeing children whose future is the subject of litigation, to find out their needs and views; and also to serve as the agency which parties who want to start proceedings are required to attend, in order to receive information about the effect of proceedings on their children and advice about alternative dispute resolution to avoid litigation. The resulting synergy between the social workers and the Judges ensures that the needs of all those involved are met in a therapeutic fashion where this is necessary and possible, alongside the judicial powers to make orders as needed. Objective: To develop a detailed understanding of the circumstances of sudden unexpected death in infancy (SUDI) cases subject to serious case review (SCR)., Design: This was a thematic analysis of SCRs relating to cases of SUDI in England. SCRs were obtained for SUDI cases dying between 1 April 2011 and 31 March 2014. These were cases (aged 0-2 years) that presented as a SUDI and for which no clear medical or forensic cause of death was found., Results: SCRs were held for 30 SUDI cases, published reports were available for 27/30. The median (range) age at death was 2 (0-19) months. Background risk factors in families included: alcohol or drug dependency in 18/27, parental mental health problems in 14/27, domestic abuse in 9/27 and parental criminal records in 13/27. Nineteen infants had received support from social care, 10/19 were subject to child protection plans. Neglect was a feature in 15/27 cases. Parents did not engage with professionals in 18/27 cases, involving social care in 14/18, health care in 13/18 and drug and substance misuse services in 5/18. Eighteen of 27 deaths occurred in highly hazardous sleep environments, 16/18 involved cosleeping and 13/16 cosleeping deaths occurred with parents who were intoxicated with alcohol or impaired by drugs., Conclusion: Most SUDI cases occurred in hazardous sleep environments and are potentially preventable. They occurred in families well known to services with concerns about neglect, substance misuse and poor engagement. Under federal and many state laws, persons under domestic violence restraining orders (DVROs) are prohibited from possession of firearms. Using multiple sources and a Lexis Nexis search, we developed a list of state laws pertaining to the relinquishment or removal of firearms from persons prohibited from possession by DVROs. After downloading the text of each law, we conducted a legal analysis to enumerate provisions of the laws specifying implementation. We found 49 laws in 29 states and Washington, DC. The laws were conceptualized as instructions to the court, the respondent, and law enforcement. We detail the content of each state's law, including such elements as whether it applies to ex parte DVROs; whether certain criteria must be met, such as previous use of a firearm in domestic violence or lack of an employment exemption, before the law can be applied; and whether the application of the law is mandatory. We also detail instructions to the respondent regarding to whom firearms may be relinquished, whether the respondent must seek permission to transfer the firearm to a third party, and the time by which dispossession must occur. Finally, whether law enforcement bears the responsibility for removing the firearm or whether the law gives the court the authority to order a search and seizure for the firearms is discussed. The purpose of the research is to provide an overview of these state laws that can be used by key stakeholders in legislative, judicial, advocacy, or research roles. Implications are discussed.

Feminist advocacy and activism over the last 40 years broke historic ground in shining a light on "domestic" or "family" violence, traditionally conceptualized as male violence against female intimate partners and their children. This has resulted in a large body of research, particularly in the United States, United Kingdom, Australia, and similar jurisdictions, around the gendered nature of family violence and violence within heterosexual relationships and heterosexual-parented families. As a consequence, the predominant narrative-in political, policy, and advocacy settings-is largely heteronormative. Less research has focused on family violence in non-heterosexual relationships. The data that do exist have employed different methodological approaches and there are limitations on the extent to which they can be compared to the data on violence within heterosexual relationships. However, the existing research does demonstrate that family violence within lesbian, gay, bisexual, transgender, and intersex (LGBTI) communities is a significant issue. Even so, the current narrative does not acknowledge this, and predominantly reflects heterosexual norms of intimate relationships and family structures in society. LGBTI relationships are described as "invisible" in policy and practice responses to family violence, due to the failure to acknowledge violence in such communities. This article explores these claims in relation to lesbian relationships in the context of Australian legislative responses to family violence. It considers the extent to which family violence laws in two Australian jurisdictions recognize and frame lesbian identity in intimate relationships and lesbian-parented families. This is considered in light of the emerging conceptualization of family violence in lesbian relationships and lesbian-parented families, as evidenced by the wider scholarly literature on the nature and dynamics of such violence.

We are issuing a final rule to exempt a system of records entitled Social Security Administration Violence Evaluation and Reporting System (SSAvers) from certain provisions of the Privacy Act because this system will contain investigatory material compiled for law enforcement purposes.

While sexual abuse is increasingly well recognised as a form of domestic and family violence in Australian legal responses, the recognition and response to reproductive coercion is understudied and under-recognised. This article maps the behaviours and concepts associated with reproductive coercion. Focusing on civil protection orders and family law responses, two of the most commonly accessed responses to domestic and family violence, this article considers whether current legislative definitions and case law recognise reproductive coercion as a form of domestic and family violence. To understand better how reproductive coercion and sexual abuse are interrelated and how they manifest within violent relationships, the article draws on interviews with survivors of domestic and family violence. It concludes that while some legislative frameworks could potentially recognise and respond to reproductive coercion, there is an urgent need for improved understanding of reproductive coercion and the legal response particularly by those who work directly with battered women including police, lawyers and judicial officers.

Domestic Violence at the University Emergency Department Bern: A Retrospective Analysis from 2006 to 2016 Abstract. Domestic Violence (DV) is considered as one of the largest medical risks worldwide. In Switzerland, DV is defined as offence requiring public prosecution since 2004. The present retrospective cohort study aims to investigate cases of DV in one of the largest Swiss emergency departments. The aggressors are predominantly male and either (ex-)partner or (ex-)husband of the victim. The head and the extremities are most often injured. Strangulation was documented in 16 % of the cases. Prevalence in our ED is very low with 0.07 % in 2016 (overall 0.09 % 2006-2016) and much lower compared with international data. We assume that we face many unreported cases and that victims are reluctant to seek medical help. Healthcare professionals should receive regular education in domestic violence, standards of care must be defined, and a sensitive and open-minded communication style is essential.

Objective: To analyze the conceptions of the nursing professionals working in Basic Health Units regarding the detection and prevention of violence against the elderly., Methods: Descriptive, exploratory, qualitative study. Performed in two BHUs in Mossoró/RN, using a semi-structured interview script, from March to August of 2013. Sample composed of four nurses and six nursing technicians. The content analysis, pre-analysis, material exploration, and treatment of results were performed., Results: Four categories were identified: Strategies used to identify violence against the elderly; Types of violence against the elderly; Conduct used after finding a suspicion of violence; SUS and the problem of violence against the elderly. Many professionals recognize/distrust possible cases, however, they do not know how to proceed. The dimension of the problem requires that pragmatic interventions be performed in the clinical setting and in the social context., Final Considerations: There is a need for continuing education for professionals and greater communication between the bodies responsible for reporting and embracement.

Objective: An innovative health-justice partnership was established to deliver legal assistance to women experiencing family violence who attended an Australian hospital. This paper reports on a multifaceted response to build capacity and willingness of health professionals to identify signs of family violence and engage with referral pathways to on-site legal assistance., Methods: A Realistic Evaluation analysed health professionals' knowledge and attitudes towards identification, response and referral for family violence before and after training; and use of referral pathways., Results: Of 123 health professionals participating in training, 67 completed baseline and follow-up surveys. Training improved health professionals' self-reported knowledge of, and confidence in, responding to family violence and understanding of lawyers' roles in hospitals. Belief that patients should be referred to on-site legal services increased. Training did not correspond to actual increased referrals to legal assistance., Conclusion: The program built capacity and willingness of health professionals to identify signs of, and respond to, family violence. Increase in referral rates to legal assistance was not shown. Potential improvements include better data capture and greater availability of legal services. Implications for public health: Strong hospital system supports and reliable recording of family violence referrals need to be in place before introducing such partnerships to other hospitals., (© 2017 The Authors.)

Although the role of companion animals within the dynamic of domestic violence (DV) is increasingly recognized, the overlap of animal harm and insurance discrimination for victims/survivors of DV has not been considered. Prompted by a case study presented in a National Link Coalition LINK-Letter, this research note examines "Pet Insurance" policies available in Australia and whether nonaccidental injury caused by an intimate partner would be covered. We discuss the implications of exclusion criteria for victims/survivors of DV, shelters providing places for animals within a DV dynamic, and, more broadly, for cross- or mandatory-reporting (of animal harm) initiatives.

In Colorado, "treatment victim advocates" (TVAs) serve alongside providers and probation/parole officers on "multidisciplinary treatment teams" (MTTs) to oversee domestic violence offender's treatment. Although this model provides an opportunity for victim safety concerns to be heard, the utility of using victim advocates as advisors regarding interventions for domestic violence offenders has yet to be studied. Using survey data and narrative responses from TVAs ( N = 37), the current study examines the challenges and opportunities TVAs face while serving on MTTs. Results suggest that, overall, TVAs are successful in communicating with other members of the MTT, are confident that their perspectives are valued in the offender decision-making process, and are able to provide a wide variety of services and referrals to the victims with whom they are engaged. Implications and recommendations for the Colorado model as well as correctional professionals managing domestic violence offenders internationally are presented and discussed.

Domestic violence (DV) affects over a third of Chinese women in a relationship. Focusing on ethnographic data from six staff members and six DV survivors at a rural, state-affiliated women's center in China in 2010, this article relies on Henrietta Moore's notion of the poststructuralist gendered subject to examine how the staff draw on discourses about gender and social harmony in persuading women to stay in their marriages, rather than on human rights discourses that emphasize survivor safety. It shows that DV survivors are frequently sent back to dangerous homes where their health is placed at risk.

The Offender Focused Domestic Violence Initiative (OFDVI) represents for the first time anywhere the application of the evidence-based focused deterrence policing approach to combat intimate partner domestic violence (IPDV). Through holding offenders accountable, the strategy has resulted in 20% reductions each in IPDV-related calls for police service and arrests. Victim injuries have been significantly reduced and the 1-year IPDV offender recidivism rate is about 16-17%. The backbone of the OFDVI strategy is the multidisciplinary collaboration of law enforcement and community partners which has resulted in identification and resolving system issues which have historically allowed offenders to repeat IPDV without consequence.

This article is based on a review of 60 evaluations (published and unpublished) relating to European domestic violence perpetrator programmes, involving 7,212 programme participants across 12 countries. The purpose of the review, part of the "IMPACT: Evaluation of European Perpetrator Programmes" project funded by the European Commission (Daphne III Programme), was to provide detailed knowledge about the range of European evaluation studies with particular emphasis on the design, methods, input, output, and outcome measures used in order to identify the possibilities and challenges of a multicountry, Europe-wide evaluation methodology that could be used to assess perpetrator programmes in the future. We provide a model to standardise the reporting of evaluation studies and to ensure attention is paid to what information is being collected at different time points so as to understand what and how the behaviour and attitudes of perpetrators might change throughout the course of the programme.

This article outlines the role of the Institute for Family Violence Studies (IFVS) within the Florida State University College of Social Work in navigating issues intersecting social work and the law ( http://familyvio.csw.fsu.edu/ ). By developing comprehensive state and national trainings for unique populations and conducting interdisciplinary research, the IFVS promotes public policy that benefits healthy families and decreases family and intimate partner violence. The crucial role of staff and students, the IFVS's collaborative alliances, and funding sources are highlighted. Projects such as the Clearinghouse on Supervised Visitation, the National Prevention Toolkit on Officer-Involved Domestic Violence, Successful Co-Parenting After Divorce, and the LGBTQ Family Life Project are described. Plans for future projects, as well as other new avenues for research, are summarized.

In this article Richard Griffith, Senior Lecturer in Health Law at Swansea University, sets out the powers available to the police and court to protect people from domestic violence.

Approximately one in three women in the United States experience intimate partner violence (IPV). IPV is associated with long-term negative health consequences; therefore, there is a need to examine potential prevention strategies. Evidence suggests that domestic violence protective orders (DVPOs), a legal intervention that prevents contact between two parties for up to 12 months, are an effective secondary prevention tool. However, because judges have relative autonomy in granting or denying DVPOs, research is needed to examine the processes they use to guide their decisions. The aim of the study was to investigate how District Court judges decide whether to issue a DVPO. Using in-depth interviews with 20 North Carolina District Court judges, the present study addressed three research questions: (a) what factors influence judges' decisions to grant or deny a DVPO, (b) what heuristics or cognitive shortcuts potentially guide their decisions, and (c) what judges worry about when making decisions. Three themes emerged from the data analyses: (a) violent incidents must reach a certain threshold, (b) the presence of children creates competing concerns, and (c) judges worry about the negative impact their decisions may have on the lives of those involved. Recommendations for improving the DVPO issuance process are also discussed.

Richard Griffith, Senior Lecturer in Health Law at Swansea University, explains how the Domestic Violence Disclosure Scheme aims to protect potential victims by allowing disclosure of a partner's previous crimes.

Background: Domestic violence and abuse (DVA) and child safeguarding are interlinked problems, impacting on all family members. Documenting in electronic patient records (EPRs) is an important part of managing these families. Current evidence and guidance, however, treats DVA and child safeguarding separately. This does not reflect the complexity clinicians face when documenting both issues in one family., Aim: To explore how and why general practice clinicians document DVA in families with children., Design and Setting: A qualitative interview study using vignettes with GPs and practice nurses (PNs) in England., Method: Semi-structured telephone interviews with 54 clinicians (42 GPs and 12 PNs) were conducted across six sites in England. Data were analysed thematically using a coding frame incorporating concepts from the literature and emerging themes., Results: Most clinicians recognised DVA and its impact on child safeguarding, but struggled to work out the best way to document it. They described tensions among the different roles of the EPR: a legal document; providing continuity of care; information sharing to improve safety; and a patient-owned record. This led to strategies to hide information, so that it was only available to other clinicians., Conclusion: Managing DVA in families with children is complex and challenging for general practice clinicians. National integrated guidance is urgently needed regarding how clinicians should manage the competing roles of the EPR, while maintaining safety of the whole family, especially in the context of online EPRs and patient access., (© British Journal of General Practice 2017.)
