L’articolo riflette sulla recente riforma che ha abolito, nell’ordinamento tedesco, il divieto per i medici di informare sulle procedure abortive da loro offerte. In particolare, si sostiene che questa testimoni un fondamentale cambiamento nella percezione sociale e giuridica dell’interruzione volontaria di gravidanza e rappresenti, così, solo un primo passo verso un radicale mutamento di paradigma nell’inquadramento giuridico delle procedure abortive in Germania. Our contribution offers an analysis of the UK Supreme Court judgment in the case of Whittington Hospital NHS Trust v. XX, regarding the possibility of considering the costs for commercial surrogacy arrangements in California as a recoverable head of damage. The commentary analyses the divergent conceptions of public policy and legal policy illustrated in the majority and dissenting opinions. Forty years after the adoption of law 194/78 on voluntary termination of pregnancy, Italy still encounters difficulties in ensuring prompt access to abortion services. In particular, heated debates on conscientious objection are still ongoing. Given current discussions in other countries, the article suggests adopting a comparative perspective in order to renew the discussion and to address issues concerning, on the one hand, the extent to which a medical practitioner may refuse to participate in abortion procedures and, on the other hand, the necessity to guarantee full implementation of the law despite a limited number of doctors willing to perform abortions., BioLaw Journal - Rivista di BioDiritto, N. 3 (2018)
