Abstract

This second edition of a monograph provides updated information on court decisions concerning college student publications and underground newspapers to acquaint advisers, administrators, and students with college student press law. Chapters of the monograph examine freedom of speech on the college campus; the relationship between colleges and student publications; permissible control by administrators; administrators as censors; the conflicting roles of publications advisers; a publication's responsibilities in the areas of libel, privacy, and obscenity; advertising; and additional matters of concern, such as contempt, copyright, endorsements, and broadcasting. 3. A Ban on Prior Restraint in High Schools: The Aftermath of the 'Fujishima' Decision.

Abstract

After a unique court decision forbidding prior restraint in public high school publications in three states, a study was devised based on the responses to individual questionnaires sent to principals, faculty advisers, and student editors in each of the schools in the judicial district involved in the decision. Respondents answered questions concerning school size and location, frequency of newspaper distribution, newspaper sponsorship, and supervision of the paper. Other questions dealt with censorship, underground newspapers, freedom in high school newspapers, and personal familiarity with the court decision. Advisers and principals answered additional questions regarding their journalism experience and training and their practices for reviewing printed material. The results disclosed the following: only 10% of the advisors and 15% of the principals were familiar with the court decision; the decision did not precipitate an increase in campus disruptions; the journalism atmosphere was less restrictive in large communities and schools; and principals and advisers with academic or professional backgrounds tended to give students more freedom. The lack of consistency among the schools in permitting student freedom indicated that the court decision had little effect on high school journalism. (MAI)

Abstract

There has been a troublesome anomaly in the UK between cash payment to men for sperm donation and the effective assumption that women will pay to donate eggs. Some commentators, including Donald Evans in this journal, have argued that the anomaly should be resolved by treating women on the same terms as men. But this argument ignores important difficulties about property in the body, particularly in relation to gametes. There are good reasons for thinking that the contract model and payment for gametes are both inappropriate, and that a model based on altruism should be applied to both sexes. Abstract

The "marketplace of ideas' is not only an enduring metaphor to describe how freedom of expression works in a democracy, but it also is a real-world "guidebook" for everyday legal decision making and interpretation of the First Amendment. This article asks the reader to move beyond the "marketplace" metaphor to discover a deeper mythic and metaphoric image that transcends the social, political and economic world of cases and controversies. Using the hermeneutic/ objectivist approach put forward by Paul Ricoeur, this article analyzes the metaphoric language of six major Supreme Court decisions that span 70 years of First Amendment interpretation. The result is the uncovering of a new framing metaphor--the GUARDIAN--that transports our thinking about freedom of expression into our deepest myth-consciousness. This article demonstrates how mining our legal texts for new meanings of freedom of expression, unencumbered by traditional philosophical or methodological paradigms, may reveal new understandings about ourselves and our ideology. Abstract

This article provides information on problems experienced by newspapers in the southern region of the U.S. after the American Civil War. Problems experienced by newspapers during the war include shortages of paper and ink, and lack of transportation and postal services. Most of the newspapers were suspended during the war. After the war, editors were able to revive prewar newspapers, while others started new journals.
