Allocation of a child's custody after divorce relies upon the universal principle of the child's best interest. Nevertheless, it is argued that despite its seemingly gender-neutral nature, one of the shortcomings caused by the uncertainty of such a principle is that it paves the way for gender discrimination. As a result, the topic of child custody has increasingly been mentioned in the framework of equality between men and women, as shown by references made to the relationship between custody law and gender equality both in international instruments relating to women's rights and in those relating to children's rights. In this paper we analyze the relationship between different interpretation methods of the seemingly gender-neutral principle of the child's best interest and gender equality in the context of allocation of custody after divorce. We go through the tender years, primary caretaker and joint custody concepts, which are the methods used or proposed to be used to concretize the principle of the child's best interest in different law systems and in Turkish law and contemplate whether they enable to achieve the goal of gender equality. On the grounds of these findings we discuss whether it is possible to achieve a child custody law which can reconcile the principle of the child's best interest with gender equality. / Boşanma sonrasında çocuğun velayetinin kimin tarafından icra edileceği sorunu evrensel bir ilke olan çocuğun üstün yararı ilkesi çerçevesinde çözümlenmektedir. Land consolidation is divided into voluntary consolidation and compulsory consolidation based on whether the consent of the owner(s) of land is required. Compulsory consolidation takes place especially in case of land arrangement based on zoning rules and consolidation of agricultural land. In case consolidation is made by an administrative act based on public law rules, the transfer of real (proprietary) rights and personal rights that are annotated in the land registry can cause complex problems. The Turkish Civil Code contains only provisions about the transfer of security interests onto the new land. The practice of land registry administrations does not comply with the spirit and purpose of this provision. The method suggested in the academic literature is in compliance with this provision. However, it requires complex calculations and cannot provide adequate solutions to all relevant problems. In this article, an alternative method is proposed. In all cases, i.e. even if the consolidated lands are owned by the same person, ownership with shares*** should be established on the new land. The increase in overseas activities of multinational corporations due to globalisation has also augmented the discussions over overseas human rights violations of such corporations. According to the discussions under international law, holding corporations directly liable for human rights violations remains yet a disputed issue. Against the backdrop of debates under international law, the liability of multinational corporations arising from tort law has become an alternative legal ground for holding multinational corporations accountable for their overseas wrongs. In a dispute where the parent company is domiciled in England and its subsidiary is domiciled in a foreign country, victims who suffer from the activities of the subsidiary may file compensatory claims against both the subsidiary and the parent company before English courts based on principles of tort law. This article examines civil jurisdiction of English courts about such disputes. In this context, initially the debates in international law regarding the human rights liabilities of multinational companies are briefly touched upon, then the Civil Procedure Rules are examined followed by an analysis of the Vedanta v Lungowe and Okpabi v Shell decisions. / Küreselleşme ile beraber çok uluslu şirketlerin özellikle gelişmekte olan ülkelerdeki sınır ötesi faaliyetleri arttıkça bu şirketlerin sınır ötesi insan hakları ihlallerine ilişkin tartışmalar da yoğunlaşmıştır. This article analyzes the acquisition of Turkish nationality based on the filiation principle, according to the Turkish Nationality Law, and questions the possible legal effects of a subsequent termination of the filiation relationship, which constituted the legal basis for the acquisition of Turkish nationality. Within this framework, we presented the filiation principle in the acquisition of Turkish nationality and the retroactive effect of the termination of the filiation relationship between a parent and a child according to the Turkish Civil Code. In considering the effects of termination of the filiation relationship on nationality, we considered the provisions of the European Convention on Nationality, Swiss, and French laws. Possible legal effects of a subsequent termination were further analyzed according to the provisions of the Turkish Nationality Law and the views of the legal doctrine. In conclusion, we assert that a person shall maintain his/her Turkish nationality despite the subsequent termination of filiation, and an explanatory provision to this effect shall be inserted into the relevant legislation in order to guarantee legal certainty. / Bu çalışma kapsamında, Türk vatandaşlık hukuku uyarınca soybağı esasıyla vatandaşlık kazanılması ve Türk vatandaşlığının kazanılmasına temel teşkil eden soybağı ilişkisinin sonradan ortadan kalkması halinde, soybağı üzerindeki bu değişikliğin Türk vatandaşlığı açısından olası hukuki sonuçları incelenmiştir. In Turkish and Swiss law, if a bailee (third party) is in possession based on a legal relationship with the bailor, the bailor (transferor) can transfer the indirect (constructive) possession by an agreement with the transferee without the consent of the third-party bailee. The Turkish Civil Code (CC) - like the Swiss Civil Code - contains some provisions intended to prevent any negative effect from such an agreement on the interests of the third party. First, the transfer of indirect possession by agreement between transferor and transferee has no legal effect on the third party until that party is notified by the transferor (Article 979/11 of Turkish Civil Code [CC]). This period of ineffectiveness ends upon notice to the third party. However, the third party can refuse delivery to the transferee based on the same defenses that could be invoked against the transferor (Article 979/III CC). Contrary to the prevailing view in Turkish and Swiss literatures, this study argues that the above-referenced provision allows the third party to invoke defenses based on personal rights besides those based on property rights. However, this provision is only applicable to the transfer of indirect possession of chattel. In contrast to a recent opinion in Swiss literature, notice of the transfer does not cause the transferee to become a new party to the legal relationship between the original third-party bailee and transferor. Turkish and Swiss law includes only a provision about lease contracts to that effect. This provision is applicable with regard to the lease of personal and real property. Given the increased population, extending the state's duties very much day after another, and also in order to provide the public interests, states should inevitably hold different contracts with various divisions of society. The governmental contracts have so far classified into two types of the governance and commissioner which their principles and rules are different from each other. In other words, the principals of commissioner contracts make the state follow the private and civil law. Additionally, considering the role of the state as the other party contracts and employer or goods buyer, and providing the public interests, which the private and public contracts taken into account in England, the private governmental contracts are based on principles and rules rooted deeply in the governance role of the state and its being representative in providing the public interests. The state cannot act disregarding its representative role such as the parties of civil contracts. So, the states usually include special condition in their private contracts and apply some principles in these contracts to make them similar to their public contracts. However, there are some differences between these two types of contracts which distinguish them. Actually, their common denominator, their accomplishment and signing up are to provide the public, state and society interests. This makes different the private contracts of the state from the private sector and also, principles dominating them are very different from those affecting the civil contracts.

The thesis reviews the online intermediary liability framework of the E-Commerce Directive (in Articles 12 - 15) along two research questions. 1) Is the current legal framework regulating content liability of online platforms under the ECD still adequate when it comes to combating illegal content? 2) Are there alternative models for intermediary regulation that are better suited to include internet intermediaries in the fight against illegal content? These questions were formulated against the premises that unlawful content online has been a persisting and growing problem and that the position of online intermediaries today makes enhanced responsibilities on their part necessary. The thesis undertakes to analyse the nature of the enforcement challenges in the EU when trying to engage online platforms under the current liability framework, and charts out an alternative approach to holding online platforms responsible. Chapter 3 reviews the current intermediary framework in the EU and the horizontal challenges of holding internet intermediaries liable. This is analysed against the backdrop of the proliferation of the internet and online platforms, sketched out in the preceding Chapter 2. Due to the ambiguity and outdatedness of the ECD provisions, on the one hand, and different national secondary liability traditions, on the other hand, the liability protections of online platforms have been interpreted and applied differently by EU Member States, and most importantly courts, leading to an uneven and ineffective enforcement landscape. Chapter 4 analyses sectoral provisions that cover different kinds of offences related to unlawful content and their interactions with the ECD and national legislation on intermediary liability. The thesis evaluates enforcement efforts in the areas of defamation, hate speech, terrorist content, copyright, trademarks, product safety and food safety. Arbitration and multi-tier dispute resolution clauses may contain a time limit to commence arbitration. The expiry of such a time limit could have different legal results. First, it could make the arbitration clause ineffective. Second, it could extinguish the claim or prevent its enforcement through legal proceedings. In the latter case, the contract provision about the time limit would have to be examined with regard to its compliance with mandatory provisions of the law applicable to limitation periods. Even the determination of the law applicable to limitation periods causes considerable difficulty. It is another difficult issue to determine which provisions of the law applicable to limitation periods are mandatory and, if so, whether the contract provision complies with the limits of the law. Constitutional dismemberment is one of the main consequences attached to constitutional amendments that Albert's book analyses. After having analyzed Albert's definition, the present essay focuses on the practice of constitutional dismemberment via referendum and discusses whether, in times of populism and democratic decay, the constitutional design should provide for specific measures in order to protect the political opposition from the allegiance between the populist leadership and the majority of the population. Building on the existing literature and on a comparative analysis, the essay concludes by highlighting the pros and cons of introducing special protections for political minorities during constitutional referenda to protect democracy against populist deviations, suggesting the need to provide further studies in this field. / O desmembramento constitucional é uma das principais consequências associadas às emendas constitucionais que o livro de Albert analisa. The civil war in Syria coupled with the attacks by ISIS, has resulted in one of the largest humanitarian crises since World War II. Although international efforts have resulted in regaining control of important cities, these military approaches have escalated and inflamed the violence of which innocent civilians bear the consequences. The continuing violence and resulting threats or insecurities negatively affect the lives, freedom, dignity and development of the people to name but a few. For that reason, the aim is to explore the applicability of a human security approach to the conflict in Syria that focuses on, among other aspects, minimising violence, mitigating the effects of the conflict, protecting people, restoring peace and eliminating the grounds that resulted in the development of these conditions in the first place.

The development of global information and transportation technology is accompanied by the development of criminal acts that no longer recognize jurisdictional boundaries, so that the response requires joint handling of world countries. Mutual assistance in criminal matters is one way to stop fraudulent acts of criminals who want to hide assets. The implementation of the Mutual Legal Assistance System was realized in the implementation of Law Number 1 of 2006 concerning Reciprocal Assistance in Criminal Issues, namely by establishing cooperation with countries that have the potential to be used as hiding places or to save income from the crime. This study addresses the arbitrability of corporate law disputes and the validity of arbitration clauses stipulated in the articles of association (AoA) of joint stock companies, and compares Turkish law with German and Swiss jurisdictions in particular. While corporate law disputes are considered arbitrable, disputes concerning invalidity of corporate decisions and actions for dissolution are heavily debated. The paper argues that both types of disputes are arbitrable, albeit judicial dissolution requests accommodate practical hurdles. It is also argued that arbitral awards should be granted the erga omnes effect, as long as the interested third parties are provided with the necessary procedural protection. Furthermore, arbitration clauses can be validly stipulated in the AoA of privately held joint stock companies. However, the binding effect of the arbitration clause in question depends on its legal nature, namely, korporative or formell. Addressing this issue, the paper proposes to adopt a two-step test. Finally, it suggests practicable legislative recommendations and a model arbitration clause in order to enable and facilitate arbitration in corporate law disputes., NA

The topic of analysis of this paper is the crime of "Failure by Medical Professionals to Report an Offence", found in article 280 of the Turkish Criminal Code numbered 5237. The crime is situated in the second part, titled "Crimes against the Judiciary", under the fourth section, titled "Crimes against the Nation and the State", under the second book of the Code, and is the equivalent of Article 530 of the annulled Turkish Criminal Code numbered 765. Pursuant to Art. 280, medical professionals who encounter an indication pointing towards a crime in the course of their duties, and do not notify the authorities of that fact or show delay in their notifications, are punishable by imprisonment. The lack of any limitation concerning the encountered crime which would create the obligation to report caused the medical professionals to face an obligation of substantial extent. Throughout the analysis of the crime, the doctrinal discussions concerning the crime are evaluated. In this context, the topics such as the norm's protected legal value, the scope of the term medical professional, the status of medical professionals in the public sector, the definition of the term indication in relation to the crime and whether documents and statements are included, whether the crime is committable by probable intent, whether the patient-doctor privilege, the right to be excused from testifying or the obligation to give treatment are justifications for the crime, and the rules of aggregation between TCC Art. 280 and similar crimes are explained. / Bu çalışmada, 5237 sayılı Türk Ceza Kanunu’nun 280. maddesinde düzenlenen “Sağlık Mesleği Mensuplarının Suçu Bildirmemesi” suçu ele alınmaktadır. The debate over the exercise of primary and secondary constituent power is a long-lasting one and is grounded on positions diverging according to the interpretation of constitutionalism and democracy, and to the conception of constitution's flexibility. In order to safeguard the sacrality of fundamental Charter at the same time ensuring its flexibility, framers, moreover after WWII, entrenched therein both specific procedures for the exercise of the secondary constituent power and clauses for the protection of constitutional fundamentals. After the exhaustion of the primary constituent power, a relevant role has been played by Supreme Courts, which ensured the enforceability of the abovementioned clauses and procedures, and, in some cases, inferred them in the lack of explicit constitutional provisions. The Brazilian Supremo Tribunal Federal (STF) is among those Courts which had to infer their competence in reviewing constitutional amendments from the unamendability clauses entrenched in the Charter. On January 2018 significant amendments to the Criminal Law and the Law On the Procedure for Application of the Criminal Law came into force in Latvia. These changes not only in the first time introduce the criminal responsibility for the emotional violence, but also determine the procedure for assessing emotional disparity, equating the effects to telepathic injuries.In the article, the author reviews a modality of crime “persecution” - cyber-persecution. Although the legislator in the annotation of the law provides that the article also shall be applicable to acts committed in cyberspace, at the same time, the author indicates some problems that may arise due to the narrow interpretation of the law by the law enforcement. The purpose of the article is to study the object (protected legitimate interest) and the objective side (actus reus) of the offense - cyber-stalking. For purposes of research, several methods have been used. The method of comparative analysis, for examination and comparison of external and international regulations. Methods of legal interpretation used to disclose the differences between the understanding of the written text of the definition of the crime and what ought to be understood in the meaning of the norm. Finally, the author presents the conclusions and proposals on the application of the norm.

Article 531 of the Turkish Commercial Code grants the right to request corporate dissolution for just causes to shareholders representing at least 10% of the capital in joint stock companies, and 5% in publicly traded companies. In addition to dissolution, the court can order purchase of the claimant's shares at real value (buy-out remedy) or adopt a different solution. This article conducts an economic analysis of the buy-out remedy against minority oppression and compares Turkish law with Swiss and English legislation. The buy-out remedy is supposed to provide an ex post control on the controller's conduct, and it is expected to function as a put option conditional upon oppression. However, the current provision does not provide the expected incentives. Addressing this issue, I suggest that: (1) the relief sought by the claimant should be taken into account; (2) the purchaser of the claimant's shares should be the oppressive controller, rather than the company in question; (3) the standard of 'just cause' to be proven should not be equal for each remedy, and thus, the courts should be able to give a buy-out order even if the facts do not justify corporate dissolution; (4) dissolution orders should not be given in cases where there is a going-concern value to protect; and finally, (5) the valuation of the claimant's shares should, in principle, be made on a going concern and pro rata basis, and any depreciation of the claimant's shares due to the controller's abusive conducts should be taken into account., Dr. Nusret-Semahat Arsel International Business Law Implementation and Research Center (NASAMER) of Koc University Law School

The paper has presented an empirical picture of inequalities, both within and outside the labour market for women, from gender relations emerging within the framework of overlapping social stratification in rural India. Analysis is based on secondary data, where the emphasis is not only on measurement of quantitative variables, but also on the interactions between various qualitative, socio-economic and socio-cultural variables. Main finding of the present study is that the participation of women in labour force varies across economic classes, social groups, religions, regions and the rural urban divide. Factors determining labour supply decisions of women are different from those of men. Interconnectedness of female employment with other social parameters which are outside the realm of the standard labour market analysis gets highlighted in the study.

In recent years, the Gulf Cooperation Council (GCC) states have been increasingly willing to ratify United Nations human rights instruments. This article examines the underlying rationales for these ratifications and the limited range and drivers of subsequent domestic reforms post ratification. Drawing on both a quantitative analysis of engagement with the UN treaty bodies and Charter-based mechanisms in over 120 UN reports and qualitative interviews with over sixty-five government officials, members of civil society, National Human Rights Institutions, lawyers, and judges from all six states, this article argues that in the GCC states, UN human rights treaty ratification results from a desire to increase standing in the international community. This series consists of maps sent to the Secretary of State to complete the application of the U.S. Attorney General to enable the federal government to have sole jurisdiction over Fort Drum military reservation. Information on maps include area and description of the original reservation, custody and accountability of acquired and disposed acreage, and boundary lines of the installation as completed from deed descriptions and aerial surveys. Maps are base maps revised to show boundary changes and new markers.

This series consists of maps sent to the Secretary of State to complete the application of the Attorney General of the U.S. for cession of jurisdiction to the U.S. from the State of New York of the Federal Correctional Facility at Otisville, New York. The maps represent a property survey showing two parcels covering Orange and Sullivan counties and land in the Town of Mt. Hope, Orange County. Included are full property descriptions showing easements, property lines, roadways, and other physical features.

The Organized Crime Task Force (OCTF) was created as a means to increase resources and to fill jurisdictional gaps related to fighting organized crime in New York State. The OCTF prosecutes multi-county, multi-state, and multi-national organized criminal activities happening within New York State. This series documents decisions, policy, investigations, and operations of the Organized Crime Task Force.

This series consists of daily entries of legal papers served, hearings attended, and other business conducted by the Attorney General's Office in New York City. The title of the action is stated for each entry. At the end of each day's entries, the amount of postage is calculated. Some volumes are missing.

This series consists of summaries of proceedings in corporation cases. Most are quo warran to cases, in which public officials or corporations were sued for exceeding their legal mandates; actions to amend or annul corporation charters or grants of land by letters patent; and actions to dissolve corporations. Information includes cause; participant names; nature of proposed action; whether the application was granted, dismissed, or denied; and whether an Attorney General's opinion was prepared.
