From cover memo: "We request your review of the project to plug an unused geothermal well (KA1-1) with respect to the conservation district. The KA1-1 Geothermal Well site is located in TMK (3) 1-2-010 :003, which is in the protective subzone of the conservation district on the island of Hawaii. This location is also known as the Wao Kele 0 Puna rain forest. The well was constructed by True Geothermal in the late 1980's and consists of a 7.8-acre drilling pad, water storage basin and a 7850 feet geothermal well (see Attachment B, Sheet C-1). The plans to use the well for power never advanced and in 2006 the Office of Hawaiian Affairs (OHA) purchased the 25,856-acre parcel on which the well is located. The proposed work includes plugging the well and grading the site to fill a water storage basin (see Attachment B; Sheets C-3, C-5, C-1). The well should be plugged because eventually, if left unattended may pose a health issue as fluids and gasses could leak into the overlying potable aquifer and atmosphere. The water basin is about 10-feet deep and partially lined with a tattered liner. The basin is aesthetically incompatible with the pristine rain forest land use and should be graded over as it could pose a safety issue with the risk of people fall ing in. The work will not impact historic or archaeological properties. The closing of the well by DLNR is also a condition of the Memorandum of Understanding between the Department of Land and Natural Resources, State of Hawaii and the Office of Hawaiian Affairs and signed June 27, 2006."

"This annual report is prepared pursuant to Section 1960-11 , Hawaii Revised Statutes, and covers the period July 1, 2003 through June 30, 2004. The Department of Land and Natural Resources (DLNR) is responsible for the effective management of geothermal resources and its development, to protect the health and safety of the public and to ensure the continued viability of the resource for the future. The Department of Business, Economic Development and Tourism (DBEDT) has no specific regulatory authority, however, through its planning and coordination of energy programs in the State, facilitates the commercial development of geothermal resources. Currently, the Island of Hawaii is the only island benefiting from geothermal development. Power generation from geothermal energy began in May 1993 and currently provides more than 20% of the Big Island's power demands. The Mineral Resources Program within DLNR was abolished in 1995 in response to budget reductions. Statutory regulatory and resource management responsibilities continue to be performed under other Departmental programs within the Engineering Division. The current Administration will assess the geothermal program requirements and review existing policies for continued applicability."

"OHA has entered into an Agreement of Sale with The Trust for Public Lands ("TPL"), a California nonprofit public benefit corporation to purchase that certain real property known as Wao Kele O Puna, (Tax Map Keys: 1-2-10-2 and 1-2-10-3, respectively), consisting of approximately 25,855.891 acres, situated in Puna, Island and County of Hawai'i, State of Hawai'i (the Property), more particularly described in Exhibit "A" attached hereto. The Parties wish to work together to provide proper management ofthe Property and to develop OHA's own capacity to manage lands independently from DLNR. The Parties further wish to preserve the Property's natural and cultural resources and maintain traditional and customary practices on the Property through appropriate resource management. As discussed herein, DLNR will bear initial management responsibility as soon as the Property is designated as a forest reserve. However, management responsibility will be turned over to OHA as LHA acquires capacity, experience and expertise in land management."

"The purpose of this Memorandum of Understanding (MOU) is to clarify and to facilitate the coordination of regulatory responsibilities between the DEPARTMENT OF HEALTH (DOH) and the DEPARTMENT OF LAND AND NATURAL RESOURCES (DLNR) for the cooperative regulatory oversight of geothermal well drilling. The implementation of the purposes of the MOD will assure that all geothermal drilling activities are appropriatelymonitored by the State to minimize the potential for adverse impacts on health and safety of personnel involved in the project and residents of nearby communities."

"This report covers the period July I, 1993 - June 30, 1994. Pursuant to Chapter 1960, Hawaii Revised Statutes (HRS), the Department of Land and Natural Resources (DLNR) established a consolidated permit application and review process. Recognizing that there has been no application for any large-scale geothermal project for the State of Hawaii, Governor John Waihee on December 8, 1992 issued a policy statement stating that there is no such project under consideration by the State. DLNR staff and resources efforts have been appropriately utilized and actively involved in the monitoring and regulation of existing projects currently permitted to explore, develop and generate geothermal electricity exclusively for the Island of Hawaii. Although these efforts relative to geothermal development activities on the Big Island of Hawaii did not involve any aspect of large scale development of geothermal power, the DLNR's activities have been consistent with the objectives and purpose of Chapter 1960, HRS as amended. The allocation of program resources and duties performed by staff have been fully utilized in the DLNR's geothermal resource management responsibilities."

From attached letter: "The enclosed is a CDUA relating to the establishment of 12 Natural Area Reserves. They consist of seven sites on Hawaii and three on Oahu that were previously approved, November 9, 1978, by the Land Board, and two on Kauai, which the Board had approved on September 28, 1979. I hope you will agree that the present CDUA requirement does not validate otherapproved matters (such as assignment of management responsibilities and recommending to the Governor the issuance of Executive Orders) contained in those Board submittals. Also enclosed are copies of letters from the counties of Hawaii, Kauai, and Honolulu, stating the non-requirement of SMA Rules and Regulation review."
