CONSTRAINTS AND DUTIES OF [...], Private equity has become a dominant force in distressed investing and Chapter 11 corporate reorganization. As a result, three new types of attorney conflicts have emerged, each of which threatens to undermine the efficacy and credibility of the bankruptcy system. Bankruptcy judges, practitioners, and scholars must respond. This Comment provides those stakeholders with a doctrinal and normative framework to understand the conflicts that pervade the system. In particular, this Comment defines three types of conflicts, explains how each threatens the functionality of Chapter 11 corporate restructuring, lays the doctrinal groundwork for a new understanding of attorney disinterestedness, and provides solutions to mitigate the relevant conflicts. In doing so, this Comment provides much-needed guidance to bankruptcy stakeholders who are keen to ensure debtor estates receive competent, loyal, and zealous representation.

Abstract

Our study extends and enhances entrepreneurial action theory (EAT) by considering the strategic advantage or disadvantage of impulsive action. To date, EAT has largely sidestepped the role of dispositional impulsivity, limiting its veridicality and inclusivity. Popularized notions of celebrity entrepreneurs and an increasingly large body of empirical research on the prevalence of impulsivity have inspired a reassessment of what drives entrepreneurs. Looking beyond both the anecdotes and well-established prevalence of impulsivity, we develop and illustrate a novel theory concerning the fate of impulsive nascent entrepreneurs who are wired for nondeliberative, less-calculative action. We use an agent-based model and conduct simulation-based experiments involving 2.7 million virtual entrepreneurs to identify and explicate the specific conditions under which impulsivity does or does not generate strategic advantage. Accordingly, we contribute a broader and deeper theorization of EAT, taking notable steps toward the inclusion of nontraditional entrepreneurs and the varied impacts of impulsive action in this domain's evolving conception of new venture emergence. Abstract

We present a measurement of the branching fraction for the decay of the neutral B meson into the final state J/psipi(+)pi(-). The data set contains approximately 56 x 10(6) BB pairs produced at the Upsilon(4S) resonance and recorded with the BABAR detector at the PEP-II asymmetric-energy e(+)e(-) storage ring. The result of this analysis is B(B0-->J/psipi(+)pi(-))=(4.6+/-0.7+/-0.6) x 10(-5), where the first error is statistical and the second is systematic. In addition, we measure B(B0-->J/psirho(0))=(1.6+/-0.6+/-0.4) x 10(-5).

Abstract

Using the CLEO detector at the Cornell Electron Storage Ring, we have found evidence for L=1 charmed mesons in e+e- annihilations. We observe a D**0 state at mass 2461±3±1 MeV/c2 and width 20-12-10+9+9 MeV/c2 decaying to D+-. We also see an enhancement in the m(D*+-)-m(D*+) mass-difference spectrum and by examining D*+ decay-angle dependence, we see structure consistent with two states decaying to D*+-. We observe a lower-mass state, at mass (2428±3±2) MeV/c2 and width (23-6-4+8+10) MeV/c2, assuming that the higher-mass component is from the decay D**0(2461)D*+-. We present arguments for the spin-parity assignments of these states. We also report observation of candidate L=1 cs» state decaying to D*+Ks0. © 1990 The American Physical Society.

28. Engineering Education on the 'Fuzzy' Front End: A High-Technology Entrepreneurship Model

Abstract

We have developed a university entrepreneurship program, culminating in a prototype and business plan, with five objectives: (1) value for all academic participants' (2) introduction to engineering issues for students; (3) refinement of engineering students' "soft" skills; (4) training for students in creating value out of embryonic ideas; and (5) a genuine entrepreneurship opportunity for students who wish to pursue a start-up company. The framework is disclosed in the context of three case studies. Furthermore, educational outcomes are derived and discussed based on participant evaluations and faculty reflection. Value creation is evaluated in terms of student performance in graduation exams, in external competitions, industrial interest, investment, intellectual property creation, and market intelligence. Finally, factors that add value to or redirect university research are discussed in the context to better serve society. (Contains 2 figures.)
