The article examines the peculiarities of bringing members of criminal organizations to criminal liability for crimes in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors, assigning them punishment, concluding plea agreements with them, as well as applying exemption from punishment and serving it. According to results of the study of sentences handed down during 2008–2022, a fairly significant share of crimes committed by criminal organizations in the sphere of trafficking in narcotic drugs, psychotropic substances, their analogues and precursors was established – about 40%. Arguments are given regarding the probable explanation of this fact. Acquittals were issued for 13.6% of the defendants due to the failure of law enforcement agencies to prove that a person committed the crime provided for in Art. 255 of the Criminal Code of Ukraine. The analysis of the results of imprisonment for a certain period of time shows that 51.4% of convicts are sentenced to a milder punishment than provided by law (with the application of Article 69 of the Criminal Code of Ukraine), and 92.7% of convicts are sentenced to either the minimum possible punishment within the sanction of Art. 255 of the Criminal Code of Ukraine, or even lower than the lowest limit established by the sanction of this article. Quite often, plea agreements are concluded with such subjects (57.1%). Since 2017, these agreements have been concluded with 95.2% of convicts. Almost 40% of convicts actually do not serve a prison sentence for a certain period of time, because they are released from serving a probationary sentence. At the same time, the duties imposed on those released do not always contribute to the correction or re-education of convicts. Proposals for solving these problems are made., У статті досліджено особливості притягнення до кримінальної відповідальності учасників злочинних організацій за злочини у сфері обігу наркотичних засобів, психотропних речовин, їх аналогів і прекурсорів, призначення їм покарання, укладення з ними угод про визнання винуватості, а також застосування звільнення від покарання та його відбування. За результатами вивчення вироків, винесених упродовж 2008–2022 рр., встановлено досить значну частку злочинів, учинених злочинними організаціями у сфері обігу наркотичних засобів, психотропних речовин, їх аналогів і прекурсорів – близько 40 %. Наведено аргументи щодо ймовірного пояснення цього факту. Винесення виправдувальних вироків щодо 13,6 % підсудних відбулося через недоведення правозастовними органами вчинення особою злочину, передбаченого ст. 255 КК України. Аналіз результатів призначення позбавлення волі на певний строк свідчить про те, що 51,4 % засуджених призначено більш м’яке покарання, ніж передбачено законом (із застосуванням ст. 69 КК України), а 92,7 % засуджених покарання призначається або в мінімально можливих межах санкції ст. 255 КК України, або навіть нижче від найнижчої межі, встановленої санкцією цієї статті. Досить часто з такими суб’єктами укладають угоди про визнання винуватості (57,1 %). Починаючи з 2017 р., ці угоди укладено із 95,2 % засуджених. Майже 40 % засуджених реально не відбуває покарання у виді позбавлення волі на певний строк, оскільки їх звільняють від відбування покарання з випробуванням. Водночас, обов’язки, які покладаються на звільнених, не завжди сприяють виправленню чи перевихованню засуджених. Висловлено пропозиції щодо розв’язання цих проблем.

A tatuagem era associada à marginalidade e às classes socioeconômicas mais baixas, considerada inicialmente como sinais de contestação ou de comportamentos rebeldes. Lentamente a prática de se tatuar passou a estar presente em todos os níveis da sociedade, implicando mudanças de mentalidade e ressignificação de imaginários. O presente estudo utilizou como referencial teórico a perspectiva psicanalítica, tendo como objetivo refletir sobre a subjetividade humana revelada por meio das tatuagens em pessoas delitivas em cumprimento de pena numa Associação de Proteção e Assistência aos Condenados (APAC). O estudo foi submetido à apreciação ética pelo Comitê de Ética e Pesquisa com Seres Humanos da Faculdade Patos de Minas (FPM) CAEE: 81171717.8.0000.8078. A coleta de dados se deu por meio da aplicação de um questionário elaborado pelas pesquisadoras a partir de um estudo piloto. Além disso, foi utilizada entrevista semiestruturada. A amostra foi composta por 10 participantes. Dos resultados obtidos por este estudo destaca-se: carências, prejuízos em fases anteriores de desenvolvimento, vivências de conflitos e desamparos relacionados a figura paterna. Do total, seis dos entrevistados revelaram que o sentimento atual que possuem em relação as suas tatuagens é de arrependimento. Tattooing was associated with marginality and lower socioeconomic classes, such as contestation or rebellion. Slowly the practice of tattooing was present at all levels of society, implying changes of mentality and resignification of imaginaries. The present study used as a theoretical reference the psychoanalytical perspective, aiming to investigate on the human subjectivities revealed through the tattoos, by delinquent individuals in compliance with the Apac model. Data collection is done through a semi-structured questionnaire. The sample was made by 10 participants. The results obtained in the tattoos are: deficiencies, damages in previous phases of development, experiences of conflict and helplessness related to the father figure. 60% of respondents revealed that the current feeling about their tattoos is regret. El tatuaje se asoció con la marginalidad y las clases socioeconómicas más bajas, como la contestación o la rebelión. Poco a poco, la práctica del tatuaje estuvo presente en todos los niveles de la sociedad, lo que implica cambios de mentalidad y resignificación de los imaginarios. El presente estudio utilizó como referencia teórica la perspectiva psicoanalítica, con el objetivo de investigar sobre las subjetividades humanas reveladas a través de los tatuajes, por individuos delincuentes que cumplen con el modelo Apac. La recopilación de datos se realiza a través de un cuestionario semiestructurado. La muestra fue realizada por 10 participantes. Los resultados obtenidos en los tatuajes son: deficiencias, daños en fases previas de desarrollo, experiencias de conflicto e impotencia relacionadas con la figura paterna. El 60% de los encuestados reveló que el sentimiento actual sobre sus tatuajes es de arrepentimiento.

El presente trabajo tuvo como motivación que a lo largo de mi profesión de abogada y visitas a los centros penitenciarios he observado que muy pocos condenados realizan estudios superiores en los centros carcelarios. Tan solo el INPEC les ofrece educación en manualidades y muy poco en carreras técnicas. La docencia universitaria ayudaría de forma exitosa a la rehumanización del condenado. Y produciría conocimiento a favor de la humanidad. Si un condenado solo aprende manualidades, se vuelve un ser repetitivo, pero no le enseña a cambiar, a tener otras expectativas que mejoren su calidad de vida. Only INPEC offers them education in crafts and very little in technical careers. University teaching would help successfully to rehumanize the convicted person. And it would produce knowledge in favor of humanity. If a convict only learns crafts, he becomes repetitive, but it does not teach him to change, to have other expectations that improve his quality of life. Especialización

Введение: предмет уголовно-исполнительного права является научной катего рией, лишенной формального содержания. Он на протяжении продолжительного периода времени остается в центре внимания отечественных ученых. Несмотря на активное осмысление этой категории в теории уголовно-исполнительного права, наиболее сущностные ее аспекты не получили должного разрешения. В юридиче ской доктрине в содержание предмета уголовно-исполнительного права учеными закладываются различные научные идеи, что в конечном итоге не позволяет в должной мере познать его сущность. Цель: теоретическое обоснование содержания предмета уголовно-исполнительного права. Указанная цель достигается решением следующих задач: определить содержание предмета уголовно-исполнительного пра ва. Методологическая основа: общенаучные (диалектический, анализ, сравнение) и частнонаучные (юридико-догматический) методы. Результаты: предметом уголовно-исполнительного права признается материальное явление, находящееся за пределами законодательства. С учетом служебной роли уголовно-исполнительного законодательства и социально-позитивного результата его действия предметом данной отрасли предлагается рассматривать осужденного в части формирования социально ориентированных ценностей личности, позволяющих вести сознательно законопослушный образ жизни в период отбывания наказания и после освобождения от его отбывания. Выводы: понимание истинного содержания предмета уголовно исполнительного права позволит не только разграничить его от смежных категорий, но и определить предназначение данной отрасли.

На підставі здійсненого аналізу змісту визначених у законі обов’язків для органів пробації виявлено проблемні питання, що стосуються виконання покарання у вигляді позбавлення права обіймати певні посади або займатись відповідною діяльністю відносно засуджених за злочини у сфері пенсійного та соціального забезпечення України, а також запропоновано науково обґрунтовані заходи щодо їх вирішення по суті. In the article, based on the analysis of the content of the duties specified by the law for probation bodies, the problem issues concerning the execution of a sentence in the form of deprivation of the right to occupy certain positions or to engage in appropriate activities regarding those convicted of crimes in the sphere of pensions and social security of Ukraine, as well as Proposed scientifically substantiated measures on their solution in essence. На основании проведенного анализа содержания установленных в законе обязанностей для органов пробации определены проблемные вопросы, относящиеся к исполнению наказания в виде лишения права занимать соответствующие должности или заниматься соответствующей деятельностью относительно осужденных за преступления в сфере пенсионного и социального обеспечения Украины, а также предложены научно обоснованные мероприятия, направленные на их решение по существу.

The bachelor thesis is focused on the possibility of integrating criminals back into society. In the theoretical part are introduced the main terms and issues to layman, thanks to the literature and acquired information. In the practical part will be described the process of data collection up to the results of the research. The main aim of the bachelor thesis on "Possibilities of social integration of criminals back into society"is to clarify the integration of the perpetrator of criminal activity back into society after release from imprisonment. In a secondary goal will be found out whether the needs of released prisoners, when they are reintegrated into society, correspond to the possibilities provided by our society.

Обосновывается необходимость приобретения навыков и умений у сотрудников для выявления склонности к отклоняющемуся поведению у осужденных., In article it is specified, that educational and preventive work is directed to colonies on positive style of a life of the young condemned. The author specifies, that in a colony at psihologo-pedagogical influence on the condemned pedagogical work is conducted. In article problems of the organisation of the timely decision of exciting questions are considered. Necessity of acquisition of skills and abilities at employees for revealing of propensity to deviating behaviour at the condemned is proved.

The article considers the question of the need for incentive institutions in the framework of the criminal-executive law, as effective incentives associated with the formation of convicted law-abiding behavior in order to quickly respond to positive changes in the behavior of convicted persons ready to take the path of correction. The need to distinguish between the notions of “institution of encouragement”, “norm of encouragement” and “incentive measure”, which should not be regarded as identical, is analyzed. The author proposes the definition of the incentive norm in accordance with the analysis of the opinions of legal scholars and the provisions of the criminal executive legislation. The article analyzes the concept of the incentive norm and, as a consequence, the allocation by the author of its structural element — the incentive measure — a narrower concept than the “incentive norm”. The author pays attention not only to encouraging institutions in the criminal-executive law, but also to their complex, multidimensional interaction with the provisions of the branches of various sciences, such as psychology, pedagogy, sociology and a number of others. Special attention is paid to the role of pedagogical, educational activity and its influence on the process of correctional impact on convicts., Рассматривается вопрос о необходимости поощрительных институтов в рамках уголовно-исполнительного права, как действенных стимулов, связанных с формированием у осужденных правопослушного поведения, позволяющего быстро реагировать на позитивные изменения поведения осужденных лиц, готовых встать на путь исправления. Анализируется необходимость разграничения понятия «институт поощрения», «норма поощрения» и «мера поощрения», которые нецелесообразно рассматривать как тождественные. Автором предлагается определение поощрительной нормы в соответствии с анализом мнений ученых-правоведов и положений уголовно-исполнительного законодательства. Анализируется понятие поощрительной нормы и как следствие — выделение автором ее структурного элемента: меры поощрения — более узкого понятия, нежели «поощрительная норма». Уделяется внимание не только поощрительным институтам в уголовно-исполнительном праве, но и их комплексному, многоаспектному взаимодействию с положениями отраслей различных наук, таких как психология, педагогика, социология и ряд иных. Уделяется особое внимание роли педагогической, воспитательной деятельности и ее влиянию на процесс исправительного воздействия на осужденных.

In the article on the basis of the analysis of scientific literature, the essence and content of activities connected with the prevention of crimes committed by the personnel of the penitentiary institutions in connection with the use of force against the convicts are determined, as well as the main problems that arise in this way are determined. , and formulated scientifically substantiated proposals for their substantive resolution. As practice shows, in the structure of crimes committed by the personnel of the penitentiary institutions of Ukraine, a significant place is occupied by those related to the use of force against the convicted persons. In particular, only in 2016, the share of these crimes in the total number was 7%. The essence of this problem lies not only in the fact that in this way the staff of the penitentiary institutions undermined the authority of the state authorities and encroached on the administration of justice in Ukraine, but it also manifests itself in the ineffectiveness of the activities related to the prevention of crimes committed by the said persons in the field of execution of sentences. In turn, one of the conditions conducive to such a state of preventive activity is the low level of theoretical and practical knowledge related to the essence and content of the prevention of crimes involving the personnel of penitentiary institutions. Consequently, there is a complex application problem that needs to be solved, including at the doctrinal level. Proceeding from this, the main task of this scientific article was to find out, on the basis of the analysis of scientific literature, the essence and content of prevention of crimes committed by the personnel of penitentiary institutions in connection with the use of force against convicts and the development of scientifically grounded measures to solve existing problems.&nbsp

Planteamos una lectura comparada a partir del sema proceso en las novelas Condenado sin proceso, de Nacer Wabeau, y El proceso, de Franz Kafka; en tanto, en ambos textos, el juicio y la condena surgen como imposiciones contra sujetos inocentes, incapaces de hacer valer su derecho de libertad. Los personajes pasan por el filtro de un castigo injusto y a todas luces dirigido a imponer penas sin asidero de verdad. We propose a compared reading from the topic “process” in the novels Condenado sin proceso, by Nacer Wabeau, and El proceso, by Franz Kafka. While in both novels the judgement and the sentence arise as imposition against innocent subjects, unable to assert their right of freedom, they go through an unfair punishment filter, which in all lights directs the imposition of the penalty without basic truth.

This master thesis examines the influence of short-term prison sentences on social and psychological development of individuals imprisoned in prison. It is struggling to find and define phenomena that may affect the personality of the individual in prison facili-ties.The thesis defines the professional key concepts that relate to the topic penitertiary environment. It is specifically about those concepts, which are known only to a small circle of people (mainly people who are involved in prisonry). Specifically, the notions of punishment, convicted persons, treatment programs, penitentiary problems or institu-tionalization. It also describes the psychological and social aspects with which the pri-soners face in prison.The issue of short-term prison deals with the practical part of the thesis as the respondents were using individuals who were sentenced to imprisonment of up to one year. Information is processed through interviews and questionnaires records (it is possible to write even a case study).

Розглядається поняття «пенітенціарна система» і використання його на різних етапах розвитку української держави. Відзначається, що сьогодні в Україні застосування даного поняття поширюється. Проте в юридичній літературі і на законодавчому рівні відсутній єдиний підхід до визначення його змісту. У широкому сенсі, пенітенціарна система – це сукупність взаємопов'язаних і взаємообумовлених державно- правових засобів, методів і гарантій, спрямованих на досягнення цілей кримінального покарання в діяльності органів і установ виконання покарань; у вузькому сенсі - це система органів і установ виконання покарань. The concept of «penitentiary system» and its usage at various stages of Ukrainian state development is dealt. It is noted that in Ukraine, this concept is now used increasingly. However, there is no single approach to defining its content in the legal literature and in the legislature. Broadly penal system is an accumulation of interdependent and interrelated state remedies, methodologies and guarantees which are directed to achieve the goal of criminal justice in the activity of bodies of the penal system. In the narrow sense, it is the system of the bodies of the penal. The penal system have to be oriented for the model of the transitional type functioning which combines a conventional humanitarian strategy for the execution of a punishment by reference to the national actuality, requirement strengthening the rule of law and the real resource capabilities.

В статье рассматривается содержание и реализация обязанностей, устанавливаемых виновному лицу в обязательном порядке при назначении уголовного наказания в виде ограничения свободы. Указывается на проблемы законодательной регламентации данных обязанностей в нормах уголовного и уголовно-исполнительного законодательства, предлагается внесение соответствующих изменений., In article the maintenance and realization of the duties, established to the guilty person is considered without fail at criminal sentencing in the form of freedom restriction. На основі порівняльно-правової методології виявлено співвідношення та розбіжності правового статусу засуджених в Україні з міжнародними нормами і стандартами з прав людини. Встановлено, що на сучасному етапі державної політики з виконання покарань все більше виокремлюються проблемні питання, пов’язані з правами людини. Based on comparative legal methodology the ratio of differences of legal status of prisoners in Ukraine towards international norms and standards on human rights are found. It is established that at the present stage of state policy of punishment implementation much more issues related to human rights are distinguished.

The aim of my bachelor work is to map the problems of crime related to the distribution and the use of drugs over the last eleven years. The problems of drug related crime involve many contradictory attitudes, opinions and conflicts in the field of academy, politics and medicine as well as the public opinion of citizens. That is why the aim is not to map this complicated phenomenon in a comprehensive way, but to use the form of a brief survey of chosen crimes that I consider to be serious offences under the influence of drugs and in connection with their use. My bachelor work should be in service of students alone or other readers as the source of data related to these wide-ranging problems. In my bachelor work I would like to map the relation between the distribution of drugs and the subsequent crimes, committed under their influence. An ordinary citizen has a relatively slight chance to get acquainted with the up-to-date drug statistics. He or she stays depended on the occasional and rather exceptional news in daily newspapers and magazines. The occurrence of drug related problems cannot be eliminated by education, within the widest meaning of the word, or prevention, or the most sophisticated legislative acts. However, precautions performed in a large number of social groups (family, school, sport and cultural offer, media, health institutions{\dots}) can reduce the number of users as well as the risks associated with the use. That is why I concentrated on the mapping of serious crime in connection with the use of narcotic and psychotropic substances. The work can serve as a survey for students as well as for lecturers teaching at universities so they could study the problems of drug related crime and subsequently design effective precautions either in the form of preventively training actions, or as a valuable piece of knowledge used in practice by the students of Faculty of Health and Social Studies, University of South Bohemia in České Budějovice. This work can also provide valuable material for evaluation of the present development of given area as well as the prediction of the future development. Quantitative research was selected as a method of work. Secondary data analysis served as a source of information, which was provided by CR Police-District Headquarters in Český Krumlov, the division of statistics, the Institute of Criminology and Social Prevention of the Czech Republic and the Ministry of Justice of the Czech Republic. On the basis of findings presented in my bachelor work it is possible to expect another growth of drug related crime in the future. It could be said that the drug related crime will considerably influence the development of general crime, not only in terms of quality but also in terms of quantity.

Quando se analisa o número de arguidos e condenados por crime de incêndio e se cruza com os registos desse crime feitos pelas autoridades, mesmo tendo em conta a falta de informação e a sua reduzida qualidade, verifica-se a existência de alguns problemas no respeitante à investigação das causas e à investigação criminal conducente à constituição dos referidos arguidos Analysing the number of accused and condemned by forest fire crime and crossing it with the registers of the same crime made by authorities, evenhaving in account the information lack and it reduced quality, we verify the existence of some problems concerning the research of the causes or the criminal investigation
