Resumen El objetivo del presente trabajo fue estudiar el efecto que tienen las motivaciones para consultar y escribir e-WOM sobre el compromiso con el e-WOM y la influencia de dicho compromiso en la adopción del e-WOM consultado. Para analizar estas relaciones, se realizó una investigación empírica aplicada en el contexto de los restaurantes. El ámbito geográfico fue Ecuador, con una muestra de 461 consumidores. Se utilizó un modelo de ecuaciones estructurales y se validó la cadena de relaciones. Los resultados confirmaron las relaciones entre estas variables; además, se presentaron implicaciones académicas interesantes para profundizar en el estudio sobre el compromiso con el e-WOM, así como implicaciones para la gestión de restaurantes orientadas al manejo de sus plataformas virtuales o redes sociales. Abstract The objective of this work is to study the effect that motivations for consulting and writing e-WOM have on the commitment to e-WOM and the influence of said commitment on the adoption of the e-WOM consulted. To analyze these relationships, an empirical research applied in the context of restaurants was carried out. The geographic scope was Ecuador with a sample of 461 consumers. A structural equation model was used, and the chain of relationships was validated. The results confirmed the relationships between these variables, presenting interesting academic implications to deepen the study of commitment to e-WOM, as well as implications for the management of restaurants oriented to the management of their virtual platforms or social networks. Curs: 2018-2019, Tutores: Cristina Pellisé de Urquiza, Cristina González Beifuss, The Singapore Convention on Mediation is a new multilateral treaty aiming to provide a worldwide uniform, efficient framework for the recognition and enforcement of mediated settlement agreements that resolve international commercial disputes which countries will be able to be part of it. This paper will analyze and explain the text of the Convention in a language accessible to non-lawyers as well as will compare the treatment given to the enforcement and recognition of mediated settlement agreements resolving international commercial conflicts by the Convention, by Spanish law and by Brazilian law. The results will show that currently the treatment given to the subject matter vary from country to country and the Convention. This result highlights the importance that each country reviews the terms of the proposed Convention analyzing the impacts of becoming a part of it and, if the decision is to became a part of the Convention, the approach that will be given to certain subjects when internalizing the Convention in its legal system.

Uzlaştırma müessesesi, mağdur haklarının korunması yönündeki gelişmeler neticesinde ortaya çıkan onarıcı adalet anlayışının uygulamalarından biridir. Bu müessese aslında kültürümüze yabancı olmayan bir kavram olmasına rağmen ne yazık ki Mülga Türk Ceza Kanunu ile Mülga Ceza Muhakemesi Usulü Kanununda yer almamakta idi. 2005 yılında yapılan düzenleme ile mevzuatımıza ilk önce Türk Ceza Kanunu ile girmiş olup daha sonra yapılan değişiklikle Ceza Muhakemesi Kanunumuzda yer almaya başlamıştır. Uzlaştırma sürecinde yer alan aktörler; uzlaştırmacı, mağdur ve faildir. Bu müessesenin temelinde, mağdurun mağduriyetinin giderilmesi ve failin yargılama ortamına yönlendirilmemesi yer almaktadır. Uzlaştırmacı tarafından, taraflar arasında iletişim kurulması sağlanarak tarafların özgür iradeleriyle aralarındaki husumet giderilmeye çalışılmaktadır. Bu bağlamda uzlaştırma, alternatif uyuşmazlık çözüm yöntemlerinden biridir. Uzlaştırma, yargının iş yükünün azaltılması ve toplumsal barışın sağlanmasına katkıda bulunmaktadır. Bu çalışma ile uygulanmaya yeni başlanan ve Türk Ceza Hukuku’nda önemli bir yere sahip olan uzlaştırma müessesesi anlatılmaya çalışılmıştır. Çalışmada, araştırmanın temel konularını irdeleyen farklı kaynaklardan ve yargı kararlarından yararlanılmıştır. Uzlaştırma müessesesinde köklü değişiklikler gerçekleştiren 6763 sayılı Kanun değişiklikleri, uygulamaya yönelik örnekler ve uygulamada karşılaşılan problemlere yer verilmiştir.--------------------The reconciliation institution is one of the applications of restorative justice comprehension which have arisen in consequence of the developments aimed at protection of the rights of the victims. Even though this institution is a concept that is not distant to our culture, unfortunately it was not existent within the scope of the Repealed Turkish Criminal Law and Repealed Criminal Procedure Law. By virtue of the regulation made in 2005, this institution was first included within the scope of the Turkish Criminal Law and by means of the subsequent amendment, it commenced to be existent within the context of our Criminal Procedure Law. The actors available in the reconciliation process are the reconciler, the victim and the perpetrator. Remediation of the unjust suffering of the victim and non-direction of the perpetrator to the trial environment constitute the fundamentals of this institution. By virtue of ensuring communication between the parties by the reconciler, the hostility between the parties is tried to be settled with the free will of the parties. In this context, reconciliation constitutes one of the alternative dispute settlement methods. Reconciliation contributes to reduction in the work load of the jurisdiction and establishment of social peace. By virtue of this study, the reconciliation institution which has just been commenced to be applied and that has an important place in the Turkish Criminal Law is tried to be explained. Regarding this study, different sources that scrutinize the fundamental matters of the research and judicial decisions were benefited. The amendment law numbered 6763 which conducts profound changes with regard to the reconciliation institution, application-oriented examples and the problems which are encountered in the implementation are specified within the context of the study.

A sociedade de riscos contemporânea é permeada por riscos de ordem concreta e abstrata que relacionam-se respectivamente com a ideia de prevenção e precaução. O contraponto presente entre a certeza científica e a falta de comprovação da ocorrência dos danos no futuro caracterizam respectivamente os riscos mencionados. A possibilidade de ocorrência de danos em suas mais diversas classificações, reafirma a necessidade de medidas aptas a reduzir ou evitar a ocorrência destes resultados. A quantidade de riscos concretos e abstratos que decorrem da sociedade de risco atual requer a prática de medidas tendentes a mitigar a ocorrência de danos a partir deles. O gerenciamento dos riscos faz com que medidas preventivas e precaucionais devam ser tomadas para que o dano ambiental seja abrandado e o meio ambiente protegido para as presentes e futuras gerações. Considerando o cenário de riscos atuais, o objetivo deste trabalho é verificar a contribuição do Termo de Ajustamento de Conduta – TAC como um instrumento de mitigação do dano ambiental. Para tanto, verifica-se a contribuição por meio dos termos firmados no ajustamento para início da restauração da mata ciliar, mitigando de forma preventiva e precaucional o dano com a proteção do bem ambiental. O caso concreto sob análise neste trabalho é o TAC firmado entre o Ministério Público – MP e o município de Santa Tereza/RS sobre os corredores ecológicos da Bacia Hidrográfica do Rio Taquari-Antas. Para a elaboração do trabalho foi utilizado o método hermenêutico a pesquisa bibliográfica e documental com a revisão de doutrina sobre o tema e revisão dos inquéritos civis e TAC que tratam sobre o caso concreto The contemporary society of risks is permeated by risks of concrete and abstract order that relate respectively to the idea of prevention and precaution. The counterpoint between scientific certainty and the lack of proof of future damage characterize, respectively, the risks mentioned above. The possibility of occurrence of damages in its most diverse classifications, reaffirms the necessity of measures able to reduce or avoid the event of these results. The amount of concrete and abstract risks that arise from the current risk society requires the practice of measures to mitigate the occurrence of damages from them. Risk management means that preventive and precautionary measures must be taken to mitigate environmental damage and protect the environment for present and future generations. Considering the scenario of current risks, the objective of this work is to verify the contribution of the Term of Adjustment of Conduct - TAC as an instrument to mitigate environmental damage. For this, the contribution is checked by the terms established in the adjustment for the beginning of the restoration of the ciliary forest, mitigating in a preventive and precautionary way the damage with the protection of the environmental good. The concrete case under analysis in this work is the TAC signed between the Public Ministry - MP and the municipality of Santa Tereza / RS on the ecological corridors of the Taquari-Antas River Basin. For the elaboration of the work, the hermeneutical method was used for the bibliographical and documentary research with the revision of doctrine on the subject and review of the civil inquiries and TACs that deal with the concrete case.

Treballs Finals del Màster Oficial de Comptabilitat i Fiscalitat, Facultat d'Economia i Empresa, Universitat de Barcelona, Curs: 2016-2017, Tutor: Javier Collado Muñoz El objetivo de este trabajo es analizar la normativa y metodología que regulan la determinación del valor en aduana, o base imponible, de las de las mercancías introducidas en el territorio aduanero de la Unión Europea. Se detallará de forma extensa el método principal que se utiliza para obtener dicho valor en aduana, el método de transacción, y se mencionarán y explicarán, de forma más breve, el resto de métodos secundarios de valoración. De la misma forma, se explicarán varios conceptos relacionados, como la documentación involucrada en la declaración en aduana, los Incoterms o la importante figura del representante aduanero. Finalmente, se estudiará una transacción real, a la que se adicionarán supuestos hipotéticos de mayor complejidad, y así poder poner en práctica el contenido del presente trabajo. Para su realización, se analizará la normativa europea vigente que regula el funcionamiento aduanero y se pretende, de este modo, realizar una pequeña introducción al mundo de la tributación aduanera.
