In the judgment of the ECtHR in the case of Association of Academics v. Iceland, the Court commented on two important issues concerning the broadly understood procedure for resolving collective disputes. Firstly, the Court pointed out that "found that the taking of industrial action should be accorded the status of an essential element of the Article 11 guarantee but it is clear that strike action is protected by Article 11 as it is considered to be a part of trade union activity". Secondly, it considered that the institution of mandatory arbitration could be a substitute for the right to strike, which was prohibited due to the need to protect the health of Icelandic citizens. In the context of the issues outlined in this way, the aim of the gloss is to verify the two theses mentioned above. First, the thesis was analyzed according to which the right to strike is not an essential element of freedom of association. For this reason, the jurisprudence of the Tribunal has been discussed against the background of ILO standards, taking into account the doctrine's views on the status of the right to strike in the system of human rights protection and its relationship with other irenic methods of dispute resolution. Secondly, the thesis of the ECtHR was verified, according to which the mandatory arbitration established by the Icelandic legislator in the circumstances presented in the facts of the case does not constitute a violation of the right to strike. As part of the second thesis, the concept of mandatory arbitration and its status in the jurisprudence of the Court, as well as ILO bodies and labor law doctrine were analyzed. The present documentary research work aims to hermeneutically describe and analyze the essential elements of collective freedom of association, from the collective subjects as their holders, within the normative and practical problems derived from the involvement of labor actors. At first, the essential rights that such freedom includes in the substantive labor law and the current regulations are dealt with in a timely manner; to later develop the performance of international organizations regarding the regulations and practice of such rights in Venezuela, in the specific case of the thirteenth Commission of Inquiry appointed by the Board of Directors of the International Labor Organization. And finally, expose actions of civil society around the Decree with Rank, Value and Force of Organic Law of Labor, Workers and Workers, and the more general features of a legislative initiative of the labor movement, of a preliminary draft of the Organic Law of Freedom of Association, as a response to the existing problem. Coming to the conclusion that the labor movement must rebuild itself and resume its historical role in labor relations, to press the necessary changes in the adverse Venezuelan normative and practical context, to seek to achieve effective union freedom. The first part is focused on legislation, subjects and forms of collective labor law. It also describes collective bargaining, collective agreements and collective disputes. The second part of the thesis contains an analysis of the trade union´s activities and recommendations for individual parties to collective bargaining., Fakulta ekonomicko-správní, Studentka přednesla obhajobu práce s názvem:Činnost odborové organizace u zaměstnavatele. Cílem práce je analyzovat činnost odborové organizace v rámci zaměstnavatele. V práci bude provedena deskripce právní úpravy činnosti odborové organizace se zaměřením na problematiku informování a projednávání záležitostí s odborovou organizací v rámci zaměstnavatele a na situace, kdy zaměstnavatel potřebuje k vybraným jednáním souhlas odborové organizace. Bude provedena analýza činnosti konkrétní odborové organizace u vybraného zaměstnavatele. Na základě zjištěných poznatků bude provedena syntéza a podány návrhy a doporučení pro praxi zaměstnavatele, příp. odborové organizace. John Rawls, in his work "A Theory of Justice", explains what to consider the Theory of Justice through the analysis of two principles: the first, which deals with equal basic freedoms for all; the second, which deals with balance and balance in social and economic economies and their connection with accessibility to loads and leadership positions in all. The author states that such principles must be adopted by collective entities that they call Social Institutions, which, in turn, form a basic structure of society. Within the scope of Collective Labor Law, it is identified that the indicators conform to the concept of social institutions described by Rawls, so that it is convenient to analyze the application of the principles of justice in such entities. The applicability analysis of the second principle of justice can be taken as a basis, since indicators are historically more common as institutions that prioritize the voice of white, heterosexual and cisgender men in their internal structure. When performing a critical analysis of the structure of the indicators, we suggest that you apply the second principle of justice, such as the balance of social inequalities, the economy and the opportunity to access loads and positions, assist in the pluralization of the internal environment of such entries, in a way that its demands demand and fight flags normally altered in order to include workers tend to occur in more social, economic and cultural classes, to use a fairer environment, according to Rawls' liberal egalitarian vision of justice. Dissertação de mestrado em Direito Judiciário (Direitos Processuais e Organização Judiciária), O presente trabalho de investigação tem por objetivo discutir a importância da liberdade sindical para o fortalecimento e desenvolvimento das relações de trabalho, como mecanismo de promoção de igualdade entre os agentes desta relação. Será estudado, da mesma forma os direitos sindicais de outros países, em especial, o direito coletivo do trabalho em Portugal, que elevou a liberdade sindical ao texto da sua Constituição de 1976. Visa, também, expor as repercussões legais da liberdade sindical no direito laboral e processual laboral, posto que reflete a afirmação dos preceitos fundamentais de direitos humanos e da dignidade do trabalho e do trabalhador, em cumprimento à sua função social. A liberdade sindical também contribui para que mecanismos legais com notória função de flexibilização das normas trabalhistas, encontrem obstáculos em sua aplicação, pois diante de instituições sindicais representativas e atuantes, as ações voltadas para a redução de direitos em detrimento do poder econômico perdem a sua eficácia, no entanto, as relações de trabalho são fortalecidas pela segurança jurídica e força normativa das leis que protegem o trabalho e os trabalhadores. A crítica principal que se constrói no presente trabalho científico está voltada para a manutenção do regime de unicidade sindical no Brasil, imposta pela CR/1988, que impede que os institutos previstos pela OIT, consoante à liberdade sindical, sejam aplicados em território brasiliano, bem como auxilia enormemente para que os sindicatos sejam enfraquecidos na atuação negocial, frente às entidades patronais, que foram privilegiadas com medidas legislativas que acentuaram as suas vantagens frente aos direitos dos trabalhadores. Com o advento da “reforma trabalhista”, mediante a promulgação da Lei nº 13.467 de 2017, os desequilíbrios se acentuaram e atualmente o Brasil se encontra em um patamar de subdesenvolvimento das normas trabalhistas, com a aplicação de mecanismos antidemocráticos que tornam a luta por direitos dos hipossuficientes ainda mais desigual., This research work aims to discuss the importance of union’s liberty of association for the strengthening and development of labor relations, as a mechanism for promoting equality between agents in this relationship. It will be studied, in the same way, the union rights of other countries, in particular, the labour’s collective rights in Portugal, which elevated union’s liberty of association to the text of its 1976 Constitution. It also aims to expose the legal repercussions of union’s liberty of association in law labor and labor procedure, as it reflects the affirmation of the fundamental precepts of human rights and the dignity of work and the worker, in compliance with their social function. Union freedom also contributes so that legal mechanisms with a notable function of flexibilization of labor standards find obstacles in their application, because in the face of representative and active union institutions, actions aimed at reducing rights to the detriment of economic power lose their effectiveness, however, labor relations are strengthened by the legal certainty and normative force of laws that protect labor and workers. The main criticism built in this scientific work is aimed at maintaining the union unicity regime in Brazil, imposed by CR/1988, which prevents the institutes provided for by the ILO, according to freedom of association, from being applied in Brazilian territory, as well. how it helps enormously so that unions are weakened in their negotiating role, in relation to employers, who were privileged with legislative measures that accentuated their advantages in relation to workers' rights. With the advent of the "labour reform", through the enactment of Law No. 13,467 of 2017, the imbalances have increased and currently Brazil is at a level of underdevelopment of labor standards, with the application of anti-democratic mechanisms that make the struggle for the rights of the low-income even more unequal.

O ramo do Direito do Trabalho assume lugar de destaque na sociedade contemporânea. Se, por um lado, ao referirmo-nos à figura do empregador, diremos que é ela responsável por regular as relações que contribuem para a geração de riqueza, o que por sua vez tem reflexo direto no nível de desenvolvimento dos países, por outro, ao referirmo-nos ao trabalhador, diremos que é por via do Direito do Trabalho que asseguramos o cumprimento das exigências impostas pelo Estado Social de Direito, alicerçado na Declaração Universal dos Direitos do Homem e na Carta da Organização das Nações Unidas. Ao Direito do Trabalho corresponde, de forma automática, o Direito do Trabalho Coletivo, cuja intervenção na regulação das relações laborais é, desde há muito, primordial. Todo o sistema de normas de Direito do Trabalho Coletivo constrói-se com base na ideia segundo a qual a legitimação das estruturas representativas das entidades cujas normas serão de aplicar se obtém por via da filiação, a qual, enquanto corolário da autonomia coletiva, enforma e limita a atuação das várias personagens cuja atuação tem lugar na negociação. Ao considerar-se o supramencionado, mas tendo em conta a nem sempre compatível necessidade premente da uniformização das condições de trabalho, o legislador tem vindo a estabelecer algumas limitações e desvios a princípios ditos fundamentais – e por sua vez também à própria autonomia coletiva. Neste sentido, propomo-nos a analisar a conformidade das mencionadas exceções com o espírito do sistema, sob a máxima de que o Direito jamais se poderá furtar ao cumprimento de si próprio. Labor Law is key in contemporary society. When, on the one hand, we talk about the figure of the Employer, we hold it responsible for the regulation of the relationships which contribute to economic growth, which, in turn, Has a direct reflection on the countries’ development level. However, on the other hand, when referring to the figure of the Employee, Labor Law is the instrument responsible for ensuring compliance with the requirements imposed by the Social Rule of Law, rooted on the Universal Declaration of Human Rights and on the Charter of the United Nations. Labor Law is intrinsically linked with the so-called Collective Labor Law, the intervention of which regulation of labor relationships has, for a long time, been paramount. The rules-based system of Collective Labor Law is built upon the idea that the legitimacy of the representative structures of the entities whose rules are to be applied results from union membership, which as a corollary of collective autonomy, shapes and limits the activity of the different individuals who intervene in the negotiation. In view of the above, but bearing in mind the sometimes incompatible urgent need to standardize working conditions, the legislator has been defining some limitations to and deviations from the so-called fundamental principles – and, in turn, also to the collective autonomy itself. In this sense, it is our intent to analyze the conformity of the aforementioned exceptions with the spirit of the system, rooted on the motto that the Law can never evade its own fulfillment.

La historia de luchas sociales y políticas, no siempre pacíficas, son el contexto bajo el cual se han desarrollado movimientos y organizaciones con el fin de ser reconocidos como insumo importante dentro de la estructura del Estado, por lo que al ser sujetos de obligaciones y derechos los mismo deben ser reconocidos y respetados. Dentro los movimientos mencionados los sindicatos de trabajadores han sido protagonistas en el desarrollo del derecho laboral colectivo y de su eventual constitucionalización, esto hablando del contexto colombiano. Ahora bien, existen paradigmas frente a las garantías constitucionalmente otorgadas, y uno de ellos es el que se presenta como derecho y realidad, y encontramos así fenómenos como la globalización y la flexibilización laboral, las cuales plenamente se encuentran confrontadas a derechos constitucionalmente consagrados, sin embargo dichos fenómenos llegan a nacen a partir del modelo económico imperante el llamado neoliberalismo. A partir de esta colisión dentro del Estado, se evidencia una falta de legitimidad frente a normas constitucionales, así como un desconocimiento de los mismos dentro de las políticas adoptadas por el Estado, dentro de las cuales se evidenciara siempre una particular desventaja con preeminencia a sectores económicos. Si bien cambia el contexto dentro de un Capital Industrial a uno de Capital Financiero, es claro que el pulso dentro del primero en siglo pasado, aún hoy se mantiene y el Estado dentro del modelo tripartita no está realizando papel como agente equiparador de cargas entre empleadores y trabajadores bien de forma individual como colectiva. Going on strike is surely the most important outward manifestation of collective disputes, although experience suggests that there are many protest, claims, and pressure procedures within the scope of labor relations. This work reviews the main characteristics of the Uruguayan basis for the right to strike, including the scope of its subjective application, content, effects, goals, methods, and limits. The Uruguayan system of collective labor relations has been characterized as being substantially autonomous and unregulated, given that there are virtually no state rules governing the right to strike. This is because, even today, the Uruguayan labor framework traditionally abstains from participating in the legislative process, a feature inherited from the time when Labor Law was enacted. Thus, in Uruguay, this far-reaching, open, and tolerant perspective concerning the right to strike is widely prevalent, owing to the lack of state (legal) regulation on the right to strike. Geçmişten günümüze oluşturduğu birikim üzerinde şekillenen sanat kavramı, yaratıcı ve eleştirel niteliği ile toplumların sosyal ve kültürel birikimlerine katkı sunması yanında, toplumsal politikaların şekillenmesinde de rol oynamaktadır. Sanat kavramının taşıdığı bu önem, bir toplumda sanatçıların hukuksal, sosyal ve ekonomik alanlarda korunmalarını gerekli kılmaktadır. Toplumların sosyal ve kültürel birikimlerinin ifade biçimlerinden biri olan sanatsal alandaki çalışmaları bağlamında hukuksal olarak korunmaları, o toplumun gelişmişlik düzeyi bakımından da bir ölçü niteliğindedir. Sanatçıların toplu iş hukukuna ilişkin haklarının, esasında genel olarak sanat ve sanatçının korunması başlığı altında ele alınması gerekmektedir. Zira sanatçıların hukuksal anlamda korunmaları, genel olarak sanatçıların yaşamı ve üretkenliği bakımından da katkı sağlayacaktır. Sanatçıların çalışma yaşamına ilişkin hakları, ülkemizde genel nitelikli hukuksal düzenlemeler çerçevesinde şekillenmekte ve bu alana yönelik özel nitelikli hukuksal düzenlemeler bulunmamaktadır. Sanatsal çalışmanın kendine özgü dokusu ise özel nitelikli düzenleme ve tedbirleri gerekli kılmaktadır. Bu çalışmada, sanatçıların toplu iş hukukuna ilişkin hakları bakımından durumları ele alınmıştır. Sanatçıların sahip oldukları söz konusu hakları etkin biçimde kullanıp kullanamadıkları ortaya konularak, mevzuat ve uygulamadan kaynaklanan sorunları tespit edilmeye çalışılmıştır. Bu çerçevede konuya ilişkin olarak, özellikle idari ve hukuksal düzeyde yapılacak çalışmalara katkı sunulması amaçlanmıştır., The concept of art, which has been shaped on the accumulation it has created from past to present, contributes to the social and cultural accumulation of societies with its creative and critical quality, and plays a role in shaping social policies. This importance of the concept of art necessitates the legal, social and economic protection of artists in a society. The legal protection of societies in the context of their works in the artistic field, which is one of the forms of expression of social and cultural accumulations, is a measure in terms of the development level of that society. The rights of artists regarding collective labor law should be dealt with in general under the title of art and artist protection. Because the legal protection of artists will contribute to the life and productivity of artists in general. The rights of artists to working life are shaped within the framework of general legal regulations in our country and there are no special legal regulations in this field. The distinctive fabric of artistic work requires special arrangements and measures. In this study, the situation of artists in terms of collective labor law rights is discussed. It has been tried to determine the problems arising from the legislation and practice by revealing whether the artists can exercise their rights effectively. In this context, it is aimed to contribute to the studies to be carried out especially at administrative and legal level.

It points out the technological revolution and the new morphology of labor as causes of the trade union representation crisis, proposing a direct bargaining, by company, both internally (subsidiary to trade union), as well as externally, due to the difficulties of international unionization. It theorizes the principles of bargaining and maintains that it is instituted, as a system of processes, at two distinct levels: one, by the regulatory establishment and institution of obligations: the bargaining process; the other, by the effects arising from its object (convention or agreement), which establish various legal obligations, which are also designed as a cooperative order . Next, it deals with the typology of the lato sensu collective agreement, its nature and clauses classifications, emphasizing its prevalent content: The norms, to establish criteria of review of their legality, either in the context of the bargaining process itself, through the techniques of mediation and comparison of collective bargaining agreements ( conglobamento ), or after the same, the effective content of their object, from the minimum judicial intervention in autonomy of willing subjects, provided that a minimum core of worker s rights is respected. As the base of the study, it addresses the phenomenological aspect of the internationalization of legislation methods guided by technology, global framework agreements, the transnational dimension of collective bargaining as a source of labor law, framing it in the context of Mercosur and its reception in the Brazilian legal system. From there, it adopts a comparative approach between, on the one hand, the illegitimacy of state sources of legislation and heterocomposition: and, on the other, the legitimacy of normative self-production and selfcomposition, to propose collective bargaining as a viable instrument of mediated, discursive, rational, dialectical, dialogical, circular and horizontalized procedure as an expression of validity in the creation of the right to work in participatory democracy, elevated to selfregulation of solution of the collective conflicts from the structural coupling between the dignity of the individual worker and the corporate interests O trabalho, que se situa na área de concentração Pensamento Jurídico e Relações Sociais e na linha de pesquisa Direito do Trabalho e Previdenciário, apresenta uma teoria geral da negociação coletiva, enquanto processo estruturado e mediado de autoprodução normativa e de autocomposição dos conflitos coletivos do trabalho, bem como da convenção coletiva como seu instrumento, com ênfase na autonomia privada coletiva e seus limites. Aponta a revolução tecnológica e a nova morfologia do trabalho como causas da crise da representatividade sindical, propondo uma negociação direta, por empresa, tanto no âmbito interno (subsidiária à sindical), quanto externo, em razão das dificuldades da sindicalização internacional. Teoriza os princípios da negociação e sustenta que esta é instituída, como um sistema de processos, em dois planos distintos: um, pela criação normativa e instituição de obrigações (o processo negocial); outro, pelos efeitos advindos do seu objeto (convenção ou acordo), que instituem vínculos jurídicos vários, os quais se projetam, também processualmente, como ordem em cooperação . Em seguida, trata da tipologia da convenção coletiva lato sensu, sua natureza e classificação das suas cláusulas, enfatizando o seu conteúdo prevalente, o normativo, para estabelecer critérios do controle da sua legalidade, seja no contexto do próprio processo negocial, por meio das técnicas da mediação e do conglobamento, seja após concluída a negociação, do conteúdo eficacial do seu objeto, a partir da intervenção judicial mínima na autonomia de vontade dos sujeitos estipulantes, desde que respeitado um núcleo mínimo indisponível de direitos dos trabalhadores. Constituída a base do estudo, aborda o aspecto fenomenológico da internacionalização dos métodos de produção guiada pela tecnologia, os acordos marco globais, a dimensão transnacional da negociação coletiva como fonte do direito do trabalho, contextualizando-a no Mercosul e a sua recepção na ordem jurídica brasileira. El análisis de la procedencia de la acción de tutela excepcionalmente para la protección de derechos fundamentales en el marco de relaciones entre personas jurídicas del sector privado en el contexto de Conflictos colectivos laborales, es un tópico problemático al interior de la jurisdicción, entre los jueces de la vía ordinaria que actúan como jueces de instancia en la resolución de la acción constitucional y la Corte Constitucional como órgano de cierre, sin embargo ante la inexistencia de mecanismos judiciales y administrativos idóneos para evitar perjuicios irremediables en la materialización de los derechos fundamentales, la investigación pretende dar cuenta de los deberes a cargo del Estado, los empleadores y los trabajadores en su concepción individual o como organización colectiva formalizada o informal, para alcanzar los objetivos estratégicos del Trabajo Decente, en particular el concerniente promover derechos fundamentales y la participación activa en un dialogo social. The analysis of the origin of the tutela action exceptionally for the protection of fundamental rights in the framework of relations between legal persons of the private sector in the context of collective labor disputes, is a problematic topic within the jurisdiction, among the judges of the ordinary way that they act as judges of instance in the resolution of the constitutional action and the Constitutional Court as a closing organ, however in the absence of adequate judicial and administrative mechanisms to avoid irreparable damage in the materialization of fundamental rights, the investigation seeks to account for the duties of the State, employers and workers in their individual conception or as formalized or informal collective organization, to achieve the strategic objectives of Decent Work, in particular the one concerned to promote fundamental rights and active participation in a social dialogue. través del tiempo la huelga ha tenido un proceso de evolución internacional importante, surgiendo como consecuencia de la lucha de los trabajadores por el reconocimiento de sus derechos frente a ciertos abusos patronales. Sus primeros acontecimientos, nos llevan a Inglaterra y Francia durante el siglo XIX, donde establecieron que la huelga era un delito que afectaba el derecho al trabajo. Esto como consecuencia del momento de revolución laboral que traía consigo la revolución industrial que se estaba viviendo en el continente Europeo, en donde se empezaron a tomar medidas de lucha contra el abuso del modelo económico capitalista que generaba un alto nivel de explotación laboral, por lo que los trabajadores empezaron a buscar mejoras salariales, mejores condiciones, en general mejores beneficios laborales. El derecho a la huelga es un derecho reciente que surge, entonces, como consecuencia de los cambios en el modelo económico de los Estados, en donde los trabajadores empezaron a sentar precedentes a nivel mundial para lograr que los empleadores reconocieran diferentes derechos laborales que anteriormente no tenían. Throughout time, strikes have undergone an important process of international evolution, arising as a consequence of the workers' struggle for the recognition of their rights in the face of certain employer abuses. Its first events take us to England and France during the 19th century, where they established that a strike was a crime that affected the right to work. This was a consequence of the labor revolution brought about by the industrial revolution that was taking place in the European continent, where measures began to be taken to fight against the abuse of the capitalist economic model that generated a high level of labor exploitation, so that workers began to seek better wages, better conditions, in general, better labor benefits. The right to strike is a recent right that arose, then, as a consequence of the changes in the economic model of the States, where workers began to set precedents worldwide to get employers to recognize different labor rights that they did not have before. Součástí druhé části práce je analýza kolektivních smluv vyššího stupně včetně následných závěrů a doporučení pro jednotlivé strany kolektivního vyjednávání., The bachelor thesis deals with collective bargaining. The first part of the bachelor thesis includes the development, legislation, content and subjects of collective labor law. It also describes the collective agreement and collective disputes. In the second part is an analysis of collective agreements of the higher level including the suggestions to the parties of collective bargaining., Ústav správních a sociálních věd, Studentka seznámila komisi s výsledky své bakalářské práce. Cílem práce je analýza konkrétních kolektivních smluv a na jejich základě poskytnout případná doporučení a závěry pro subjekty kolektivních pracovně právních vztahů. Teoretická východiska práce byly vypracovány na základě rešerše literatury a analýzy současného stavu. Praktická část analyzuje a hodnotí kolektivní smlouvy vyššího stupně uzavřené pro roky 2011 a 2012. V závěru jsou identifikovány konkrétní přínosy a návrhy na zlepšení. Po prezentaci byly kladeny doplňující otázky.
