Environmental impact assessment (EIA) is implemented in most countries as an administrative procedure. In this context, it is subject to the principles of administrative justice. However, to date, no empirical research has been conducted to determine the extent to which EIA decisions comply with the principles of administrative justice. In this paper, empirical data from 42 EIA cases in South Africa are used to establish EIA compliance with the administrative justice principles of lawfulness, procedural fairness and reasonableness. This is achieved by measuring EIA decisions against specially developed key performance indicators (KPIs). Overall, decisions were found to mostly comply with the principles of administrative justice. However, questions arise with regards to the quality and substance of the information feeding into the decision-making process and on which decisions are ultimately based.

This paper aims to better understand tourism-related waste behaviour within marine protected areas (MPAs) by applying the Theory of Planned Behaviour (TPB) to a specific South African case study. Observed- and self-reported elements of waste separation behaviour were determined for four diving charters and five accommodation facilities within the Aliwal Shoal MPA. Observations and waste characterisation were performed to understand actual behaviour, while survey questionnaires based on the TPB were administered to determine self-reported behaviour. Interviews were conducted to explore challenges and opportunities for waste separation at source. The results found a significant percentage of recyclable waste (>70%) within the disposable waste stream, and no waste separation infrastructure at any of the facilities investigated. Survey responses indicated a positive attitude towards waste separation, with a social drive towards participating. Respondents also indicated that they generally participated in waste separation at source, a claim not supported by the observation data. The identified challenges for waste separation at source included a lack of separation infrastructure and collection services, inconvenience, time constraints, and unwillingness of customers to participate. Accordingly, the main opportunities towards waste separation included the provision of waste separation resources and reliable municipal services, and strategies towards improved waste-related awareness and behaviour.

Privately protected areas (PPAs) are internationally considered to be important policy implementation instruments to augment and strengthen protected area networks. However, there has been limited reflection on the performance of PPAs over time. This paper aims to identify key risks to the performance of PPAs as policy implementation instruments through the application of Theory of Change (ToC). Identifying and understanding these risks are important to allow for the evaluation and monitoring of PPA performance. The ToC method was applied to a specific PPA policy instrument namely, private nature reserves (PNRs) in the South African context. The research results produced 29 key assumptions translated into 29 key risks. These risk are critically discussed against existing South African and international literature. To test and refine the risks further it is recommended that they be applied to PPA case studies in different contexts.

With increased political polarisation and the emergence of populist governments around the world – many of which erode regulatory requirements such as EIA – there is an urgent need to be able to identify and explain the potential benefits of EIA for government. The aim of this paper is to explore the benefits of EIA for government as perceived by EIA regulators. A semi-structured questionnaire was administered to 175 representatives from the South African EIA regulator. The questionnaire asked the respondents to indicate what they perceive to be potential and realised EIA benefits for government. They were also asked how they recommend the gap between potential and realised benefits might be closed. The results show that the main perceived benefits of EIA to government relate to short-term, project-specific benefits such as the protection of local biodiversity, public participation, legal compliance and enforcement, as well as certain immediate economic benefits. The promotion of sustainable development is not considered a realistically achievable benefit for EIA. It is recommended that for EIA to clearly define and achieve its potential benefits for government, it needs to rediscover and embrace its roots as a project level instrument aimed at dealing with biophysical impacts and environmental protection

The costs of conducting Environmental Impact Assessment (EIA) are well known. Yet the benefits of EIA are much more intangible, leading to a situation where some question its value as the tool of choice for informing decision makers of the sustainability consequences of their actions. Exponents of EIA have thus called for more research on the benefits of EIA in order to provide better evidence on its costs versus benefits, and therefore its value as a decision-making tool. This paper contributes to this evidence by exploring the perceived potential benefits and perceived realised benefits of EIA from a regulators' perspective in the context of sustainable development. Using South Africa as a case study, one third of all the officials responsible for EIA review and decision-making (referred to in this paper as the “regulator”) were surveyed to identify their perceptions of the benefits of EIA, and their ideas on how to bridge the gap between potential benefits and realised benefits. The paper contributes suggestions for the analysis of benefits in a sustainable development context, and identifies some additional benefits currently missing from the literature. In a South African context, the key potential and realised benefits as perceived by regulators are the protection of biodiversity, public participation, access to information, mitigation of environmental impacts, and legal compliance and enforcement.

Brominated flame-retardants (BFRs), including polybrominated diphenyl ethers (PBDEs) and hexabromocyclododecane (HBCD), were analysed in 77 eggs of 13 wild bird species from Gauteng and northern Free State (the industrial heartland of South Africa). BFRs were in all eggs, but not all BFRs were quantifiable. Concentrations ranged between 2.9 and 46 ng g−1 wm (wet mass) and the predominant congeners were BDE-47, -153, -154, -183 and -209. The BFR compositional patterns of the congeners in eggs differed between species, feeding guilds, and habitats. Differences in associations of birds with humans seemed to have as much an influence as the trophic levels occupied by the maternal animals. The congener pattern of BFRs differed between terrestrial and aquatic species. The congener concentrations and patterns also differed from eggs from other countries, suggesting differences in sources. BFR concentrations in eggs from the current study area were below a reported no observed effect level (NOEL; 1 000 ng g−1 wm). Although this suggests that the BFRs do not pose a risk, the NOEL was mostly based on information from birds from moderate and colder climates. This NOEL might not apply to birds from warmer climates with different life histories, as in the current study, because there are currently only draft regulations on importing BFRs or BFR-containing products in South Africa. The BFR-containing products otherwise destined for countries with BFR restrictions in place may now find their way to South Africa. The additional waste these poorly regulated products generate will eventually find their way to landfills ensuring that release to the environment and consequent exposures to biota will continue without effective interventions and waste management. Our findings indicate the need for on-going environmental monitoring to assess trends, identify hot spots, investigate effects, strengthen waste management, and the need to urgently implement the commitments under the Stockholm Convention.

The aim of this letter is to provide an administrative justice perspective on EIA effectiveness. EIA is described as essentially an administrative instrument, reflecting a number of principles that revolve around an assessment process which should reflect administrative justice. This includes lawfulness, procedural fairness and reasonableness. Consciously and explicitly incorporating these principles into EIA decision-making has significant potential to strengthen EIA effectiveness and making it fit for the twenty-first century

EIA is increasingly being questioned as a decision-making instrument of choice for decision makers. In addressing these concerns, the paper aims to re-think the fundamentals of EIA through the identification of key assumptions underlying EIA evaluation. This aim was achieved through the application of the theory of change (ToC) method to the South African EIA system, which resulted in the identification of 19 key underlying assumptions. Going forward we recommend the testing of these assumptions towards a better understanding of the fundamental nature and purpose of EIA as a policy implementation instrument

We outline the experiences and the challenges of optimizing two-dimensional gas chromatography coupled with time-of-flight mass spectrometry (GCxGC-TOF-MS) in conjunction with the H4IIE-luc bio-assay for analyzing polychlorinated dibenzo-p-dioxins (PCDDs) and polychlorinated dibenzofurans (PCDFs) in the South African context. Investigating such alternative analytical methods can assist countries with developing economies to meet their obligations under the Stockholm Convention.

Polychlorinated biphenyls (PCBs) were analysed in wild bird eggs from industrialised areas in South Africa. The concentration, congener profile, feeding guild, potential associated risk and biology were investigated. PCBs were detected in all eggs with 30 congeners present in more than 80% of the samples. Σ(34)PCB concentrations ranged between 0.9 and 296 ng g(-1) wet weight (ww). The metabolic potential of the PCB metabolic groups showed good agreement with the biodegradability of the individual congeners. Phenobarbital-type (PB-type) inducer PCBs were prevalent, indicating the predominance of less toxic PCB congeners. However, non-ortho PCBs which were not included in the current analyses, could affect the toxic potential of the PCBs in the eggs requiring more investigation. Although the current levels of PCBs measured do not indicate a health risk to the birds assessed, the presence of mono-ortho PCBs at appreciable levels motivates for the assessment of dioxin-like chemicals in wild bird eggs.
