PurposeWith a focus on the position of EU mobile workers in the Dutch meat industry, this article discusses the multi-level State efforts to enhance protection of workers who experienced limited protection of existing State and private enforcement institutions. The COVID-19 pandemic, with virus outbreaks at Dutch meat plants, fuelled public and political will to structurally improve these workers' precarious work and living conditions. Yet, the process of policy change is slow. The authors show it is the gradual transformation in the institutional environment that the State needs to counter to become more protective for EU mobile workers.Design/methodology/approachUsing the gradual institutional change approach and the concept of State ignorance, the authors examine State responses drawing on interviews with expert stakeholders in the public and private domain, public administration records and newspaper articles.FindingsThrough knowledge creation, boosted social dialogue mechanisms, enhanced enforcement capacity and new housing legislation, the Dutch State focuses on countering gradual institutional change through which existing institutions lost their effectiveness as protectors of EU mobile workers. The organization of work is, nevertheless, not (yet) fundamentally addressed with tighter public legislation.Originality/valueThe findings contribute to a more nuanced understanding of the role of the State as multifaceted actor in institutional change processes towards increased protection for EU mobile workers.

In een periode van één jaar heeft het Hof van Justitie vijf uitspraken gedaan over het recht op gelijke behandeling dat is opgenomen in verschillende richtlijnen die het verblijf van derdelanders in een lidstaat regelen. Met deze uitspraken draagt het Hof van Justitie bij aan de versterking van de gelijke behandeling van rechtmatig in de Europese Unie verblijvende derdelanders op het terrein van de sociale zekerheid en daarmee hun integratie in de lidstaat waar zij rechtmatig verblijf genieten.

The effective return of irregularly staying migrants is identified as an overriding objective in the New Pact on Migration and Asylum, while return operations are the fastest-growing activity of Frontex. Since the 2019 amendment of its Regulation, the agency has received a significant augmentation of its mandate and capacity in pre-return and return-related activities. This way, Frontex takes a centre-stage role in the Commission’s plan to intensify returns. This article fills the relevant gap in existing literature, updating our knowledge on the latest legislative developments in EU return operations and answering questions related to their human rights implications at a time when the scrutiny over Frontex is at its peak. The article discusses the human rights risks of these operations and the effectiveness of the available safeguards. This article is the product mainly of legal doctrinal research, i.e. the analysis of the relevant EU law and legal literature, along with civil society and institutional reports and other empirical documentation. At the same time, it also looks at quantitative data on the agency’s return activities from 2004 until 2019.

By and large, the attention and resources of governments, NGOs, and humanitarian actors have been directed at children and working-age displaced people, ignoring the needs and perspectives of displaced elders. Africa is the continent with the largest number of displaced people aged 60 and over. To help achieve equity and better representation for this latter group, it appears essential to delineate and clarify the evidence base on displaced elders in Africa. We systematically searched bibliographic databases in the social and health sciences. One hundred forty-one papers met our inclusion criteria globally, of which 16 were based on data collected in African countries. The scoping review establishes that the main focus has been the specific vulnerabilities faced by older African displaced people, particularly with regard to physical health and the erosion of social support systems. Contrary to research on older displaced populations elsewhere, studies on the mental health of displaced elders in Africa are lacking. Similarly, more priority should be given to phenomenological and life course approaches to better understand the lived experience of displaced African elders.

Although the Schengen Border Code (SBC) explicitly obliges Member States to apply the Schengen rules in full compliance with the fundamental rights, Member States’ adherence to this obligation can be questioned in light of recurrent and reliable reports about fundamental rights violations at the EU’s external borders. This contribution will examine why, apart from the deficiencies in the SCHE-VAL mechanism, the current response towards fundamental rights violations at the border is ineffective. First, it will analyse the legal framework, including the implementing rules, to see if additional guidance is needed. Second, the enforcement mechanisms will be examined: how are violations being addressed at the national level, and how does the EU Commission perceive and fulfills its role regarding enforcement of compliance? As the Commission has often referred to the monitoring mechanism as proposed in the draft Screening Regulation, the contribution will examine to what extent this New Pact file will help to resolve the current impunity. Finally, the article will analyse the role of Frontex regarding human rights violations by Member States. What is their responsibility, how do they perform it, and who is enforcing compliance by Frontex?
