3. Custom, power, and the power of rules : a study of the interaction of power and rules in the process of customary international law

Abstract

The process of customary international law is the process whereby rules of customary international law are developed, maintained or changed. This thesis studies the role of power, in its most general sense, within that process. It seeks to do so from an interdisciplinary perspective, combining elements of international relations theory and methodology with aspects of the history, theory and practice of international law. Chapter One examines the various ways in which the discipline of international relations has, over its relatively brief history, dealt with international law, with a particular emphasis on recent efforts by some international relations scholars to reconsider the role of international law and incorporate it into their explanations of State behaviour. Chapter Two examines how the discipline of international law has dealt with the issue of power, and how most legal scholars remain unaccustomed to thinking about how applications of power can generate international law. Chapter Three reviews a number of theoretical problems associated with the process of customary international law, as well as some of the attempts that have been made to resolve them. It also suggests reasons why existing theories of customary international law remain unsatisfactory and sets out criteria for a new theory of customary international law. Chapter Four responds to the problems identified in Chapter Three by advancing an alternative theory of customary international law. This theory is based on the hypothesis that the process of customary international law involves the interaction of "State power" and "legal power", each of which affects the other in the development, maintenance and change of customary rules. Chapter Five situates this new theory of customary international law with respect to several important and related approaches to international legal theory.

Abstract

Data on the high-pressure melting temperatures of metals is of great interest in several fields of physics including geophysics. Measuring melt curves is difficult but can be performed in static experiments (with laser-heated diamond-anvil cells, for instance) or dynamically (i.e., using shock experiments). However, at the present time, both experimental and theoretical results for the melt curve of lead are at too much variance to be considered definitive. As a result, we decided to perform a series of shock experiments designed to provide a measurement of the melt curve of lead up to about 50 GPa in pressure. At the same time, we developed and fielded a reflectivity diagnostic, and conducted measurements on tin as well. The results show that the melt curve of lead is somewhat higher than the one previously obtained with static compression and heating techniques. [ABSTRACT FROM AUTHOR]

35. After the new failure of nerve: Charles Olson and American modernism, 1946-1951

Abstract

One medium has dominated accounts of American art in the years following the Second World War. The period witnessed, in the words of one critic, a 'Triumph of American Painting', with advances in the easel picture far surpassing those in other media. Whilst more recent accounts have nuanced this view, drawing attention to developments in music and sculpture, literary contributions to the new American modernism have gone almost without assessment. Were there advances in literature comparable to those of Mark Rothko and Barnett Newman, David Smith and John Cage? Drawing extensively on his unpublished writings, After the New Failure of Nerve reveals the poet Charles Olson to have been the keenest literary advocate of the new American avant-garde and one of the most astute observers of its conditions and possibilities. Paying special attention to unpublished notes, lectures, and correspondence, the thesis utilises Olson’s early writings in order to examine the momentum given early postwar modernism by a potent contemporary reaction against abstract rationality, a reaction identified at the time as a 'New Failure of Nerve'. Born of recent disillusionment with 'scientific' Marxism and New Deal progressivism, the thesis demonstrates the several ways in which this 'New Failure of Nerve' fuelled vanguard American art from the middle of the Second World War to the end of the decade. It argues that the new critique of abstract rationality—which was also reflected in the contemporary American work of the Frankfurt School—defined the way American artists understood the function of postwar modernism, the posture of the postwar modernist artist, and the status of the postwar modernist artwork. This pivotal moment in the history of modernism was shaped, I contend, by a philosophical critique explored most ambitiously by an American poet.

46. Coral Colonisation of an Artificial Reef in a Turbid Nearshore Environment, Dampier Harbour, Western Australia

Abstract

A 0.6 hectare artificial reef of local rock and recycled concrete sleepers was constructed in December 2006 at Parker Point in the industrial port of Dampier, western Australia, with the aim of providing an environmental offset for a nearshore coral community lost to land reclamation. Corals successfully colonised the artificial reef, despite the relatively harsh environmental conditions at the site (annual water temperature range 18-32°C, intermittent high turbidity, frequent cyclones, frequent nearby ship movements). Coral settlement to the artificial reef was examined by terracotta tile deployments, and later stages of coral community development were examined by in-situ visual surveys within fixed 25 x 25 cm quadrats on the rock and concrete substrates. Mean coral density on the tiles varied from 113 ± 17 SE to 909 ± 85 SE per m2 over five deployments, whereas mean coral density in the quadrats was only 6.0 ± 1.0 SE per m2 at eight months post construction, increasing to 24.0 ± 2.1 SE per m2 at 62 months post construction. Coral taxa colonising the artificial reef were a subset of those on the surrounding natural reef, but occurred in different proportions-Pseudosiderastrea tayami, Mycedium elephantotus and Leptastrea purpurea being disproportionately abundant on the artificial reef. Coral cover increased rapidly in the later stages of the study, reaching 2.3 ± 0.7 SE % at 62 months post construction. This study indicates that simple materials of opportunity can provide a suitable substrate for coral recruitment in Dampier Harbour, and that natural colonisation at the study site remains sufficient to initiate a coral community on artificial substrate despite ongoing natural and anthropogenic perturbations. © 2013 Blakeway et al.
